MINUTES OF THE N~ETING OF THE COj?NCIL
OF THE VILLAGE OF TEQUESTA, FLORIDA
April 2$, 19$1
A Meeting of the Council of the Village of Tequesta, Florida,
was held at 7:30 P.M., Tuesday, April 2$, 19$1. The meeting was
held in the Village Ha1.1, 357 Tequesta Drive, Tequesta, Florida.
Councilmembers x~resent were Brown, Cook, Little, Mapes and
Stoddard. Alc, pr~~~~ent ~~rQ.bre Robert Harp, Village Manager,
Cyrese Colbert, Village Clerk and John C. Randolph, Village
Attorney,
The opening Prayer and Pledge of Allegiance to the Flag
was given. by Councilmember Brown.
There were no anno~~ncements,
Changes made to the agenda were:

Mr. Clark Krueger, Gee & Jenson was present to discuss the
drainage ditch West, of Seabrook Road inparticular the Devito
property. Mr, Krueger told Council that he was present at this
Council Meeting to try and explain to Council the situation
on the DiVito property and its problems. The Village of Tequesta
has received a letter from Jerome F, Skrandel, Town Attorney for
the Town of Jupiter, expressing Jupiter Town Commi;~:aic>n:~rs F,or~cern
over the little or no slope they felt had been provided.

write a letter to the Village of Tequesta expressing their concern
and requesting the Tequesta Council to advise Jupiter of its
positior. and intentions in this matter,
Gee & Jenson. feels that the wash out that is oce..urr:in~r ~n

from their pool or from the rain gutter around the home.
Mr, Krueger told Council that the Village started repair
work on the ditch with the Villagers personnel in January. The
property owners were not happy with the work so they hired an
attorney and the Village stopped the repair work,
Mrs, Devito, 109 W, TrYindsor Road, told Council about her
property and what she feels is the loss of her property. She

feels the sharp drop out at the ditch is a safety hazard.
Council discussed the problem and reviewed pictures that
• had been taken by Gee &, Jenson,
It was the consensus of the Council that the Village Manager
and Clark Krueger, Gee & Jenson should review this situation and
to get the problem resolved as soon as possible.
Council asked Mrs. Devito if the Village had her permission
to enter her property and. to take the necessary steps to repair
the ditch abutting her property. Mrs. Devito gave her permission
for the Village to enter onto her property and to do the needed
work,
Farmer Councilmember Joe Yoder, Village representative to
the Dock and Pier Steering Committee was present to discuss the
proposed Ordinance and its contents. Nir, Yoder explained that
he didntt have much to add to the Ordinance that was being
presented tonight.
John Giba, 7~ Fairview East, told Council he feels the
solution to the problems of Lone Star and Rinker Materials is
to get them to move taut of Tequesta. He feels the Village should
stop helping people outside the Village with police protection,
then maybe they will annex into Tequesta,
Mr, Herb Fc:>xman, 2~ ~tickory Hill Road, told Council. of the
• problem the Tequesta Pines area is having with ~ wheel motorcycles.
He told Council that t~~~;~e bikes are going onto private va~~ant l:~t
and they are a nuisance,
Police Chief Flannery was present and informed Council that
he just found out who the ka_ds vaer~a who z,~Fere ~ausing the trouble
and that he would talk to the parents of these kids and to the
kids themselves.
t~~ix•, John Webber, Hickory Hill Road, also told Council. he
feels that these 3 wheel motorcycles are a nuisance,
Py'Ir, Robert t~~oore , 3 75 Country Club Drive , talked about the
heavy traffic on Country Club Drive and feels the speed limit on
Country Club Drive should be lowered to 25 m,p,h.
Council asked the Village Attorney if the Village could
lower the speed limit on the streets within the Village. The
Village Attorney said that in his opinion the Village could
lower the speed limit on streets wa.thir~ the Village but warned
Council they could pass the motion as a first step but this
does not mean that it will. be done automatically. Little
moved, "that we reduce speed limit from ~0 m.p.h. to 25 m.p.h.
within the residential areas of the Village of Tec1uesta". Cook
seconded and vote on the motion was:

