HomeMy WebLinkAboutMinutes_Regular_10/09/1979• MINUTES OF THE MEETING OF THE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA October 9, 1979 A Meeting of the Council of the Village of Tequesta, Florida, was held at 7:30 P.M., Tuesday, October 9, 1979 in the Village Hall, 357 Tequesta Drive, Tequesta, Florida. Councilmembers present were Brown, Cook, Mapes, Ryan and Yoder. Also present were Robert Harp, Village Manager, Cyrese Colbert, Village Clerk and John C. Randolph, Village Attorney. The Opening Prayer and Pledge of Allegiance to the Flag was given by Councilmember Yoder. Mayor Brown announced that there will be a Public Hearing on Novermber 13, 1979 for proposed amendment to the Land Use Plan for Blowing Rock Condominium, Mayor Brown requested that the item, $910,000 Revenue Bond Issue be added to the Agenda as item 3a. He also requested that the item, first reading of a proposed Marina Facilities Ordinance be be added to the Agenda under item 1~c. Both additions were approved by Council. The minutes of the September 25, 1979 Council Meeting were received. Under the item, Village Village Manager what he told who wanted water service for County. The Village Manager their request in writing and Council did not want to e~pa time. Manager's Report, Cook asked the two representatives for a developer area North of of Riverbend in Martin replied that he told them tb put to send it to~the Village, but that ~d the Villages water service at this Detective Kenneth C, Bachman, Town of Jupiter Police Department was present to present to Council the R.A.I.D. Project, which stands for Recreation, Rehabilitation, Alcohol, Information and Drugs. Mr, Bachman told Council that he has been with the Jupiter Police Department for~four (4) years and has been a policeman for ten (10) years. He said that th$ Community has a pretty serinus drug problem and that over 700 people have joined together to try and combat this problem in a different way. Frank Flannery, Tequesta Police Chief, told Council that since he has moved to Tequesta from Chicago he has seen a decrease in the use of hard narcotics but he has seen an increased use of other drugs, He spoke of different problems that law enforcement has in trying to combat the crime, 10-09-79 -~02 He told Council that a couple of weeks ago a yo the Post Office on Bridge Road was found laying on t i from an overdose of valium, Some children had been overdosed on valium at school that same day, After the Police discovered that there had been a robbery in Palm Beach County prior to this incident and that of ualium was involved. ung boy near he ground reported some investigation of a Walgreens the theft The Village Attorney read by "title only" A RESOLUTION OF THE VILLAGE OF TEQUESTA, FLORIDA EXPRESSING TTS SUPPORT OF THE GOALS AND ASPIRATIONS OF THE R.A.I.D. GROUP: Ryan moved, "that we adopt this Resolution". Mapes seconded and vote on the motion was: Brown -for Cook ®for Mapes ~-f o r Ryan -for Yoder ,for and therefore Resolution No. 1~79/~O was passed and adopted. Yoder moved, "that the Mayor represent the Village of Tequesta at the C.O.G. Meeting to approve this Resolution" Cook seconded and vote on the motion was: Brown --for • Cook -for Mapes -for Ryan -for Yoder -for and therefore the motion was passed and adopted, Mr, John Wise, Gee 8c Jenson, told Council that Mr, Clark Krueger would give them an update on the drainage improvements being done in Tequesta. Mr. Clark Krueger reviewed with Council work remaining to be done or completed for various areas in Tequesta: Country Ci,ub -~swales have not been gra~ad and resodded along the length of the repaving, The Swale regrading will involve the repair or replaeement of several lawn irrigation lines. The contract calls for the work to be substantially completed by October 24, 1979• Dover' Road Area ~- the installation of conf list Inlet A13 has to be completed. The extension of the collection system has not been completed or started. Work has not started as of yet on the Dover Road ditch. The clean up of the streets, swales and general area for final inspection is not complete. The contract Balls for the work to be substantially competed by October 24, 1979. Tequesta Country Club Community -~ the work within Phase I is essentially 9$J complete, Phase II is approximately 15~ complete. 