HomeMy WebLinkAboutMinutes_Regular_01/13/1981i• MINUTES OF THE MEETING OF THE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA January 13, 19£31 A meeting of the Council of the Village of Tequesta, Florida, was held at 7:30 P.M., Tuesday, January 13, 1..9$1, Portions of the agenda, ie: Minutes and Reports, were considered immediately following the Public Hearing which was held at 7:00 P.M. and was adjourned at 7:15 P,M. The meeting was held in the Village' Hall, 357 Tequesta Drive, Tequesta, Florida, Councilmembers present were Cook, Little, Mapes, Ryan and Stoddard, Also present were Robert Harp, Village Manager, Cyrese Colbert, Village Clerk and John C. Randolph, Village Attorney, `The opening Prayer and Pledge of Allegiance to the Flag was given by Mayor Mapes. The following addition was made to the agenda and approved: 3f. Purchase The Minutes of were received, The to December 20, 19$' were received. of Police Cars the Council Meeting of December 9, 19$0 Village Manager's Reports for December 7, 19$0 ~ and December 21, 19$0 to January 10, 1931 The Village Financial Statement and Water Department Financial Statement for the period ending November, 19$0 were received. The Village Manager announced, with great pleasure, that one of. Tequesta's Police Officers, Gabriel J. Ramos, was the top graduate in Recruit Class No, 24. at Palm Beach Junior College Department of Law Enforcement. Ms, Joanna Rodriguez, Gee & Jenson, was present to answer any questions Council may have on the new Tequesta Village Hall Annex Building, Ms. Rodriguez told Council that the change requested by Council far the additional storage space has been made, Stoddard asked Ms, Rodriguez, if the Village is in violation with the doors from the restrooms opening into the kitchen area, Ms, Rodriguez told Stoddard that she would look into it. r 01-13-$1 -02 The Village Attorney advised that these plans are going to go through the normal procedures before they go out to bid. The Council's duty tonight is to give Gee & Jenson, if Council so desires, the direction to proceed with the plans, Stoddard moved, "that the plans be approved for further procedures". Little seconded and vote on the motion was: Cook -for Little -for Mapes -for Ryan -for Stoddard -for and therefore the motion was gassed and adopted. Mr. Mel Kirk, Chapel Court Subdivision, was present again to request that the owners of the proposed "Chapel Court Subdivision" be allowed to connect into the Village's drainage system nn Pine Hill Trail West. The subdivision will have approximately 3$ single family residences. Mr. Kirk and Mr. Ted Davis were present'at the December 9, 19$0 Council Meeting to present their request. Council at that time told Mr. Kirk and Mr. Davis that they would like to have the Village Manager, Village Attorney, Village Engineering Firm and the Village Police Chief review the area of the proposed subdivision. On January $, 19$1, Mr. Clark Krueger, Gee & Jenson sent • the Village Manager a letter stating that they had reviewed the drainage calculations for Chapel Court Subdivision and gave a list of comments and recommendations. (the letter will become part of these Minutes and are so attached) Mr. Kirk was again asked of the possibilities of annexing into Tequesta, Mr. Kirk told Council that the problem of the proposed 50' wide streets with Tequesta requiring 60' wide streets still exist. There were comments from the audience from Mr. Herb Foxman, Mr. Sal Manc°a,so and Mrs. Jill Gemino, all of Tequesta Pines, The primary concern of the Village Council in regard to the drainage was the lack of jurisdiction and control of a drainage system which would have a direct impact on drainage systems within the Village. However, it was the consensus of the Village Council that it would not object to the drainage as proposed by the developer in the event that the Village would have control and jur~.`~dictior~, wh:~ch co°il,d only come about by annexation. It is the further consensus of ~i:rre village Council that they would give consideration to granting a variance in regard to the Village's subdivision regulations relating to the width of the streets. This and other subdivision regulations are matters which need further consideration and clarification by the Village Council. The Village Attorney will coordinate with the developer's Attorney in regard to the mechanics of annexing into the Village subject to the matter discussed above. O1-13®$1 -03 The Village Manager informed Council, of a request received from Mr, Heinz Von. Zabern for water service for the former Conch Cove Marina site, The area is proposed to be developed for 6$ condominium units, There is an existing $" water main presently in front of this property which belongs to the Village, but it stops approximately 1200 feet north of County Line Road. Cotter Christian, Gee & Jenson believes this section should be completed to insure adequate fire flow for the entire area of this water main and it would also loop this system. It was the feeling of Gee & Jenson that the area should be included in the Village's water service area and