MINUTES OF THE MEETING OF THE COUNCIL
OF THE VILLAGE OF TEQUESTA, FLORIDA
March 10, 19$1
A meeting of the Council of the Village of Tequesta, Florida,
was held at 7:30 P.M., Tuesday, March 10, 19$1. The meeting
was held in the Village Hall, 357 Tequesta Drive, Tequesta,
Florida. Councilmembers present were Cook, Little, Mapes,
Ryan and Stoddard. Also present were Robert Harp, Village
Manager, Cyrese Colbert, Village Clerk and John C. Randolph,
Village Attorney.
The opening Prayer and Pledge of Allegiance to the Flag
was given by Councilmember Little.
Changes made to the agenda were:
(addition) 1c. Preliminary approval of sketch plan for
Chapel Court
(addition) 2c. Sketch plan for Bay View Terrace
(addition) 2d. Discussion of Rinker Plant
(addition) 3d. Minutes - Workshop Meeting - March 3, 191.
Mr. F. Jack Harden, AIA, Vice-President, Gee & Jenson, was
present and reviewed with Council his letter to the Village dated
March 10, 19$1, on the bids recently received on the Village
Hall addition.
In the letter Mr. Harden explained that his firm has
reviewed the low bid and found that it basically reflects the
present day costs, Out of the bids received there are three
low bids that are within 5~ of each other.
Mr. Harden explained that when the cost estimate: were
originally done back in November, 19$0 the cost was on a square
foot cost of $45.00 as of December, 19$0 which was a valid cost
for this project at that time. There was no allowance made at
that time for the porch area or roof overhangs and there was
only '1 for contingencies instead of 10~ which it should have been.
Also attached to the letter was a list of "Possible Modifications
to Reduce Cost". Council reviewed this list. The suggestion to
change the glass from Solar bronze to c7..ean plate was not well
received by Council.

The low bid for the addition was Booth Construction, Inc.
• Little moved, "that we accept the bid of Booth Construction,
Inc, at a cost of $170,117.00 with modifications to be negotiated
at a later time by Mr. Harp (Village Manager) and Mr. Harden".
Stoddard seconded and vote on the motion was:

and therefore the motion was passed and adopted.
Mr. Mel Kirk, Kirk & Associates,was present to get the
approval of the sketch plan for Chapel Court. This approval
will allow the various engineering work for the subdivision
to p.raceed. Mr. Kirk reviewed the sketch plan with Council.
There are 3$ lots in the subdivision.
The Village Manager had notified Council that he had
reviewed the sketch plan and found it generally conforms to
the Subdivision Regulations for the sketch plan.
The Village Manager recommended the Village Council
approve the sketch plan, subject to the property being
annexed into the Village. Ryan moved, "to accept the sketch
• plan of Chapel Court Subdivision, subject to it being annexed
into Tequesta". Stoddard seconded and vote on the motion was:

and therefore the motion was passed and adopted.
There was a question from the audience wanting to know
if the contractor working on the drainage for Chapel. Co~zrt
would be responsible for putting the sod back. in the swale
area. The Village Manager advised that the contractor would
replace or repair the Swale area.
The Village Manager explained to Council that he has
reviewed the sketch plans for the proposed Bay View Terrace
subdivision and find it generally conforms to the Subdivision
Regulations.
The Village Manager recommended that the Village Council
approve the sketch plans. This approval will allow the necessary
engineering work for the subdivision to proceed with approval
• of the preliminary and/or final. plat to be approved at a later
date when the various subdivision regulations for same have
been met. Stoddard moved, "that the preliminary sketch plan

John Giba, Village representative to Palm Beach County
Technical Advisory Committee, gave Council an update on the
amendments that have been proposed for the Comprehensive Planning
Act. Mr. Giba told Council that the Comprehensive Plan should
be reviewed and updated periodically. Cook asked the Village
Attorney if this was his job. The Village Attorney advised that
it is one of his duties with the assistance of the Village Staff
to review and update the Comprehensive Plan of the Village.
Mr. Herb Foxman, Tequesta Pines, complained to Council
that dirt bikes and three wheel motor bikes are using swale
areas in front of peoples homes and the park area in Tequesta
Pines and the Tequesta Gardens areas to ride their motor
vehicles. Council assured Mr. Foxman this would be looked
into by the Police Department.
• The Village Attorney advised Council that the Village
has received a "Petition for Annexation" from the owners of
property located at Countyline Road (proposed Chapel Court
Subdivision). The property will be zoned R-1 Single Family
Dwelling District. Stoddard moved, "that we accept the
Petit~.on for Annexation by Chapel Court (subdivision)".

and therefore the motion was passed and adopted.
The Village Attorney read in full AN ORDINANCE OF THE
VILLAGE OF TEQUESTA, FLORIDA, ANNEXING CERTAIN PARCELS OF LAND
TO THE TERRITORIAL LIMITS OF THE VILLAGE OF TEQUESTA.(Chapel
Court subdivision), The Villa e Attorney advised the Ordinance
must be advertised for four (la.~ consecutive weeks before second
and final reading. Stoddard moved, "that we approve the Ordinance
annexing Chapel Court subdivision on first reading". Cook
seconded and vote on the motion was:

and therefore the motion was passed and adopted.
• The Village Attorney reviewed with Council his letter to
the Village Manager dated February 26, 19$1 pertaining to
Rinker Materials Corp., Lone Star and F.E.C. Railroad Right-of-Way.
In the letter it explained that several complaints have been
received by both Town Council and administration, about the noise,
dust and unsightly appearance of these areas.
The Village Attorney told Council that the Building Official,
the Village Manager and himself investigated and surveyed the
areas that the complaint had been received about end they found
that the complaints were wellfounded. They found pratices of
dumping and storing of sand, dirt, gravel, rocks and boulders
and other materials outside. The Village Attorney explained
that although there are certain activities that go on against
the Zoning Ordinance, he was not sure it would be practical
from a standpoint of enforcement of addressing this problem
by way of the Zoning Ordinance. In his opinion the best way
to approach the problem is to adopt a new Ordinance which would
prohibit the outdoor dumping and storage of materials such as
sand, gravel, dirt, rocks and boulders. There could be exceptions
made only for necessary building construction activities.
Council instructed the Village Manager to set up a
Workshop Meeting with Rinker Materials Corp., and the Village
Council to possibly discuss this situation and to make an
• on site inspection of the area.
Mr. Robert Moore, Country Club Drive, asked the Council
to have the noise of the trucks travelling down Country Club
Drive looked into for possible violation of the noise level
ordinance.
The minutes of the February 21~, 19$1 Council Meeting and
the Village Manager's Report for February 22, 19$1 thru March 7,
19$1 were both received.
The minutes of the March 3, 19$1 Workshop Meeting were
received.
Council instructed the Village Manager and the Village
Attorney to prepare an Ordinance on Dock and Pier Regulations.
