MINUTES OF THE
VILLAGE COUNCIL WORKSHOP MEETING
APRIL 2, 19$7
The Village Council held a Workshop meeting on
Thursday, April 2, 1987, at 5:30 P.M. to discuss revisions to
the Village Zoning Ordinance concerned primarily with
modification of the C-2 and C-3 District.
The meeting was called to order at 5:30 P.M.
Councilmembers present were: Carlton D. Stoddard, Mayor;
Edward C. Howell, Vice-Mayor; Councilmembers present: Earl
L. Collings, Ron Mackail, Edwin J. Nelson. Village Officials
present were: Thomas G. Bradford, Village Manager; John C.
Randolph, Esq., Village Attorney; Scott D. Ladd, Building
Official; Bill C. Kascavelis, Finance Director/Clerk. Others
present were: Gene Caputo and Mark Kutney of Executive
Management & Engineering Consultants, Inc., Village Planning
& Zoning Consultants.
Mr. Caputo and Mr. Kutney reviewed the proposed
amendments to the zoning ordinance that had been revised in
accordance with recommendations made at the previous workshop
held on March 3, 1987.
The consensus of Council concerning major items of
consideration were:
1. The capital improvement impact fee was acceptable as
recommended to be considered for ordinance
preparation upon submittal to the Village Attorney.
2. The Commercial Tourist Resort district (CTR) was
acceptable with the following provisions:
a) Swimming pools, tennis courts, and any other
similar uses deemed appropriate by the Building
Official to be provided for under the Permitted
Accessory Uses and Structures section.
b) A minimum room size of 300 square feet is to be
provided for under the Design Standards section.
c) The parking formula is to be revised to include
accommodation of employee parking needs.

d) The retail parking requirements are to be changed
to read that "there shall be provided one (1)
space for every 100 square feet of floor area
devoted to sales and customer service."
The consensus of the Village Council was that the
concept of Adult Congregate Living Facility was
acceptable but that the language should be altered to
allow for the provision of kitchens within each unit,
and that the maximum density allowed for ACLF's would
be 24 units per acre. Additionally, it was requested
that a market analysis study be a requirement of an
ACLF application for Special Exception. It was
requested that Item 3a, 10, b, page 13 be deleted.

The requirements for Hotels/Motels were acceptable as
presented. The provision for libraries, art galleries
and museums as special exceptions within the C-2
Commercial district was acceptable as presented. Mr.
Caputo noted that the ordinance had been changed to
disallow home occupations in residential areas and this
was acceptable as presented.
Mr. Caputo was requested to incorporate the desires of
the Council relative to the review of the Zoning
Ordinance revisions presented and to incorporate the
same sending the draft revisions to the Village Manager
for review prior to sending the document to the Village
Attorney for ordinance preparation.
A copy of the Zoning Ordinance revisions reviewed by
the Village Council at this Workshop meeting is
attached to these minutes for informational purposes.
The meeting was adjourned at approximately 8:35 P.M.

Attached herewith you will find the latest proposed revisions to the C-2
Ca~fercial Zoning District. The revisions include the rew overlay district for
hotel/r,~otels and the amendments and revisions to the proposal, as discussed at
the March 3rd, 1987 workshop and reflected in your r~emo to me dated March bth,
~~1987. Also attached is a comparison of ACLF regulations throughout Palm Beach
,County and a recommendation on comc:ercial and residential impact fees.
These items are new ready for review by the Council at their workshop meeting
Thursday April 2, 1987.

Judi ter:
Special exception within R-3, C-2 and C-3; can be permitted as a part of a
Planned Unit Development. Density requirements range from 8 to 32 units per
acre depending upon the type of building and services rendered. Kitchens
allcwed with the following conditions: 1) Two meals a day must be provided
within a common dining area and the cost must be included to each resident;
2) Management must have the right to ban stoves; 3) Units cannot be con-
verted to normal units or apartments, etc.
Lake Worth:
Permitted within residential-multifamily zoning districts; must meet the
density of required district. Could be regulated as an apartment with
kitchens as a unit.

of Tequesta can be suppler,ented due to increased activity which can burden

A. PURPOSE AND INTENT ~~,~~

-The Cor?-,rnercial Tourist Resort District (CTR) is an overlay zone intended to ``

reg~.~iate the development of tourist and otr,er transient accorr~nodations and
facilities by providing criteria and standards that will promote economical
and efficient land use, creative design, an irr,proved level of amenities and
the protection of existing and future Village deveiopr-,ent. A rezoning to
this overlay classifi~.~ation requires a clear showing of need for the
establislu~ent of a transient accor~rno~lation within the Village.
in addition, tourist oriented support facilities such as restaur;3nts and
c~ariras are permissible as acc_-ssory uses. Due to tr,e c'r.aracteristics and
impacts of transient activir_ies, they require a location within the C-2

E. 'J~MENCLATURE
The boundaries of land zoned to the Ca~nercial Tourist Resort Overlay
designation shall be indicated on the official zoning map by the symbol
"CTR" together with design symbol for the un~jerlying zone district designa-
tion (e.g. CTR/C-2).
F. MARKET ANALYSIS
In all instances of rezoning to the CTR designation, the applicant shall
provide a market analysis which demonstrates the viability for a transient
accommodation of the size to be built at the proposed location. For these
purposes, the market analysis shall contain, but not be limited to, the
following determinations:
(1) Determination of the '.rade area of the proposed transient accom-
modation.
(2) Determination of trade area population, pry>>ent and future.
(3) Statement of need.
G. DEIGN STANDARDS
1) DENSITY:`
A) The r.~xim~un density for a transient accv~~rn~dation shall not exceed
1 room for every 1000 square feet of lot area. However, r~o trar.-
si~nt acco~nnodation shall be approved witiiin this district which
has less than 50 rooms.
2) Transient accor~-nodations shall be architecturally designed so that access
to all rooms is provided through the interior of the building, via lob-
bies and corridors that are air conditioned and screened from the view
of the public at large.

