HomeMy WebLinkAboutMinutes_Regular_04/10/1984• MINUTES OF THE VILLAGE COUNCIL MEETING OF THE VILLAGE OF TEQUESTA, FLORIDA April 10, 1984 A meeting was held by the Village Council of the Village of Tequesta, at 7:30 P.M., Tuesday, April 10, 1984 in the Village Hall, 357 Tequesta Drive, Tequesta, Florida. Councilmembers present were: Brown, Mapes, Murphy, Stoddard and Wagar. Also present were: Robert Harp, Village Manager, Cyrese Colbert, Village Clerk and John C. Randolph, Village Attorney. The opening Prayer and Pledge of Allegiance to the Flag was given by Councilmember Mapes. Mayor Stoddard announced that he had received notice from the U.S. Department of Commerce National Oceanic and Atmospheric Administration that the National Weather Service Office will conduct a Hurricane Probability Workshop and Awareness Program, on Wednesday, May 2, 1984 from 10:00 A.M. to 3:00 P.M. la. Mr. Jim Collins, Gee & Jenson, reviewed with Council his letter to the Village Manager dated April 4, 1984. Mr. Collins told Council there • were items that needed to be resolved tonight in order to close out the Tequesta Drive Drainage Project. Mr. Collins told Council that inspections of the project have found it to be complete. Bergeron has requested an additional 17 days to the previously recommended 35 days, Gee & Jenson does not agree with the additional seventeen days. Councilmembers agreed with Gee & Jenson that the additional 17 days should not be approved. John Giba, resident, asked Jim Collins if cuts across Tequesta Drive have been brought up to standard. He told Council there were dips in Tequesta Drive, at the cuts, and they will get worse with time if they are not taken care of. Mr. Collins told Council that he was not aware of any dips in the road. The Village Attorney told Council that the reason for a Performance Bond, which Bergeron has, is to cover matters which do not show up prior to approval of the job and that the Bond is good for one year after final payment is made. Council agreed that this matter should be tabled until the Engineers and Contractors could review this matter. Wagar moved, "to table this until the next Council Meeting". Brown seconded and vote on the motion was: Brown -for Mapes -for Murphy -for Stoddard -for Wagar -for and therefore the motion was passed and adopted. VILLAGE OF TEQUESTA 04-10-84 -02 !B. The next item on the agenda was the discussion of Capital Improvement Charge for Jupiter Island (Stoddard). Mr. Mike Rocco, Gee & Jenson reviewed with Council Jee & Jenson's letter of April 6, 1984 to the Village Manager. Mr. Rocco reviewed the basis for Gee & Jenson's recommendations. In their letter of April 6, 1984 Gee & Jenson recommended 1. The Village amend Article 1, Section 18-3, of the Village Code so as to provide for a Capital Improvement Charge of $970.65 for each new connection on Jupiter Island to the Village of Tequesta's Water System 2. Reimburse such connections for amounts paid in excess of $970.65 per connection. 3. Reimbursement to be funded from future like capital connection charges on a first paid first reimbursed schedule. Reimbursement to be made only when there are sufficient funds to reimburse each connection fully, no partial reimbursements and no credits towards any other rate, charge or fee. The Village Manager told Council this iter,l has been discussed by Council before, but in his opinion, it should not be opened ended. There were representatives from Landfall Condominium, Sea Watch Condominium and Jupiter Island Property Owners Association who spoke in favor of the developers receiving refunds. Mr. Thomas J. Beddow, former Vice-Mayor told Council that the money that paid for the Intracoastal crossing was an advance of Village funds for the benefit of the developers on the island and he felt there should be some kind of interest paid on the advancements of the funds. Councilmember Mapes told Council he thinks that the Village owes • the difference to the developers. He told Council he feels the developers are entitled to things being equal but also feels things should be equal to the Village of Tequesta. The Village Attorney told Council the Village should get a suggestion from the Engineers about the reimbursement and then get input from the developers. Councilmember Brown told Council the developers should wait until the next hook-up to be reimbursed and at that time the lower rates