HomeMy WebLinkAboutMinutes_Regular_12/08/1981 MINUTES OF THE VILLAGE COUNCIL MEETING OF THE VILLAGE OF TEQUESTA, FLORIDA December f?, 1~?~l A meeting was held bzr the Village Council of the Village of Te~uesta, Florida at 7:30 P,M., Tuesday, December ~?, 1~~1 in the Village Hall, 357 Tequesta Drive, Tequesta, Florida. Couneilmembers present were: Cook, Little, Mapes and Stoddard. Brown advised he would not be in attendance, Also present were: Robert Harp, Village Manager, Cyrese Colbert, Village Clerk and John C. Randolph, Village Attorney. The opening Prayer and Pledge of Allegiance to the Flag was given by Counci.lmember Cook, There were no announcements. Changes made and approved to the agenda were: addition ~ 4.j. Discussion of Employees Christmas Bonus • Mayor Mapes asked if there was anyone present who wanted to sp~:ak on any item not; nn the agenda, Mrs, James Young, resident, wanted to know when somethin~* would be done about enfr~rcn{~ the no through truck Ordinance, She-: was informed by Counrxil that we are still in litigation over '~~~-~e Ordinance and are trying t~~~ work with the Police Department ,~ncl the Attorney until such time as the case is heard in Court. ':'~1r. Robert Moore, resident, told Council he thinks if the t.tarn~_nfif system is tighten~:~~ by the Polie,e Department maybe that Z~~otzlcl help. I~~`tayor Mapes t,ol.d the Council that ~:~n November 30, 1~~1. Perry Cable went out of service about the time the Dolphins had their football game and he was inundated with telephone calls at h:ame he figured it was ti. me to have Perry Cable come before Cnun.cil, He also gave times and dates t.-,hat. the Cable has gene out of service in the past week, Mapes told the audience that Mr, Perry has the flu and has lost his voice but I~Zr. Frank Bauer, Director of Operations for Perry was presea~t to answer questions anyone might have, Mr, Bauer told Council, that in 1°`~1 Perry Cable began redesig.nin~; this area and before it got• off the drawing board 12-0$-$1 -02 Perry Cable was behind the times because of the expanded techn~7_ogy • that is going on in the cable television world. Mr. Bauer told Mapes that the shortages of late is due to the engineers workin, on upgrading the system. Perry Cable is approximately three ~3) months behind in their schedule at this time, but they should be supplying the new service to this area the latter part of January or the first Hart of February. Mr, Bauer then reviewed for Council the stations that Perry Cable will have availale, They are Channel 2, 4, 5, 6, 7, $, ~, 10, 11, 12 (2 stations) 34, and. on the gray box they will have Channel 16; C.N.N. (2t,. hours) 17; Nickelodeon, 1$; E,SP.N., 19; U.S.A. Network, C-Span and B.E.T., Channel 20; Weather, 21; W.O.R., Channel 22; Station 33 or Channel 6 (Miami) and Channel 24; WKID, The three (3) movie pay ootion__ Channels are 25; Home Box Office, Channel 27; Cinemas and 2$; Movie Channel. Mr. Bauer told Council that the eight ($) additional Channels (Channels 16-24) wi11 cost $3,95 per month and the three (3) movie pay ~.:s1~t:i~~n will range from $$,50 to X10,00 per month. Mrs, ~1ord, resident, told P~Lr. Bauer that she has had trouble with her cable for the past month. and would like to see that problem resolved before the adding of new channels, • T~Zr. Crockett, resident, told Mr, Bauer, that Perry Cable can have all the cabT.e stations in the world but if you don't have continuity you don't have anything', Council said it would wait t11 February to see if all these ideas and plans of Perrv Cable will happen, but if not,, Perrv Cable should expect another call from the Village and exrect to attend another Council Meeting. The Village Attorney read by title A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA REQUESTING A PERPETUAL UTILITY EASEMENT FROM THE STATE OF FLORIDA, SAID EASEMENT TO BE UTILIZED FOR THE INSTALLATION OF A 12 INCH SUBAQUEOUS WATER MAIN CROSSING THE ATLANTIC INTRACOASTAL WATERWAY IN MARTIN COUIV'TY, FLORIDA and told Council that this Resolution was drawn up at the request of Gee & Jenson, engineers for the Water Department, The perpetual utility easement is to be used for the installation of a 12 inch subaqueous water main crossing the Intracoastal Waterway. Stoddard moved, "that the Resolution be approved". Little seconded and vote on the motion was: Cook -for Little -for Mapes -for Stoddard -for • and therefore Resolution No. 7-~1/$2 was passed and adopted, • 12-Ofd-F~l -03 The next item on the agenda was consideration of a • Resolution supporting a one cent State--wide Sales Tax for property tax relief. The Resolution approve the efforts of the Florida League of Cities to secure property tax relief for the people of Florida and an alternate growing source of revenue for local. governments through an increase statewide of 1¢ in the sales tax, Mapes told Council he would like their input on the Resolution. Little said that he feels the 1¢ sales tax is the most logical way to gain additional revenues, It would effect people coming into the State to visit and people who live here. Mapes said he had heard that 25`.l of the revenue collected by the additional tax would be generated from tourists. The Village Attorney read by title the Resolution. entitled, A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, APPROVING THE EFFORTS OF THE FLORIDA LEAGUE OF CITIES TO SECURE PROPERTY TAX RELIEF FOR THE PEOPLE OF FLORIDA AND AN ALTERNATE GROWING SOURCE OF REVENUE FOR LOCAL GOVERNMENTS THROUGH A ~..