HomeMy WebLinkAboutMinutes_Regular_01/15/1985~ti MINUTES OF THE VILLAGE COUNCIL PUBLIC HEARING OF THE VILLAGE OF TEQUESTA, FLORIDA JANUARY 15, 1985 A Public Hearing was held by the Village Council of the Village of Tequesta at 7:00 P.M., in the Village Hall, 357 Tequesta Drive, Tequesta, Florida. Councilmembers present were: Brown, Mapes, Murphy, Stoddard and Wagar. Also present were: Robert Harp, Village Manager, Cyrese Colbert, Village Clerk, Scott Ladd, Building Official and John C. Randolph, Village Attorney. The purpose of this Public Hearing was to hear public input on the proposed amendments to the Official Zoning Ordinance. The Village Attorney read by title the Ordinance entitled: • "AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING THE OFFICIAL ZONING ORDINANCE N0. 319 OF THE VILLAGE; AMENDING SECTION IV THEREOF RELATING TO DEFINITIONS; AMENDING SECTION VII BY AMENDING THE SCHEDULE OF REGULATIONS IN THE R-3 ZONING DISTRICT BY REVISING THE MAXIMUM BUILDING HEIGHT, IN THE R-lA AND R-1 ZONING DISTRICTS RELATING TO SPECIAL EXCEPT- IONS FOR CHURCHES, IN THE R-lA, R-1 AND R-2 ZONING DISTRICTS TO PROVIDE SPECIAL EXCEPTIONS FOR PLANNED RESIDENTIAL DEVELOPMENTS AND COMMUNITY ANTENNA SYS- TEMS; BY AMENDING THE SCHEDULE OF DISTRICT AND USE REGULATIONS UNDER SECTION VII IN THE R-3 ZONING DIS- TRICT BY ELIMINATING THE SPECIAL EXCEPTION RELATING TO PLANNED UNIT DEVELOPMENT AND THE MULTIPLE FAMILY DWELLING NOT IN EXCESS OF 8 STORIES OR 85 FEET IN HEIGHT AND BY ADDING COMMUNITY ANTENNA SYSTEMS AS A SPECIAL EXCEPTION USE; BY DELETING THE SPECIAL EXCEPTION FOR PLANNED UNIT DEVELOPMENT IN THE C-1 ZONING DISTRICT; BY AMENDING SECTION VIII RELATING TO OFF-STREET PARKING AND LOADING REGULATIONS; BY AMENDING SECTION IX RELATING TO PLANNED UNIT DEVE- LOPMENTS; BY AMENDING SECTION X RELATING TO SUPPLE- MENTAL REGULATIONS; BY AMENDING SECTION XII RELATING TO SIGN REGULATIONS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; AND PROVIDING FOR AN EFFECTIVE DATE." The Village Attorney advised that there was "due Public Notice" and that the Village had "Proof of Publication" that the Public Notice was advertised. :_J . Minutes of the Public Hearing January 15, 1985 Page 2 - ----------------------------------- The Village Attorney also announced that the second Public Hearing will be held on Tuesday, January 29,1985 at 7:00 P.M. in the Village Hall. The Village Attorney also told Council that they could vote on this Ordinance after receiving all input. That the purpose of this Public Hearing is to put people on notice of this Zoning Ordinance change. The Village Attorney also instructed Council they could make changes as they deem fit, but changes should be made tonight if there are any changes to be made. Hearing no comments from Council, Mayor Stoddard opened it up to the audience. Marsha Evans, Tequesta Pines, told Council she had heard that there is going to be "0"'lot line in Tequesta and how was that going to work. Mr. Eugene Caputo, Village Planning and Zoning Consultant, told Ms. Evans that "0" lot line concept of the single family residential area • does not change the density. What it does do, is provide for greater open space, larger green spaces. It allows a little bit different housing style. The Village Attorney advised Council that if changes were to be made, then Council should vote on them individually. Mapes moved, "to add the wording in the R-2 Zoning District after the word removal at Section 3a, Page 12." Murphy seconded and vote on the motion was: Brown - for Mapes - for Murphy - for Stoddard - for Wagar - for and therefore the motion was passed and adopted. Councilmember Brown questioned the need for P.R.D. in Tequesta and who would really benefit from it. Brown pointed out that there were only two areas in Tequesta that is big enough for P.R.D. One of the areas is on the east side of Country Club Drive just across from the Country Club parking lot and the other area to northeast of Cypress Drive and bordering on the east side of Tequesta Pines. Mapes moved, "that on page 7, section E9b, the words "twelve (12) dwelling units" be deleted and that the wording "the maximum number of dwelling units otherwise allowed in that particular Zoning District" be Minutes of the Public Hearing • January 15, 1985 Page 3 - --------------------------------- added after the word exceed in line 2 and change paragraph 10.a.1. to paragraph 9.a.1 in section b, the fifth line." Murphy seconded and vote on the motion was: Brown - for Mapes - for Murphy - for Stoddard - for Wagar - for and therefore the motion was passed and adopted. Brown moved, "to add the word "array" between antenna and structure under definitions on page 1." Mapes seconded and vote on the motion was: Brown - for Mapes - for Murphy - for Stoddard - for Wagar - for • and therefore the motion was passed and adopted. Wagar moved, "to delete the words fabricated of metal after the word tower under definitions e. Mast." Murphy seconded and vote on the motion was: Brown - for Mapes - for Murphy - for Stoddard - for Wagar - for and therefore the motion was passed and adopted. Brown moved, "to delete entire last sentence under definitions f. Satellite television antenna system (page 2)." Mapes seconded and vote on the motion was: Brown - for Mapes - for Murphy - for Stoddard - for Wagar - for and therefore the motion was passed and adopted. Minutes of the Public Hearing . January 15, 1985 Page 4 - ------------------------------------ Council pointed out an error on page 18 section F4 after the word Design there should not be the word "and" so it was deleted. Mr. Warren Davis, resident, asked if the "0" lot line pertains to new buildings or existing buildings. Mr. Caputo pointed out that the "0" lot line is only in P.R.D. which is three (3) acres or more. Mapes moved, "that under C.0. 2, the twenty (20) feet in diameter be changed to twelve (12) feet and on page 24 C,O, 6 the one hundred twenty (120) miles per hour be changed to one hundred forty (140)." Brown seconded and vote on the motion was: Brown - for Mapes - for Murphy - for Stoddard - for Wagar - for and therefore the motion was passed and adopted. • Brown showed concern over the wording in Section F1 pertaining to the height limitation. Council agreed that the height limitation in the R-2 Zoning District may be increased to a maximum of three (3) stories or forty (40') feet as pointed out on page 5 Section E2. Wagar moved, "to provide in this Ordinance that in the Property Development Regulation, both in the P.C.D. and the P.R.D. Sections that it be cross referenced that the maximum height requirement not to exceed four (4) stories or fifty (50') feet." Murphy seconded and vote on the motion was: Brown - for Mapes - for Murphy - for Stoddard - for Wagar - for and therefore the motion was passed and adopted. Mapes moved, "that the first reading of the Ordinance be approved with amendments." Murphy seconded and vote on the motion was: Brown - Against Mapes - for Murphy - for Stoddard - for Wagar - for and therefore the motion was passed and adopted. •\ r Minutes of the Public Hearing January 15, 1985 Page 5 ------------------------------------- The second Public Hearing on Tuesday, January 29, 1985 at 7:00 P.
