It is a Civil Infraction which requires immediate attention. Option One If you receive a Notice of Violation and you want to avoid being issued a Notice of Hearing you must complete the following steps: 1. Repair/correct the violation by the date specified. 2. Contact the Village Code Enforcement Officer at 561-575-6213 / 561-575-6210 to arrange an inspection, and 3. Meet the Code Enforcement Officer on the premise to verify the violation has been corrected. Option Two If you received a Notice of Violation and you do not repair/cor- rect the violation by the date specified on the violation form, the Code Enforcement Officer may issue you a Notice of Hearing. If you receive a Notice of Hearing you must complete the following steps: 1. Notify the Code Enforcement Officer at least 10 days prior to the hearing date of any witnesses and/or Attorney you may hire to represent you. 2. Attend the hearing and plead your case in front of the Code Enforcement Board/Special Master. 3. Satisfy the requirements of the Code Enforcement Board/ • Special Master. Option Three 1. If you should decide to contest your case and are found guilty, you can be fined. That fine, by FSS 162 can be any amount up to $250.00 a day. If found guilty on a repeat violation of the same offense, you can be fined up to $500.00 a day for every day you are or remain in violation. A repeat violation is one that occurs at anytime up to five (5) years after the initial offense. A mandatory appearance is required on any repeat violation. ACCUMULATIONS OF WEEDS AND OTHER PLANTS Sec. 30-31. Findings. The village council finds and determines that the continuous growth of the village requires the reasonable and effective control of the growth and accumulation of weeds, undergrowth, and other plant life to prevent adverse affects on the economic welfare of adjacent property and to protect the public health by preventing infestation by rodents and other wild animals and the breeding of mosquitoes and vermin. (Code 1977, § 10-16) Sec. 30-32. Excessive accumulations prohibited; declaration of nuisance. The existence of excessive accumulations or of untended growth of weeds, undergrowth, or other dead or living plant life, as defined in this article, upon any lot, tract or parcel of land, improved or unimproved, within 100 feet of any improved or unimproved property within the village, to the extent and in such manner that the lot, tract or parcel of land becomes or may reasonably become infested with rodents, vermin, or wild animals, or may become a breeding place for such, or in any other way threatens the public health, safety and welfare, or which may reasonably cause disease or adversely affects and impairs the economic welfare of adjacent property, is hereby prohibited and declared to be a public nuisance. (Code 1977, § 10-17) Sec. 30-33. Prohihited conditions. (a) It shall be unlawful for the owner of any lot, parcel or tract of land with or without improvements constructed thereon within the village to permit grass, weeds, or undergrowth to grow thereon to a height of 12 inches or more from the ground. (b) It shall be unlawful for the owner of any lot, parcel or tract of land whether with or without improvements constructed thereon within the village to permit rubbish, trash, debris, dead trees or other unsanitary or unsightly conditions to remain on the premises. (c) It shall be unlawful for the owner of any lot, parcel or tract of land with improvements constructed thereon within the village to permit the existence of depressions or excavations or any other condition on such premises thereon in which water may accumulate in such a manner or fashion to make possible the propagation of mosquitoes therein. (d) It shall be unlawful for the owner of any lot, parcel or tract of land whether there are improvements and construction thereon or not to permit rubbish, trash, debris, dead trees or other unsanitary or unsightly conditions to remain on the premises. (e) If properties are protected under chapter 50, article II, pertaining to environmentally sensitive lands, they shall be exempted from those provisions of this section which require the removal of weeds, grass and undergrowth where it is determined by the village that to remove such weeds, grass and undergrowth will be in violation of chapter 50, article II. (Code 1977, § 10-18) Sec. 30-34. Notice to abate violation; right of village to do work and assess costs. (a) Upon the failure of an owner or tenant to comply with the provisions of this article, the village shall give one written notice by certified mail, return receipt requested, to the record owner of such property at the address indicated in the records of the county property appraiser's office, that a violation exists which is in violation of this article. If return receipt of the notice is not received by the village within ten days of mailing, then notice shall be published in a newspaper of general circulation in the community. (b) The notice shall: (1) Advise the owner of the existence and nature of the violation. (2) Specify what corrective action must