HomeMy WebLinkAboutMinutes_Regular_09/27/1983 MINUTES OF THE VILLAGE COUNCIL MEETING OF THE VILLAGE OF TEQUESTA, FLORIDA September 27, 1983. A meeting was held by the Village Council of the Village of Tequesta at 7:30 P.M., Tuesday, September 27, 1983 in the Village Hall, 357 Tequesta Drive, Tequesta, Florida. Councilmembers present were: Beddow, Brown, Little, Stoddard and Wagar. Also present were: Robert Harp, Village Manager, Cyrese Colbert, Village Clerk, Scott Ladd, Building Official and John C. Randolph, Village Attorney. The opening Prayer and Pledge of Allegiance to the Flag was given by Councilmember Brown. Changes made to the agenda and approved were: add lc. John Giba - Proposition One add ld. Tom Mortati add 2b. Report on Old Dixie & Cypress Drive Drainage add 2c. Connector Road add 3b. Ordinance Annexing Lobster Shanty add 3c. Resolution amending Resolution on Refunding Bonds • Mr. Bill Wilshauer, Palm Beach County Staff member, was present and showed Council the proposed plans for Blowing Rock Preserve Park. Mr. Wilshauer also told Council that the park should be renamed Coral Cove Park in about a week. The park will probably be completed about November and be operational around Thanksgiving. Mr. Wilshauer then reviewed the operational plans for the park. Mr. Wilshauer told Council that the Sheriff's Office will maintain traffic around Beach Road and provide "No Parking" signs. la. Mr. Ladd, Building Official reviewed briefly the Site Plan Review for the signs for "The Arrangements" in the Tequesta Fashion Mall. Wagar moved, "to approve Site Plan Review for The Arrangements signs". Beddow seconded and vote on the motion was: Beddow -for Brown -for Little -for Stoddard -for Wagar -for and therefore the motion was passed and adopted. lb. The Building Official reviewed with Council the Site Plan Review for signs for "Tequesta Galleries". Brown moved, "approval 09-27-83 -02 of the Site Plan Review for "Tequesta Galleries" signs". Beddow seconded • and vote on the motion was: Beddow -for Brown -for Little -for Stoddard -for Wagar -for and therefore the motion was passed and adopted. The Building Official told Council that he would like to report to Council on the Compare/Girvin property as they had requested. This property is located at 312 Tequesta Drive and had received Site Plan Review approval from Council for a two (2) story office building, but no building permit has been pulled and Council had requested a status report. The Building Official told Council that he had contacted Mr. Girvin and that Mr. Girvin said he could not find people ready to lease any office space and that his office lease renewal was coming up where he presently has his office so he had to renew it. This project has been put off for 18 months. lc. John Giba, resident, spoke to Council on his opinion of what Proposition One was about and what he thought the impact would be if passed. ld. Tom Mortati, resident, gave the Mayor a petition requesting . that Council pass a Resolution having Pfeuffer's property cleaned up. The petition was turned over to the Village Manager. The Village Manager told Council that the owner has been sent a Certified letter giving him until October 15, 1983 to get his lawn cleaned up. Beddow said he was not happy because things are just not taken care of once an Ordinance is on the books. Brown said he was also upset because it takes a resident's complaint before action is taken. He said he still has trouble getting the vacant lot in the back of his house cleaned and if he has that much trouble getting action and he is on Council then what does a resident have to go through to get something done. Beddow said he expects staff to make periodical inspections of this Village and then bring those items before Council. John Giba, resident, told Council there was a growing concern of newspaper boxes being set up in areas throughout the Village. 2a. The next item on the agenda was the consideration of Resolution for title acquisition of surplus U.S. Coast .Guard land. Stoddard said there is a question of when this land will become surplus. He said that a newspaper reported wrong when it was printed that .the Village was trying to buy the land. He said the Village is not trying to buy the land but to have it granted to us. The Village Attorney read by ~ 09-27-83 -03 title a Resolution entitled, A RESOLUTION BY THE VILLAGE OF TEQUESTA, • FLORIDA, FOR TITLE ACQUISITION OF SURPLUS U.S. COAST GUARD LAND IN TEQUESTA FOR RECREATIONAL AND CIVIC ORIENTED ACTIVITIES. Stoddard gave the gavel to Vice-Mayor Beddow so that he could make a motion. Stoddard moved, "to approve this Resolution as amended". Brown seconded, and vote on the motion was: Beddow -for Brown -for Little -for Stoddard -for Wagar -for and therefore Resolution No. 14-82/83 was passed and adopted. 