MINUTES OF THE MEETING OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA JANUARY 28, 1986 A meeting was held by the Village Council of the Village of Tequesta, Florida at 7:30 P.M., Tuesday, January 28, 1986 in the Village Hall, 357 Tequesta Drive, Tequesta, Florida. Councilmembers present were: Gemino, Howell, Nelson and Stoddard. Also present were: Robert Harp, Village Manager, Cyrese Colbert, Village Clerk, and John C. Randolph, Village Attorney. The Opening Prayer and Pledge of Allegiance to the Flag was given by Mayor Stoddard. Changes ~_.a«e and approved to the agenda were: add:. 2b. Ordinance for Sleeping Outside (Stoddard) add: 2c. No thru Truck Ordinance (Stoddard) add: 2d. Report on Recent Lawsuit against the Village (Randolph) Mayor Stoddard announced the following: 1. The filing period for candidates for the Village Election will be January 28, 1986 to February 11, 1986. 2. There will be a C.O.G, meeting on February 10, 1986. 3. There will be a Palm Beach County Legislative Delegation P~ieeting on Thursday, January 30, 1986 at 6:00 P,M. 4. There will be a meeting of the County Beach Erosion Control Committee at 2:00 P.M. on February 10, 1986. 5. There will be a Palm Beach County Municipal League Meeting on January 29, 1986. la. The next item on the agenda was the discussion of Comprehensive Plan. Mr. Gene Caputo, Planner, told Council that the last meeting Council had with his company on the Comprehensive Plan was in August 1985. A9r. Caputo told Council we have reached a point in the direction taken where he needs to know from Council what they would like to do. Mr. Jack Horniman brought Council up to date on what has taken place with the Comprehensive Plan. l ' Minutes of the Meeting • January 28, 1986 Page 2 - -------------------------------------- Council discussed with the Village Attorney and Jack Horniman if the Village should go ahead and finish the amendments to the Comprehensive Plan of 1986 and submit it for approval. Gemino moved, "that we accept the Village Attorney's recommendation that we accept the new guidelines for the Comprehensive Plan for the Village of Tequesta." Nelson seconded and vote on the motion was: Gemino - for Howell - for Nelson - for Stoddard - for and therefore the motion was passed and adopted. Council set a Council Workshop Meeting with Council sitting as the Local Planning Agency for February 10, 1986 at 5:.00 P.M. in the Village Hall. lb. The next item on the agenda was the consideration of Modified Site plan Review for a Satellite Dish for Mr. ~ Mrs. George Boyhan, 88 River Drive. • Mr, John Moore, Jupiter Satellite Systems, was present representing Mr. ~ Mrs. Boyhan. Mr. A9oore told Council the maximum dish height will be 10'. Council had received copies of the Site Plan indicating the proposed location for the dish, an engineering drawing for the dish and a map showing the location of the property. Scott Ladd, Building Official passed out picture of the property in question with an arrow indicating where the dish will go. Stoddard asked if the dish will be visible from the street and will the neighbors be able to see it from their yard. Howell asked if the surrounding neighbors had been notified. Mr. Ladd told Council the neighbors had not been notified because it is not a requirement according to the Ordinance. Howell said he would like to see that neighbors are notified that a dish antenna is going up in their neighborhood or next to them. Stoddard said he could not vote for this because it can be seen plainly by the neighbors in the back and by .the surrounding neighbors. Gemino said if the property owners can shield the dish they can have it. • Minutes of the Meeting January 28, 1986 Page 3 - --------------------------------- Mr. Moore told Council he found a satellite dish was no more offensive than a screened in room. The Village Attorney read a section of the Ordinance that providesthat a satellite dish shall be screened and buffered from surrounding areas, Moore told Council there are trees there now that can grow up to cover the dish. Council did not agree that these trees were enough and were concerned that neighbors had not been given the chance to know that this dish would be going up in their back yard, if approved. It was the consensus of Council that residents within 300 feet of a proposed installation of a satellite dish be notified. Howell moved, "that the Modified Site Plan Review for the installation of a satellite dish at 88 River Drive be denied". Gemino seconded and vote on the motion was: • Gemino for = Howell for Nelson - for Stoddard - for and therefore the motion was passed and adopted. Howell moved, "that the neighbors within a rad~zs of 300 feet be notified that a structure will be going up in the neighborhood and that trey be given a certain number of days to respond." Gemino seconded and vote on the motion was: Gemino - for Howell - for Nelson - for Stoddard - for and therefore the motion was passed and adopted. Mrs. Campbell resident, asked if Council would waive the $100.00 fee since the people didn't understand the desire of Council to have the neighbors notified. Council agreed to waive the $100.00 fee for refiling the application. • • Minutes of the Meeting January 28, 1986 Page 4 - --------------------------------- lc. The next item on the agenda was the consideration of granting an ease- ment to ENCON at the Dover Road area. Mr. Paul P. Brienza, P.E. District Engineer, Loxahatchee River Environmental Control District (ENCON) was present to