that water service should be approved for the proposed 6$ unit area, subject to the owner's providing for the construction of the additional section of $" water main, Mr, Von Zabern told Council that he felt if he paid for 'ire additional line he should be reimbursed when other new customers connected to that line, Some Council members stated that they felt it was the same as a developer desiring water and if they needed the lines and the water then the developer should have the lines built and then deeded to the Village Water System, Little moved, "that • we have our Engineers Look into the feasibility of supplying water for the Heinz Van Zabern project". Cook seconded and vote on the motion was: Cook -for Little -for Mapes -for Ryan -f o r Stoddard -for and therefore the motion was passed and adopted. He announced this Ordinance had been published i.n the Courier orx De~;er3.ber 11, 19$0, span moved, "that we approve second reading of this Ordinance". Little seconded and vote on the ma~tion was': Cook -for F Little -for Mapes -for Ryan -for Stoddard -for and therefo Ordinance No. 2$$ was passed and adopted on 01-13-$1 -04 second reading. The Village Attorney read by "title" only, AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING THE OFFICIAL ZONING ORDINANCE OF THE VILLAGE SO AS TO PROVIDE A ZONING CHANGE FOR THE PROPERTY DESCRIBED HEREIN FROM C-2 - WHOLESALE COMMERCIAL AND LIGHT INDUSTRIAL TO C-1 - .RETAIL COMMERCIAL AND FURTHER AMENDING THE ZONING MAP OF THE VILLAGE SO AS TO REFLECT SAID CHANGES. He announced this Ordinance had been published two times in the Courier, December ll, 19$0 and January 1,., 19$1, Public Hearing on this Zoning change was held this same day at 7:00 P.M. This changed the zoning of three-(3) parcels of land from C-2 to C-1. Stoddard moved, "that the second reading of this Ordinance be adopted". Cook seconded and vote on the motion was; Cook -for Little -for Mapes --for Ryan -for Stoddard -for and therefore Ordinance No. 2$9 was passed and adopted on second reading. The Village Attorney read by "title" only, AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING THE OFFICIAL • ZONING ORDINANCE OF THE VILLAGE SO AS TO PROVIDE A ZONING CHANGE FOR THE PROPERTY DESCRIBED HEREIN FROM R-1, SINGLE FAMILY DWELLING DISTRICT TO C-1 RETAIL COMMERCIAL DISTRICT AND FURTHER AMENDIIv'G THE ADOPTED COMPREHENSIVE PLAN OF THE VILLAGE OF TEQUESTA BY PROVIDING A LAND USE CLASSIFICATION CONSISTENT WITH THE C-1 RETAIL COMMERCIAL DISTRICT. The Attorney announced that this Ordinance had been published two times in the Courier, December 11, 19$U and January 4, 19$1 and that a Public Hearing on this Ordinance had been held this same evening at 7:00 P.M. This parcel of land is behind the North County First Aid Squad Hall. Little moved, "that the second reading of the Ordinance be adopted". Stoddard seconded and vote on the motion was: Cook -for Little -for Mapes -for Ryan -for Stoddard -for and therefore Ordinance No. 290 was passed and adopted on second reading, The Village Attorney told Council that in the original plat of Tequesta Pines DiVasta Construction Company dedicated certain utility and drainage easements beTon~;ing ro Fal~»i BeACh County. The developer has now gone to Palm Beach County Commission requesting to have abandoned a certain portion of O1-13 -gl ~-05 the drainage easement. The County Commission requires that any County easement located within_a municipality be vacated by the Municipality prior to aban~~anm.~nt t~:~ ;hE C,~unty, The Village Attorney e~cplained that he felt it is necessary that a certain portion of said drainage easement remain in the control of the Village to be reserved as a drainage and utility easement and that part of the consideration for this abandonment, is the ability of the Village to use the remaining portion of said easement for installation of water supply wells. The Village Attorney then read by title A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, VACATING ANY INTEREST OF THE VILLAGE IN ANU TO A PORTION OF A DRAINAGE EASEMENT, FURTHER DESCRIBED HEREIN, BEING A PART OF A PALM BEACH COUNTY DRAINAGE EASEMENT, DEDICATED IN THE PLAT OF TEQUESTA PINES, RESERVING SPECIFICALLY, HOWEVER, THE REMAINING PORTION OF SAID EASEMENT NOT VACATED HEREIN TO THE EXCLUSIVE USE OF THE VILLAGE OF TEQUESTA FOR THE CONSTRUCTION AND MAINTENANCE OF UTILITIES (INCLUDING BUT NOT LIMITED TO WATER SUPPLY WELLS) AND DRAINAGE. Stoddard moved, f'that the Resolution be adopted'. Ryan seconded and vote on the motion was: Cook -for Little -for • Mapes -for Ryan -for Stoddard -for and. therefore Resolution No. 4-~0/$1 was passed and adopted. The Village Manager informed Council that we have received a letter from Richard F. Morley, Principal Planner Palm Beach County Planning, Zoning and Building, advising the Palm Beach County Commissioners have approved 50/50 matching funds between the Village and the County for a bikeway on SR 707 fram U.S. #~1 to Jupiter Inlet Colony, south side. The Village Manager told Council that he had $pck an iw:+~th the Town Manager for Jupiter and was so informed that