10-09-79 -03 Preparations are being made for the delivery of the bridge, Some adjustments will have to be made to Pond No. 5 and Pond No, 2 • because of water ponding in the swale areas of those ponds. The estimated contract price for the Country Club Drive resurfacing and drainage improvement contract was $99,961,60 but with the projected additional costs the estimated total cost is now $107,961.60. The estimated contract price for the Dover Road area drainage improvement was $102,611.0 but with the projected additional costs the estimated total price is $147,211.$0. The estimated contract price for the Tequesta Country Club Community drainage improvements Phase I was $265,970, but with the projected additional costs the estimated. total of Phase II was $15$,570. but is now $13,570. Mr. Larry Zielinski, Dover Road, told that the people who are working for the co Dover Road have torn down some of his fence like bottles and papers onto his property. that he .agrees with Mr. Zielinski and that unhappy with the contractor,.also. He said the housekeeping is horrible with equipment and machinery stored everywhere throughout the Village. • John Giba, Planning Consultant, told Council that he has been in touch with staff people in Martin County about the connector road and that the status of the road is dormant. Roger Anderson, Executive Director for Loxahatchee River Environmental Control District, told Council that the line recently installed down Country Club Drive was activated and shortly after ENCON activated it one of the motors of a pump at the lift station. quit running, But the other pump was fixed and everything is working now. Under his request ENCON also had installed an upstream odor control facility at the Turtle Creek station which will eliminate any odor that may be in the system. TJIr, Anderson told Council that he was here on an invitation by the Village Manager for Mayor Brown. Mayor Brown had some questions to ask Mr, Anderson. Mayor Brown told Mr, Anderson that he would like him to tell the Council ENCON's feelings about being in the water business, Mr, Anderson told Council that at the last ENCON Board meeting the Board Members instructed him to have preliminary plans for a regional water system ready within three (3) months and final plans ready within six (6) months. He said he has several concepts in mind, one of which he finds most exciting is a permanent long range water supply. 'They are in touch with an organization that has over 3,000 acres as a dedicated water catchment. area that has strong possibility of becoming the areas 30 million gallons plus of water a day supplier. This could be 10-09~ -04 a very 1ow'cost savings factor also. But he said this is a • 11b1ue sky" plan, He has also spoke with the F.M. Water Company and they should get down to the real nitty--gritty within the next two weeks. He has sent a letter to Jupiter Water System about a possible purchase of their system but he feels it is highly unlikely that Jupiter will want to sell its water system, The next item on the agenda was the $910,000, Improvement Revenue Bonds. The Village Manager sent a memorandum to Council recommending that Council set a Special Council Meeting for the purpose of considering a proposal from William R. Hough & Company for the purchase of the $910,000 Improvement Revenue Bonds. But Council discussed the fact that the.~interest rates had recently been set at 14~~ and maybe going through with the Bond Issue at this time may not be the best thing. Yoder told Council he would like the Village Manager to investigate an alternative as a supplier of the money. He said maybe we have more borrowing capacity in the Water Department. Mapes moved, "that the-Mayor be authorized to call a Special Meeting after he talks to Bond Counsel". Yoder seconded and vote on the motion was: Brown -f o r Cook -for Mapes -for Ryan -f o r Yoder -for • and therefore the motion was passed and adopted, The Village Attorney read by "title only" AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, ANNEXING CERTAIN PARCELS OF LAND (the Pontifical Institute for Foreign Missions) TO THE TERRITORIAL LIMITS OF THE VILLAGE OF TEQUESTA, Mapes moved, "that the second reading of this Ordinance be adopted". Ryan seconded and vote on the motion was: Brown -f o r Cook -for Mapes -for Ryan -for Yoder -for and therefore Ordinance No. 273 was passed and adopted on second reading. The Village Attorney