HomeMy WebLinkAboutMinutes_Regular_02/23/1982 T~ZINUTES OF THE MEETING OF THE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA February 23, 192 A meeting of the Council of the Village of Tequesta, Florida, was held at 733 P.M., Tuesday, February 23, 192. The meeting was held in the Village Hall, 357 Tequesta Drive, Tequesta, Florida. Gauncilmembers present were: Brown, Cook, Little, Mapes and Stoddard, Also present were: Robert Harp, Village Manager, Cyrese Colbert, Village Clerk and John C. Randolph, Village Attorney. The opening Prayer and Pledge of Allegiance to the Flag was given by Vice-1JZayor Stoddard, Mayor Tfapes announced a Zoning GtiTorkshop Meeting on February 25, 19$2. Mayor Mapes also announced that the first scheduled Council Pl~eeting for March will be PJIarch 23, 192. The March 9, _ 19$2 date which would normally be the first Tuesday Council Meeting • for the month will be the Village Election Day. Council gave their approval for the Council. ~~eeting date of T~Zarch 23, 192. Nir, George Rivers, Jupiter resident, told Council that he is in the Town of Jupiter but receives his water from the Village of Tequesta. T-ir, Rivers told Council that he feels the minimum charge that Tequesta charges is unfair to those people who go away for the summer, Mr. Rivers asked if there could bE another way of billing those months that people are not r;cre. C>:~ancil. told Mr. Rivers they would check into it. Little moved, "that we approve the Site Plan Review (Gill Building - presented at the Site Plan Review at 7:00 P.M. this same date) as presented", Stoddard seconded the motion and vote on the motion was: Brown -for Cook -for Little -for i~Ia pe s -f o r Stoddard -for and therefore the motion was passed and. adopted. The nest item on the agenda was the "Consideration of bids for 192 Police Cars". The VillagE Manager advised Council that he had sent them a memorandum on February 22, 19$2 pertaining to this matter. There were four (t,.) bids received on the police ' 02-23 -$2 -02 car, The estimated budget amount for the car was $$,000, and is to be paid for from the Federal Revenue Sharing Fund, It was recommended by the Village i~:anager and the Police Chief that the bid from Palm Beach Dodge, Inc, in the amount of $$,451,$0 be accepted. Stoddard moved, "the approval of the bid of Palm Beach Dodge in the amount of $$,451.$0 and that it be paid for from the Federal F~evenue Sharing Fund". Brown seconded and vote on the motion c~as: Brown -for Cook -for Little -for Mapes -for Stoddard -for and therefore the motion was passed and adopted. The Village P~lanager reviewed with Council. information pertaining to proposed amendments to the General Fund Budget• and Water Department Operation and T~~Iaintenance Fund Budget (see attached). The Village I~ianager then read a Resolution entitled A RESOLUTION OF THE VILLAGE OF TEQUESTA FLORIDA PROVIDING FOR REVISIONS TO THE BUDGETS FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 19$1, Stoddard moved, "that a Resolution entitled A RESOLUTIONd OF THE VILLAGE OF TEQUESTA, FLORIDA PROVIDING FOR REVISIONS TO THE BUDGETS FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 19$1 be approved". Little seconded and vote on the motion was: • Brown -for Cook -far Little -for Mapes -for Stoddard -for and therefore Resolution No, 12-$1/$2 was passed and adopted, The next item on the Agenda was the "Discussion of truck traffic in Turtle Creek't. The Village Attorney reviewed what has taken place since Council held a ~tiorkshop/Special Council Meeting on February 7, 19$2 with Turtle Creek Property Owners Association and their Attorney. He reminded Council of the request tY:at was made of the Trillage of Tequesta by Turtle Cree'.~ Property Owners Assoc:iatiot~. The Attorney told the Council various options that thy; Village had. 1. The Village could leave status as is (would proceed forward to trial) 2, Could consider amending Ordinance to allow truck traffic to enter from the North without, bothering about commitments 3. Could enter into an agreement with Turtle Creek Pro:~erty Owners Association and maybe Hartland Enterprises agreeing to amend Ordinance and to allow trucks to come in from the north with a volunteered dismissal of the suit by T.C.P.O.A. and Hartland Enterprises. He told Council. that they can amend the Ordinance tonight and allow the traffic to come in from the north and not, make any commit=:~rt~ts to T.C.P.O.A. . 02-23 -$2 -03 Mapes said he would like the Village Attorney to prepare an Ordinance amending the section of the truck Ordinance No. 297 that will allow trucks to enter from the north end of Country Club Drive and leave the law suit as it stands. Stoddard said he would go along with option No. 2 that would amend the Ordinance to allow trucks to enter from the north end and not make any commits ~en~~a to T . C . P . 0. A . Little said in his opinion, there should be no amendments to the Ordinance but let it all go to court and let the courts settle it. Brown moved, 'Sthat the Village Attorney be authorized to amend the Ordinance (to allow trucks to enter from the north end) and the Resolution (to keep the permitting of trucks entering)". Stoddard seconded and vote on the motion was: Brown -for Cools -for Little -against 12apes -for Stoddard -for and therefore the motion was passed and adopted. The Village Manager's Report for February '7, 19$2 • to February 20, 19$2, the Village Financial Statement for January, 19$2 and the 1rVater Department Financial Statement for January, 19$2 were all received. The Village Manager discussed with Council the Village of Tequesta's Audit Report for Fiscal Year ended September 30, 19$~-. Mapes told Council that he has a promise from the Financial Director and the Village Mana ger that the so called "material weaknesses" pointed out by the Audit will be corrected before September, 19$2. Little moved, "to receive the Audit Report for Fiscal Year ended September 30, 19$~-". Stoddard seconded and vote on the motion was: Brown -for Cook -for Little -for Mapes -for Stoddard -for and therefore the motion was passed and adopted.