• The Village Attorney briefed Council on the Ordinance

OF THE VILLAGE OF TEQUESTA SO AS TO PROVIDE THAT PAYMENTS

DEDICATION OF PARKS IN PROPOSED SUBDIVISIONS MAY BE HF,LD

that this Ordinance is basically Like the model Ordinance that
had bEen suggested by the C.O.G. Dick arld Pier Ordinance Steering
Co!r:mittee. Each Counci~lm,~>mber had received copies of the
proposed Ordinance before t;he Co,.zneil TfReeting caa.th. ample time
to review the Ordinar_c:F~, Brown moved, "that we approve first

The Village ~~anager inform~:d Council, that the Village has
been advised of the neces>ity for the Vil.la~;e to appoint a
• representative to the Board of Dir~.~:tors for the Jupiter--Tectuesta
Junior Citizens. The Village i`~ana~~er recomm~:nded the appointment
of Richard Berube as the Village's repre:~entative. Irittl.e
moved, "that we appoint P~r. Riohard Berube". Brown seconded

town. Vi.ce~i~'Iayor Stoddard agreed that he would.
Stoddard wanted to know if Council had any ~;omments on
his suggestions of the el:iminat<i.on of garbage cane thtat; ~aou'ld.
• be substituted by plastic; bag: and the installation of green
paper carrier boxes for newspapers.
Cour,cilmember»~ discussed this briefly then directed the
Village Attorney to look into this to see what legal. steps
may have to be taken to implement t~~~e su.ggestions.
Council then d.scus~ed the increasing Bost of the
Inrracoastal Cros~~ing being brought about by the delays in
permitting, They feel the additional cost should be passed on
t~~ new eanstruction in the area because the new c~~nstruction
is basciall.y what is causing the need for the additional line.
They instructed the Village i~lIana~;er to contact John. McKune,
Gee w Jenson and Village Attorney to provide for an Ordinance
increasing the Capital Improvement Charge for water connections
to the Village Water System in the Jupiter Island area cif the
Sy item.
Council then discus;~ed the Town of Jup3.ter Resolution
No. 1.~~&1 expressing Jupiter's intention to qualify and serve
as the regional water supply authority for the north County
area and requesting the cooperation of the several local
governments affected to secure the official designation thereof
by the Florida Department {?f Environmental Regulation.
~~Zapes told Council that he had asked Roger Anderson,
Loxahatchee River Environmental Control District, if the rights
to become the regional water supplier in this area had been taken

from them and l~~r. Anderson told Mapes it had not.
• Little expressed his feelings that Tequesta should be
the supplier for North of the Loxahatchee River.
Stoddard told Council he also feels Tequesta should be
the supplier for this side of the river.
Little moved, "that we reject the Town of Jupiter's
Resolution No. 1$-$1". Stoddard seconded and vote on the
motion was:

and therefore the motion was passed and adopted.
The Village Manager was requested to look into the date
of the removal of P1_antreat by the Loxahatchee River Environmental
Control District.
The meeting was adjourned at 9:41 P.M.

Subject: Election of Mayor and Vice-Mayor
Date: March 20, 1981
Fle would suggest the following rules and procedures be applicable
to the election of the rlayor and Vice-Mayor at the March 24, 1981 Council
Meeting:
1. The Council appoint Chairman to conduct the election of
the Mayor and Vice-Mayor. This has been the Village
Manager in the past.
2. Nominations shall be in written form as advised in March 20,
1981 memorandum.
3. I~Fominations da not require a second.
4. Nominators can speak for one (1) minute in behalf of their
nominee., if they desire.
5. Balloting will be by voice vote.
6. As soon as one (1) of the nominees receives a majority vote,
the chair will declare the nominee elected.

This is to remind you that any Councilmember desiring to nominate
a member of Council as Mayor or Vice-Mayor must submit the nomination in
writing in substantially the following form:
• "I hereby resolve that (Name of Candidate) shal'1 be
appointed as and to be (Mayor or Vice-Mayor)of the Village
of Tequesta pursuant to Article II, Section 2.06, Mayor
and Successors, of the Charter of the Village of Tequesta".
