HomeMy WebLinkAboutMinutes_Regular_07/24/1984MINUTES OF THE VILLAGE COUNCIL MEETING OF THE VILLAGE OF TEQUESTA, FLORIDA JULY 24, 1984 A meeting was held by the Village Council of the Village of Tequesta at 7:30 P.M., Tuesday, July 24, 1984 in the Village Hall, 357 Tequesta Drive, Tequesta, Florida. Councilmembers present were: Brown, Mapes, Murphy and Stoddard. Wagar had advised he would be on vacation. Also present were: Robert Harp, Village Manager, Cyrese Colbert, Village Clerk and John C. Randolph, Village Attorney. The Prayer and Pledge of Allegiance to the Flag was given by Vice-Mayor Murphy. Changes made and approved to the agenda were: add 1 c. Mr. Hemhauser, 356 Venus Avenue add 2 b. F.E.C. lawsuit add 3 c. Connector Road - Martin County Mayor Stoddard made the following announcements: 1. Jim Worth, Water Department Superintendent, received the Citizen • of the Month award from the Jupiter-Tequesta Chamber of Commerce. 2. There will be a C.O.G. meeting, Wednesday, August 1, 1984 in the Village Hall. 3. There will be a Hurricane Watch Meeting for the Hurricane Captains in the Village Hall, Tuesday, July 31, 1984 at 10:00 A.M. 4. There will be a meeting on Jupiter's Bulk Water Rate Increase in the Jupiter Town Hall on Thursday, July 26, 1984 at 7:30 P.M. la. Mr. John F. McKune, P.E., Gee & Jenson read into the record the July 17, 1984 letter from William D. Reese, P.E. Gee & Jenson on the Water System Improvements, Bid tabulations. Mr. McKune pointed out that the letter from the Town of Jupiter was not attached as stated in the letter. Gee & Jenson recommended awarding the bid contract to R. J. Sullivan Corporation in the amount of $572,000. Mr. McKune told Council that completion should be within 200 days to the point of pumping water. Mapes told Mr. McKune and Council that he is concerned about the contract with the Town of Jupiter and going over the restricted allocated water amount for that period of time our system is down. Mapes advised Council that the people on the Water System should be warned well in advance that the Village may have to impose a water restriction use during that time. Village Council Minutes • July 24, 1984 Page 2 - Mr. McKune told Council that James Worth, Water System Superintendent, works closely with the Town of Jupiter and will continue doing so during the plant shutdown and there may be a need to impose water use restriction. Stoddard wants to know the earliest starting date for the construction. Mr. McKune told Council that construction can start as early as ten (10) days after receiving "Notice to Proceed", assuming the Village gets the necessary paper work. The Village Manager reminded Council the bid documents specified that the plant be opened by March 1, 1985. Mapes moved, "the water bids as recommended to us in the amount of $572,000 by the R. J. Sullivan Corporation be accepted." Brown seconded and vote on the motion was: Brown for Mapes for Murphy for Stoddard for • and therefore the motion was passed and adopted. lb. The next item on the agenda was the Site Plan Review - Denny's Res- taurant. Mr. Gary Wright, Interplan Practice Company was present to repre- sent Denny's Restaurant - Pride Plaza. Mr. Wright told Council that this restaurant would be the newest Denny's designed and would be opened 24 hours a day. Council was concerned with the ingress and egress at peak hours but was told by the Building Official that everything is in order and should work out. Brown asked where the water retention would be for the project. The Building Official explained that the water would have on site retention in the green areas then go to a catch basin and then into the river. Brown asked if the project had approval from all permitting agencies to dump into the river and was told it did. Mapes moved, "that the Site Plan Review for Denny's Restaurant be approved." Murphy seconded and vote on the motion was: Brown for Mapes for Murphy for Stoddard for Wagar for and therefore the motion was passed and adopted. lc. Mr. Hemhauser, 356 Venus Avenue asked Council how many times should a . person be told to remove a boat from the front yard before action is taken. Mr. Hemhauser asked if there was an Ordinance in Tequesta that prohibited Village Council Minutes • July 24, 1984 Page 3 - people from parking boats in the front yards. Stoddard told Mr. Hemhauser that the Village does have an Ordinance that prohibits people from parking recreational vehicles in the front yards. Mapes agreed with Mr. Hemhauser that if these Ordinances are not enforced then the Ordinances should be taken off the books. Council instructed the Village Manager to inform the Police Department to take care of these violations. Brown told Council and. the Village Manager that he had noticed that the same types of offenses have gone on without any action either by the Police Department or the Building Department until it is brought up to Council by someone. If it is an Ordinance on the books, then it should be enforced. Council agreed that matters like this should be handled better by the Police Department, Building Department or who ever is responsible for these violations. 