be taken. (3) Require the owner to remedy or abate the violation within ten days from the date of receipt of a notice mailed by certified mail, return receipt requested, or, if notice is provided by publication, such notice shall require the property owner to remedy or abate the violation within ten days of such notice. (4) State that failure to take the prescribed corrective action within the specified time will result in the village abating the violation without further notice to the owner by entering the premises and taking such steps reasonably necessary to effect abatement, the cost of which action, plus administrative charges, shall constitute a lien against the property. (5) Advise the owner of a right to request a hearing as provided in this Code. (6) Advise the owner that upon reoccurrence of the violation the village may without further notice to the owner enter the premises and take such steps reasonably necessary to effect abatement, the cost of which, plus administrative charges, will be a lien against the property. The village council finds and determines that the continuous growth of the village requires the reasonable and effective control of the growth and accumulation of weeds, undergrowth, and other plant life to prevent adverse affects on the economic welfare of adjacent property and to protect the public health by preventing infestation by rodents and other wild animals and the breeding of mosquitoes and vermin. (Code 1977, § 10-16) Sec. 30-32. Excessive accumulations prohibited; declaration of nuisance. The existence of excessive accumulations or of untended growth of weeds, undergrowth, or other dead or living plant life, as defined in this article, upon any lot, tract or parcel of land, improved or unimproved, within 100 feet of any improved or unimproved property within the village, to the extent and in such manner that the lot, tract or parcel of land becomes or may reasonably become infested with rodents, vermin, or wild animals, or may become a breeding place for such, or in any other way threatens the public health, safety and welfare, or which may reasonably cause disease or adversely affects and impairs the economic welfare of adjacent property, is hereby prohibited and declared to be a public nuisance. (Code 1977, § 10-17) Sec. 30-33. Prohibited conditions. (a) It shall be unlawful for the owner of any lot, parcel or tract of land with or without improvements constructed thereon within the village to permit grass, weeds, or undergrowth to grow thereon to a height of 12 inches or more from the ground. (b) It shall be unlawful for the owner of any lot, parcel or tract of land whether with or without improvements constructed thereon within the village to permit rubbish, trash, debris, dead trees or other unsanitary or unsightly conditions to remain on the premises. (c) It shall be unlawful for the owner of any lot, parcel or tract of land with improvements constructed thereon within the village to permit the existence of depressions or excavations or any other condition on such premises thereon in which water may accumulate in such a manner or fashion to make possible the propagation of mosquitoes therein. (d) It shall be unlawful for the owner of any lot, parcel or tract of land whether there are improvements and construction thereon or not to permit rubbish, trash, debris, dead trees or other unsanitary or unsightly conditions to remain on the premises. (e) If properties are protected under chapter 50, article II, pertaining to environmentally sensitive lands, they shall be exempted from those provisions of this section which require the removal of weeds, grass and undergrowth where it is determined by the village that to remove such weeds, grass and undergrowth will be in violation of chapter 50, article II. Notice to abate violation; right of village to do work and assess costs. (a) Upon the failure of an owner or tenant to comply with the provisions of this article, the village shall give one written notice by certified mail, return receipt requested, to the record owner of such property at the address indicated in the records of the county property appraiser's office, that a violation exists which is in violation of this article. If return receipt of the notice is not received by the village within ten days of mailing, then notice shall be published in a newspaper of general circulation in the community. (b) The notice shall: (1) Advise the owner of the existence and nature of the violation. (2) Specify what corrective action must be taken. (3) Require the owner to remedy or abate the violation within ten days from the date of receipt of a notice mailed by certified mail, return receipt requested, or, if notice is provided by publication, such notice shall require the property owner to remedy or abate the violation within ten days of such notice. (4) State that failure to take the prescribed corrective action within the specified time will result in the village abating the violation without further notice to the owner by entering the premises and taking such steps reasonably necessary to