The Village Council held a regularly scheduled Council Meeting at Village Hall, 357 Tequesta Drive, Tequesta, Florida on July 14, 1987, immediately following the Local Government Planning Agency Public Hearing. Mayor Stoddard called the meeting to order at 8:00 P.M., and a roll call was taken by the Village Clerk. Councilmembers present were: Carlton D. Stoddard, Mayor; Edward C. Howell, Vice-Mayor; Earl L. Collings and Ron Mackail. Councilmember Nelson was excused from attendance in accordance with a motion adopted by Council at the Public Hearing earlier in the evening. Other officials present were Thomas G. Bradford, Village Manager; John C. Randolph, Esq., Village Attorney; Scott D. Ladd, Building Official; Gary Preston, Director of Public Works and Recreation; and Bill C. Kascavelis, • Finance Director/Clerk. II. APPROVAL OF AGENDA A. The agenda was amended to include a presentation by former Councilmember Lee Brown and Tim McDowell concerning the Jupiter/Tequesta Repeater Group located in Tequesta. III. APPROVAL OF MINUTES AND REPORTS A. The Local Planning Agency Public Hearing minutes of the June 9, 1987 meeting were approved as submitted. B. The Village Council Meeting minutes of the meeting held June 9, 1987 were approved as submitted. C. The Village Manager's Report covering the period of June 8- June 10, 1987 was approved as submitted. IV. COMMUNICATIONS FROM CITIZENS A. Mr. Lee Brown reviewed the functions and the purpose of a Repeater Group. He noted that a regular hand held radio or C.B. unit was functional for approximately a two mile radius; however, with the C~ • Minutes of Meeting July 14, 1987 Page 2 - ---------------------------- assistance of a repeater and tower the communications capabilities are enhanced to a radius of approximately twenty-five (25) miles. He also noted that an amateur radio operator could not use the air frequencies for profit. Mr. Brown thanked the Village Council for providing the Repeater facilities, located at the Village water tower. • Mr. Tim McDowell, President of the Jupiter/Tequesta Repeater Group of North Palm Beach County reviewed various functions of the group. They included: 1. Coordination of Civil Defense systems in Palm Beach County for the County Disaster Relief Program. 2. Coordination for community shelters and the Red Cross in the administration of Disaster Relief. 3. Authorization to report weather conditions to boaters in the waterways. 4. He noted the telephone line provided the Repeater Group by the Village was appreciated and has enabled their ability to notify responsible agencies of the County concerning threatening weather conditions, or disasters occuring within the area requiring actions by the various Civil Defense, Law Enforcement Agencies, and Fire Department and Rescue personnel of the County. 5. He noted a back-up repeater was located in Jupiter and Palm Beach Gardens. 6. The area covered by the Jupiter/Tequesta Repeater Group encompasses North Palm Beach from Fort Pierce to Indiantown, to Lake Park and east to the boaters on the ocean. B. Mr. John Giba questioned procedures currently in effect in the processing of site plan approvals by the Village Council. He suggested that prior to a site plan being approved that the conditions required to be met by the developer be reduced to writing and signed by the applicant prior to the site plan being finalized and approved by Council. • Minutes of Meeting July 14, 1987 Page 3- ------------------ The Village Attorney indicated that Mr. Giba's proposal had merit, and a policy of having all site plan applicants sign a document noting all conditions to the site plan approval could be administratively implemented in the processing of site plan approvals. V. APPOINTMENTS A. Council considered the appointment of William Burckart to the Tequesta Planning Commission. Councilmember Collings moved, seconded by Councilmember Mackail, "to appoint Mr. William Burckart to the Tequesta Planning Commission". The vote on the motion was: Edward C. Howell - for • Ron Mackail = for Earl L. Collings for Carlton D. Stoddard - for The motion therefore passed and was adopted. VI. DEVELOPMENT MATTERS A. Council considered the request for a site plan modification of Tequesta Shoppes storefront located at U.S. Highway 1, by R.H. Properties, owner. Mr. Randy Haisfield of R.H. Properties reviewed the modification of the storefront of the Raymond James Associates office. Upon completion of the review Councilmember Mackail moved, seconded by Councilmember Collings,"to approve the request for the site plan modification as submitted". The vote on the motion was: Edward C. Howell - for Earl L. Collins - for Ron Mackail - for Carlton D. Council considered the request for a free standing sign for Tequesta Financial Centre, Inc., located at 218 U.S. Highway 1. Mr. Ernest Hamilton, owner, reviewed the particulars of the black granite, lighted, 9'x6' sign with the Council. Upon completion of the presentation, Councilmember Howell moved, seconded by Councilmember Mackail, "to approve the request for the free standing sign for Tequesta Financial Centre, Inc., located at 218 U.S. Highway 1 as submitted". The vote on the