represent ENCON in their request for an easement. Mr. Brienza explained that the Old "Plantreat" was on Dover Road and that ENCON is proposing to construct a Gravity Sewer on North Dover Road from Garden Street eastward to their "Plantreat" Lift Station. The new Gravity Sewer will eliminate the need of the small Lift Station located behind the First Baptist Church. That area will now be sodded after all equipment has been removed. Mr. Brienza also told Council. that ENCON would like to landscape the new Lift Station. Stoddard said that this area should be leveled and well seeded. Mr. Stoddard spoke in reference to the large total area that had at one time been the large "Plantreat". • Dorothy Campbell, resident, told Council that the old "Plantreat" area that is owned by the Village would make a nice park. Mr.Brienza reviewed with Council the work time table and when it would most affect traffic in this area. Howell moved, "that we make a study to see if we could have a little Village park in that area." Gemino seconded and vote on the motion was: Gemino - for Howell - for Nelson - for Stoddard - for and therefore the motion was passed and adopted, Gemino moved, "that we accept ENCON's request for the easement on Dover Road." Howell seconded and vote on the motion was: Gemino - for Howell - for Nelson - for Stoddard - for and therefore the motion was passed and adopted. • • Minutes of the Meeting January 28, 1986 Page 5 - ----------------------------------------- 2a. The Village Attorney advised Council that he has contacted Bill Payne at Rinker Materials relating to the blockages on Tequesta Drive by the rail- road. This was in response to a letter from Mayor Stoddard dated January 17, 1986. The Village Attorney advised that Bill Payne said he would check this matter out and get back to the Village Attorney. 2b. Stoddard gave the Village Attorney copies of the Police Report dealing with people sleeping outside and asked the Village Attorney if he could possibly draw up an Ordinance to be adopted prohibiting the sleeping outside by transient. 2c. Stoddard informed Council that Martin County has put up new sign for Martin County which are "No Thru Trucks" signs. Stoddard felt this backed up Tequesta's feelings that there should be no thru trucks on Country Club Drive. 2d. The Village Attorney advised Council that the Village has been served with a "Writ for Mandamus" requiring that the Building Official grant a permit to allow Nozzle Nolen, Inc. to install their sign on Old Dixie Highway in Tequesta. The Village Attorney advised Council that he has answered this, but felt at this time that more information should not be discussed at the . Council Meeting. 3a. The next item on the agenda was the consideration of Appointment of Committee to assist Village Council in selection of Village Manager. Stoddard told Council that three (3) former Pdayors have requested to be on the Committee. The Village Manager told Council that former Mayor Mapes has also requested that he be allowed to serve on the Committee. Stoddard reassured Council that even with this Committee the final choice for the Village Manager rest with the Council. Mayor Stoddard opened the floor for nominations to the Committee. Howell said he would like to have a Council Workshop Meeting so that Council could set up some kind of guidelines as to what Council is looking for in a new Manager. Gemino read a list of names of people who would like to serve on this Committee. Mrs. Dorothy Campbell, resident, said she would like to see a back- ground check done on the top five that have been selected by the Pdanager's • Committee. Gemino agreed. • Minutes of the [~7eeting January 28, 1986 Page 6 - ------------------------------------- Council set a Workshop Meeting for January 29, 1986 at 5:00 P.M., to set guidelines and to review top five candidates and to pick members of the Committee. 3b. Nelson moved, "that Community Savings, F.A. be a Depository for Village Funds". Gemino seconded and vote on the motion was: Gemino - for Howell - for Nelson - for Stoddard - for and therefore the motion was passed and adopted. 4a-d The Council Meeting Minutes for November 26, 1985, the Special Council Meeting Minutes for December 5, 1985, the Village Manager's Report for January 12 - 25, 1986, the Village and Water Department Financial Statements for December 1985 were all received. • Howell asked if the Long Range Planning Commission will have a report for Council soon on what they have been doing. Howell said it was his understanding that they are to give Council a report every 6 - 12 months. Council was advised that the Long Range Planning Commission would like to research a logo for the Village. Howell moved, "that the Long Range Planning Commission look into getting a logo for the Village and to look into a sign for the entrance into Tequesta". Gemino seconded and vote on the motion was: Gemino - for Howell - for Nelson - for Stoddard - for and therefore the motion was passed and adopted, Gemino said she would like to be brought up to date with what is happening with Step-Saver. Gemino said there has been a meeting with the Community Appearance Board and that Step-Saver's application for their new sign was not approved. Stoddard said he has found a real problem in the new proposed sign. One that it is too large and that it does not fit our new proposed Sign Code. • Stoddard said that his problem is that the total proposed sign is 84 square feet and the proposed Sign Codes allows only 60 square