effect abatement, the cost of which action, plus administrative charges, shall constitute a lien against the property. (5) Advise the owner of a right to request a hearing as provided in this Code. (6) Advise the owner that upon reoccurrence of the violation the village may without further notice to the owner enter the premises and take such steps reasonably necessary to effect abatement, the cost of which, plus administrative charges, will be a lien against the property. (7) Advise the owner that upon reoccurrence the violation may be referred to the special master and fines may be levied. (c) If a hearing is requested by the owner within ten days from the date of receipt of the notice of violation, or within ten days from the date notice is published, the owner may appeal the notice of violation before the special master at the next regularly scheduled meeting. If the special master determines that the violation does exist, the owner shall take corrective action required in the notice within five days of the hearing. If the property owner does not comply, the village shall have the right to enter the premises and take steps reasonably necessary to effect abatement without further notice to the owner, the cost of which action, plus administrative charges, shall constitute a lien against the property. (d) If no hearing is requested within ten days from the date of receipt of the notice of violation or within ten days from the date notice is published and the owner has not commenced the corrective action required, the village shall have the right to enter upon the premises and take such steps reasonably necessary to effect abatement, the cost of which action, plus administrative charges, shall constitute a lien against the property. (e) Nothing in this article shall preclude the village from taking immediate action to abate the violation if, in the opinion of the code enforcement officer, the violation constitutes an imminent danger to human life. (f) Upon completion of any work undertaken by the village to abate a violation of this article, the village clerk shall send a notice to such owner by certified mail, return receipt requested, stating that, due to the failure to comply with the code enforcement officer's order, the village has caused the land to be cleared. The notice shall show the total amount assessed against the property and state that the amount has been assessed against the owner and a lien against the property has been filed. Abatement by village. Upon failure of the owner of such lots, parcels or tracts of land to remedy the condition of such premises found to be in violation of the requirements of this article within ten days after being given notice as provided in section 30-34, then the manager shall have the condition remedied, either by contract, or direct labor, or by a combination of both methods. (Code 1977, § 10-20) Sec. 30-36. Lien book. Upon providing notice of violation to the owner of the property in violation of the requirements of this article, the clerk shall place a copy of such lien into a lien book which shall be prepared and kept for that purpose. The lien book shall be kept open for public inspection in the village clerk's office. (Code 1977, § 10-21) Sec. 30-37. Statement of costs and completion of work. As soon as practicable after completion of the work pursuant to this article, if such work be done by the village, the manager shall execute, or cause to be executed, and file with the clerk a statement of costs and completion of work, which shall certify the completion of work by the village, the date of completion and the cost thereof. The clerk shall thereafter cause to be published in a newspaper of general circulation in the village a notice giving the description of the property, the amount of the cost of the work, the date of completion of the work and the fact that the cost thereof is a lien against the property. The notice also shall be recorded in the public records of the county. (Code 1977, § 10-22) Sec. 30-38. Village's costs to constitute lien; right to contest costs; correction of costs. The cost of clearing such lands or removing or remedying the condition thereof found to be in violation of this article shall be and become a lien against such lands and properties, to the same extent and character as a lien for special assessments, as of the date of completion of the work by the village; provided that any person owning all or any interest in such property shall have the right at any time within 30 days after publication of the notice of completion of work to present to the clerk a sworn petition stating his interest in the property and alleging that in the opinion of the petitioner the cost of the work as entered in the lien book exceeds the actual cost thereof or is otherwise erroneous. Such petition shall thereupon be presented to the village council for its consideration at its next regular meeting, at which time and place the village council shall consider the petition and make due inquiry into the questions involved. If it shall appear to the satisfaction of the village