DEFINITION:
Transient Accorr><modations - A building in which lodging or boarding and
lagging are provided for, and offered to the public for compensation, in
which ingress and egress to and from all rooms are made through lobbies, and
corridor within the interior of the building, said corridors shall be air
conditioned and enclosed from the view of the general public, and providing
additional services such as restaurants, lounges, meeting rooms, and
recreational facilities.

and by its manner of display and merchandising usually sells a limited
selection of items and brands of pre-packaged or prepared foods, ready to
eat foods, snacks, gum, candy, beverages, dairy products or sundries, all of
w~!-,ich are frequently purchased for immediate use, and may be developed with
facilities for the dispensing and sales of vehicular fuels, but with no sale

A. Restaurant - An establishment whose primary business is~ the sale of
food and beverages to patrons for consumption on the premises and whose
decision and method of operation includes any of the following:

marily within a completely enclosed building accommodating at least
ninety (90) percent of the establishments permitted seating capacity
and whose design, method of operation or any portion of whose business
includes any of the following characteristics:
1) Food and beverages are ordered from a limited menu posted in sign
form within the primary food service building or on the premises.
2) Foods, frozen desserts, or beverages may be served directly to the
customer in a motor vehicle either by a carhop or by other means

d. The proposed store shall incorporate into its ecnstruction and opera-
tion fire protection devices as (required by the ?alm Beach Ccunty Fire

b. All storage on the property shall be zep~ within encl.~sed or other
secured storage cubicles.
c. The operator of theself-storage facility shall provide locks for all
units and maintain a master key to all locks.
d, Fencing shall be required around the peri;reter of the project in accor-
dance with Section X of-this ordinance.
e. There shall be a minim~.rm of 35 feet pro:~ided between self-storage faci-
lities buildings for driveway, parking acid firelane purposes.

b. A by-pass Lane shall be provided if one-way traffic flow pattern is
utilized in the parking lot.

(General Comment) Due to the highly intensive nature of the permitted uses
inclsded within the proposed C-3 District as compared to the other less inten-
sive evmrnercial zones within the Village, and the relatively small geographic
area being proposed for the C-3 District, it is ret~ommended that PCD's not be
permitted within the C-3 District.
(E) General Requirements and Special Regulations
(b) Permitted Uses:

1. Single-family uses as provided for in a PRD.
2. Any uses within the R-2 and R-3 zoning districts which are

F. ~~C~lON X. SUPPLEMENTAL REGULATIONS
The district regulations of this zoning ordinan;.e shall be subject to the
following provisions and exemptions.
''A) Ger,e.~al Provisions.
(1) ;Miscellaneous Structures
(a) Chimneys, water tanks, radio or television antennas for corrlimercial
purposes, elevator lofts, church spires, flag poles and parapet walls
may be erected at the height limits as herein established or by the
heigi~t limits established within the sYecific zoning district.
(b) Brcad~,ast receiving a;;ter_nas o_, co~nunication antennas shall not
exceed more than forty (40) feet above grade in tr,e R/OP, R-1A, R-1,
and n-2 4oning Districts. In the R-3 Zoning District, no s:ch antenna
shall expend more than twenty (20) feet above t're roof of any prin-
cipal building. Said antenna(s) shall also be subject to the provi-
sions of subsection (0) of this section.
(c) Walls and fences may be erected or maintained within or ad`.acent to a
property line to a height not exceeding six (6) feet. No wall or
fence shall be permitted to extend forward of the front building line
on any lot or parcel. No height limitation is placed on hedges.
However, in the event that a wall, fence, or hedge is erected or
located on a corner lot or a double frontage lot, a vehicular and
pedestrian visibility triangle shall be provided for a minimum
distance of ten (10) feet in both directions from the intersecting
corner point of property lines. The maximum height of any wall,
fence, or hedge within said visibility triangle shall be t;o and one-
half (2~) feet.

• (d) All clothes lines shall be installed on to^atiors which shall not be

Patio or porch railings rr~ay not be used as clothes Iines. Clothes
line extending from second or higher floors of buildings are prohi-

(2) Ca^3stal Coristructior,:
(a) Construction in coastal areas of the village must comply with all of
the provisions of the "Palm 3each County Coastal Construction and
Excavation Setback Crdinance No. 72-12" and the construction control
line established by tt;e State of Florida Bureau of Beaches and Shores,
which ordinance or its successor small prevail in the absence of a
conflicting village ordinance.
• (3) Recreation S ce:
{a) In multiple residential developments where eight (8) or .more dwelling
units are in one (1) or more structures under single ownership, there
shall be provided recreation space and/or facilities at the rate of

(b) Wt;ere the accessory building is attached to the principal building or
connected thereto by a breezeway, the side yard shall be measured from
the outer wall thereof.
(5) Commercial Activit in Non-Commercial Districts:
(a) No advertised business, or business or profession open to the public,
professional or otherwise, shall be carried on in any noncommercial
zoning district of the village.
