HomeMy WebLinkAboutMinutes_Regular_01/10/1984 MINUTES OF THE VILLAGE COUNCIL MEETING OF THE VILLAGE OF TEQUESTA, FLORIDA January 10, 1984 A meeting was held by the Village Council of the Village of Tequesta at 7:30 P.M., Tuesday, January 10, 1984 in the Village Hall, 357 Tequesta Drive, Tequesta, Florida. Councilmembers present were: Beddow, Brown, Little, Stoddard and Wagar. Also present were: Robert Harp, Village Manager, Cyrese Colbert, Village Clerk and John C. Randolph, Village Attorney. The opening Prayer and Pledge of Allegiance to the Flag was given by Councilmember Brown. Cha add add add add add • add add add ages made and approved to the agenda were: la. Water Treatment Plant news article (Beddow) Council discussed a possible workshop meeting with or without Mr. A]_ Woodard about his proposed settlement with the Village. Vice- Mayor Beddow asked for a copy of the court transcript where Mr. Woodard talked about the money loss incurred by him during the suit against the Village. Vice-Mayor Beddow said he would also like to find out if this is covered by insurance. Council agreed that the Village Manager and the Village Attorney should get together on this and report back to Council at the next Council Meeting. Mayor Stoddard announced a meeting of the Annexation Committee on Monday, January 16, 1984 at 9:30 A.M. in the Village Hall. He also told Council that the committee has asked that he be present and that he would attend.. The Village Attorney advised that the meeting is opened to the Public and that minutes are taken and that the press should be invited. Mayor Stoddard announced to the press that they were invited to attend this meeting. The Village Manager also advised that the minutes that are taken and recorded must be turned into the Village Administrative Office and shall become part of the Village's permanent records according to "Florida in the Sunshine Law". U 01-10-84 -02 Mayor Stoddard also announced that the Blood Mobile will be at the Tequesta Publix on Friday, January 13, 1984 between the hours of 12:00 and 3:00 P.M. Mayor Stoddard announced that the Tequesta Garden Club was delighted with the Proclamation for Arbor Day and ,that they will plant a tree in the "Village Green" Park. Mayor Stoddard announced that there will be a County Appraiser's meeting on January 30, 1984 at 2:00 in the Jupiter Town Hall. Mayor Stoddard complimented the Tequesta Police Department on the fine p.r. work they did as Santa Claus over. the Christmas holidays. The Village Clerk announced that March 13, 1984 was the Village Election and that Seats 1, 3 & 5 were up for election. The Village Clerk also announced that all potential Candidates must file with the Village Clerk a "Notice of Candidacy" from and including Tuesday, January 31, 1984 to and including noon Tuesday, February 14, 1984. There will be a meeting for all potential candidates on Monday, January 30, 1984 at 5:30 P.M, in the Village Hall. la. The next item on the agenda was Coral Cove Park Annexation. Mayor Stoddard told Council he has been approached by Palm Beach County's Director of Security for Coral Cove Park, Ken Gunter and that Mr. Gunter told Mayor Stoddard that Palm Beach County is very concerned with security in the park. Mayor Stoddard said that park security, in the future, • will be taken over by Palm Beach County's Sheriff Office and this will present a problem. Mayor Stoddard said that he had asked Chief Flannery to be present at this meeting tonight to discuss it. Councilmember Little told Council that he feels Proposition One is coming down on ths':~State and he does not think that the Village of Tequesta has any business getting involved in policing Palm Beach County owned parks. He said we have no jurisdication in this park. Chief Flannery told Mayor Stoddard that that was correct and if the Tequesta Police Department were to be called by the Sheriff's Office for assistance Tequesta Police could only go in there and hold a suspect until the Sheriff's Officers could arrive. Councilmember Little said he, for one, does not want to make any commitments that the Village of Tequesta will have any control over this park. Vice-Mayor Beddow agreed with Councilmember Little. Vice- Mayor Beddow said that this park has to be maintained by Palm Beach County and patrolled by Palm Beach County. Vice-Mayor Beddow told Council that even if the park was in Tequesta he feels that it should be protected by Palm Beach County. It is not the Village's park even if the Village was to annex the park. Mayor Stoddard told Council he has made no commitment to the County pertaining to annexation. Mayor Stoddard said he has indicated to the Police Chief that he would appreciate it if he would • keep an eye on that and the Chief said he would. O1-10-84 -03 Mayor Stoddard said he was told by the Palm Beach County Commission Chairman that any time the Village wanted to it could approach Palm Beach County for annexation of the park. Mayor Stoddard said we should have a workshop meeting with Palm Beach County to find out what they want us to do and what we should expect from them. Vice-Mayor Beddow said he would like to see the whole Council go to a Workshop meeting with Palm Beach County to discuss this. Mr. Joslin, Tequesta Voters and Taxpayers Association, told Council that his association was assuming that the park was already approved for annexation and that Council was in agreement on this. Mr. Joslin told Council he wanted to go on record that the park should be annexed only if it was not a taxable burden to the taxpayers. Vice-Mayor Beddow expressed to Council that he does not agree, at this point, that Tequesta