2a. The Village Attorney read by title an Ordinance entitled: "AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING CHAPTER 18, ARTICLE I, • SECTION 18-3, OF THE VILLAGE CODE, AS AMENDED, BY CHANGING THE ADDITIONAL CAPITAL IMPROVEMENT CHARGE FOR NEW CONNECTIONS TO THE WATER SYSTEM LOCATED ON THAT GEOGRAPHIC AREA WITHIN THE SYSTEM KNOWN AS JUPITER IS- LAND FROM $1,485 FOR EACH NEW CONNECTION TO $970.65 FOR EACH NEW CONNECTION TO THE VILLAGE OF TEQUESTA WATER SYSTEM ON THE AREA WITHIN SAID SYSTEM KNOWN AS JUPITER ISLAND; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE." The Village Attorney told Council this Ordinance is similar to other rate Ordinances adopted by Village Council with the exception of the money figure. Discussion by Council followed expressing some reservation by Council for the need of passing this Ordinance now, since Palm Beach County is trying to acquire lg acres of land on Jupiter Island for a County Park. If this is done, Council feels the lost of revenue to the Water System would be great and the connection fees that are now in existence may be needed for the Water System. The Village Attorney suggested that if there is any questions on this subject, he recommends that this be turned over to Gee & Jenson for their. review in case this acre is turned into a Park. The Village Manager pointed out to Council that the world has not • stopped over there on the Island and there is still building going on with the people paying the higher connection fee as prescribed by Ordinance. Village Council Minutes July 24, 1984 • Page 4 - The Village Attorney advised Council to adopt the Ordinance on first reading and turn it over to Gee & Jenson for their review, that way, if Gee & Jenson approves, we just have to advertise for second reading, if they don't nothing would be lost. Mapes moved, "the approval of this Ordinance on first reading and that this Ordinance be sent to Gee & Jenson for their input." Brown seconded and vote on the motion was: Brown for Mapes for Murphy for Stoddard for and therefore the motion was passed and adopted. 2b. The F.E.C, lawsuit against the Village was the next item on the agenda. The Village Attorney informed Council that he is going to file an answer to the claim made by F.E.C. if that is what the Council wishes. Stoddard asked the Village Manager to comment. The Village Manager told Council he feels this item should not be discussed because of the lawsuit we are in, unless, the Village is willing to pay the bill right now for the • improvement to the railroad at Tequesta Drive. The Village Attorney inter- jected that he has said before that when the Village is in litigation, the Council should not discuss any item pertaining to the litigation, in the best interest of the Village. There was no further discussion. The Village Attorney reminded Council that he is attending the meeting, on behalf of the Village, at the Town of Jupiter on the increase of their Bulk Water Rates to Tequesta on Thursday night, July 26, 1984. He said that Howard. Osterman, Town of Jupiter, has asked him to meet with him before the meeting. The Village Attorney asked Council if Councilmember Mapes could attend that meeting with him. Murphy moved, "Mapes be authorized to attend that meeting with the Village Attorney and Howard Ostermann". Brown seconded and vote on the motion was: Brown for Mapes for Murphy for Stoddard for and therefore the motion. was passed and adopted. The Village Attorney advised Council that he has spoken with Chip Carlson, Assistant County Attorney and Mr. Carlson is sending out another letter to Palm Beach County Commissioners on the annexation of Coral Cove Park. • Village Council Minutes • July 24, 1984 Page 5 - 3a. The next item on the agenda was. the Proposed County Park - Jupiter Island. Stoddard said that he had received a note of approval from Council- member Wagar with a few changes made to