council that thecost as entered is erroneous, then the village council shall by resolution so declare and shall have the entry thereof in the lien book corrected, and shall fix and confirm the amount to be charged against such lot, parcel or tract of land as it shall find just and proper, and the amount so fixed shall stand as the amount of the lien, effective as of the date of completion of the work, or the village council may confirm the lien in the amount originally entered in the lien book. (a) The lien for the cost of clearing such lots, parcels or tracts of land or removing or remedying the condition thereof found to be in violation of this article shall become due and payable 30 days after publication of the notice of completion of such work, except in cases wherein a petition is filed within such period as provided in section 30-38, and where upon consideration of such petition the village council has changed and corrected the amount of lien as entered in the lien book, and in such cases the lien shall become due and payable 30 days after such village council action. After the respective due dates fixed in this section, all unpaid liens shall become delinquent and shall thereafter bear interest at the rate of ten percent per annum until sold the following year by the village at a tax sale held pursuant to F.S. ch. 197, at which time and thereafter the liens shall be subject to the same charges and penalties as provided by law in the case of general village taxes. All delinquent liens shall be offered for sale at the annual tax sale of the village next following the date of delinquency. All liens shall be of the same extent and character as special assessment liens, and with the same penalties and the same rights of collection, foreclosure, sale and forfeiture as obtained by special assessment liens in the Florida Statutes. (b) The lien for the cost of clearing any lot, parcel or tract of land or of removing or remedying the conditions thereof found to be in violation of this article, if the lien is in excess of $100.00, may be paid in two equal installments due, respectively, on November 1 following the due date prescribed in subsection (a) of this section, and on November 1 of the year following, provided that the owner of the lot, parcel or tract of land shall file with the manager, on or before the due date, a written undertaking waiving any and all irregularities or illegality in connection with the imposing of such lien. Such deferred installments shall bear interest at the rate of ten percent per annum from and after the due date of the lien, but any such lien or installment thereof may be paid at any time when accompanied by the payment of interest due upon the entire unpaid balance of the lien to date of payment. Failure to pay any such installment when the installment shall become due shall without notice or other proceeding cause the entire unpaid balance of the lien to become due and payable forthwith; provided that if, before the lien is sold at an annual tax sale the amount of such delinquency and all interest upon the entire unpaid balance is paid, then the further installments shall again be due and payable at the times set forth in such written undertaking. Any person violating this article shall be subject to its lien provisions, but the village also retains the right to bring a civil suit to abate such conditions as a nuisance. The Respondent, SAMPHOU KHANTHAVONG, was present at the hearing and there was a finding of proper notice. 2. The Tequesta Code Enforcement Officer testified to and produced photographs of the violation. CONCLUSIONS OF LAW Respondents, TB SEA CORP and BROOKE AND SAMPHOU KHANTHAVONG, are in violation of Chapter 30 Article II Section 30-33, of the Code of Ordinances of the Village of Tequesta. (lR T~FR It is the Order of the Code Enforcement Special Magistrate that Respondents, TB SEA CORD and BROOKE AND SAMPHOU KHANTHAVONG, shall comply with Chapter 30 Article II Section 30-33, of the Code of Ordinances of the Village of Tequesta by the 28th day of February, 2008. If Respondents do not comply within the time specified, Respondents shall be assessed a fine of up to two-hundred-fifty-dollars ($250.00) per day until the property is in full compliance. A Fine Assessment Hearing will be held before the Special Magistrate on the 27th day of March, 2008, at 10:00 a.m., at the Village of Tequesta, Code Compliance Division, 345 Tequesta Drive, Tequesta, Florida. Respondents shall be assessed three-hundred-thirty-dollars and forty-two-cents ($330.42) for administrative costs to be paid by the 28th day of February, 2008. Future violations of the aforementioned code sections may be considered a repeat violation for which a fine of up to five-hundred-dollars ($500.00) per day may be imposed beginning on the date the violation begins. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes for the original amount. Upon complying, it is the responsibility of the Respondent to notify the Village of Tequesta Code Enforcement Clerk at (561) 575-3826 to request a reinspection of the property.
