HomeMy WebLinkAboutMinutes_Regular_10/13/1981 • MINUTES OF THE VILLAGE COUNCIL MEETING OF THE VILLAGE OF TEQUESTA, FLORIDA October 13, 1031 A meeting was held by the Village Council of the Village r,f Tequesta, Florida, at 7:30 P,M,, Tuesday, October 13, 14$1 in the Village Hall, 357 Tequesta Drive, Ter~uesta, Florida. Councilmembers present were: Brown, Cook, Little, Mapes and Stoddard, Also present were: Robert Harp, Village Manager, Cyrese Colbert, Village Clerk and John C, Randolph, Village Attorney, Mr, John McKune, Gee & Jenson, told Council that they have received a letter from D,N.R. stating that they will grant an easement as soon as they receive the permit from D.E,R. for the bridge crossing, On the original crossing, Mr, McKune told Council that the Jacksonville Office of D.E.R. wants Miami Office to grant the permit and the Miami Office wants Jacksonville Office to grant the permit. But the biggest stumbling b]_ock is tl~e Palm Beach County Health Department, Mr, Stacy A. Thomas, Assistant Principal, Jupiter Community School was present and reviewed with Council the Jupiter Community Ed~_zcation Status Report for. the 1.9£30 Fall Session and the 1~?~1. Summer Session, The agreement for the Community School Program is for a period of October 1, 1931 to September 3O, 1Uf32, This wi1.l be the seventh ,year of the program and the Village has partir,=ipate;~. each gear. The cost to the Village is t~~, ~~?~?, and has been pro?rided for in the 1Qf31/1Q~2 General Fund Budget, The agreement was recommended by the Village Manager. Stoddard moved, "to accept the agreement", Little seconded and vote on the motion. was: Brown -for Cook -for Little -for Mapes -.for Stoddard -for and therefore the motion was passed and adopted, The next item on the agenda was Rinker Materia~_s Corporation presentation concerning Old Dixie Highway Plant, 1.0-~..3-~1. --02 Attorney Marshall Criser of Gunster, Yoakley, Criser & Stewart re~ • presenting Rinker was the first to speak, Mr. Criser introduced Carl Watson, Vice-President Material Division, John Lewis, Tequesta Plant Manager, Jerry Outlaw, Executive Vice-President of Real Estate Division, Jack Long, Chief Engineer of Rinker, Bill Payne, General Counsel of Real Estate Division, Jerry Henan, Mr,Maloney and Jan Browning, Professional Engineer, Lindahl, Browning, ~'arrari & Helstrom, Inc. Mr, Criser told Council that the Jupiter--Tequesta Plant has not been updated or modernized to any great extent in years. T~Ir, Criser told Council that Rinker came before the Council with plans to improve their facilities, but it was not approved by the Village, Rinker is now ready to upgrade the Plant with plans they feel. should be acceptable to the Village of Tequesta, Mr. Criser told Council that Rinke r was at this meeting to respond to the request letter from the Village Manager to Mr. David B, Rinker in reference to the Tequesta Plant, Old Dixie Highway, Tequesta, dated June ~.~, 101. He said that Rinker is ready to comply but Rinker has the right to expect certain things. Mr, Criser told Council that a letter of intent on Tequesta Plant Improvements had been sent to Council and asked that the records show that the Village Clerk was hand delivered a copy of that letter for the records at this meeting, (copy is made a part' of) • (minutes Mr, Criser told Council. that Rinker believes there is no legal or factual basis for the request for reduction of its facilities at the Tequesta Plant and Rinker has one of two choices. They can leave the plant as is or they can modernize the facility as in other communities as submitted by Rinker, Rinker also believes no non-conforming use eaeists at t}~e Jupiter~Tequesta Rinker Plant, except ~t~ayue the height ox the hatching plant. Rinker's proposed improvements will. not increase the height cif the hatching plant and no increase of the work load or capacity Council, was told by RinLcer representatives at this meeting, Council was shown a scale of the proposed facility layout and proposed facility elevation, The proposed improvements consist of adding a new office and warehouse on the east side of Old Dixie Highway, elimination of the old combination warehouse/shop/office and old aggregate storage facility and material handling system on the west side. Stoddard told Rinker he wanted a summary of the ~~~°}nnage delivered in the Village of Tequesta. Mr. Carl Watson told Stoddard that records are kept of the capacity of how many yards