should step in and take the liability of the park for Palm Beach County. Vice-Mayor Beddow told Council he personally, does not want any single member of the Council to negotiate with Palm Beach County on this question. Beddow moved, "that we authorize the Village Manager to explore the possibility of setting a date for a workshop meeting with Palm Beach County Officials and the Village Council on the matter of annexation of Coral Cove Park". Brown seconded and vote on the motion was: Beddow -for Brown -for • Little -for Stoddard -for Wagar -for and therefore the .motion was passed and adopted. Mr. Bob Smith, 400 Beach Road, expressed to Council Beach Road's residents concern over the County's policing of the park. Beddow moved, "that Bob Joslin be appointed to the Annexation Committee". Wagar seconded and vote on the motion was: Beddow -for Brown -for Little -for Stoddard -for Wagar -for and therefore the motion was passed and adopted. The Village Manager told Council that the Village needs a resume from Mr. Joslin. lb. Ron Harsh, Central Alarm Service System, told Council he has owned this company for ten (10) years and that he was present tonight to offer his assistance in the false alarm problerl. There were three (3) things he felt the Village could do that might help • eliminate some of the problems. They are (1) set up a Committee, (2). change Ordinance and (3). keep an alarm logbook. Mr. Harsh told Council he is willing to help with the Committee on reviewing the Village of Tequesta's alarm system. Chief Flannery said that he O1-10-84 -04 is willing to work with Mr. Harsh and his committee and he will come back before Council with the Village Manager, Mr. Harsh and the Committee. Councilmember Little said he would like a user to be on the committee. Council agreed that the Village Manager should help set this meeting up. lc. Joan Nestor, 57 Pine Hill Trail West, told Council they have not seen the signs posted in Chapel Court they-were told would be posted by the owners of the property. Mrs. Nestor told Council that the 3 wheelers are still all over the place. The Village Manager advised that the signs had been installed and run over by the 3 wheelers. The Village Manager also informed Mrs. Nestor and Council that he had talked with Ken Davis, Chapel Court, about the outfall reconstruction at the retention pond. 2a. The next item on the agenda was the first reading of an Ordinance providing Land Use Classification for Lobster Shanty. The Village Attorney told Council that the Village:-needs to Land Use this recently annexed piece of property. The Village Attorney read by title an Ordinance entitled, AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, PROVIDING FOR A LAND USE CLASSIFICATION PURSUANT TO THE COMPREHENSIVE PLAN OF THE VILLAGE OF TEQUESTA OF "COMMERCIAL" FOR THE PROPERTY HEREIN DESCRIBED. The Village Attorney also told Council that the property owner has been notified of the Land Use designation of his property. Little moved, "to approve first reading of this Ordinance". Brown seconded and vote on the motion was: • Beddow -for Brown -for Little -for Stoddard -for ti+]agar -for and therefore the motion was passed and adopted. 3a. Mayor Stoddard talked about the problems he and his neighbors were having with Perry Cable. Council agreed that a letter should be sent to Perry Cable, strongly stating Council's unhappiness with Perry Cable's service as of late. 3b. The next item on the agenda was the report on meeting with Palm Beach County about the .Beach Erosion Control District they are thinking about forming. Mayor Stoddard told Council there will be a meeting on this subject soon. Mayor Stoddard passed. the gavel to Vice-Mayor Beddow in order for him to make a motion. Stoddard moved, "to nominate Vice-Mayor Beddow as the Village's represent- ative to Palm Beach County's Beach Erosion Control District Task Force". Brown seconded and vote on the motion was: Beddow -for Brown -for Little -for • Stoddard -for ~, Wabar for and therefore the motion was passed and adopted. r 01-10-84 -05 3c. Mayor Stoddard told Council he would like to send a telegram to Governor Graham to let him know the Village is against the State of Florida re-appropriating to another area the $9 million set aside for beach restoration for this area of the State. Wagar moved, "that the telegram be sent to the Governor". Little seconded and vote on the motion was: Beddow -for Brown -for Little -for Stoddard -for Wagar -for and therefore the motion was passed and adopted. 3d. The next item on the agenda was the Rinker Plant. Vice-Mayor Beddow asked that this be on the agenda because he was concerned about the double-ended siding at Rinker that has not even been started yet. Vice-Mayor Beddow thinks it is time for Rinker to move this construction to completion. Council agreed that a C.O. should not be issued until the double-ended siding is completed. Councilmember Wagar said the F.E.C. will determine when the double ended siding goes in and he doesn't think the Village Council could push the railroad into it. The Village Attorney told Council he would write a letter to Rinker about the double-ended siding and the progress of the construction. Council talked briefly about Vice-Mayor Beddow's concern over the temporary shut down of the Water Plant. The Village Manager's Report for December 12, 1983 to January 6, 1984 was received. The Council Meeting Minutes for December 13, 1983 will be brought back at the next Council Meeting with corrections. The Village Financial Statement and Water Department Financial Statement for November 1983 were received. The meeting was adjourned at 11:00 P.M.
