The Village Council held a public hearing at Village Hall, 357 Tequesta Drive, Tequesta, Florida at 7:45 P.M. on August 11, 1987, to review proposed Ordinance 355 for the first reading, amending Zoning Ordinance 319 in its entirety, and amending regulations of all zoning districts, amending zoning classifications, and creating a new C-3 general commercial district. The public hearing was called to order by Mayor Stoddard, and a roll call was taken by the Village Clerk. Councilmembers present were: Carlton D. Stoddard, Mayor; Edward C. Howell, Vice-Mayor; and Councilmember Earl L. Collings. Councilmembers Edwin J. Nelson and • Ron Mackail were excused from the meeting. Others present were: Thomas G. Bradford, Village Manager; John C. Randolph, Esq., Village Attorney; Gene Caputo, Village Planning and Zoning Consultant; and Bill C. Kascavelis, Finance Director/Clerk. II. The agenda was approved as submitted. III. The Village Manager reviewed the Comprehensive Zoning Ordinance and he noted that the review began approximately a year ago when Council addressed the creation of a special C-2 zoning district located in the northeast portion of the Village (the area north of Tequesta Drive bordered on the east by U.S. Highway 1, and on the west by Old Dixie Highway). Mr. Caputo stated that the document carries out the desires of the Village as determined by Village Council Workshops held during the past year which were designed to implement the Village Comprehensive Plan. The Village Attorney indicated that the purpose of the meeting was to enable a review by residents of the proposed ordinance, and to set a date, time and place for the second required public hearing before final adoption of the ordinance. • The Village Attorney read Ordinance 355 by title only, "an Ordinance of the Village of Tequesta, Palm Beach County, Florida, amending Zoning Ordinance 319, as Minutes of Meeting • August 11, 1987 Page 2- ------------------ amended, including the amended Zoning Map made a part of said ordinance; in its entirety by providing for a new Comprehensive Zoning Ordinance promoting health, safety, morals and general welfare of the inhabitants of the Village of Tequesta, Florida; to facilitate the adequate provision of transportation, sewerage, water, parks, and other public requirements; to regulate and restrict the erection, construction, reconstruction or alteration of buildings; to regulate and restrict the height, number of stories and size of all buildings and structures, and the size of all yards and other open spaces surrounding buildings; to regulate and restrict the density of population and for all said purposes to divide the Village into districts of such number, shape and area as may be best suited to carry out these regulations and amendments: to provide for its enforcement; to provide for special exceptions and variances in event of hardship and providing penalties for violations hereof; providing for severability; • providing an effective date." Mr. Caputo reviewed the general provisions of the ordinance, with concern to the Council pertaining to procedures for site plan reviews for new developments. 1.) It was noted that the ordinance as presently written refers to the Community Appearance Board as the final approving authority; whereas, the Council should be designated the final approving authority. Council agreed with Mr. Caputo's assessment. 2.) It was noted that special exception applicants are required to appear before the Community Appearance Board prior to appearing before the Council. Council also concurred that this should be revised requiring applicants to appear before the Council for special exception approval first. 3.) The Village Attorney noted that the language dealing with "Unity of Title" was permissive, and should be addressed and made more specific, and proof thereof in the hands of the Building Official prior to issuance of the building permit. • Minutes of Meeting • August 11, 1987 Page 3- ------------------ C~ 4.) The language dealing with traffic studies for new developments should be revised requiring an applicant to be responsible for payment for the study by a firm mutually agreed upon by the Village and the applicant. 5.) Consideration should also be given to require a development agreement letter to be signed by both parties, specifying all site plan requirements, and all conditions. Council requested that the Village staff and Mr. Caputo review the ordinance and make the recommended changes prior to the second reading.