Rinker can batch • per hour, But there are few times that Rinker gets the maximum of yards per truck. He told Council that the Tequesta plant will probably bat~`~h between ~0 and 110 yards per hour with the improvements, but the capacity will not change. ~.0-1~ -~'1 -03 Little reminded Council that Rinker could increase its • capacity now without enlarging or improving the Plant and that he feels it would be better if they improved the appearance of the plant while producing the same outflow as they do now. This way the Plant would more attractive to the surrounding area. Cook tdld Rinker that if the Village approved the proposed improvements she would demand lots of landscaping surrounding the Plant and that the landscaping be maintained and watered as not to die or need to be replaced, Stoddard asked Rinker if it is true that a new Rinker Plant may be in the works on the Bee Line Highway near Pratt & Whitney Aircraft, Mr. Carl Watson told Council that Rinker sees a need for a Plant in that area and that it definitively would take business away from the Jupiter/Tequesta Plant but Rinker does not own the land and there is .nothing on the drawing board but there is a possibility, John Giba, resident, said he would like to see the number of trueks regulated as to how many trips are made. Robert Moore, resident, said he would like to compliment Rinker for observing the "No Thru Truck Ordinance", Tom Stone, resident, told Council he has had businesses • on Cypress Drive for years and has never had any complaints about dust from Rinker, Little moved, "that we accept the conceptual plan that has been presented by Rinker but that we are not bound with the acceptance of the conceptual approval. to any of the details that have been submitted in the drawings that accompany it tonight and that the Village does have a Site Plan Review process to go through at which time these items should be submitted". CHARGE; PROVIDINTG FOR INSPECTION; PROVIDING FOR EXEMPTION OF HEARING; . The Village Police Chief told the Manager that the alarm would be disconnected, Without further discussion Stoddard moved, "on second reading that this Ordinance be approved", Little seconded end vote on the motion. was: Brown -for Cook -for Little -for Mapes -for Stoddard -for and therefore Ordinance No, 3C~9 was passed and adopted on second reading. The Village Attorney presented Council with a draft Resolutior_ on rules and regulations for the Truck Ordinance entitled A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, PROMtTLGATING AND ADOPTING RULES RELATING TO THE GRANTING OR DENIAL OF SPECIAL PERMITS FOR THE OPERATION OF TRUCKS ON TEQUESTA DRIVE AND COUNTRY FLUB DRIVE WITHIN THE VILLAGE, He informed Council that he did rot present this Resolution to Council f'or adoption tonight but wanted Council's input on it. The Village Attorney reviewed the Resolution with Council. Council discussed the Resolution and. gave the Attorney their input, The • Resolution is to be ready for consideration for adoption at the next Council Meeting with the changes made by the Attorney. The Village Attorney presented Council with a Resolution entitled A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, PETITIONING THE BOARD OF COUNTY COMMISSIONERS OF PALM BEACH COUNTY, PURSUANT TO SECTION 125,01 (6)(a) and (7}, FLORIDA STATUTES, TO PROVIDE RELIEF FROM TAXES LEVIED UPON PROPERTY SITUATE WITHIN THE VILLAGE OF TEQUESTA TO FINANCE SERVICES RENDERED SPECIALLY FOR THE BENEFIT OF THE PROPERTY OR RESIDENCE IN UNINCORPORATED AREAS OF PALM BEACH COUNTY BY REMITTIPIG TO THE VILLAGE OF TEQtESTA THE IDENTIFIED COST OF SUCH SERVICES LEVIED AND COLLECTED DURING THE 1977-7~, 197-79, 1970-~0 AND 190-£~1 FISCAL YEARS , AND BY FINANCING SUCH SERVICES FROM REVER?UES DERIVED SPECIFICALLY FROM OR ON BEHALF OF A MUNICIPAL SERVICE TAXING UNIT, SPECIAL DISTRICT, UNINCORPORATED AREA, SERVICE AREA OR PROCxRAM AREA, OR BY ANY OTHER LAWFUL METHOD, DURING THE 1~£~1-$2 FISCAL YEAR; AND FOR OTHER PURPOSES. The Village Attorney t~~ld Council that this Resolution was brought about because of the mews article about Delray Beach petitioning Palm Beach County by Resolution, for tax relief from dual taxation. The Village Attorney then read the Resolution. Stoddard moved, "that we approve this Resolution petitioning the Palm Beach County Commission from taxes levied upon property situated within the Village of Tequesta to finance services rendered specially for the benefit of the property