Bradford, Village Manager DATE: January 12, 1987 SUBJECT: Step-Saver Sign Proposal ,~ Attached hereto please find the compromise proposal of S&S Enterprises in regard to the Step-Saver sign in Tequesta. The color rendering is in my possession and may be reviewed at your convenience. This compromise offer is the result of our discussions with S&S Enterprises and their representatives. This compromise, if accepted, offers the Village the elimination of the existing sign. with a new sign in conformance with the new sign ordinance in a new location away from a primary entrance to the Village. It is strongly recommended that this proposal be accepted by the Village Council. This submission is to be considered an appeal directly to the Village Council. This matter will be added to the Village Council meeting agenda of January 13 for your consideration. TGB/mk Attachments. cc: John C. Randolph, Village Attorney Scott D. Thank you for your letter of December 17, 1986. As you are aware, this matter has been pending for over two years, despite my client's best efforts to reach an amicable settlement as well as their having their proposals approved by one village body and later rejected by another. Subsequent to your December 17, 1986 letter, my clients have met and propose to resolve this matter as follows: 1. S & S will, as the Village requested, move the existing sign to the north side of the property at their expense. As the Village has previously agreed, the Village is to move any existing water lines and/or meters, if any, at the village's expense should it become necessary due to the sign replacement. 2. The height and existing square footage of the sign shall be the maximum allowed for such signs pursuant to your current ordinance. The price sign is to be treated as an exempt sign and shall be separate and lower than the main sign. 3. The Shell sign and Food Mart sign shall be the standard corporate colors for such signs (red and yellow, and yellow and red, respectively). Because the Fancy Fried Chicken will have to be custom made, my clients are willing to have its colors be dark brown letters with beige background, as the pillage requested. The price sign shall be the standard Shell price sign with black letters and yellow background (along frith its standard color border. ~CE~VED ,lAt~ 12 1987 [? John C. Randolph, Esquire West Palm Beach, Florida 33402 January 8, 1987 Page Two 4. My clients are also willing to install plantings at the base of the sign of a bush rather than ground cover type, at least two~feet in height. I have enclosed a location drawing and a vertical rendering of the sign structure. This proposal is, of course, made with a complete reservation of all of my client's rights in this matter and shall not be used in any litigation if we are unable to resolve this matter amicably. In other words, this is for settlement purposes only. My clients hope that this offer, which meets the primary objection of the Village to the existing sign, will be acceptable. Please contact me at your earliest convenience with the Village's response to this proposal. Best Wishes for the New Year. Very truly yours ed C.
