HomeMy WebLinkAboutMinutes_Regular_11/27/1979• MINUTES OF THE MEETIIv'G OF THE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA November 2.7, 1979 A Meeting of the Council. of the Village of Tequesta, Florida, was held at 7:1x.0 P.M., Tuesday, November 27, 1979 in the Village Hall, 357 Tequesta Drive, Tequesta, Florida. This was immediately fol.lovaing a Public Hearing at 7:00 P.M. Councilmembers present were Brown, Cook, Mapes and Ryan. Cour~cilmember Yoder was out of town. Also present were Robert Harp, Village Manager, Cyrese Colbert, Village Clerk and John C. Randolph, Village Attorney. The opening Prayer and Pledge of Allegiance to the Flag was given by Vice-i+~iayor Mapes, There were no announcerrients. N°iayor Brown told the audience that Council had recently • set a 10:00 P.M. deadline for ending the Council Meetings and only after Council's approval could the time be extended till 10:30 P.M. He also set guide lines for the meeting and for those people wish?.ng to address themselves to Council or to a speaker. A time limit of five (5) minutes was put on speakers wishing to address themselves to any one item. Council had not received tree minutes of the Fublic Hearing for November 13, 1979 or the Tfiinutes of the Council Meeting for November 13, 1979, so both items la and lb were deleted from the agenda . i~2r, John Wise, Gee & Jenson ,-was present to give an update report on the drainage and street resurfacing program. Mr. Wise tol..d Council that he would give the Village Manager a checl{ list for the records of things that still needed to be completed. l~~r. Vdise gave the following break down: Dover Road Area - the differences between the contractor for that area and the Engineers have been worked out. Mr. Wise told Council that there was still the problem of the drainage pipe being at th.e wrong elevation• Council expressed its feelings and so directed Gee & Jensor. to make sure the drainage in that area is correct without question.. i'-ir, ~~Jise also informed Council that on November 26, 1979 when ~raork was scheduled for the clearing out of the drainage ditch in the Dover Road area the contractor'a crew was stopped by a Jupiter 11-27-79 -02 Police Officer who said he would have to arrest the worker if • he proceeded with the work, The Town l~ianager had instructed the Police Department to stop all work on the ditch that would involve Jupiter, The Tourn of Jupiter was apparently upset that the contractor had not pulled a permit to do the work within the Town limits of Jupiter and the Town of Jupiter had not seen the final plans or permits obtained by Gee & Jenson or the contractor. Gee & Jenson was presently working on getting the problem resolved. Phase II - Country Club Community - T~ir. Wise told Council that Clark Krueger had sent a letter to the Village Manager about the Tt~iitscher-Sawyer and Griffith-McComb Drainage Easements. Council agreed and so directed Gee & Jenson to proceed with the easement at the T~Iitscher-Sawyer and Griffith-T~~cComb drainage improvement easements. Chief Flannery told Council that he had attended a seminar in West Palm Beach on November 11, 1979 to see what actually took place when Hurricane David hit our area. One question that was repeatedly asked was, "would the fact'th,at people were so prepared and David was not that damaging cause people to have a false security?" Chief Flannery told Council that during the hurricane the Village had the use of four-T~rheel drives from people outside the Village. Some of the people who were asked to leave Jupiter Island remained in their homes. Jorn Giba, Planning Consultant told Council that he had nothing other than what was on the agenda. • The Village Attorney told Council that a petition for Annexation had been received from the JIB Club, Inc, The petition requests that the property be zoned R-3 with special exception for T~iarina zoning classification, The Village Attorney recommended that if Council vaould consider the petition, then in the Ordinance it should state ....."properties shall be zoned R-3 Multiple Family Dwelling District upon the termination of two years from the effective date of this annexation ordinance or earlier if granted by the governing body of Palm Beach County, Florida...." Mapes moved, "that we accept tY~ petition as amended by the Village Attorney to read..... Said property shall be zoned R-3 T~dlultiple Family Dwelling District upon the termination of two years from the effective date of this annexation ordinance or earlier if granted by the g~verning body of Palm Beach County, Florida; as provided in F.S. 171.062". Ryan seconded and vote on the motion was: Brown -for Cook -for T~Zape s -for Ryan -for and therefore the motion was passed and adopted. (The vote on the motion was taken after the following discussion took place) John Giba, told Council that the area is planned for approximately 11.E units per acres. 11-27-79 -03 The Village Attorney told Council that the Attorney that • is working for the County on this property has told him that he was not sure the suit would be mute because the property is being annexed into Tequesta. The Village Attorney then gave a break- down of the lavasuit that is pending. Palm Beach County Commission on December 29, 1977 approved a seven-story condominium apartment at the JIB Club, Inc. an existing one-story complex, After hearing the protests of residents,one commissioner .changed his mind arid~the approval never was confirmed. JIB Club, Inc, then sued the County, A Circuit Judge rules? that the County had changed its mind improperly and ordered that the highrise be allowed, The County Commissioners then voted to take the matter to the 4.th, District Court of Appeals and that is where it is now. P~tr, Heinz von Zabern, JIB Club, Inc. President told Council that he would give a deed restriction to the Village limiting the height to five (5) stories at the time of the second reading of the Ordinance annexing his property (December 27, 1979). Trdhen asked by Councilmember Cook if the Annexation Committee had looked into this petition and request,P•'Tr. Blodgett, Chairman of the Annexation Committee, tald Council his Committee has never been asked to give a list of pros and cons about the possible JIB Club annexation, Several people from Jupiter Inlet Colony including Mr. Tom Roth, Elda Crimon and Frank Britt spoke about the annexation. . A T~Is, Rosemary Troy, Jupiter, also spoke to the annexation. t~Tr, Roth asked if the ten (10) boat slips allowed for the marina would be included in the count for the remainder of the units for the condos. i~'Trs. Crimon was against the annexation and I~1r, Britt was in favor of the annexation and of the proposed building, P~'ir, Dick Hutchison, President of Beach Road Association told Council that the Association is in favor of the annexation and of the condo being built. The Village Attorney read in full, with the exception of the legal description an ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, ANNEXING CERTAIN PARCELS OF LAl`TD TO THE TERRITORIAL LIMITS OF THE VILLAGE OF TEQUESTA (JIB Club , Inc. ) l~~Tapes moved, "the adoption of the first reading of the Ordinance". Ryan seconded and vote on the motion was: Brown -for Cook -for T~•Za pe s -f o r Ryan -for and therefore the motion Teas passed and adopted, The Village PJZanager reviewed with Council the proposed Shady • Lane Subdivision on Point Drive. The Village Manager told Council that the proposed subdivision generally conforms to the requirements 11-27-79 -0~ • of Article II - Procedure For Plat Approval, Section 1. General- Pre-Application Procedure - Sketch Plan. The Village Manager told Council that the entire street, in effect, is a cul-de-sac. The Jupiter-Tequesta Fire Control District and Nichols Sanitation, Inc. have both advised the Village that the cul-de-sac does not present a problem as long as cars do not park on the paved portion of the cul-de-sac. P~~apes moved, "to accept the sketch plan as submitted and direct the Developer to go on with the next steps of the prelimary plat plan", Cook seconded and vote on the motion was: Brown -for Cook -fir Mapes -for Ryan -for and therefore the motion was passed and adopted. Council set a Special Council Meeting for December 27, 1979 at 7:00 P.NI. for the second reading of an Ordinance to annex the JIB Club , Inc . The meeting was adjourned at Q:1a.5 P.M.