or residence in unincorporated area of Palm Beach County by remitting • to the Village of Tequesta the identified cost of such services". .Brown seconded and vote on the motion was: 10-:L3-~~. -0,5 Brown -for • Cook Little -for -for Mapes -for Stoddard -for and. therefore Resolution No, 3-$1/£~2 was passed and adopted, In a memorandum to Council from the Village Manager dated October 7, 19$1 it was explained that it was necessary for a new antenna to be provided for the Water Department base radio when it was moved to the new building. The cost of the antenna and the installation was $2$7.65 and should be paid for from the Renewal and Replacement Fund, Stoddard moved, °tthat we approve the expediture of $2'7.65 for the Water Department Base Radio Antenna and that it be paid for from the Renewal and Replacement FundT', Little seconded and vote on the motion was: Brown -for Cook -for Little -for Mapes -for Stoddard -for and therefore the motion was passed and adopted, In a memorandum to Council dated October 17, 19£1 the Village • Manager enclosed a copy of Change Order No. 3 for the Village Hall addition which was necessary to provide for proper wiring for the Water Department computer in the new building and a deduction for four (t,.) door grills not installed, Brown moved, "that we approve Change Order No, 3 of Booth Construction, Inc, in the amount of $1,343,24T~, Cook seconded and vote on the motion was: Brown -for Cook -for Little -for Mapes -for Stoddard -for and therefore the motion was passed and adopted, The Site Plan Review Minutes for July 2f#, .1.9$1, the Co~zncil Meeting Minutes for July 2$, 19$1., the Village Manager's Report far September 20, 1.9$1 to October 10, 19$l, the Financial Statement for August, 19$1 and the Water Department Financial Statement for August, 1.9$1 were all received by Council, The meeting was adjourned at 10:22 P.M. ~, Cyres Colbert ~, ~, ~j1-,~~r~ ~ e,~ Date Approved Over • Lee A~. A Public Hearing was held by the Village Council of the Village of Tequesta, Florida at 7:00 P,M., Tuesday, October 13, 191 in the Village Ha11, 357 Tequesta Drive, Tequesta, Florida, Councilmembers present were: Brown, Cook, Little, Mapes and Stoddard. Also present were: Robert Harp, Village Manager, C;rrese Colbert, Village Glerk and John C, P~andolph, Village Attornev, This was the Second Budget Public Hearing, The Village Manager briefly reviewed the proposed Budget, He pointed out the various sources of revenues and expenditures. T~ir. John Giba, resident, asked if there has been a new man added to the Building Department. It was explained that the Building Inspector had replaced the retiring Building Official and a new Building Inspector has been added. He told Council he would like to see better control on the bicycles using the • bicycle path instead of the road way. Stoddard. moved, "we adopt the millage rate of 3.01.66 for the ,year 19$1/b2", Brown seconded and vote on the motion was: Brown -f o r Cook -for Little -for Mapes -for Stoddard -for and therefore the motion was passed and adopted, The Village Manager read a Resolution entitled A RESOLUTION OF THE VILLAGE OF TEQUESTA, FLORIDA PROVIDIIVTG FOR LEVYING A MILEAGE RATE OF 43,0166 DOLLARS PER 41,000.00 OF TAXABLE VALUATION FOR THE YEAR 19$1. Cook moved, "that we approve this Resolution". Little seconded and vote on the motion was: Brown -for Cook -for Little -for PJTapes -for Stoddard -for and therefore Resolution No. 1-~1/~2 was passed and adopted. ~ T 10-13-~1 -02 Little moved, "that we approve the Budget as presented for ].9~31/~32". The Village Manager read by title A RESOLUTION OF THE VILLAGE OF TEQUESTA, FLORIDA PROVIDING FOR THE ADOPTION OF THE BUDGETS FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 19$1. Brown moved, "for the adoption of Resolution providing for the adoption of the Budget for the fiscal year commencing October 1, 191 as presented". Stoddard seconded and vote on the motion was: Brown -for Cook -for Little -far Mapes -for Stoddard -for and therefore Resolution No. 2-$1/$2 was passed and adopted. Stoddard moved, "the Village Manager be authorized to • adjust the millage pursuant to the final Certified Taxable Value submitted by the Palm Beach County Property Appraiser t~ keep the Revenue for Advalorem Taxes the same amount as budgeted". Brown seconded and vote on the motion was: Brown -for Cook -for Little -for Mapes -for Stoddard -for and therefore the motion was passed and adopted.
