The Village Council held a public hearing to review the proposed Comprehensive Zoning Ordinance at Village Hall, 357 Tequesta Drive, Tequesta, Florida at 7:00 P.M. on August 25, 1987. The Public Hearing was called to order by Mayor Stoddard and a roll call was taken by the Village Clerk. Councilmembers present were: Carlton D. Stoddard, Mayor; Edward C. Howell, Vice-Mayor; Councilmembers Edwin J. Nelson and Ron Mackail. Councilmember Earl L. Collings was excused from the meeting. Village officials present were: Thomas G. Bradford, Village Manager; Scott D. Ladd, Building Official; John C. Randolph, Village Attorney; Gene Caputo, Planning and Zoning Consultant; and Bill C. Kascavelis, Finance Director/Village Clerk. • II. Councilmember Edwin J. Nelson gave the invocation and led those in attendance to the Pledge of Allegiance to the American Flag. III. The agenda for the public hearing was approved as submitted. IV. Village Attorney Randolph read, by title only, the proposed Comprehensive Zoning Ordinance No. 355, "AN ORDINANCE OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AMENDING ZONING ORDINANCE NO. 319, AS AMENDED, INCLUDING THE AMENDED ZONING MAP MADE A PART OF SAID ORDINANCE; IN ITS ENTIRETY BY PROVIDING FOR A NEW COMPREHENSIVE ZONING ORDINANCE TO PROMOTE THE HEALTH, SAFETY, MORALS, AND GENERAL WELFARE OF THE INHABITANTS OF THE VILLAGE OF TEQUESTA, FLORIDA; TO FACILITATE THE ADEQUATE PROVISION OF TRANSPORTATION, SEWERAGE, WATER, PARKS, AND OTHER PUBLIC REQUIREMENTS; TO REGULATE AND RESTRICT THE ERECTION, CONSTRUCTION, RECONSTRUCTION OR ALTERATION OF BUILDINGS; TO REGULATE AND RESTRICT THE HEIGHT, NUMBER OF STORIES AND SIZE OF ALL BUILDINGS AND STRUCTURES, AND THE SIZE OF ALL YARDS AND OTHER OPEN SPACES SURROUNDING BUILDINGS; TO REGULATE AND RESTRICT THE DENSITY OF POPULATION AND FOR ALL SAID PURPOSES TO DIVIDE . THE VILLAGE INTO DISTRICTS OF SUCH NUMBER, SHAPE AND AREA AS MAY BE BEST SUITED TO CARRY OUT THESE REGULATIONS AND AMENDMENTS: TO PROVIDE FOR ITS ENFORCEMENT; TO PROVIDE FOR SPECIAL EXCEPTIONS AND VARIANCES IN EVENT OF HARDSHIP AND PROVIDING PENALTIES FOR VIOLATIONS HEREOF; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE." Mr. Gene Caputo, Village Planning and Zoning Consultant presented a general overview of the Comprehensive Zoning Ordinance, and recommended the following revisions: 1.) Page 4, Definition 10: Adult Congregate living facilities 2.) Page 15, Item 1-15: added with just compensation to the owner. 3.) Page 48, Item I: strike out, or Life Care retirement facility. 4.) Page 49, Item K-1: strike kitchen entire sentence. 5.) Page 98, Item E, add: for one more year only. • Mr. Caputo also noted that zoning maps are available for inclusion to the zoning ordinance. He noted the Village Council and staff members have been working on the Comprehensive Zoning Ordinance for the past year, and he recommended its adoption. In response to a question from Mayor Stoddard, Village Attorney Randolph indicated the ordinance was legally sound, and he did not foresee any problems with the ordinance being adopted. Village Manager Bradford commented that the Comprehensive Zoning Ordinance was an excellent document, which addressed many areas and concerns of the Council that were not covered in the previous zoning ordinance. Upon completion of the review, Councilmember Howell moved, seconded by Councilmember Nelson, "to approve the second reading of Ordinance No. 355, Comprehensive Zoning Ordinance of the Village, as amended." The vote on the motion was: Carlton D. Stoddard Edward C. Howell Ron Mackail Edwin J.