read by "title only" AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING CHAPTER 11 OF THE CODE OF ORDINANCES OF THE VILLAGE TO INCLUDE THEREIN A REQUIREMENT THAT ALL BUSINESS VEHICLES USED IN CONNECTION WITH BUSINESSES, OCCUPATIONS OR PROFESSIONS INCLUDED WITHIN SAID CHAPTER BE IDENTIFIED IN A CERTAIN MANNER, PROVIDING A PENALTY FEE, PROVIDING FOR SEVERABILITY, PROVIDING AN EFFECTIVE DATE. Mapes moved, "the second • reading be adopted", Yoder seconded for purpose of discussion, Yoder told Council that since the first reading of this Ordinance he has talked to people whom this would affect and he has a different outlook than before on this Ordinance, He told Council that he 10-09-79 ~05 did not see why people like painters, lawn men, etc, should go . to the expense of displaying their identification on their vehicles when business people like lawyers and doctors do not, A.W. Butterfield, Building Official, told Council that he feels that commercial vehicles doing business on private property should be identified. Councilmembers Ryan and Cook agreed with Yoder in that this Ordinance would infringe on the rights to free enterprise. Mapes moved, "to table this Ordinance until which time the Police Chief can relate his feelings to Council on this Ordinance". Yoder seconded and vote on the motion was: Brown -f o r Cook ~-against NTapes -for Ryan ~-against Yoder -for and therefore the motion was passed and adopted. The next item on the agenda was the consideration of an Ordinance for Marina facilities. The Village Attorney reviewed various changes made in the Ordinance. • Mr, Dick Hutchison, told Council that people on Beach Road are concerned that people may use their boats for residential purposes year round. They would like to see it limited to eight months out of the year, Mr. Tom Roath, Jupiter Inlet Colony, told Council that the Jupiter Inlet Colony people are concerned with the Ordinance even with the changes which have been made. They believe there is a problem with over crowded parking, Council agreed to have incorporated into the Ordinance a limit of 25~ of the boats in the slips being used for residential purposes and that a person or persons could not have residence on the craft for more than eight ($) months during any one year. Council, Mr. Hutchison and Mr. Roath agreed that this wauld solve mast of the problems they had with this Ordinance. The Village Attorney read by "title only" AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING THE ZONING ORDINANCE OF THE VILLAGE TO INCLUDE SPECIAL EXCEPTION USE IN R-2 AND R-~3 ~'NLTIPLE FAMILY DWELLING llTSTRTCTS FOR MARINA FACILITIES, FOR PROPERTIES WITHIN SAID ZONES WHICH ARE CONTIGUOUS TO THE INTRA- COASTAL WATERWAY, DEFINING SAME, SETTING FORTH RESTRICTIONS AND SPECIFICA TIONS RELATING TO SAME, PROVIDING FOR SEVERABILITY, PROVIDING AN EFFECTIVE DATES PROVIDING FOR CODIFICATION. Mapes • moved, "the first reading of the Ordinance be accepted". Ryan seconded and vote on the motion was: 10-C9-79 -06 I• Brown -f o r Cook -for Mapes -for Ryan -f o r Yoder -for and therefore the motion was passed and adopted. The Village Attorney advised Council that Jupiter Inlet Corporation is now asking the United States Supreme Court to hear their case against the Village of Tequesta. The Village Manager told Council there were only two (2) bids received and opened for the surface color coating of the tennis courts in Tequesta Park. The Recreation Director and Village Manager recommended Council accept the low bid of $7,256.00 from Hardrives Company. Mapes moved, "that the Village Manager's recommendations be followed". Cook seconded and vote on the motion was: Br+~wn -f o r Cook -for Mapes -for Ryan -f o r Yoder -for n LJ and therefore the motion was passed and adopted. The discussion of job description for Financial Director was postponed until the October 23, 1979 Council Meeting. Councilmember Cook told Council that the Leisure Time Committee has set several goals for their Committee and one of them is to get the County to fund more money for recreation for this area. Mayor Brown told Council that the Ft. Jupiter Association asked that an Ordinance be passed in Tequesta that would prevent unsightly docks from going into the River. The meeting was adjourned at 10:52 P.M. Any item left on the agenda after that time would be on the next agenda for the next Council Meeting. •
