n MINUTES OF THE T~fIEETING OF THE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA December 11, 1.x'7° A Meeting of the Council of the Village of Tequesta, Florida, was held at x:35 P.M., Tuesday, December 11, 1~7~, in the Village Hall, 357 Tequesta Drive, Tequesta, Florida. Council.members prevent were Brown, Caok, Mapes, Ryan and Yoder. Also present were Robert Harp, Village T•'Ianager, Cyrese Colbert, Village Clerk and John C. Randolph, Village Attor.•ney. The opening. Prayer and Pledge of Allegiance to the Flag; Maas given by Counc;ilmember Ryan, The Village Attarney gave seci~nd reading of AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, PROVIDING FORA CHANGE IN ZONING CLASSIFICATION OF VARIOUS PARCELS OF LAND AND AMENDINCx THE OFI+ ICIAL VILLAGE ZONING TvIAP TO CONFORM TO THE VILLAGE LAND USE T~~IAP AS ADOPTED JULY 24, 1°7o bar title only. Ryan moved, "that ~4re approve the second reading of the OrdinancF with. the • excepti^,n ~f it;em ~3, the Donner nropert~Yr, als-~ T~Tith the excenti~n. Hof the railroad property items x`17, 21~., 25 & 27".T'~apes seconded and vote ~~n the m~~tion was: Brown -for Cook -for I~iapes -for Ryan -for Yoder -for ar~d therefore the motion: was passed and adopted. Yader then asked the Village Attarney if he could make a manor. to reconsider tine rrioti.or.. The Village Attarney advised that since Yoder was on the prevailing side of the vote he in fact could. make a motion to reconsider the previous motion. Yoder moved, "to reconsider the previol.zs motion". Ryan seconded and vote on the motion was: Brown --for Cook ®~~, :~nst Mapes -far Ryan -for Yader -for and therefore the motion was passed and adopted, • Yader eyplained that what lie had. intended to do way adopt the entire Ordinance to campl~r ~~rith the Land i)se Plan but in voting for the original motion he had not dote o. He felt the nnl~r 1?nd that sho~.zld be excluded. U.ras the railr-gad pr~^perty beca~_ise of the misw,ordin~, 12-11-7° -02 Yoder moved, "to adopt the Ordinance excluding the railroad . property previously mentivr~ed". Cook seconded. R,~Tan then moved, "to amend the motion. excluding the Donner property, item ~3, also". Cook seconded the motion amendrr~ent, Vote on the amendment was: Brown -against Cook -for T~~lanes -for Ryan -for Yoder -against the amendment was t'.~erefore passed and ad~~pted. Vote nn the original motion was: Brown -against Cook -far P~Za *~e s -f o r Ryan -_for Yoder -against the original motion was also therefore passed and adopted and Ordinance No, 275 was passed and adopted excluding items ~3, ~17, X24, X25 and. X27. The next item on the agenda was the Status Report an Drainage and. Street Resurfacing Program by Jahn Wise, Gee 8c Jenson. fir, r^Jise had reported that the work on the Dover Road drainage ditch was • still at a stand still because Jupiter would not allow the contractor to start work on the drainage ditch, Mayor Brown asked tr:e Village Attorney, what action: the Village could. take if Jupiter became unreasonable in their request grid does not allow the work to be done, The Village Attorney told Council that if the Vi1_lage sees that Jupiter is being unreasonable then we! could have the court order a "Declaration Relief" ordering; Jupiter to issue tree necessary permits. Mr, V~'ise recommended the Village wait for an answer from. Jupiter before proceeding with any court acta.on, Mr. ~~v'ise informed Co~znc~_1. that the ~~ork was still ~rnceedin~•, in the Country Club area and that the contractor ~a~~~zld start nn the i~cComb/Black easement the next da~r, i~2r, Sandy Nettles, Gee & Jenson, t~~ld Council that, their investigations for the S6~TI1!~2 Program have indicated the possibility of two distinct aquifer units in the Tequesta area, Gee & Jenson. recommended that a ~s~e1.l develorment program be implemented to clean each of the monitor wells to their original total depth. TUZr, Nettles told Council that out of 29 we11s only 4 wells can be depended on for their data. Gee & Jenson had offered two alternatives for having this redevelopment work done. Pair, Nettles advised that the A.E.C,O.A., Inc. firm is the only one that indicated • any desire to do the work. The cost of Alternate No, 1 is $7,907.75 and the cost of Alternate No. 2 is $4,242,95, Mapes moved, "that we instruct Gee & Jenson to clean out the 29 wells in Alternate No. 2 in the amount of $4,21~2,~?5r', Yoder seconded and vote on the motion was: 12-11-?~? -03 • Brown. -f~~r Cook -fn r. Mapes -for Ryan -for Yoder -for and therefore the motion ~~aas passed and adopted, The Building Official told Council. was requested for the building addition Center. The Building Official informed Council. that the parking is adequate and traffic between the Village Square Shopping Center and the proposed building is to be changed to ane-way traffic. Mrs. Ruth Butterfield, Community Appearance Board Chairman told Council that the CAB .felt this building-_r would enhance this corner anal do away with a no?