HomeMy WebLinkAboutMinutes_Regular_01/27/1981 MINUTES OF THE MEETING OF THE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA January 27, 19$l A Meeting of the Council of the Village of Tequesta, Florida, was held at 7:30 P.M., Tuesday, January 27, 19$l. The meeting was held in the Village Hall, 357 Tequesta Drive, Tequesta, Florida. Councilmembers present were Cook, Kittle, Mapes and Stoddard. Councilmember Ryan had advised the Administrative Office that he could. not be in attendance. Also present were Robert Harp, Village Manager, Cyrese Colbert, Village Clerk and. Adams Weaver of Johnston, Sasser, Randolph and Weaver. The opening Prayer and Pledge of Allegiance to the Flag was given by Mayor Mapes. The following changes were made to the agenda: (added) lb. Discussion of Intracoastal Crossing (changes) lb, to 1c. Report on Water Service for former • Conch Cove Marina Property, Martin County Mr. John McKune, Gee & Jenson, was present to report on the feasibility of service to the Jupiter Island Beach Company. hlr. McKune reviewed his letter, to Council., of January 22, 19$1. In the status report received from Gee & Jenson, it stated that Gee & Jenson had, ...,"concluded that although the Village's total water supply is sufficient to meet the additional demands of the Company, the Village should not at this time assume the responsibility of owning and maintaining the Company's internal water system". Jupiter Island Beach Company had in its service area ultimately 49 single family residences in Rolling Hills and approximately 35 single family residences on Jupiter Island. Jupiter Island is served by a single six-inch subaqueous crossing undernEath the Intracoastal Waterway. Mr. McKune told Council in his letter that the estimated cost of the necessary improvements to the Company would be approximately $200,000. Although it doesn't seem practical for the Company to spend this amount of money now, Gee 8c Jenson feels it is technically feasible for the Village to provide either emergency or bulk sale service through an interconnection of the systems. Doing this the Village would have no obligations 01-27-$1 -02 or .responsibilities to the Company's internal system. • Mr, McKune then went into discussion of item lb, on the agenda which was, The Discussion of the Intracoastal Crossing. Mr. McKune told Council that the Village is having a difficult time obtaining the dredge and fill permit needed for the Intracoastal Crossing that is needed to serve the Palm Beach County portion of Jupiter Island, In 1975 the area of the Intracoastal which is the proposed site of the subaqueous crossing for the water main was claimed as a perserve because of the "turtle grass" that is found in that area, Turtle grass plays an important part of the food chain that is needed and is very slow growing. n~ir, McKune gave the Council a group of alternatives that the Village could use. It ranged from the plan that we now have (Plan A), but cannot be used because of the techr~ic~,.l problem of the: "turtle grass", at a cost of $335,000, to tying into the existing 10" main north 'to an $" main then again to a 10" main then cross over the Intracoastal at Rolling Hills area, w~~th booster pump, then back down again at a cost of $650,000, There were two (2) other alternatives but all alternatives had to go across the Intracoastal at one poinnt which would rewire disturbing the "turtle grass". • Mr. McKune told Council of a successfully transplanted "turtle be hired to come to this area to transplanting new "turtle grass". McKune told Council that the next logical step, since the local DER has turned the Village down, is to go to Tallahassee DER ..and he would like Council's direction on that tonight, Stoddard moved, "that Gee & Jenson be authorized to investigate the technical problem of that (Plan A and the turtle grass) and try and find answers then go to Tallahassee. That Gee & Jenson also be authorized to retain and consult with a technical Marine Biologist or other technician to establish a proper way to re-establish that grass or other solutions". Little seconded. and vote on the motion was: Cook -for Little -for Mapes -for Stoddard -for and therefore the motion was passed and adopted. Mr. McKune then discussed his letter to Council dated • January 22, 19$1 in regard to water service to the Von Zabern property in Martin County, There are sixty-eight (6$) proposed condominium units to 01-27•-$1 ®03 be located at the former Conch Cove Marina site in Martin County and the owner, Mr. Von Zabern has asked that the Village supply • those units with water. Gee & Jenson feels that the Village can supply the units with water provided an $" water main is constructed from the County Line to the terminus of the eyisting water main which lies approximately 1400 feet to the north. Gee & Jenson recommended that the additional section of water• main be constructed, completing a "loop", and the design and construction being paid for and the responsibility of the developer. After the construction is completed and accepted by the Village the developer should then transfer the ownership and maintenance responsibilities to the Village. Stoddard moved, "that we supply water to the Conch Cove Marina (area) as long as the line is installed and paid for by Heinz von Zabern and deeded back to Tequesta". Little seconded and vote on the motion was: Cook -for Little -fvr Mapes -for Stoddard -for and therefore the motion was passed and adopted. Stoddard moved, "to serve the area served by the $" water main from County Line Road north to Conch Cove Road". Cook seconded and vote on the motion was: Cook -for Little -for Mapes -for Stoddard -for and therefore the motion was passed and adopted. Mr. Jim Young, 261 