2b. The next item on the agenda was the report on Old Dixie and Cypress Drive drainage. Stoddard said that he and the Village Manager where at a meeting on this subject and were told by F.E.C. Railway that they gave all parties involved until October 1, 1983 to get this drainage problem resolved. The total cost is approximately $300,000. and Tequesta's share is $78,500. The other entities involved are the County, Rinker and Town of Jupiter. The proposed drainage improvement calls for a 36" tie line from the ditch at Rinker and F.E.C. all the way to the river. The purchase of 36' strip of land is also involved in this. There is another meeting scheduled for October 6, 1983 at which time Rinker will be at the meeting to make their final determination of how much they will be involved. • Beddow questioned who will maintain this ditch and Stoddard told him the maintenance of the ditch would be Jupiter's responsibility. Council expressed concern with the cost involved for the Village of Tequesta and Jupiter since Jupiter will start draining Cypress Drive into this ditch. Council also felt that Rinker should pick up a larger amount of the cost than is presently proposed. 3a. The next item on the agenda was the discussion of possible revision of Section 13-10, Identification Cards, of the Village Code. The Village Attorney told Council he understands this item is on the agenda because of some action that has taken place by the Police Department and that he would answer any questions that Council may have. Little and Beddow both felt that this Ordinance was overstepping the policing power in Tequesta. They felt the Village Attorney needed to amend the Ordinance. Stoddard said he had checked with the Chamber of Commerce about who was concerned with this. The response he has been getting is that this Ordinance is almost an invasion of privacy. Beddow moved, "that the proposed enforcement, effective October 1, 1983 be withheld until such time as the Village Attorney can fully review this section of the Code and make recommendation for its revision". Wagar seconded and vote on the motion was: • • 09-27-83 -04 Beddow -for Brown -for Little -for Stoddard -for Wagar -for and therefore the motion was passed and adopted. Beddow moved, "we rescind Section 13-10" Brown seconded and vote on the motion was: Beddow -for Brown -for Little -for Stoddard -for Wagar -for and therefore the motion was passed and adopted. The Village Attorney will prepare a revision to Section 13-2 (Solicitation of donations and gifts - Village Code) and bring it back to Council. 2c. Beddow told Council he would like to discuss the Connector Road situation with Council. Beddow told Council he felt the Village should reconfirm to the Governor the Village's concern with the Connector Road. He felt. the citizens of Tequesta should write letters to the Governor and to Senator Harry Johnston. Little told Council that if the Village continues asking the State to give part of J.D. State Park to Martin County for a connector road, he feels, the Village would be helping Martin County get out of a situation they have gotten them- selves into years ago. He feels Martin County could take land from the Little Club, but they (Martin County) would rather put it up in Tallahassee. 3b. The Village Attorney read by title an Ordinance entitled, AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA ANNEXING CERTAIN PARCELS OF LAND DESCRIBED HEREIN TO THE TERRITORIAL LIMITS OF THE VILLAGE OF TEQUESTA. The Village Attorney explained that this Ordinance is to annex the Lobster Shanty into the Village. The Ordinance has to be published once a week for four consecutive weeks before second reading. Little moved, "to approve Ordinance on first reading". Brown seconded and vote on the motion was: Beddow -for Brown -for Little -for Stoddard -for Wagar -for and therefore the motion was passed and adopted. 3c. The next item on the agenda was the consideration of a Resolution amending Resolution No. 13-77/78 adopted on July 25, 1978. The Village Attorney read a Resolution entitled, RESOLUTION AMENDING RESOLUTION N0. 13-77/78, ADOPTED ON JULY 25, 1978, ENTITLED: "A RESOLUTION PROVIDING '" 09-27-83 -05 FOR THE REDEMPTION OF CERTAIN OF THE OUTSTANDING WATER REVENUE CERTI- • FICATES, DATED JULY 1, 1967, OF THE VILLAGE OF TEQUESTA, FLORIDA, ON CERTAIN REDEMPTION DATES OF THE RESPECTIVE CERTIFICATES". Beddow moved, "that we approve the Resolution subject to assurances from Bond Counsel that we are not increasing the payments required by the Village, in the escrow and that by appropriate Resolution we are not creating a situation where we come to the end of the road on the redemption of the last of the debentures you're $388,000. or some other amount short". Little seconded and vote on the motion was: Beddow -for Brown -for Little -for Stoddard -for Wagar -for and therefore Resolution No. 15-82/83 was passed and adopted. Beddow requested the Village Attorney to give Council some information about Ryan's contract with the Village of Tequesta for water and the Attorney's opinion if a time limit could now be added to the contract. The Village Manager's Report for September 12 - 23, 1983, the Village Financial Statement for August 1983 and the Water Department Financial Statement for August 1983 were received. • The meeting was adjourned at 0:26 P.M.
