MINUTES OF THE VILLAGE COUNCIL MEETING
OF THE VILLAGE OF TEQUESTA, FLORIDA
July 26, 1983
A meeting was held by the Village Council of the Village
of Tequesta, at 7:30 P.M., Tuesday, July 26, 1983 in the Village Hall,
357 Tequesta Drive, Tequesta, Florida. Councilmembers present were:
Beddow, Brown and Stoddard. Also present were Robert Harp, Village
Manager, Cyrese Colbert, Village Clerk and John C. Randolph, Village
Attorney.
The opening Prayer and Pledge of Allegiance to the Flag was
given by Mayor Stoddard.
Mayor Stoddard announced the cancellation of the August 9,
1983 Council Meeting.

Girls Softball team for the donation of $200. the tillage

The first item on the agenda was Site Plan Review for Cypress
Villas, Gerry Wuhrman. The Village Manager read the letter of intended
use that this property will be used for. These will be single family
attached housing units. Each unit will be part of a quadraplex building
and will have two bedrooms, two baths, den, kitchen and living room.
Ttie letter stated that an overall Homeowners Association will be organized
to regulate and maintain the project.
Mr. Gerry Wuhrman explained to Council what Cypress Villas
would look like with a grayish color exterior and costing in the low
50's to high 50's.
Mr. Herbert D. Kelley, Jr., P.E., Kelley Engineering Associates,
Inc. who is the Engineering firm for the developer was present to answer
any questions Council might have on the traffic study and the drainage
system. Mr. Kelly told Council~as stated in his letter of July 6, 1983
to Mr. Wuhrman that based on the presented site plan, containment on
each site tract would accommodate storm water runoff, with a percolation
rate of less than one minute per inch. In the letter it also stated
that they found no adverse runoff conditions which would cause storm
water problems to Cypress Drive.

Mr. Peter Baron, resident, told Council he feels the developer
• should put in a statement to any buyer that the development is next
to a railroad. Mr. Wuhrman told Council he saw no problem with this
as long as any future developer in this area had to do this so that
it would be urrm and not discriminatory against this development.
Mr. Robert Voorhees, 4 Starboard Way, told Council he thinks
they should look into this developement more closely so that it won't
turn into a low income housing area. Mr. Voorhees says he feels that
way because he has family members that live in Georgetown Place and
~ha~ they have had a lot of problems with people who only rent there
and that the Police are there a lot because of the problems.
Mr. Al Wilshire, told Council that the intersection at Tequesta
Drive and Cypress Drive is the worst intersection in Tequesta and if
this new development is allowed then a traffic light should be installed.
Beddow wanted to know if the Building Official has consulted
with the Police Chief to see if this development would cause an undue
burden on the Police Department. Beddow said that after hearing the
residents testimony that Georgetown Place is a burden on the Police
Department that this development may also become a burden. The Village
Attorney told Council that he believes the resident's points are well
taken, but there are Ordinances that are designed to tape care of these
complaints. There is also the Homeowners Association that can address
the Council's recommendations when the Council finds out exactly what
type problems they are concerned with. The developer can_then put them
. in the Homeowner's Association documents. The Village Attorney told
Council that they could postpone the consideration of Site Plan Review
until the drainage is addressed and the Homeowners Association documents
are reviewed. Beddow said he thinks that this Site Plarr can be deferred
until the last meeting in August. Beddow said he also thinks the Police
Chief should be here to answer questions Council may have on the impact
on the Police Department.
Mr. Wuhrman asked that the Site Plan Review be approved,
but no Building Permit be issued until the items are satisfied such
as the Homeowners documents, Police Department approval/denial and the
drainage.
Beddow moved, "that we defer consideration of the request
to approve the Site Plan Review until our next scheduled meeting on
August 23, 1983 and that meanwhile we secure from our Engineer advice
concerning the adequacy of plans for drainage, #2. that in that period
of time the applicant submit to the Building Official and through the
Building Official and the Community Appearance Board his plans for landscaping
and screening and #3. that the Village Manager talk to the Police Chief
concerning the problem of whether or not this proposed development is
likely to place an undue burden on the Policing service in the Village
of Tequesta and if possible to have the Police Chief here to give
us the .benefit of his view at the next meeting on August 23, and further,
if possible, to have prior to that meeting the Police Chief and
• applicant consult with each other concerning any problem the Police
Chief may envision and ~ehen~as~and if we approve Site Plan Review we
will have to make it subject to the closing of the contract for the
purchase of all the issue of Capital Stock of the Corporation who presently

own, the land and that the applicant will provide some effective machine
• to notify the prospective purchaser that they are buying close to a
railroad. Also to ask the Building Official to review the plans and
specifications to the best of his knowledge so that the plans may be
approved expeditiously:' Brown seconded and vote on the motion was:

and therefore the motion was passed and adopted.
lb. The next item on the agenda was, Jack Baker's Lobster Shanty
building permit for parking area located in the Village of Tequesta
and delayed annexation of Jack Baker's Lobster Shanty. Mr. John Adams,
Attorney for Jack Baker`s Lobster Shanty was present and explained to
Council that the owner of the Lobster Shanty has plans to enlarge the
present restaurant but in order to do that~the parking has to be increased.
The property that the restaurant sits on is in the County and part of
the property which will be the increased parking is within the municipal
limits of the Village of Tequesta. Council talked at length about this
problem and Beddow gave the unanimous opinion of Council to Mr. John
Adams. Beddow told Mr. Adams that it is Council's suggestion that
Jack Balser conduct simultaneous with Palm Beach County and the Village
of Tequesta the Site Plan Review as respect to .the building and as respect
the parking lot and that presumably having gotten a building permit
from the County for the building you will enter into an agreement with
• us, satisfactory to our Attorney, from the standpoint of its being
a binding commitment, that immediately upon the issuance of a Certificate
of Occupancy by the County for the building you will file a petition
to annex into the Village for that portion of the property, the totality
of the property, that is the parking lot and the restaurant that is
presently in the County, and that there will be a Unity of Title.
lc. The next item on the agenda was the consideration of rate
increase by Pery Cable T.V. Mr. Phil Sheam Perry Cable, was present
to answer any questions Council and the audience may have on the rate
increase request. Mr. Sheaman said that Perry Cable has appeared before
Council three (3) times, on June 14, 1983, July 14, 1983 and again on
July 26, 1983 and he hoped this evening would be the last time. Beddow
thanked Perry Cable for sending out letters to the people about the
rate increase request and the notice of. tonigh~s meeting. Mayor Stoddard
opened the floor to the public for their input.
Mr. Stanley Rollin, President of the Tequesta Garden Condos,
told Council he does not feel that Tequesta Gardens Condos have had
the quality or service that justifies a rate increase and that people
at Tequesta Gardens are opposed to the rate increase.
Mr. Bob Voorhees, 31 Starboard Way, said he is dissatified
with Perry Cable service and that he is against the rate increase.
. Mr. Russell Norris, 10 Garden Street, asked Council to deny
the increase, because it is unreasonable and discriminatory.
Mr. Joe Blizzard, 16 Pine Tree Circle, was against the rate

increase.
N1r. Sterling Trumane, 22 Pine Hill Trail, told Council he
has had Perry Cable service for eight (8) years and has had no problems
with them.
Mr. Peter Baron, 7 Garden Street, told Council he didn't
like the letter he received from Perry Cab]_e about free service that
some people were getting with special televisions. He also opposed
the rate increase.
Beddow told Mr. Sheaman that there were only three (3) members
of Council present and in all fairness to Perry Cable he would like
to postpone the vote until the next Council Meeting.
Mr. Sheaman told Council Perry Cable will be at the next
meeting and went down the list of people who spoke at this meeting
against Perry Cable`s rate increase request and apolozied to each of
them for their unsatisfactory service or treatment.
Mr. George Watt, 360 Fiesta Avenue asked Council if the pine
trees in back of the Villager Apartments could be cut down by the Village
because of the possibility of one of them falling during a hurricane.
The Village Manager explained to Council that the property the trees
are on is probably Village easement but the trees were put there by
the developer. The Village Attorney and Village Manager where to check
• this out.
Beddow moved, "the approval of the appointment of William
Blodgett to the Annexation Committee for a two (2) year term". Brown
seconded and vote on the motion was:

Beddow moved, "that Councilmember Brown be appointed to represent
the Village at the next C.O.G. meeting". Stoddard handed the gavel
to Vice-Mayor Beddow and seconded the motion.Vote on the motion was:

and therefore the motion was passed and adopted.
Beddow moved, "that for the purpose of "Due Notice" to the
Palm Beach County Property Appraiser Office that we adopt a tentative
Ad Valorem tax millage rate of 3.2483". Brown seconded and vote on
the motion was:

and therefore the motion was passed and adopted.
The Village Manager gave .September 1,..1983 as the first date
of the first Public Hearing for the 1983/84 Budget.
The minutes of the July 12, 1983 Site Plan Review and the
minutes of the July 12, 1983 Council Meetings were received. The Village
Financial Statement for July 1983 and the Water Department Financial
Statement for July 1983 were received. The Village Manager's Report
for July 11, 1983 to July 22, 1983 was received.
The meeting was adjourned at 10:41 P.M.