Country Club Drive, asked Council to have the Police Department enforce the truck Ordinance. Mr. John Giba, 7$ Fairview East, asked Council if anything had been done on his request to have someone check out possible Zoning violations by the Rinker Company at their plant. The Village Manager explained that the Building Official is still out ill and the Building Department is short on help. But it will be looked into. Mr. Earl Scott, 9$ Beechwood Trail, told Council he talked with the Village's Engineer on the request of Chapel Court to have their run-off drain into the Village's drainage system and he was told by the Engineer that the Engineer had not looked at Chapel Court drainage system. Mr. Scott was told this night that the Village will have complete control over how much water is allowed to run off into the drainage pond by Chapel Court. • The Village Manager read by title a resolution entitled, c1-2~-$~.. -~04 A RESOLUTION OF THE VILLAGE OF TEQUESTA SUPPORTING THE PALM BEACH COUNTY ASSOCIATION OF CHIEFS OF POLICE, INC. AND REQUESTING A • REVIEW AND REVTSION OF THE FLORIDA JUSTICE SYSTEM. He explained the resolution and reviewed the recommendations of the Palm Beach County Association of Chiefs of Police, Inc. Cook moved, "that it (Reso.lution) be adopted". Stoddard seconded and vote on the motion was: Cook -for Little -for Mapes -for Stoddard -for and therefore Resolution No. 5-~$0/$1 was passed and adopted. The Mayor read by "title" a resolution entitled, A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA ESTABLISHING MARCH 10, 19$1 AS THE DATE OF THE 19$1 GENERAL ELECTION, The Village Manager reviewed briefly the resolution. Stoddard moved, "that the RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, ESTABLISHING MARCH 10, 19$1 AS THE DATE OF THE 19$1 GENERAL ELECTION be adopted". Cook seconded and vote on the motion was: Cook -for Little -for Mapes -for • Stoddard -for and therefore Resolution No. 6-$O/$1 was passed and adopted. The Village Clerk announced March 10, 19$1 as the election date, that Seat 2 and Seat 4 were up for re-election, and that a Candidate Workshop Meeting would be held on Monday, February 9, 19$x. in the Village Hall. Mayor Mapes announced that he would seek re-election for Seat ~., Cook moved, "to accept the Site Plan Approval. (for Village Hall addition for Water Department and Building Department Offices) as presented", Little seconded and vote on the motion was: Cook -for Little -for Mapes -for Stoddard -for and therefore the motion was passed and adopted. The ne~et item on the agenda was the Discussion of Transfer of County Roads to the Village. The Village Manager reviewed his memorandum to Council, dated January 22, 19$1, He also • reviewed the agreement between the Village and Palm Beach County. • ~ 01-27-$1 -05 There are four roads within the municipal limits of the • Village that are scheduled for transfer from the County Road System to the Village as provided by Section 334.03 Florida Statutes, These four roads include, Point Drive from Tequesta Drive to Rio-Vista Drive, all of Riverside Drive located within the corporate limits of the Village of Tequesta, all of Seabrook Road located within the corporate limits of the Village of Tequesta and Tequesta Drive from Riverside Drive west to Point Drive. Palm Beach County has advised the Village that if the agreement could be approved within a week, it would expedite the resurfacing of said roads since the County crews are going to resurface all of the streets in Bermuda Terrace next week. .After the work is finished in Bermuda Terrace then work could start on the roads to be transfered, The agreement spells out the work that is to be done on the four (4) streets. That work includes the replacement of the thirty-six (36) inch diameter corrugated metal pipe culvert under Tequesta Drive at Point Drive with reinforced concrete pipe the same diameter. It includes repairs to the bridge over the Loxahatchee River consisting of guardrail replacement, sand-cement abutment rip-rap and the cleaning, patching and sealing of all concrete. Another agreement between. Palm Beach County and the Village will provide for the maintenance of the Tequesta Drive Bridge over the Loxahatchee River. This agreement provides for the County Engineering Department to inspect the bridge biennially The fee for this service will be paid to the County. The cost of the inspections would be $750. every two (2) years: County crews will perform necessary and required maintenance and shall be reimbursed by the Village of Tequesta. Stoddard moved, "that we accept and bind the agreement between Tequesta and Palm Beach County, Florida, accepting the road as specified and offered". Cook seconded and vote on the motion was; Cook -for Little -for Mapes -for Stoddard -for and therefore the motion was passed and adopted. Stoddard moved, "that Tequesta enter into this agreement between Tequesta and Palm Beach County for the maintenance of the Tequesta Drive Bridge over the Loxahatchee". Little seconded and vote on the motion was: Cook -for Little -for Mapes -for • Stoddard -for and therefore the motion was passed and adopted. • y 01-27-$1 -06 The minutes of the January 13, 19$l Council Meeting were received with no corrections. Stoddard complimented the Village • Clerk on the job well done on the minutes. The Villaga Manager's Report for January 11, 191 to JnnduaWry 2~, 19g1 was received. The Village Financial Statement a Ater Department Financial Statement for December, 19$0 was received, Little asked when the Plantreat: building ~a$, going to be removed. Cook told Council she has had complaints of abuse to garbage ~~:~ cans by Nichols. The Village Manager told Council he would look into both matters.
