OF THE VILLAGE OF TEQUESTA, FLORIDA
JANUARY 8, 1985
A meeting was held by the Village Council of the Village of Tequesta,
Florida at 7:30 P.M., Tuesday, January 8, 1985 in the Village Hall, 357
Tequesta Drive, Tequesta, Florida.
Councilmembers present were: Brown, Mapes, Stoddard and Wagar.
Murphy was not present.
Also present were: Robert Harp, Village Manager, Cyrese Colbert,
Village Clerk and John C. Randolph, Village Attorney. Department Head present
is: Chief Frank Flannery, Police Department.
The Opening Prayer and Pledge of Allegiance to the Flag was given by
Councilmember Mapes.
Changes made to the Agenda were as follows:
Add lb. Dominic Noreikis, Tequesta Gardens Condominium
Association.
. Mayor Stoddard announced the two (2) Public Hearing on the proposed
Zoning Ordinance Revisions. The first Public Hearing is scheduled for
Tuesday, January 15, 1985 at 7:00 P.M. The second Public Hearing is scheduled
for Tuesday, January 29, 1985 at 7:00 P.M., both in the Village Hall, 357
Tequesta Drive, Tequesta.
Mayor Stoddard also announced the Ground Breaking for the new building
for Community Federal Savings and Loan on Tuesday, January 15, 1985 at 11:00
A.M. He also announced that Community Federal has announced that their new
building's Community Room will be offered to the Public when not in use by
the bank.
Mayor Stoddard announced that the second meeting of the Legislative
Delegation has been rescheduled for Monday, January 14, 1985 at 2:00 P. M.
at the Delray Beach City Hall.
Mayor Stoddard also announced that the Governor has rescheduled the
Beach Acquisition meeting to February 15, 1985.
The next item on the agenda was the Violators of the False Alarm
Ordinance. The Village Attorney reviewed Section 25-20 of the Village Code
of Ordinance. The Village Attorney explained that five (5) Class "B" alarms
within one (1) year is excessive and constitutes a public nuisance. The
alarm users who has had the police respond to five (S) false alarms or more
will have to appear before the Village Council to explain or give reason why
the alarm is being activated and to what extent the user has tried to correct

the problem. If the Village Council finds that the explanations are not
valid, they can recommend a fee be charged. The fee, not to exceed $25.00
for each excessive alarm. If an alarm user fails to appear before the Village
Council, a fee of $25.00 will automatically be charged to the user for each
offense.
There were eleven (11) offenders notified to appear before Council.
The first was Michael Balma. Lt. Miller of the Police Department
told Council that Mr. Balma was out of town but that Mr. Balma has worked
real hard in trying to get his system fixed and has been most cooperative
with the Police Department. Brown moved, "for a strong warning and for the
Council to refrain from any fines at this time." Wagar seconded and vote on
the motion was:

and therefore the motion was passed and adopted.
• The next was Barnett Bank with 17 false alarms. There was no one
present. It was pointed out that this was the third time Barnett Bank had
to appear before Council for excessive alarms. Mapes moved, "a fee of
$300.00 be charged to Barnett Bank for false alarms for 1984." Brown seconded
and vote on the motion was:

and therefore the motion was passed and adopted.
Congress Liquors had 12 false alarms. They did not have a representative
present. Mapes moved, "they be fined $175.00, 12 minus S, times $25.00." Brown
seconded and vote on the motion was:

and therefore the motion was passed and adopted.

The next violator was First American Bank. Paula Buckner was present
representing First American Bank. Ms. Buckner explained that the bank had a new
system installed, and has had only one false alarm since the new system was ins-
talled. Mapes moved, "that First American Bank receive a warning because they
have been working on this problem." Wagar seconded and vote on the motion was:

J. C. Hillary's was next on the agenda. They did not have a repre-
sentative present and this was their first citation. Mapes moved "they be fined
$75.00." Brown seconded and vote on the motion was:

and therefore the motion was passed and adopted.
• K-Mart was the next violator. They had 13 false alarms and this was
their second appearance before Council. The representative from K-Mart told
Council there was not any one particular reason for the false alarms. Some were
due to weather conditions, some to human error. Mapes moved, "that K-Mart be
fined $200.00." Brown seconded and vote on the motion was:

and therefore the motion was passed and adopted.
Lighthouse Gallery did not have a representative present. This was
their second appearance before Council for false alarms. Lt. Miller of the
Police Dept. told Council that when he had talked to Lighthouse Gallery repre-
sentatives, they informed him that they run several different classes and the
new people coming in, trip the alarm. Council felt that they could and should
instruct all people using the Gallery how to handle the alarm system. That ig-
norance on their part could endanger our Police Department. Mapes moved, "they
be fined $125.00." Brown seconded and vote on the motion was:

