MINUTES OF THE VILLAGE COUNCIL MEETING
OF THE VILLAGE OF TEQUESTA, FLORIDA
SEPTEMBER 11, 1984
A meeting was held by the Village Council of the Village of
Tequesta, at 7:30 P.M., Tuesday, September 11, 1984 in the Village Hall,
357 Tequesta Drive, Tequesta, Florida.
Councilmembers present were: Brown, Mapes, Murphy, Stoddard and
Wagar. Also present were: Cyrese Colbert, Acting Village Manager and
John C. Randolph, Village Attorney.
The Prayer and Pledge of Allegiance to the Flag was given by
Councilmember Mapes.
Changes to the Agenda were as follows:
add: 3a. Setting of Public Hearing for Proposed
18 Acre Park.
Mayor Stoddard made the following announcements:
1. 2nd Public Hearing on Tax Budget - Monday, September 17, 1984
• at 7:00 P.M. in Village Hall.
2. Loxahatchee Environmental Control District Meeting - Wednesday,
September 19, 1984 at 7:00 in Village Hall.
la. The first item on the agenda was the Jupiter Community
School Report and Agreement. Mr. Stacey Thomas, Assistant Principal was
present representing the Jupiter Community School. Mr. Thomas reviewed with
Council the Jupiter Community Education Status Report for Fall 1983-Summer
1984. Mr. Thomas told Council that for the period of Fall 1983-Summer 1984,
the total classes wa.s 203 and total registrants was 3,854.
Some of the programs held by the Jupiter Community School was the
Children's Recreation, Senior Citizen's Nutritional Program, Family Coun-
seling, Big Brother/Big Sister, Adult Learning Laboratory and the Homework
Assistance Program.
The Fall Term Classes had a total of 830 registered, the Winter
Term Classes had a total of 60 registered, the Spring Term Classes had 54
registered and the Summer Term Classes had a total of 41 registered.
Mr. Thomas told Council that Mr. Jim Moody deserves to be
mentioned because of the work he has done with adults and children with
the computers.
. Mapes moved,"to approve the agreement between the Palm Beach County
School Board and the Village of Tequesta and authorize the execution of

of agreement by the appropriate Village Officials." Brown seconded and vote
on the motion was:

and therefore the motion was passed and adopted.
lb. The next item on the agenda was Palm Beach County Special
Exception Petition ~~84-133 for Automotive Leasing Facility. Mr. David
Flinchum was present representing Automotive Leasing Facility. Stoddard
told Council that this was brought to light by an alert citizen who contacted
him of this petition before Palm Beach County. Stoddard reminded Council that
this was the third time Palm Beach County Planning, Building & Zoning Dept.
has failed to notify the Village of Tequesta.
• Mr. Flitchum explained to Council that his business is going into
an already existing building. It is a long term leasing corporation which
will have a maximum of 12 cars, for long term lease, in the parking lot.
Council asked questions of Mr. Flinchum, and received satisfactory answers.
Council had no objections to the business and told Mr. Flinchum the Village
would notify the appropriate Palm Beach County Official of their no object-
ions.
2a. The Village Attorney read by title, for second reading, an
Ordinance entitled:
"AN ORDINANCE OF THE VILLAGE OF TEQUESTA,
FLORIDA, AMENDING CHAPTER 18, ARTICLE I,
SECTION 18-3, OF THE VILLAGE CODE, AS
AMENDED, BY CHANGING THE ADDITIONAL
CAPITAL IMPROVEMENT CHARGE FOR NEW CONNECT-
IONS TO THE WATER SYSTEM LOCATED ON THAT
GEOGRAPHIC AREA WITHIN THE SYSTEM KNOWN
AS JUPITER ISLAND FROM $1,485 FOR EACH
NEW CONNECTION TO $970.65 FOR EACH NEW
CONNECTION TO THE VILLAGE OF TEQUESTA
WATER SYSTEM ON THE AREA WITHIN SAID
SYSTEM KNOWN AS JUPITER ISLAND; PROVIDING
FOR SEVERABILITY; PROVIDING FOR CODIFICATION;
PROVIDING AN EFFECTIVE DATE."
• Council discussed this proposed Ordinance on which they had two
concerns. One of the concerns was the Proposed 18 Acre Park on Jupiter

