MINUTES OF THE VILLAGE COUNCIL MEETING OF THE VILLAGE OF TEQUESTA, FLORIDA DECEMBER 10, 198 A meeting was held by the Village Council of the Village of Tequesta, Florida at 7:30 P.M., Tuesday, December 10, 1986 in the Village Hall, 357 Tequesta Drive, Tequesta, Florida. Councilmember present were: Gemino, Howell, Murphy and Stoddard. Also present were:. Robert Harp, Village Manager, Cyrese Colbert, Village Cler'.: and John C. Randolph, Village Attorney. The Opening Prayer and Pledge of Allegiance to the Flag was given by Councilmember Howell. Changes made and approved to the agenda were: add: 2d. Consideration of Appointment to Village Council (Stoddard) add: 2e. Billboard Resolution Change 3a. To include James A. Coble • Mayor Stoddard announced the following:. 1. Fire/Rescue Meeting - December 12, 1985 The Village Manager and b7ayor will attend. 2. Christmas Carol Chorale - Monday, December 23, 1985 at 7:30 P.M. 3. Ceremony of Dedication of Wild $ Scenic River Saturday - December 14, 1985 at 11:30 A.M. 4. Palm Beach County Delegation Meetings: January 22, 1986 at 7:00 P.t9., February 12, 1986 at 7:00 P.M., February 19, 1986 at 7:00 P.M., Center. West Palm Beach City Hall Palm Beach Garden City Hall Palm Beach County Governmental la. The first item on the agenda was the approval of final payment to R. J. Sullivan Corporation (Bill Reese, P.E., Gee ~ Jenson). This payment due R. J. Sullivan was for the improvements to Tequesta Water Systems. The amount due this period which represents the final payment is $31,740.50. Mr. Reese told Council there remains a few warranty items but not something you hold up final payment for. Howell moved, "that we approve the final payment of $31,740.50 to R.J. Sullivan Corporation". Gemino seconded and vote on the motion was: Minutes of Council Meeting December 10, 198 Page 2 - ----------------------------------------- Gemino - for Howell - for Murphy - for Stoddard - for and therefore the motion was passed and adopted. The next item on the agenda was request for Lease for Parking - Wellfield No. 1 (Ernest Hamilton). In a Memorandum sent to Village Council, the Village Manager told Council that the Village has received a verbal request from Mr. Ernest Hamilton owner of property on U.S. Highway No. 1 requesting the Village to allow a portion of Well Field No. 1 for additional parking for a building he proposes to construct. The Memorandum also advised Council that Mr. Hamilton would be required to conform to the Village's requirements for parking lots including on-site drainage retention landscaping requirements, base and surface constructed to Village's standards. The Village Manager told Council that the Village has done this before • fox the 222 Building. The Village Manager reviewed with Council the restriction we have with Mr. Hamilton. Mr. Hamilton realizes that all additional parking acquired pursuant to the terms of the lease shall not be counted as required parking for the building proposed to be constructed. Council discussed the number of years for the lease and the annual base amount. The Village Attorney told Council he felt we should have a yearly lease and leave the burden of renewing the lease to the Lessee. Resident Dottie Campbell asked if this property could be used by the Village as a storage area. Council did not agree with this proposal. Howell moved, "that we approve this (request for lease for parking) with the condition that the lease be renewed on a yearly basis with the 60 day notice to Lessee". Murphy seconded and vote on the motion was: Gemino - for Howell - for Murphy - for Stoddard - for and therefore the motion was passed and adopted. . Mr. Edwin Nelson was next item on the agenda, Stoddard had invited Mr. Nelson so that Council may have a chance to meet Mr. Nelson and to ask any question they may have of Mr. Nelson. Stoddard thought Mr. Nelson would make a fine replacement for Mr. Mapes who had resigned from Council. Stoddard reviewed Minutes of the Council Meeting December 10, 198 Page 3 - ------------------------------------------ Mr. Nelson's resume for Council and Council asked a few questions of Mr. Nelson. ld. Dr. Stanley B. Jacobs, Vice-Chairman of the Long Range Planning Commission reviewed with Council the Commission's report on traffic problems at Tequesta Plaza. (a copy of the report is attached to and has become part of these minutes). D~:r. Jacobs suggested that maybe the Police Department could put a Police Officer on Tequesta Drive between the two shopping centers (Winn Dixie and Publix) to direct traffic and to help pedestrian cross Tequesta Drive at that area. Mr. John Giba, resident reminded Council that a few years ago, a Committee brought out the fact that Tequesta Plaza's parking was backwards in their opinion and that the direction of the parking needed to be switched. Mr. Giba felt that this traffic problem on Tequesta Drive needs to be looked at by professionals. Mrs. Dottie Campbell, 4 Tradewind Circle wanted to know when she will receive information on Gallery Square North Shopping Center that she has requested. The Village Manager told Mrs. Campbell she should be able to get the information within the next six (6) weeks. Mrs, Campbell asked if the Election Date has been changed because in the newsletter that is put out by Tequesta Association of Voters and Taxpayers, it says the election is March 4, 1986. Mrs. Campbell was told this was an error and that the Election Day is March 11, 1986. 