feet. ,• Minutes of the Meeting • January 28, 1986 Page 7 - ----------------------------------- Stoddard also said that the 3' x 6' reader panel was vated against by this Council. The Village Attorney advised Council that we should look at the Minutes of the Meeting held with the Village's Step-Saver Citizens Committee, which Gemino and Stoddard, were members of and see what was agreed upon. Stoddard said that Step-Saver is in violation of our Sign Ordinance and the Zoning Ordinance. Howell moved, "that the Mayor be authorized to represent the Village at the meetings with Palm Beach County on Beach restoration." Gemino seconded and vote on the motion was: Gemino - for Howell - for Nelson - for Stoddard - for and therefore the motion was passed and adopted. • The meeting was adjourned at 9:57 P.M. Stoddard TEQUESTA WATER STORAGE TANK IP3SPECTION JANUARY, 1986 ,.. • Purpose: Inspect all Village of Tequesta Water Storage Tanks. Two steel ground tanks to be inspected for. internal and external coating integrity. Concrete ground storage tank to be inspected for external coating integrity. One steel elevated storage tank to be inspected to determine whether warranty work is required. Storage Tank Facilities: - 1. Wellfield No. 1 a. 60,000 gallon elevated steel tank b. .5 million gallon ground steel tank 2. Wellfield No. 2 a. .5 million gallons ground steel tank 3. Wellfield No. 4 _ a. .75 million gallons ground concrete tank 8acecative Sammary: A. Wellfield No. 1 elevated storage tank should be def erred • until sometime just prior to May 1. B. Wellfield No. 1 ground storage tank repairs and internal painting should cost approximately $23,100. C. Wellfield No. 2 ground storage tank repairs and internal painting should cost approximately $24,050. D. Wellfield No. 4 ground storage tank external painting should cost approximately $14,075. 1. i+lellfield No. 1 - elevated storage tank The condition is as follows: a. Internal: Active corrosion cells exist-on the following: (1) Various places on tank column (2) Along the entire bottom of the structural ring plate at weld (3) Various seam lines (4) Under tank top (5) Float mechanism wheel and base (mechanism hangs up at full tank but does not appear to be due to rust) (6) Column ladder at various places b. External: Active corrosion cells exist on the following: (1) Tank drain valve. (2) ~n nuts at tower southeast leg (3) flank column base at concrete (4) Various turnbuckles and turnbuckle rods (5) Various tank bottom seams and erection plates, - etc. (6) Bottom of.one walkway drain hole (7) Top of walkway at various weld locations (rail to walkway) (8) Base of overflow pipe at walkway Recoamendation: The tank has several locations where warranty attention is required. However, none of the corrosion is presently jeopardizing the structural integrity or the aesthetics in any significant manner. Therefore, we recommend deferring the warranty work until just prior to the termination of the warranty period in May, 1987. 2. Wellfield No. 1 - ground storage tank The .5 million gallon steel ground tank was constructed in 1965. The condition is as follows: a. Internal: The internal parts of the tank have a paraffin type coating on the lower half of the tank. The coating does not appear to be intact on the top half of the tank. All internal parts of the tank have a surface type corrosion with the most corrosion being on the suction bell and center roof support. The suction bell and center support are pitted but not enough to require replacement. The internal ladder is in - very good condition. b. External: The vent cover has been removed from the tank due to its badly rusted condition. The hatch cover is rusted badly. The tank top access hatch ring is badly pitted. The ladder exist rails are badly rusted at the tank. Paint is missing from .portions of the tank top. The sides of the tank appear to be in good condition. The tank drain valve closes tight. ~- . -~ Recommendation: Repair tank vent ladder rails and hatch ring. Replace hatch cover. Replace drain valve in future. Clean and paint interior of tank, touch up exterior paint. 3. Wellfield No. 2 -ground storage tank The .5 million gallon steel tank was constructed in 1961. The condition is as follows: a. Internal: The internal parts of the tank have a paraffin type coating on the lower half of the tank. The coating does not appear to be intact on the top half of the tank. All internal parts of the tank have a surface corrosion with the most corrosion on the inverted. suction bell and the center roof support, The suction bell is badly pitted. The internal ladder is in very good condition. b. External: The tank vent pipe and screen is rusting away. The access hatch cover is badly rusted. There are active surface corrosion cells around the vertical steel plates that were for the aerator removed in the past. The old aerator piping on the tank side is badly pitted in places. The sides of the tank appear to be in good condition with occasional dis- c coloring. The tank drain valve closes tight. Recommendation: Cut off aerator plates and piping and repair aerator connections and vent. Replace hatch cover. Replace drain valve in future. Clean and paint tank interior. 4. i~lellfield No. 4 - ground storage tank The .75-million gallon concrete storage tank was constructed in 1977. The external condition is as follows: There are surface cracks in the concrete but appear to be minor. The paint is very thin on the tank top. Recommendation: Recoat tank to improve aesthetics.