~ existing unsightly dumpster. • Ryan moved, "that we make the written findings with nn adverse comments ar,d that the apz~lication be annroved". Cook seconded and vote ~n the motion was: Brown -for Cook -for Mapes -against Ryan -for Yoder -fr?r and therefore the motion vaas passed and adopted, The Village Attorney read 'Tby title onl " an ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING TH~ ADOPTED COMPREHENSIVE PLAN OF THE VTLLAGE OF TEQUESTA. The Ordinance provides for change in the Land Use for Blowing Rock Condominium, Lots 2 and 3, Block 2, Jupiter in the Pines Section "C" and Cunningham Court Jupiter Island. The Village Attorney explained that this Ordinance amends the land use of the three parcels of land described in the Ordinance. Mapes moved, "for adoption of the first reading of the Ordinance", Ryan seconded and vote on the motion was: Brown -for Cook -for Mapes -for Rran --for Yoder -for and therefore the motion was passed and adopted, The second reading 12.11-79 -04 of the Ordinance is scheduled for Januar~T ~, 1Q~0. • Mayor Brown to]_d Council that the Town of Juno Beach has expressed their desire to become a member of the Loxahatchee Council of Governments and the Town of Juno Beach has submitted a Resolution agreeing to the membership and conditions of C.O.G. The residents of the area surrounding; the Loxahatchee River are served by six Governmental entities, if Juno Beach were to become a member of C.O.C~, then it vaould bring the total membership of C.O.G. to the entire six Governmental entities. The Village T~Ianager read, "by title only" a RESOLUTION OF THE VTLLAGE OF TEQUESTA, FLORIDA, CONCURRING THAT THE TOWN OF JUNO BEACH, FLORIDA BE INCLUDED AS A I~~IEMBER OF THE LOXAHATCHEE COUNCIL OF GOVERNMENTS (COG) AND THAT TriE VILLAGE OF TEQUESTA'S REP.RESENTATTVE TO THE LOXAHATCHEE COUNCIL OF GOVERNMENTS (COG) BE AUTHORIZED TO VOTE FOR SAME. Yoder moved, "that we adopt this Resolution". Manes seconded and vote on the motion was: Brown -for Cook -for Mapes -for Ryan -fo r Yoder -for and therefore Resolution No, 3-79/x'0 was passed and adopted, • The next item on the agenda was the consideration of a Temporary Develapers Sign for Shady Lane. The Village rflana~er ir_formed Council that the Community Appearance Board at their December 5, 1979 meeting unanimously approved the Temporary Developers Sign. as submitted. P~rtapes moved, "thy temporary signs be approved for six (h) months", Ryan seconded and vote on t•he motion ~~~as: Bro~~m -f o r Cook -for Mapes -for Ryan -f o r Yoder -_for and therefore the motion was passed and adopted. Cook moved, "that we approve William G. Wa_,ner to the Village Zoning Board of Adjustment fora three ~3) year term commencing January 1, 19$0". Ryan seconded and vote on the motion vaas: Brown -for Coale -for P~'~,apes for Rvar. -for Yoder -for • and therefore the motion. was passed and adopted. " ~ ~ 12-11-79 -05 D'Iapes moved, "that we appoint Stephen L. Oldham and Bob Woschnik • to the Building Board of Appeals and Roger W. Fulling to the Housing Board of Appeals for three (3) year terms, effective January 1, 19$0. Ryan seconded and vote on the motion was: Brown -for Cook -for Mapes -for Ryan -for Yoder -for and therefore the motion was passed and adopted. Cook moved, "that we approve the County/City Recreation Development Funding Agreement and authorize the-Mayor to execute the same", Mapes seconded and vote on the motion was: Brown -for Cook -for Ma pe s =f o r Ryan -for Yoder -for • and therefore the motion was passed and adopted. Council agreed that the Village Employees should receive a Christmas Bonus and Council wished the Employees a "Merry Christmas". Leslie A, Cook W, Harvey Mapes PETITION ~~ ~~ ~- ~ d'"'° We, the residents of Tequesta Pines and. residents Qf Willow Road, and residents of surrounding areas.in Tequesta, hereby. strongly oppose the rezoning of 11.08 acres located in Section 30, Township 40 South, Range.. ~3 East, Palm Beach County, Florida, bei that part of the SW 1/~ of NW 1/4.st of Florida East Coast Railway. right-of-way as in ©RB214.5, P1654 from R-1 (Single Family) to R-2 Multiple Family). We feel that-the impact of multi-family housing in this area would be an additional burden on increased traffic and con- gestion in the Tequesta area; a burden on our schools which.. are already on a tract system due to overcrowding; lack of :~ privacy created by more -than one-story construction. We have purchased lots and homes in this area with the under- standing that this parcel of land was zoned R-1 and we feel this is an unjust and unnecessary encroachment upon our rights as homeowners in Tequesta. In addition,, many of us have purchased homesites in Tequesta Pines because of its "natural state.." Many of the builders have cleared away only those pine trees that were necessary leaving the building :sites very wooded and natural.. This ecological :state would be impossible to maintain if multi-family units were to be built.: , We are also very concerned about lowering our property values if multi-family units arq allowed:~ta be built.