would go into effect. Mapes said he would like to table this until the next Council Meeting but he would like to go on record that more than likely this money will be refunded. Mapes moved, "to table this until the next Council Meeting" Murphy seconded and vote on the motion was: Brown -for Mapes -for Murphy -for Stoddard -for Wagar -for and therefore the motion was passed and adopted. lc. The next item on the agenda was the amendment to Site Plan Review Approval - landscaping for Christ the King Lutheran Church. Mr. Wessell, Architect was present representing the Church. Mr. Laessell showed the proposed amendments with deletion of several trees and various landscaping because VILLAGE OF TEQUESTA 04-10-84 -03 Me. Wessell said the Church would not be ready for Phase III for a while and the landscaping would be a great expense for the Church. Brown moved, "to approve amendment to Site Plan Review to include at least two (2) trees in the most northern part of the parcel" Mapes seconded. Discussion followed. Councilmember Brown said he was a little bit disillusioned that all these grandioso trees were being eliminated Vote on the motion was: Brown -for Mapes -for Murphy -for Stoddard -for Wagar -for and therefore the motion was passed and adopted. ld. The next item on the agenda was ~proval of sign for Pinch-A-Penny retail store. Mapes moved, "that the sign be approved as submitted". Murphy seconded and vote on the motion was: Brown -for Mapes -for Murphy -for Stoddard -for Wagar -for and therefore the motion was passed and adopted. • lc. Pride Plaza sign approval was the next item on the agenda. This developers sign needed an extension to the time previously allowed. Mapes moved, "that the permit be renewed for an additional six (6) months from the expiration date". Brown seconded and vote on the motion was: Brown -for Mapes -for Murphy -for Stoddard -for Wagar -for and therefore the motion was passed and adopted. lf, The next item on the agenda was the approval of Chapel Court entrance signs. The Village Manager reviewed the proposed sign's color, size and lettering with the Village Council. P~lapes moved, "to approve Chapel Court entrance signs as submitted". Wagar seconded and vote on the motion was: Brown -for Mapes -for Murphy -for Stoddard -for Wagar -for and therefore the motion was passed and adopted. VILLAGE OF TEQUESTA 04-10-84 -04 2a. The next item on the agenda was the "Victim Rights Week" proclamation (Stoddard). The Village Attorney advised that proclamations like this one does not have to come before Council. The_Village Attorney read by title the proclamation entitled PROCLAMATION OF VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA DECLARING THE WEEK OF APRIL 15 THROUGH 21, 1984 AS "VICTIM RIGHTS WEEK". Mapes moved, "that the Proclamation be approved". Brown seconded and vote on the motion was: Brown -for Mapes -for Murphy -for Stoddard -for Wagar -for and therefore the motion was passed and adopted. 2b. The Village Attor a letter stating that since by the deadline they would has replied to that request Wagar moved, "the extention motion was: ley told Council he had sent Rinker Materials the double ended spur siding was not completed have to supply a Bond to the Village. Rinkers by asking for an extention of that deadline. be allowed". Mapes seconded and vote on the Brown -for Mapes -for Murphy -for Stoddard -for Wagar -for • and therefore the motion was passed and adopted. 3a. 4a. & b. The Council Meeting Minutes of March 27, 1984 and the Village Manager's Report of March 26, 1984 to April 6, 1984 were received. The next item on the agenda was discussion of siltation in Loxahatchee River (Stoddard). This subject has to do with a sandbar that is in the Loxahatchee River at the mouth of the drainage ditch on Dover Road. The Jupiter Inlet District says it is the responsibility of the Village to clear it out because they say it was caused by the drainage ditch. Councilmember Mapes told Council this is not the responsibility of the Village of Tequesta and he thinks we ought to notify Jupiter Inlet District of this. Council agreed with Mapes. Councilmember Brown informed Council and the Village Attorney that there is off-loading going on at the siding north of Tequesta Drive. Council agreed that they would like the Police Department to start using the sound meter equipment again. The meeting was adjourned at 10:20 P.M.
