HomeMy WebLinkAboutMinutes_Regular_08/28/1984• MINUTES OF THE VILLAGE COUNCIL MEETING OF THE VILLAGE OF TEQUESTA, FLORIDA AUGUST 28, 1984 A meeting was held by the Village Council of the Village of Tequesta, Florida at 7:30 P.M., Tuesday, August 28, 1984 in the Village Hall, 357 Tequesta Drive, Tequesta, Florida. Councilmembers present were: Brown, Murphy and Stoddard. Council- members Mapes and Wagar were on vacation. Also present were: Cyrese Colbert, Acting Village Manager, Scott Ladd, Building Official and John C. Randolph, Village Attorney. The Village Manager was on vacation. The Prayer and Pledge of Allegiance to the Flag was given by Council- member Brown. There were no addition or deletions to the Agenda. Mayor Stoddard made the following announcements: 1ST BUDGET PUBLIC HEARING - Thursday, September 6 at 7:00 at the Village Hall • 2ND BUDGET PUBLIC HEARING - Monday, September 17 at 7:00 at the Village Hall. WORKSHOP MEETING WITH PALM BEACH COUNTY REPRESENTATIVES on Annexation of t;orat trove rartc ana rroposecl its-Acre Park, Wednesday, September 5 at 2:00 in Village Hall. BEACH EROSION STEERING COMMITTEE - Monday, September 10 at 2:00 P.M. in Palm Beach County Courthouse. la. The first item on the agenda was a guest speaker for Mother's Against Drunk Drivers. Attorney Nugent was present representing that or- ganization. Mr. Nugent told Council that M.A.D.D.is a growing organization that works to reduce the number of drunk driver related deaths and injuries by fighting plea bargaining, probation, light fines and sentences. M.A.D.D. provides victim assistance for drunk drivers crimes, individual and family counseling, support groups, information and referral and support in the adjudication process. Mr. Nugent also told Council there is a total of 262 Chapters of M.A.D.D. with 18 of them in Florida. lb. The next item on the agenda was Site Plan Review for Fidelity Federal Safe Deposit Vault plans of a safe deposit vault addition and related facilities for the Tequesta Branch Office. The vault will go on the eastside of the building on the north corner. Mr. Dan Kirk, Property Manager and John Marion, Architect was present representing Fidelity Federal. The Building Official said, "although we will lose some on site, there is enough parking on site on the northside of bank in the shopping center parking lot". Murphy moved, "to approve Site Plan Review" Brown seconded and vote on the motion was: Brown for Murphy for Stoddard for and therefore the motion was passed and adopted. lc. The next item on the Agenda was the Site Plan Review for the Rinker Project Wall Modifications, Mr. Bill Payne, Division Manager and General Counsel for Rinker Materials. The Site Plan Review was for a wall five (5) feet high running seventy-nine (79) feet north of the eighty (80) foot opening to Rinker's property on the westside of Old Dixie Highway and twenty-four (24) feet on the southside of the opening. Mr. Payne told Council that Palm Beach County had said that maybe Tequesta would like to revisit this area after they had realized the proposed wall would be eight (8) feet high. Palm Beach County suggested the wall be lowered • to three (3) feet because of what they felt might be poor visibility. Rinker Material felt that the five (5) feet high wall would give them ade- quate site distance. Mr. Payne also talked about the improvements to Old Dixie Highway. A resident asked when Rinker was going to start putting in the plants for the buffer zone on the westside of the plant, near the railroad. Mr. Payne answered that this would be the last item to go in or else the construction would end up killing it. Brown moved, "for approval of the 60" high wall." Murphy seconded and vote on the motion was: Brown for Murphy for Stoddard for and therefore the motion was passed and adopted. ld. The next item on the Agenda was Site Plan Review for Step Saver Food Mart Convenience Store. Mr. Thomas A. Vani, was present representing B. W. Sinkins & F. A. Sheriff dba Step Saver Convenience Food Mart. The Site Plan Review was for the taking down of the existing filling station, pumps, canopies and replace it with a new convenience food mart including new pumps and canopy. They have proposed to upgrade . the entire site including: new landscaping, safer curb cuts, new signs and new paving. Minutes of the Council Meeting • August 28, 1984 Page 3 - Stoddard said he was concerned with people causing trouble at the store and asked if they would sell beer. Mr. Vani said that the store would sell beer and wing but that the company has a policy to try and be a family store. He also said they are strict about loitering, they do not sell X-rated books nor do they sell drug paraphernalia. Stoddard