Island in an area that the Village had includai a large number of hook-up
to be added to the system to help defray the cost of the line over to
Jupiter Island. If a park is built and no large amount of new hook-up
will be added, the Village could be out that much money, and this would not
be a good time to lower the rates until it is studied more. The second
concern was the monies that had already been reimbursed to Condo developers
on the island which had paid the higher price for hook-ups. Mapes moved,
"that the second reading of this Ordinance be tabled." Wagar seconded and
vote on the motion was:

and therefore the motion was passed and adopted.
2b. The Village Attorney read by title, for second reading an
Ordinance entitled:
• "AN ORDINANCE OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, FLORIDA, PROVIDING FOR
THE PROHIBITION OF THE SOUNDING OF TRAIN HORNS
AND WHISTLES AT SIGNALIZED CROSSINGS BETWEEN
10:00 P.M. AND 6:00 A.M. WHERE THE VILLAGE HAS
ERECTED TRAFFIC SIGNS ANNOUNCING TO MOTORISTS
THAT RAILROAD TRAIN HORNS AND WHISTLES WILL NOT
BE SOUNDED DURING SAID HOURS; DIRECTING THAT
THE VILLAGE MANAGER IDENTIFY ALL SUCH INTER-
SECTIONS WITHIN THE VILLAGE AND CAUSE TO BE
ERECTED AT SAID INTERSECTIONS IN ACCORDANCE
WITH STATE LAW TRAFFIC SIGNS WARNING MOTORISTS
THAT RAILROAD TRAIN HORNS AND WHISTLES WILL
NOT BE SOUNDED DURING THE HOURS OF 10:00 P.M.
TO 6:00 A.M.; DIRECTING THE VILLAGE MANAGER
TO NOTIFY RAILROAD COMPANIES OPERATING WITHIN
THE STATE OF THE ENACTMENT OF THIS ORDINANCE;
PROVIDING FOR CODIFICATION; PROVIDING FOR
SEVERABILITY; PROVIDING AN EFFECTIVE DATE OF
OCTOBER 1, 1984."
The Village Attorney told Council he has received letter from
Palm Beach County Attorney and was advised that Palm Beach County is not
acting on this yet and is leaving it up to the municipalities.

"AN ORDINANCE OF THE VILLAGE COUNCIL OF
THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY,
FLORIDA, AMENDING CHAPTER 18, ARTICLE I,
SECTION 18-3 (b) OF THE VILLAGE CODE PROVI-
DING FOR AN INCREASE IN THE SELLING PRICE
OF THE VILLAGE WATER TO $1.05 PER 1000 GALLONS;
PROVIDING FOR SEVERABILITY; PROVIDING FOR CODI-
FICATION; PROVIDING AN EFFECTIVE DATE."
• Murphy moved, "the Ordinance be passed and adopted on second
reading." Mapes seconded and vote on the motion was:

and therefore Ordinance No. 330 was passed and adopted.
The Village Attorney read by "title" only, for second reading, an
Ordinance entitled:
"AN ORDINANCE GRANTING TO FLORIDA POWER & LIGHT
COMPANY, ITS SUCCESSORS AND ASSIGNS, AN ELECTRIC
FRANCHISE, IMPOSING PROVISIONS AND CONDITIONS
RELATING THERETO, PROVIDING FOR MONTHLY PAYMENTS
TO THE VILLAGE OF TEQUESTA, AND PROVIDING FOR AN
EFFECTIVE DATE."
The Village Attorney asked Mr. Bob Bussey, Florida Power & Light
if it is the intent of Section 4 (of the Contract) to save, defend and
hold harmless the Village for any liability which may occur as a result
of your construction, operation or maintenance of your facilities within
. the rights-of-way of the Village?

BOB BUSSEY: That's correct Skip. That particular clause,
back when we were negotiating on franchise for several
cities, was specially requested by the Cities and it does
protect the Cities.
VILLAGE ATTORNEY: It's not necessarily limited to your
negligence, it's any thing that may occur as a result
of your having to work within the rights-of-way.
BOB BUSSEY: That's right. It's our construction or
maintenance of our facilities within the corporate limits
of Tequesta.
Brown moved, "adoption of Ordinance on second reading." Murphy
seconded and vote on the motion was:

• and therefore Ordinance No. 331 was passed and adopted.
Mapes said that after the Workshop meeting held yesterday,
September 10, 1984, he feels there ought to be a Public Hearing for
Tequesta to hear the pros and cons on the purchasing of 18 Acres of
for a Palm Beach County Park on Jupiter Island.
Mapes moved, "that a Public Hearing on the proposed 18 Acre
Park, on Jupiter Island, be set for Monday, September 17, 1984 at 8:00 P.M.
in the Village Hall." Wagar seconded and vote on the motion was:

and therefore the motion was passed and adopted.
The Acting Village Manager presented Council with a set of
petitions of people for the park that had been turned in at the Administrative
office.
The Acting Village Manager told Council that Mr. Bill Reese, Gee
& Jenson will be at the September 25, 1984 Council Meeting.