there may be a problem with the Town of Jupiter in having the bikeway on the south side, The County also advised that their entire bikeway program is dependent upon the County receiving Federal Revenue Sharing Funds, which had not been approved by Congress as of November 1, 19$0, Mayor Mapes handed the gavel over to Vice-Mayor Stoddard. Mayor Mapes said that he has waited so long for this he would like to make the motion himself. Mapes moved, "that we accept the County's proposition and to authorize the Village Manager r i• 01-13 ~-$1 -06 to sign the letter from the Palms Beach County Parks Department". Little seconded and vote on the motion was: Cook -for Little -for Mapes -for Ryan -for Stoddard -for and therefore the motion was passed and adopted, The Village Manager informed Council of the bids received on the mobile radio to be installed in the new Maintenance Department Truck, There were four bids received and the Village Manager recommended the bid from Radiotronics in the amount of 551.00. Little moved, "that we accept Radiotronics bid of 551,00", Stoddard seconded and vote on the motion was: Cook -for Little -for Mapes -for Ryan -for Stoddard -for and theref~:re the motion was passed and adopted. . The Village Manager told Council that only on bid has been received for the furnishing and installen of one (1) 90 foot wood pole and removing the top of one ~1) 90 foot pole and lowering the three (3) existing cross arms to a solid pole position. The one bid received was from C.R. Dunn, Inc. and the amount of the bid was $4,500, Ryan moved, "that we accept the bid", Stoddard seconded and vote on the motion was: Cook -for Little -for Mapes -for Ryan -for Stoddard -for and therefore the motion was passed and adopted, The Village Manager read by "title" only a Resolution. of the Loxahatchee Council of Governments entitled A`,RESOLUTION OF THE LOXAHATCHEE COUNCIL OF GOVERNMENTS (COG) SUPPORTING THE CONSTRUCTION OF A MUSEUM IN THE JUPITER/TEQUESTA AREA. Mayor Mapes told Council he needed the authorization. of the Village Council to sign this Resolution before he could sign •ruith Council's approval. Stoddard moved, "that we authorize the Mayor to vote in favor of this Resolution", Cook seconded and vote on the motion was: Cook -for Little -for Mapes -for Ryan -for Stoddard -for 01-13 -$1 -07 and therefore the motion was passed and adopted. The Village Manager read by "title" only a resolution of the Loxahatchee Council of Governments entitled, A RESOLUTION OF THE LOXAHATCHEE COUNCIL OF GOVERNMENTS (COG) REQUESTING ALL POSSIBLE ACTION BY THE STATE OF FLORIDA TO IMPROVE STATE ROADS, PARTICULARLY 706 (INDIANTOWN ROAD) AND ALTERNATE A1A IN THE JUPITER/TEQUESTA. The Mayor told Council he needed their approval and authorization on this Resolution also, Stoddard moved, "that the Mayor be authorized to sign this Resolution in regards for our needs for roads". Little seconded and vote on the motion was: Cook -for Little -for Mapes -for Ryan -for Stoddard -for and therefore the motion was passed and adopted. The Village Manager reviewed his memorandum on the purchase of two (2) Ford police cars which the Manager was recently authorized to purchase. The Police Department was advised that the engines come in two sizes, a 302 CI and a 351. The 302 CI is not a fuel saver nor is it a high performance engine. • It was the feeling of the Police Chief that the Village should purchase the 351 engine at an additional cost of $$2.00 per car. Little moved, "that we accept the Al Packer Ford bid of $14,502.5$ (far two cars with 351 engines)". Stoddard seconded and vote on the motion was: Cook -for Little -for Mapes -for Ryan -for Stoddard -for and therefore the motion was passed and adopted. The meeting was adjourned at 9:16 P.M. JENSON, P.E. - Mr. Bob Harp, Village Manager Village of Tequesta Post Office Box 3273 Tequesta, Florida 33458 Re: Chapel Court Subdivision Drainage Dear Bab : As per your request we have reviewed the drainage calculations for the Chapel Court Subdivision near Tequesta, Florida. Based on our findings we have the following comments or recommendations: 1. The 70' x 420' retention area proposed for .the sub- - division is of adequate size when constructed for a • retention water depth of 4.0+ feet. w 2. The drainage calculations utilized a natural, unspoiled percolation rate for the percolation discharges thru the bottom of the retention area.- We contend that this natural rate will be slowed by bottom vegetation and siltation with time. 3. We recommend that the Village allow the retention area discharge pipe to be connected to the existing drainage inlets at Beechwood Trail-under the following conditions: a. A control structure be furnished at the retention area on the end of the discharge pipe. b. The structure allow adjustment of retention water depth from at least 2 feet to 4 feet deep before discharging into the outfall pipe. A riser type structure-may be installed with stop-log adjustment over the total 4 feet of retention depth. ._ c. The initial setting on the control struct should be for a two f2) foot retention wa depth.