2a. The next item on the agenda was the resignation of W. Harvey Mapes, Jr, from Village Council, Seat No. 3. Mr. Mapes resigned from Council effective December 2, 1985. Council each agreed that the news of Mr. Mapes resignation came with sadness. Council spoke of Mr. Mapes' dedication to the Village and to Council. Council agreed that Mr. Mapes would be missed and that a letter of thanks should be sent. Gemino moved, "it is with sadness that we accept the resignation of W. Harvey Mapes, Jr, from Village Council." Howell seconded and vote on the motion was:. Gemino - for Howell - for Murphy - for Stoddard - for • and therefore the motion was passed and adopted, Gemino moved, "that we appoint Edward C. Howell as the Treasurer for the Village of Tequesta". Murphy seconded and vote on the motion was: Gemino - for Howell - for Murphy - for Stoddard - for Minutes of the Council Meeting December 10, 198 Page 4 - --------------------------------------------- and therefore the motion was passed and adopted, 2d. The next item on the agenda was the consideration of appointment to Village Council (Stoddard). Stoddard told Council that Mr, Nelson has agreed to take over Mr. Mapes seat. Stoddard recommended that Mr. Nelson be appointed now to fill Mr. Mapes seat because there are some very pressing items that need to be taken care of that will require a full time Council. Murphy said he thinks that Mr. Nelson is a fine person and that other Council members should be able to have an input. Gemino told Council that she has a person bringing in his resume tomorrow. Gemino told Council she feels Mr. Ron MacKail would also be good on Council. Council set a Special Council Meeting for December 16, 1985 at 5:00 P.M. to meet with any persons interested in filling Mr. Mapes' seat. The next item on the agenda was the consideration of signalization at Tequesta Drive and Old Dixie Highway by Florida Department of Transportation. The Village Attorney explained to Council what this was about. The Village • Attorney explained that Florida Department of Transportation, under the Statewide Rail-Highway Grade Crossing Improvement Program with Federal Participation, 90% federal funds and 10% State funds is to coordinate the traffic signals with railroad signalization. The proposed Agreement require the Village of Tequesta to pay 50% of the annual maintenance cost for the railroad signalization portion of the project. The entire project includes a complete reworking of the traffic signals at the intersection pursuant to plans for FA Project No, RRS-0005 (143) (State Proj. No. 93000-3961) for Tequesta Drive-Old Dixie Highway. The proposed agreement between the State of Florida Department of Transportation, Florida Eastcoast Railroad Company and the Village of Tequesta is to provide for the installation of the grade crossing traffic control devices. Village Council wanted a representative from the railroad to appear before Council at a Special Council Meeting on December 16, 1985. 4e. The Village Manager had sent the Village Council a copy of a letter from Robert E. Basehart, Executive Director, Palm Beach County, Department of Planning, Zoning ~ Building requesting the Village's opinion in regard to the establishment of a 1,000 feet zone around the perimeter of any municipality which prohibits billboards. Murphy moved, "to instruct the Village Manager to write a letter to Palm Beach County informing them that Tequesta is in agreement with the 1,000 feet zone around the perimeter of any municipality and that the Village is against Billboards that are already in existence". Gemino moved, "to accept resume of Marcia A. Evans for the Community Appearance Board". Howell seconded and vote on the motion was: Gemino - for Howell - for Murphy - for Stoddard - for and therefore the motion was passed and adopted. Murphy moved, "that we appoint William Wagnerto the Zoning Board of Adjustment, term to expire May 31, 1988". Gemino seconded and vote on the motion was: • Gemino - for Howell - for Murphy - for Stoddard - for and therefore the motion was passed and adopted. 3c. Village Council cancelled the Council Meeting scheduled for December 24, 1985, which is Christmas Eve. The Council Meeting Minutes for October 22, 1985, the Village Manager's Report for November 24 through December 7, 1985 and the Village and Water Department Financial Statement for October 1985 were all received. The Village Manager announced that the Village has received a Certificate of Conformance in Financial Reporting for the third year in a row. This award is presented by the Government Finance Officers Association of the United States. The Village Manager told Council that the pay phone was installed outside the Police Department and that we would monitor the use for a year. Howell reminded everyone of the Christmas Parade on Sunday, December 15, 1985 starting at 1;00 P.M. Chief ~. Frank Flannery had Traffic Control Officer Gaydosh study the bad situation at Tequesta Plaza and he made the following recommendation: ~~The main, center driveway access to ~i'equesta Plaza, opposite Plaza "v,Tay, has long been a hazardo~zs area. .After considering several solutior_s, I recommend the following: The driveway area must be narrowed: that is, traffic must be limited to one lane in and one lane out. This way, the stop sign posted there will be very obvious~to those exiting,-and the or_e definitely marked lane, will eliminate the up to four cars trying to-exit simultan- eously. Further, the Tequesta Drive roadway should be marked with a dotted. white line indicating the exact path to be travelled by those exiting Tequesta Plaza and turning west. Currently, the;,r exit and turn behind turni_n~ cars on eastbound Tequesta Drive or turn and drive in the east- bound left turn lane a short (100ft.prox.) distance, this despite the presence of silver mushroom divider buttons iri the center of the roadway. To complement this, the center divider and left -turn area needs to be repainted badly. If this recommendation is followed, additional laving in the Plaza parking lot will need to be done. I suggest that the driveway area running east-west alongside Teque~-ta Drive be laved for traffic, and either Stop signs or Stop bars & painted Stop be installed. to further control traffic at this area (see attached d.rawing). Further, the easterrhost driveway access should have a Stop barpainted and a divider stripe painted to indicate where and how traffic should enter or exit here.~~ Signed L. The other su~~;estion he made was for the two Plazas to get together and hire an off duty Policeman to control traffic at peak hours.