Stoddard's letter to Palm Beach County on the proposed County Park at Jupiter Island. Brown asked if the Village had received any input from other residents in Tequesta other than Beach Road on this proposal. Mr. Kenneth Reames, 250 Beach Road, told Council that the Board of Directors of the Beach Road Association has sent out a ballot to each con- dominium owner asking for their input.. They have received a response from 283 people. Four (4) people were in favor and two-hundred and seventy nine (279) people objected to the proposed park. Mapes said he thinks Stoddard's letter to the County is fine but would prefer a Resolution from the entire Council. Council authorized the Village Attorney to draw up a Resolution from the Council to Palm Beach County opposing the purchase of 18 acres on Beach Road for a County Park and incorporate Stoddard's letter into the Resolution. • 3b. The next item on the agenda was the approval of tentative 1984/85 Millage Rate. Mapes told Council he is highly in favor of adopting a Resolution similar to that of Jupiter: re Fire Control District, because we have no input into the meetings between Palm Beach County and the Fire Control District on their budgeting yet and we have to collect the money through our millage and then pay the County. Mapes moved, "that the Village's representative to the Loxahatchee Council of Government (COG) be authorized to vote in favor of a Resolution opposing the method of funding for Fire Rescue Service MSTU." Murphy seconded and vote on the motion was: Brown for Mapes for Murphy for Stoddard for and therefore the motion was passed and adopted. Mapes moved, "that the tentative millage rate in the amount of $5.0418 be approved." Murphy seconded and vote on the motion was: Brown for Mapes for Murphy for Stoddard for • and therefore the motion was passed and adopted. Village Council Minutes • July 24, 1984 Page 6 - Mapes moved, "that the first Public Hearing on the 1984/85 Budget be held Thursday, September 6, 1984 at 7:00 P.M. and that the second Public Hearing be held on Monday, September 17, 1984 at 7:00 P.M. in the Village Hall, 357 Tequesta Drive." Brown seconded and vote on the motion was: Brown for Mapes for Murphy for Stoddard for and therefore the motion was passed and adopted. 3c. The next item on the agenda was the Connector Road - Martin County. Mapes asked what Resolution Council passed concerning this item. Discussions followed by Council on this item and a Resolution once adopted by Council. Stoddard told Council that C.O.G. has written a letter to Martin County pressing on the Department of Resource for this matter to be resolved. Brown said he feels strongly with the present position of this Council that a road be built somewhere by Martin County but where and how • they do it, remains to be seen. The Village Clerk left the meeting to locate the Resolution for Council, so Council proceeded with the next items on the agenda. The Council Meeting Minutes of July 10, 1984, the Village Manager's Report of July 8, 1984 to July 22, 1984 and the Village and Water Department Financial Statement of June 1984 were passed and adopted. The Council then went back to the subject of Connector Road - Martin County. The Village Clerk found one Resolution that was adopted July 27, 1982 by Council to the State requesting a strip of land from the State to be used for the road. (Since this meeting, further investigation into this matter showed the above request to the State by Council and in the meetings of the July 27, 1982 it was the consensus of Council that the Council not get further involved in this subject other than by the Resolution and attending meetings with Martin County.) The Village Attorney told Council he does not feel that the Village of Tequesta should get involved in a political fight for Martin County, maybe just a letter to Martin County would be more appropriate. Council agreed to have the Mayor write a letter to Martin County and approved by the Village Manager, that the Village of Tequesta would like . to see a Connector Road, period. .. Village Council Minutes • July 24, 1984 Page 7 - Council set up a Water System Refunding Bond Workshop Meeting with Joe B. Wise, William R. Hough & Company for August 1, 1984 at 5:00 P.M. (This meeting had been rescheduled after this Council Meeting to August 2, 1984 at 5:00 P.M.) The Village Manager told Council that the person responsible for putting building debris on the Church of the Good Shepherd's property is now in the process of removing it.