also asked if they would take down the price sign that blocks the Village of Tequesta's entrance sign. Mr. Vani agreed to take care of it the following day. Council discussed several items such as cleanliness, egress and ingress, setback, etc. with Mr. Vani. Murphy moved, "to approve the Site Plan Review." Brown seconded and vote on the motion was: Brown for Murphy for Stoddard for and therefore the motion was passed and adopted. . le. The next item on the Agenda was the Site Plan Review for the entrance signs at Tequesta Pines Subdivision. Council agreed that it was a pleasant improvement to the area. Murphy moved, "to approve the signs and lighting." Brown seconded and vote on the motion was: Brown for Murphy for Stoddard for and the~.refore the motion was passed and adopted. 2a. The Village Attorney read by title an Ordinance entitled: "AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA,PROVIDING FOR THE PROHIBITION OF THE SOUNDING OF TRAIN HORNS AND WHISTLES AT SIGNALIZED CROSSINGS BETWEEN 10:00 P.M. AND 6:00 A.M. WHERE THE VILLAGE HAS ERECTED TRAFFIC SIGNS ANNOUNCING TO MOTORISTS THAT RAILROAD TRAIN HORNS AND WHISTLES WILL NOT BE SOUNDED DURING SAID HOURS; DIRECTING THAT THE VILLAGE MANAGER IDENTIFY ALL SUCH INTERSECTIONS WITHIN THE VILLAGE AND CAUSE TO BE ERECTED AT SAID INTERSECTIONS • IN ACCORDANCE WITH STATE LAW TRAFFIC SIGNS WARNING MOTORISTS THAT RAILROAD TRAIN HORNS AND WHISTLES WILL NOT BE SOUNDED DURING THE HOURS OF 10:00 P.M. TO 6:00 A.M.; Minutes of the Council Meeting • August 28, 1984 Page 4 - --------------------------------- DIRECTING THE VILLAGE MANAGER TO NOTIFY RAILROAD COMPANIES OPERATING WITHIN THE STATE OF THE ENACTMENT OF THIS ORDINANCE; PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE OF OCTOBER 1, 1984." The Village Attorney explained that the effective date of October 1, 1984 is when State law takes effect. The Village Attorney advised Council that Jupiter's Ordinance will take effect on October 1, 1984 and Martin County's Ordinance will be effective January 1, 1985. The Village Attorney said he would check with Palm Beach County to see when and if they will pass such an Ordinance. Brown moved, "approval of first reading of this Ordinance." Murphy seconded and vote on the motion was: Brown for Murphy for Stoddard for and therefore the motion was passed and adopted. • 2b. The next item on the Agenda was the first reading of an Ordinance providing for increase in Water Rates. Mayor Stoddard said he wanted to give recognition to the Village Attorney, Village Manager and Councilmember Mapes on the work they did to save the Village of Tequesta $49,293 per year over the proposed increase from the Town of Jupiter. The Village Attorney read by title an Ordinance entitled: "AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PLAM BEACH COUNTY, FLORIDA, AMENDING CHAPTER 18, ARTICLE I, SECTION 18-3(b) OF THE VILLAGE CODE PROVIDING FOR AN INCREASE IN THE SELLING PRICE OF THE VILLAGE WATER TO $1.05 PER 1000 GALLONS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE." Brown moved, "the approval of the Ordinance on first reading." Murphy seconded and vote on the motion was: Brown for Murphy for Stoddard for • and therefore the motion was passed and adopted. The Village Attorney read by "title'an Ordinance entitled: "AN ORDINANCE GRANTING TO FLORIDA POWER & LIGHT COMPANY, ITS SUCCESSORS AND ASSIGNS, AN ELECTRIC FRANCHISE, IMPOSING PROVISIONS AND CONDITIONS RELATING THERETO, PROVIDING FOR MONTHLY PAYMENTS TO THE VILLAGE OF TEQUESTA, AND PROVIDING FOR AN EFFECTIVE DATE". Brown moved, "the approval of first reading." Murphy seconded and vote on the motion was: Brown for Murphy for Stoddard for and therefore the motion was passed and adopted. 3a. Mayor Stoddard said he had received a call from Cecil Walker, • Administrative Assistant for the Department of Natural Resources requesting permission to put up "Manatees" Warning Signs in the area. He said the sign will probably be 3'x 4' or bigger. Brown moved, "approval of first reading." Murphy seconded and vote on the motion was passed and adopted. The Special Council Meeting Minutes of August 7, 1984, the Council Meeting Minutes of August 14, 1984, the Village Manager's Report for August 12, 1984 to August 24, 1984 and the Village and Water Department Financial Statement for July 1984 were all received. Council expressed their concern over the excessive amounts of water loss in the system for the year. That total being 115,404,000 gallons a total of an average of 19% waste. Stoddard said he thinks the Village Manager had a good idea on the bicycle path along Old Dixie, North of Tequesta Drive, to the new Post Office. Council agreed. Brown moved, "to get this going."