motion was: :7 Earl L. Collings Edward C. Howell Ron Mackail Carlton D. Stoddard - for - for - for - for The motion therefore passed and was adopted. VII. NEW BUSINESS A. Dr. Stanley Jacobs, Chairman of the Planning Commission, reviewed the recommended entrance sign and landscaping of the median at U.S. Highway 1 and Tequesta Drive. Upon completion of the presentation Councilmember Mackail moved, seconded by Councilmember Collings, "to approve the sign concept as presented, for the entrance sign to be located at U.S. Highway 1 and Tequesta Drive". The vote on the motion was: Earl L. Collings Edward C. Howell Ron Mackail Carlton D. Stoddard - for - for - for - for The motion therefore passed and was adopted. C~ Minutes of Meeting July 14, 1987 Page 5- ------------------ Dr. Jacobs noted that cost estimates will be provided to Council for the sign to be located at Tequesta Drive and U.S. Highway 1 (two-faced sign) and a single faced sign to be located at 707 and U.S. Highway 1. B. Council considered Resolution No. 10-86/87 providing for amendments to the Village Operating Budgets for Fiscal Year commencing October 1, 1986. The Village Manager reviewed a memorandum provided to Council detailing the amendments to the Village General Fund and Water Department Operating Budgets for Fiscal Year 1986/87. Upon completion moved, seconded Resolution No. the motion was: Earl L. Collings Edward C. Howell Ron Mackail Carlton D. Stodd, of the review Councilmember Mackail by Councilmember Howell, "to approve 10-86/87 as submitted". The vote on - for - for - for Ord - for The motion therefore passed and Resolution No. 10- 86/87 was adopted. C. Consideration of adopting the first reading of Ordinance No. 352, providing fair share contribution for park, recreational and governmental improvements. Upon completion of a discussion of the Ordinance provisions, and concerns of developer Gordon Ripma, that the fees contained in Ordinance 352 were excessive; Councilmember Collings moved, seconded by Councilmember Mackail, "to table Ordinance No. 352 until the Ordinance can be reviewed in greater detail at a workshop open to the public". Consideration of adopting the first reading of Ordinance 353, amending Chapter 11-20 and 11-24 of the Village Code of Ordinances. Upon completion of a review of the provisions of Ordinance No.353 by Council, Attorney Randolph read by title only, the first reading of Ordinance No. 353; "Ordinance No. 353, an Ordinance of the Village of Tequesta, Florida, amending Chapter 11, licenses, at Sections 11-20 and 11-24 by amending transfer fees and registration fees, by amending Section 11-24 relating to disabled veterans, etc., providing for severability; providing for codification; and providing an effective date". Councilmember Mackail moved, seconded by Councilmember Collings, "to approve the first reading of Ordinance No. 353 as presented". The vote on the motion was: Edward C. Howell - for Earl L. Collings - for Ron Mackail - for Carlton D. Stoddard - for The motion therefore passed, and the first reading of Ordinance No. 353 was adopted. E. Consideration of adopting the first reading of Ordinance No. 354, amending Appendix B, Sub-division regulations, Article 2, Section 2 (3), Preliminary Plat procedure. U Minutes of Meeting July 14, 1987 Page 7- ------------------ Upon completion of a review of the revisions contained in proposed Ordinance No. 354 by Council, Attorney Randolph read, by title only, the first reading of Ordinance No. 354, "Ordinance No. 354, an Ordinance of the Village of Tequesta, Florida, amending Appendix B, Sub-division regulations, Article 2, Section 2), Preliminary plat procedure, regarding application and fees; providing for severability; providing for codification; and providing an effective date". Councilmember Mackail moved, seconded by Councilmember Howell, "to approve the first reading of Ordinance No. 354 as presented". The vote on the motion was: Earl L. Collings Ron Mackail . Edward C. Howell Carlton D. Stoddard - for - for - for - for The motion therefore passed, and the first reading of Ordinance No. 354 was adopted. VIII. UNFINISHED BUSINESS A. Consideration of Resolution No. 11-86/87, a resolution approving an interlocal agreement for the Cypress Drive Area Drainage Study and authorizing for participation therein by the Village of Tequesta. The Village Manager reviewed the interlocal agreement between the Town of Jupiter, Village of Tequesta and Palm Beach County for the Cypress Drive Drainage Study, and indicated the Village of Tequesta's proportionate share of cost would not exceed 40$ of the total study cost, which are estimated at $9,500, plus or minus 10~ for contingencies. Mayor Stoddard took exception to the wording of the resolution and the interlocal agreement, and suggested that Section 1 of the resolution be amended to include the affected areas of Tequesta. Minutes of Meeting July 14, 1987 Page 8- ------------------ Upon completion of the discussion, Councilmember Collings moved, seconded by Councilmember Mackail, "to approve Resolution No. 11-86/87, subject to the amendments discussed". A presentation of the Village Comprehensive Traffic Study, including