Lighthouse Liquors was the next violator. Lt. Miller told Council
that they have gone into receivership and the new owner and operator has only
been there about three (3) weeks but they sent in a check for $25.00. Mapes
moved, "they be given a stern warning and that a letter be sent that they fix
their alarm system or the Village will add these ten (10) false alarms the next
time they appear." Brown seconded and vote on the motion was:

and therefore the motion was passed and adopted.
Lighthouse National Bank was present. They had a total of 25 false
alarms. It was explained to Council that the bank is changing hands and will
be the Florida National Bank. Under the prior administration, there was no
weekly or annual maintenance agreement on the alarm system. Mapes moved,
"that they be given a stern warning and they be instructed to have the alarm
system repaired, but if the false alarms continue then the twenty five (25)
alarms will be added to the list." Brown seconded and vote on the motion
was:

Peter's Restaurant was next and had no representative present.
Lt. Miller told Council that they have cancelled their alarm system. Mapes
moved, "that they be fined $125.00." Brown seconded and vote on the motion

and therefore the motion was passed and adopted.
Savings of America had eighteen (18) false alarms and had a repre-
sentative present at the meeting. Their representative gave no adequate
explanation as to why there were so many false alarms. Brown moved, "they.
be fined $325.00." Mapes seconded and vote on the motion was:

Stoddard congratulated several members of the Police Department on
jobs well done.
Mr. Dominic Noreikis, Tequesta Gardens Condominium Association, was
the next item on the agenda. Mr. Noreikis informed Council that the drainage
on the west side of their Condominium units is getting worse because the
buildings that are being built in the County area there have brought in more
and more fill. This fill prevents the storm run-off of Tequesta Gardens
from going into the County area. Tequesta Gardens would like the Village
to tie Tequesta Gardens drainage into the Dover Road drainage system.
. It was discussed that Palm Beach County should make the developers
provide drainage for that area. The homeowners association in that area of
Palm Beach County have an attorney working on this.
Councilmember Mapes told Council that the Town of Jupiter has re-
quested that they be allowed to purchase, from the Village, that portion of
Tequesta's water system that services their residents that live this side of
'the river. Mapes said he felt it was time to start doing something about tY:is
and he was prepared with a motion.
John Giba, resident, told Council he felt the Village should annex
that portion of Jupiter.
Mapes moved, "that we ask the Village Manager to call the Town
Manager of Jupiter for them to sit down with the Village for discussion, not
negotiation, so they can tell us what they think we are worth and then
we can come back and think about it." Brown seconded, and vote on the
motion after discussion was:

and therefore the motion was passed and adopted.
. There was discussion after the motion at which time, Bob Joslin and
Stoddard discussed annexation.

The Village Attorney reminded Council that the Village presently does
not have an active Annexation Committee.
Bob Joslin, T. A. V. T, told Council that the Annexation Committee
of T, A, V. T. would go out and approach the people in Jupiter about Annexation
if Council so desires. The Village Attorney told Council that, in his opinion,
if the T,A,V.T, did this at the direction of Council, there could be a violation
of "Florida in the Sunshine Law" if the T,A,V.T, did not comply with the law
and it could have serious repercussions.
Mr. Robert Sattley, Tequesta Gardens, talked to Council about collec-
tion of old newspapers for recycling. Mr. Sattley told Council that the Fire
Department was collecting them in the Town of Jupiter and receive $300.00 for
each dumpster taken out. He has been told that all money made goes to Palm
Beach County Fire District and then to the Jupiter and Tequesta Recreation
Department. He also told Cojncil that he would find out how much money has
been collected and where the money has been spent.
Mr. Sattley also talked about Senior Citizens meals and the fact
they are in need of contributions. If anyone would like to contribute,

The Council Meeting Minutes for November 27, 1984 and the Council
Meeting Minutes for December 11, 1984 were received.
The Village Manager's Report for December 9, 1984 to January 5, 1985
and the Village and Water Department Financial Statements for November 1984
were also received.
Mapes asked the Village Manager to review the drawing of funds from the
Capital Improvement Charges Fund before using the Retained Earnings Fund.
Mapes told Council that he received a letter from Ray Fitton,
Bay Harbour Homeowners Association saying that his Homeowners Association
approved asking the Village of Tequesta to take over their private road if
it was brought up to the standard required by the County. They have asked
Gee ~ Jenson to review their roads and give them a price for repairing and
whatever is necessary, but Gee $ Jenson refused because they said they would
have a conflict because they are our engineers. Council agreed to have the
Village Manager contact Gee $ Jenson to have them do the study and have the
Bay Harbour Homeowners Association reimburse the Village for the cost.
Brown announced a meeting of the Water Management District at
9:00 A. M. January 10, 1985 on Gun Club Road. This meeting will be on dock
permitting on the C-18 Canal.

Stoddard said he will take copies of the Village's letter in
support of the purchase of 3-1/2 acres of beach property to the Palm Beach
County Legislative Delegation Meeting.
Mapes moved, "that the Mayor votes in favor of the Resolution
before C.O.G. on the park purchase." Wagar seconded and vote on the motion
was:

The Village Attorney informed Council that he has. not heard any-
thing from Palm Beach County on the Annexation of Coral Cove Park but he
expects it to be on the Agenda shortly.
The meeting was adjourned at 9:18 P, M,
