HomeMy WebLinkAboutMinutes_Regular_12/09/1980i MINUTES OF THE MEETING OF THE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA December 9, 19$0 A meeting of the Council of the Village of Tequesta, Florida, was held at 7:30 P.M., Tuesday, December 9, 19$0 in the Village Hall, 357 Tequesta Drive, Tequesta, Florida. Councilmembers present were Cook, Little, Mapes, Ryan and Stoddard. Also present were Robert Harp, Village Manager, Cyrese Colbert, Village Clerk and John C. Randolph, Village Attorney. The opening Prayer and Pledge of Allegiance to the Flag was given by Councilmember Little, Mayor Mapes read aloud. a letter to Chief Flannery, from the Tequesta Pines Property Owners Association, commending Chief Flannery and his staff on the excellent protection and coverage done by his department in that area, • The following changes were added, with approval, to the agenda: 1, Time for Visitors 4a, Discussion of purchase of mini computer 6a, Employeets Christmas 6b, Vandalism in the Village Mr, Mel Kirk, engineer for Kirk and Associates was present, representing the proposed "Chapel Court" Subdivision located in Palm Beach County. The owners of the proposed subdivision have requested they be allowed to connect into the Village's drainage system on Pine Hill Trail West In a memorandum to Council the Village Manager informed Council that, ",,, the request is to provide a drainage easement on Lot 126, Tequesta Pines, for a drainpipe to come from the proposed subdivision and tie into the Village drainage system on Pine Hill Trail West", The subdivision can meet the requirements of the South Florida Water Management District for 100 on site percolation, but the County subdivision requirements require positive drainage outfall. CJ 12-0~-~~~ -02 Mapes asked Mr. Kirk if it was the intention of the owners • to annex the subdivision into Tequesta, Mr. Kirk told Council that streets in proposed subdivisions, in Tequesta have to be 60' wide, but in Palm Beach County the streets only have to be 50' wide, The subdivision could meet the 50' wide street requirements but not the 60' wide requirements. Mr. Kirk told Council that once the subdivision has been completed then there is a possibility of annexation into Tequesta, Jill K. Gemino, member of the Board of Directors for the Tequesta Pines Property Owners Association, told Council she would like the Association to review this before Council makes a final decision. Mapes told Miss Gemino that Council will be reviewing this matter more before any decision is made. Council told Mr. Kirk that the Village's Engineers, Police Department, Attorney and Village Manager would have to review this before any decision is made. The Village Manager asked Mr. Kirk if Engineer could review "Chapel Courts" Engi~ Mr. Kirk told the Village Manager that the review their Engineering study. Village could will be put on various people The discussion of the proposed Ordinance providing for a specific length of time that the F.E.C. crossing at Tequesta • Drive can he blocked was put on this agenda because two of the Councilmembers were absent at the last Council Meeting and the other Councilmember wanted their views on the proposed Ordinance. The Village Attorney told Council that the State Statutes allows a municipality to allow a reasonable amount of time for a train to block a railroad crossing. In the proposed Ordinance he put ten (10) minutes as a reasonable amount of time. Council was in agreement that the Ordinance entitled, AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, REGULATING THE BLOCKING OF RAILROAD CROSSINGS WITHIN THE VILLAGE BY RAILROAD COMPANIES OPERATING WITHIN THE VILLAGE OF TEQUESTA; PROVIDING A PENALTY FOR VIOLATION OF THIS ORDINANCE; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE, met with their approval. Miss Jill K. Gemino, Tequesta Pines Homeowner's Association, was present to answer questions Council may have had on Tequesta Pines request to erect identification .signs at the various entrances into the subdivision. The Village Manager told Council that he had advised Miss Gemino that the usual procedure is to have the Community Appearance Board give their approval first before the request • comes to Council. 12-09$0 -03 The Village Attorney advised Council that Council could give its tentative approval so Tequesta Pines could have the signs up before Christmas. Ryan moved, "the :sign's approval subject to the approval of the Community Appearance Board". Stoddard seconded and vote on the motion was: Cook -for Little -for Mapes -for Ryan -for Stoddard -for and therefore the motion was passed and adopted. Mr. Ron Poirier, President of Jupiter-Tequesta Athletic Association, was present at the request of the Loxahatchee Council of Governments Leisure Time Committee, to inform Council that there is going to be a fund raisin campaign to get money for additional lights in Tequesta ark. There is a need for about 16 poles, approximately 100 light fixtures. Mr. Poirier said they would like to have cement poles installed and not wood poles. The cost of the cement poles is about $61$, per pole. The Recreation Director gave four (4) reasons why he believes the additional lighting should not be added to the park. The Recreation Director feel there is already over use of the • facilities, fear of the cost the Village might incur after installation, may cause other governmental bodies to get lax in building of new recreational facilities in their area and the short term, long term effect they may have on the Village of Tequesta. The Village Manager concurred with the Recreation Director that the lights would put more burden on the park and on the maintenance of the park. Stoddard moved, "that we deny the application (to install additional lighting at Tequesta Park by Jupiter-Tequesta Athletic Association) at this time". Little seconded and vote on the motion was: Cook -for Little -for Mapes -for Ryan -for Stoddard -for and therefore the motion was passed and adopted. There was a two (2) minute recess so Councilmembers could look at the billing machine in the Water Department. Mr, Bill C. Kascavelis, Finance Director, gave Council a brief summarization of the feasibility of contracting for data • processing services and also the feasibility of purchasing data processing equipment adequate to service both the immediate needs of the Water Department and future applications for the Department 12-09-$0 -04 of Finance , • The Finance Director recommended, and the Village Manager concurred, with the purchase of the NCR $150 Integrated Mini Computer System for the purchase price of $34,312, as contained in a proposal of NCR. Little moved, "that the Village Manager be authorized to purchase the NCR $150 Mini Computer Sytem and that this be paid for from the Water Department (Retained Earnings Account or Capital Improvements Fund) Funds". Stoddard seconded and vote on the motion was: Cook -for Little -for Mapes -for Ryan --for Stoddard -for and therefore the motion was passed and adopted. The Minutes of the November 25, 19$0 Council Meeting and the Village Manager's Report for November 23, 19$0 to December 6, 19$0 were received. The Village Manager had sent Council a memorandum pertaining to the custom in past years of distribution of cash to Village employees at Christmas in recognition of their services during the year, The funds are included in the current year's budget for both Village and Water Department. Stoddard moved, "that the Christmas remembrances be continued as proposed". Little seconded and vote on the motion was: Cook -for Little -for Mapes -for Ryan -for Stoddard -for and therefore the motion was passed and adopted. Council-agreed to the cancellation of the December 23, 19$0 Council Meeting. Council talked at length about the increased vandalism in Tequesta, Council felt that vandalism has become a real problem and asked the Village Attorney to look into ways that the Village could make an example out of some one caught in Tequesta causing vandalism to Tequesta residents. Stoddard told Council he had attended the Martin County Commission Meeting this day and that Martin County had accepted the road through Little Club, by Resolution. • The meeting was adjourned at 9:2$ P.M.
