MINUTES OF THE SPECIAL MEETING OF THE COUNCIL
OF THE VILLAGE OF TEQUESTA, FLORIDA
December 27, 1979
A Special Meeting of the Council of the Village of Tequesta,
Florida, was held at 7:00 P.M., Thursday, December 27, 1979,
in the Village Hall, 357 Tequesta Drive, Tequesta, Florida.
Councilmembers present were Brown, Mapes and Ryan, Councilmembers
Cook and Yoder were out of town, Also present were Robert Harp,
Village Manager, Cyrese Colbert, Village Clerk and John C. Randolph,
Village Attorney.
Mayor Brown welcomed everyone to the meeting. He also told
people in the audience that the Village Staff would speak first,
then Council and then it would be opened to the Public. Anyone
from the audience wishing to speak would be allowed to do so
after raising their hand, then each person would come to the
podium, state their name and address, and anyone having a question
of the speaker should also raise their hand. A five minute time
limit was placed on each speaker,
• The Village Attorney announced that the Special Council
Meeting was called for the p~,~pose of having the second reading
of an Ordinance annexing the JIB Club, Inc,
The Village Attorney, explained that this property, if
annexed, will be Commerical Zoning, but shall be rezoned-R-3
Multiple family dwelling upon the termination of two (2) years
from the effective date of the Ordinance or earlier if granted
by Palm Beach County Commissioners.
The Attorney also told Council that this proposed Ordinance
had been duly advertised four (1,.) consective weeks, December 1,~,
15 and 22, 1979 and that notice of this meeting was also published
with the ad, Notice of this meeting was also made at the last Council
Meeting and notice was posted at the Village Hall.
The Village Attorney reminded Council that because only three
(3) members of the governing body were present the vote has to be
unanimous.
The Attorney told Council that Mr, Heinz Von Zabern has offered
to submit to the Village a "Declaration of Restrictions"to become
part of the Ordinance,: The "Declaration of Restrictions" state
that "no building shall be constructed on the premiss in excess of
five (5) stories nor shall any major portion of the building itself
exceed 55 feet in height".

He also warned that the Council was not present to discuss
• any Site Plan Review or traffic pattern or building permit or
special exception. He said the Village could not guarantee a
Special Exception will be granted and Mr, Von Zabern is aware
of that.
The Attorney told Mr. Von Zabern he would like to see the
"Declaration of Restrictions" in force for a period of thirty (30)
years, an increase from the twenty (20) years it states in the
Declaration, Mr. Von Zabern told the Attorney he had no ob.iections
to the change.

The Mayor asked John Giba, Planning Consultant, if he had
anything to say. Mr. Giba said he had nothing to add that has
not been said in other meetings.
The Mayor then opened the meeting to the audience.
(In accordance with Robert's Rules of Order the Clerk will state

After everyone had had a chance to speak Mayor Brown then gave
the discussion back to Council for their decision,
The Village Attorney told Council he would like for them
• to decide if the "Declaration of Restrictions" should be part of
th"e Ordinance. He also wanted to know if Council agreed to change
the twenty (20) years to thirty (30) years.
Ryan moved, "to accept the "Declaration of Restrictions"

with the amendment that the time period be 30 years and successive
• 10 year terms thereafter until legally removed by the majority of
the property owners". Mapes seconded and vote on the motion was:

and therefore the motion was passed and adopted,
The Village Attorney read the Ordinance entitled, AN ORDINANCE
OF THE VILLAGE OF TEQUESTA, FLORIDA, ANNEXING CERTAIN PARCELS OF
LAND TO THE TERRITORIAL LIMITS OF THE VILLAGE OF TEQUESTA.
Mapes moved, "for the adoption of the second reading of the Ordinancett.
Ryan seconded and vote on the motion was:

and therefore Ordinance No. 276 was passed and adopted.
Before the vote was taken Councilmember Ryan asked Mr. Von Zabern
if the would consider a building with only three (3) stories
instead of five (5) stories. Mr, Von Zabern told Councilmember Ryan
that it would be financially unfeasible for hime to do that.
• The Village Attorney askew Mr. Von Zabern if he understood
