HomeMy WebLinkAboutMinutes_Regular_11/13/1979 • MTNUTES OF THE MEETING OF THE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA November 13, 1979 A Meeting of the Council of the Village of Tequesta, Florida, was held at 730 P.M., Tuesday, November 13, 1979 in the Village Hall, 357 Tequesta Drive, Tequesta, Florida. Council.members present were Brown, Cook, Mapes and Ryan, Councilmember Yoder was out of town. Also present were Robert Harp, Village Manager, Cyrese Colbert, Village Clerk and Adams Weaver, Johnston, Sasser & Randolph Attorneys at Law,. John C. Randolph, Village Attorney was also out of town. The opening Prayer and Pledge of Allegiance to the Flag was given by Councilmember Cook, Agenda item 5e. Signs for Gallery Square Art Show was added to the agenda with Council's approval, The minutes of the Special Council Meeting for October 23, 1979 and the NTinutes of the Council Meeting for October 23, 1979 were • received as presented. Under the Agenda item Village Manager's Report, October 21 to November 10, 1979 item ~39 Mayor Brown asked the Village Manager what the price would be for double striping Country Club Drive if the County did the work and the Village reimbursed the Count.,y. The Village Manager told Council the price would be about $t~00. The Village Manager's Report, October 21 to November 10, 1979, the Village Financial Statement, September, 1979 and the 4tiater Department Financial Statement for September, 1979 were received .= Mr. John Wise, Gee & Jenson, was present to give a status report on the drainage improvements, Mr. Wise, told Council that Mr. Clark Krueger, Gee & Jenson will be here in just a few moments to give more details. NIr. Wise gave the following details on the different areas. Dover Road Area - most of the work done in this area would have to be done over because of errors made. He anal the Village Attorney walked the area of the drainage ditch on November 5, 1979, he said, and there will be some clearing that will have to be done first before the work is completed. Mayor Brown asked r2r, Wise about the problem of resodding in that area. Brown told Wise that the sod being put down in. that area is bahia but most of the sod that was already there is St. Augustine and the people in that area are most unhappy. Mayor Brown asked Wise why this was being done. P~1r. UTise told Council that when Council was discussing the street rights-of-way in the Country Club they had been instructed to put down bahia and this was extended to the right-of-way in the Dover Road area. Council agreed that ir. the Dover 11--13 s79 -02 Road. area the sod put down shall be like kind of sod. • NIr, Wise told Council he needed their decision on Change Order No, 2 received from Dickerson Group, Inc. for the work being done in the Dover Road area. The Change Order is for additional work to provide for more drainage in the Maple Avenue and Elm Avenue and Dover Road area and construction of necessary conflict structures. Ryan moved, "that we a prove the Change Order No, 2 in the Dover Road area in the amount of 17,956.50", Cook seconded and vote on the motion was: Brown -for Cook -for 1~'~apes -for Ryan -for and therefore the motion was passed and adopted. Mr. Larry Zielinski, Dover Road, asked John Wise if a buffer could be installed ar®und the pump in that area where the contractor is ~,xsing the pump? '~Ir. Wise said he would have it checked out but he was sure something could be dorae to relieve the noise problem. Country Club Drive -~ Nir. Wise told Council that the rings of the drain holes on Country Club Drive will have to be lowered. Country Club Community -~ Mr. Wise told Council that the problem • of the Anderson easement has been resolved. Mayor Brown asked the Village I~~lanager to read aloud the letter addressed to the Village Manager from the Village Attorney on various drainage easements. In the letter the Village Attorney said he had walked some rrproblemr' easements with John Wise and he had talked with the property owners who are affected by the proposed drainage facilities going through the easements on their properties. The engineers had advised the Village Attorney that the work could be done within the ten-foot easementthat belongs to the Village without encroaching on adjacent property, but the work would have to be done under close supervision. In the letter it mentioned three easements arid~reviewed the problem at each, P~lr. Krueger told Council that the contractorts superintendent and owner of the utility company met with the property owners and discussed different ways of doing the work within the easement. The contractor told the property owners that he could do the work within the ten feet he had to work with by putting up a shield. l~~ir. Mitscher NZr. Sawyer, Nr, Black all owners o:f property where the easements run through their property explained to Council their problem with the easements. Nir. Wise told Council and the property owners that the Village • would incur an additional expense of approximately $20,000 for trying to stay within the ten foot easement. Council agreed that NIr, Mitscher and Tfir. Sawyer should meet with N1r. Wise to get an approximate cost of replacing different items that may have to be destroyed and that lr. Wise should report back to Council with the cost, T~~ir. Richard Orman, Barker, Osha 8c Anderson., Inc, told Council that the ENCON Board has chosen Barker, Osha & Anderson for the plans for extension of their sewer treatment plant under the implementation of a 201 Facilities Planning Study, T~Zr. Grman told Council that Public Law ~2-500 requires that a 201 Facilities Planning Study be completed. prior to receipt of facilities construction grant funds as authorized