¢ STATEWIDE INCREASE IN THE SALES TAX AND URGING THE FLORIDA LEGISLATURE TO ENACT LEGISLATIOPI EMBODYING THE PROPERTY TAX RELIEF AND LOCAL GOVERNMENT ASSISTANCE ?'ROGRAM OF THE FLORIDA LEAGUE OF CITIES. Council discussed the Resolution. Stoddard moved, "that we authorize this Resolution from the Village of Tequesta as • written by the Florida League of Cities be approved", Little seconded and vote on the motion was: Cook -against Litt le -for l~japes -for Stoddard -for and therefore Resolution No, ~-1/82 was passed and adopted. The Village Attorney read by title A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, ACCEPTING FROhI THE COUNTY OF PALM BEACH THE ROADS HEREIN DESCRIBED PURSUAII'T TO THE TERMS OF RESOLUTION N0, R-f?1-1Q0 OF THE PALM BEACH COUNTY COMMISSION, Mayor Mapes told Council that the acceptance from the County of their roads is required by the State and that Palm Beach Count~T told the Village if the Village accepted the roads early then Palm Beach County would fix those roads and resurface them before the change over but if the Village of Tequesta waited till the maximum time allowed t-hey may not have money to repair and resurface the roads, The Village agreed early thi..s year but said it would wait to accent t?Ze roads until the work was completed by the Gounty, The roads have now been repaired and resurfaced, Little moved, "that we appr.~ve this Resolution. subject to the approval of t,hP new sewer main across Tequesta Drives by the Village Manager". Stoddard • seconded. and vote on the motion was: Cook -for Little -for Mapes -for Stoddard -for 1.2-0~-£~~.. -C4 anal therefore Resolution NNo. ~-f?1/~2 was passed and adopted, • The Recreation Director talked to Council about items that had been planned for the Tequesta Park playground in a combined amount of $5,000. from the Village Budget and the Palm Beach County 50/50 Matching Funds but the County has not continued the Matching Fund Program for 19~1/19~2 fiscal, year. The Village now has a Special Park. Fund. in excess of $16,000., which can be used for Capital Improvements to the Park. The Recreation Director and Village Manager believe that some of this money could be used to go ahead with the original Bolan, with the exception of one item (the Creepy Crawler) any purchase these items with some of the money coming from the Special Park Fund. Stoddard moved, "that we approve the ~=~:~enditure of ~5,0~,0. for the items mentioned (No, X44 - Fire Truck for $1,26k., 1~?0, 61~ - Space Module for $7~2., No, 619 - S see Crawlway for -391, and No, 4.$6 - Creepy Crawler for $1,75~~ and that the total Budget amount be paid.for from the Special Park Fund", Little seconded and vote on the motion. was: Cook -for Little -for Mapes -for Stoddard -for • and thereforethe motion was passed and adopted, Stoddard moved, "that we approve Theron R, Brayman, Norman L, Burg and Glen Kloiber to the Building Board of Appeals fora three (3) .year term", Cook seconded and vote on the motion was: Cook -for Little -for Mapes -for Stoddard -for and therefore the motion was passed and adopted. Stoddard moved, "that we appoint Ernest C, Bryan and Linda A. Otto to the Zoning Board of Adjustment for a three (3) -rear term.", Cook seconded and vote nn the motion was: Cook -for Little -for Mapes -for Stoddard -for and therefore the motion was passed and adopted. Mayor Mapes told Cc;uncil that the second Council Meeting in December is Tuesday, December 22, 191 and he does not feel that the meeting will really be necessary, but if there is a need for an emergency Council Meeting it will be called, • Insert Cook moved, "that we appoint Frank Brodell, Jr, to the Housing Board of Appeals". Stoddard seconded and vote on the motion was: Cook -for Little -for Mapes -for Stoddard -for and therefore the motion was passed and adopted. 1,2-0~-~1 -c5 n Stoddard moved, "that it (the December 22, 19$1 Council Meeting) be cancelled". Little seconded and vote on the motion was: Cook -for Little -for Mapes -for Stoddard -for and therefore the motion was passed and adopted. The Council Meetin_ Minutes for October 13 191. the Site Plan Review Minutes for Octo~er 27, 191, the Counci~, Meeting Minutes for Qctober 27, 19$1 the Council Meeting Minutes for November lU, 19$1 (with correction the Site Plan Review Minutes for November 24, 19$1 and the Council Meeting Minutes for November 24, 191 were all received. The Village Manager's Report for November 22, lA$1 to December 5,"_19$1; the Village Financial Statement for October 191 and the Water Debartment Financial. Statement for October 191 were also .received, Little moved, "that the Village go ahead with the Employee's Christmas Bonus". Stoddard seconded and vote on the motion was: Cook -far Little -for Mapes -for Stoddard -for and therefore the motion was passed and adopted. Little told Council that he thinks the Village of Tequesta can and should do something about the disposition of Village Court Cases that get thrown out of court because of what he feels arP inadequate laws. He also feels there may be laws that are not neces- sary and should be taken gaff the State law books. He recommended to Council that they appoint a committee consisting of five (5) people and have them pick out a Florida law that they feel needs to be worked on, changed, upgraded, deleted or whatever and go to the State and pressure the State into making the necessary changes, Council agreed and decided to think it over and discuss it at the next Ccuncil Meeting, The meeting was adjourned at 9:47 P.M.