findings, recommendations, and cost estimates presented by Jim Collings, P.E., Gee & Jenson Engineering, Inc. • Councilmember Collings noted that he was not on the Council when the Traffic Study was authorized and questioned the need for such a study. Mr. Bradford indicated that prior to receiving approval from the Florida Department of Transportation or the Palm Beach County Transportation Department for any improvements to Village thoroughfares, a study similar to the one completed by Gee & Jenson, for Tequesta Drive, would be required. Mr. Collings noted that the recommendations contained in the study did not include any new recommendations which were not previously recommended by Village residents and members of various Boards & Commissions of the Village. He equated the cost of the study as a form of bureaucratic blackmail to municipalities. Mr. Collings also told Mr. Collins that his remarks were not directed to him personally. Mr. Collings noted that the Traffic Study was broken down into primarily three specific areas: • Minutes of Meeting July 14, 1987 Page 9- Area 1: Tequesta Drive and Riverside Drive will require a traffic signal in the future. Area 2: Alternate AIA and U.S. Highway 1 intersection will require a modification of the traffic signal only. Area 3: Improvements for Tequesta Drive from Cypress Drive to U.S. Highway 1. Mr. Collings reviewed the recommendations contained in the Traffic Study, which he designated as the initial preliminary design phase for the improvements to Tequesta Drive. During the presentation numerous comments and concerns were expressed by members of the audience and the Council. For the purpose of presenting a comprehensible report of the data presented an enclosure has been taken from the Comprehensive Traffic Study document, together with cost estimates, excluding acquisition of right-of-way for the improvements recommended. Upon completion of the presentation Mr. Collins noted that the construction and engineering phase of the project including right-of-way acquisition would total approximately $500,000. He further indicated that the design of the Tequesta Improvement Project would take approximately two and a half or three months for completion, and he estimated construction of the project would require six months. It was the general consensus of Council that the Tequesta Drive Improvements from Cypress Drive tc U.S. Highway 1 should be considered as the toy priority of improvements projects needed within the Village, and emphasis should be taken to enable undertaking the entire project rather than considering completing the improvements in phases. It was also stressed that during the planning stages for the improvement, emphasis should be given to salvaging the medians and landscaping from Cypress Drive to U.S. Highway 1. Consideration of Council for the adoption of the second reading of Ordinance No. 351, an ordinance amending the Code of Ordinances by providing for Chapter 16, a fee schedule application and filing fees for development activities. Upon completio of a review of the provisions of Ordinance No. Village Attorney Randolph read, by title only, "Ordinance No. 351, an ordinance of the Village of Tequesta, Palm Beach County, Florida, amending the Florida Code of Ordinances by providing for Chapter 16, fee schedule, application and filing fees; providing for severability; providing for codification; providing for an effective date". Councilmember Collings moved, seconded by Councilmember Mackail, "to approve the second reading of Ordinance No. 351 as presented". The vote on the motion was: Earl L. Collings - for Edward C. Howell - for Ron Mackail - for Carlton D. Stoddard - for The motion therefore passed, and the second reading of Ordinance No. 351 was adopted. VIIII. ANY OTHER MATTERS A. Improvements to the intersection of Teq uesta Or ive, Waterway Road and U. S. 1 will require signal modification and pole relocation to add an additional lane to Waterway Road. D. Riverside Drive d Tequesta Drive The northbound approach of this intersection falls to Level of Service "E" by 1990. The intersection on the whole is operating at an acceptable LOS. However, to improve the northbound approach; the addition of a signal is recommended. Future peak hour traffic counts should be considered to determine if a signal is warranted. E. F. 1"ter Roadrays By Others A new road i s being proposed by the developer of "The PI aza of Tequesta" that connects U. S. 1 and Oid Dixie Highway and w i I I reduce demands on Teq uesta Drive and U. S. 1 . Th i s connection occurs north of Tequesta Drive. '~ Recent roadway improvements committed to by Palm Beach County include the 5 laving of Old Dixie Highway from S.R. 81 1 to County Line Road. Both of the above protects are recommended for comp) etion under this study as they will serve to distribute Tequesta Traffic as wel i as provide add i ti ova I access. 6. Martin County Considerations Country Club Drive presently provides access to Martin County and t s operating at an existing high Level of Service. Future traffic protections for this Tequesta Link are also going to remain at a very acceptabl a Level of Service.