and appropriated by the U.S. Congress, Mr. Orman told Council that the 201. Facilities Planning Study will be funded 75J by the U.S. Environmental Protection A envy, 20~ by the Board of County Commissioners of Falm Beach County .and 5~ by the Loxahatchee River Environmental Control District, Mr. Grman reviewed the proposed Resolution with Council and the Village Manager read the Resolution entitled, A RESOLUTION CF THE VILLAGE OF TF(~TtESTA , FLORIDA CONCURRING WITH THE GOVERNING BOARD OF THE LOXAHATCHEE RIVER ENVIRONMENTAL CONTROL DISTRICT TO MAKE APPLICATION FOR FEDERAL ASSISTANCE UNDER PUBLIC LAW ~2~-500 GRANTS PROGRAM TQ IMPLEMENT A 20.1. FACILITIES PLANNING STUDY by "title" only. Ryan moved, "that we adopt the Resolution", Cook seconded and vote on the motion. was: Brown -tor Cook -for Mapes for Ryan -for a.rid therefore Resolution No. 2~-79/0 was passed and adopted,. Giba told Council that work has started on the revising of the Zoning Ordinance. He also told Council that he has prepared a letter to Publix about the restriping of their parking lot and the rear loading to their store and has given it to the Village Manager for his review and signature. Ths Village N~anager told Council that he has not sent the letter to Publix yet because the Community Appearance Board has not met yet to discuss the problem and he would like to combine their feelings with Gba's in a letter to Publix, The Village T~~Ianager said that there had been one change made to the Marina Facilities Ordinance and. the secord page had been retyped, The Village T~~Ianager read an Ordinance of the Village of Tequesta entitled, AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING THE ZONING ORDINANCE OF THE VILLAGE TO INCLUDE SPECIAL EXCEPTION USE IN R-2 AND R-3 MULTIPLE FAMILY D'fdELLING DISTRICTS FOR MARINA FACILITIES, FOR PROPERTIES VdITHIN SAID ZONES WHICH ARE CONTIGUOUS TO THE TNTRA- COASTAL WATERWAY, DEFINING SAI~~, SETTING FORTH RESTRICTIONS AND SPECIFICATIONS RELATING TO SAPS, PROVIDING FOR SEVERABILITY, PROVIDING • AN EFFECTIVE DATE, PROVIDING FOR CODIFICATION, by title only. ' 11-13-79 -04 Mapes moved, "the adoption of the Ordinance". Ryan seconded and vote on the motion was: • Brown -for Cook -for Mapes -for Ryan -for and therefore Ordinance No. 274 was passed and adopted on second reading. The Village Manager explained that this proposed Ordinance entitled AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA PROVIDING FOR A CHANGE IN ZONING CLASSIFICATION OF VARIOUS PARCELS OF LAND AND AMENDING THE OFFICIAL VILLAGE ZONING MAP TO CONFORM TO THE VILLAGE LAND USE MAP AS ADOPTED JULY 24, 1979 has in it various parcels of land that the Village has talked about that will have to be changed to agree with the Land Use Plan so that the Zoning Plan and the Land Use Plan will be the same type of land use. The Village Manager read the Ordinance by "title only". Mapes moved, "for approval of first reading of the Ordinance". Ryan seconded and vote on the motion was: Brown Cook T~ia pe s Ryan and therefore the motion was p; -for -for -for -for ~ssed and adopted. The Village Manager explained that the rezoning of the properties involved would require two (2) public hearings. The first Public Hearing could be scheduled for 7:00 P.M. November 27, 1979 and the second could be scheduled for 7:30 P.M., Tuesday, December 11, 1979 prior to the Council Meeting being held that same night. Mapes moved, "that we set Public Hearings for Zoning Revisions for 7:00 P.M., Tuesday, November 27, 1979 and 7:30 P.M., Tuesday, December 11, 1979". Ryan seconded and vote on the motion was: Brown -for Cook -for Mapes -for Ryan -for and therefore the motion was passed and adopted, Mapes moved, "that the Village Clerk be authorized to notify property owners (F, Reed 8c Dorothy S. Fitton) of a 4.60 acre parcel of land south of the Presbyterian Church property of a proposal to change Land Use of their property and of a Public Hearing to be held at 7:00 P.M., Tuesday, January $, 19$0". Ryan seconded and vote on the motion was: • Brown -for Cook -for Napes -for Ryan -for ar.,c~ therefore the motion was passed and adopted. • Nir. Joe B. Wise, William R. Hough & Co., sent a letter to Council +ated October 31, 1979 reconfirming their suggestion that the Village :~pp1y to the State Board of Administration for relief from the 72~ statutory rate limitation upon borrowing in Florida Municipalities. Council in general felt that doing this would not obligate the Village in any way but would be~there if needed. Ryan moved, "that we authorize William R. Hough & Co., in concert with the Village Manager and the Village Attorney to prepare such an application to be submitted by mail at an early date". Cook seconded and vote on the motion was: Brown -for Cook -for Mapes -for Ryan -for and therefore the motion was passed and adopted. The Vill-age Mana er told Council there had been only one bid received for three (3~ 19$O Police cars for the net cost of $16,030. with a delivery date of 90 days. Ryan moved, "that we accept the bid and that the cars be purchased with Federal Revenue Sharing Funds". Cook seconded and vote on the motion was: Brown -for Cook -for T~Iapes -for • Ryan -for and therefore the motion was passed and adopted. The Village Manager told Council that the Lighthouse Gallery had requested to erect two (2) banners in Gallery Square North saying "Art Show" for their show to be held on Sunday, November 1£~, 1979. He recommended that the Lighthouse Gallery be given permission for the banners. Ryan moved, "that we allow Lighthouse Gallery to erect the temporary banners". Mapes seconded and vote on the motion was: Brown -for Cook -for Mapes -for Ryan -for and therefore the motion was passed and adopted.
