MINUTES OF THE MEETING OF THE COUNCIL
OF THE VILLAGE OF TEQUESTA, FLORIDA

The Public Hearing scheduled for 7:00 P.M. this same night
had adjourned at 7:06 P.M. and the Council Meeting was scheduled
for 7:30 P.M. so the Village Attorney told Council they could
dispose of the items under minutes and reports.
The Minutes of the 7:00 P.M. Public Hearing for December 11,
1979, the 7:30 P.M. Public Hearing for December 11, 1979 and the
Council Meeting for December 11, 1979 were received.
Under item X23 of the Village Manager's Report the Village
Manager told Council that in a meeting with the owner of Publix in
Tequesta Plaza, the owner has agreed to build two (2) decorative
walls, behind Publix. The Village Manager's Report for December 10-
22, 1979 and the Village Manager's Report for December 23, 1979 to
January 5, 1980 were both received. The Village Financial Statement
and the Water Department Financial Statement for November, 197
were received.
The~time was now 7:32 P.M. and Mayor Brown called the
meeting to order of the Council of the Village of Tequesta, Florida,
at 7:32 P.M., Tuesday, January $, 19$0 ire the Village Hall, 357
Tequesta Drive, Tequesta, Florida. Councilmembers present were
Brown, Cook, Mapes, Ryan and Yoder. Also present were Robert Harp,
Village Manager, Cyrese Colbert, Village Clerk and John C. Randolph,
Village Attorney.
The opening Prayer and Pledge of Allegiance to the Flag was
given by Councilmember Ryan.
John Giba reported that he had talked with Rinkers and they
had expressed their unhappiness with their present plant because
the Village and they do not agree with certain alterations they
would like dor~eand the present plant is obsolete. He also told
Council that Martin County Commissioners have prepared a Resolution
to buy 30 feet of;property from the Department of Natural Resources
in the Girl Scout park and to condemn 10 feet of the Martin Little
Club's property which will permit them to go to the Department of
Environmental Regulations and talk to them about the building of a
connector road through there.
Mr. John Wise, Gee & Jenson; was present to give Council an
update status report on the drainage and street resurfacing program,
• Mr. Wise told Council that the overall program seems to be under
control and he is very pleased. He gave the following breakdown

Riverside Drive culverts- work has begun and should be completed
next week, Drainage Ditch, Dover Road area- should be cleaned next
week, Seabrook cleaning- should also be cleaned next week, Country
Club Drive- no activity this week on the resurfacing and drainage in
the area. Mayor Brown asked if this was holding up the bicycle path
on Country Club Drive. The Village Manager said it was not, that
we were waiting on the county. The Village Manager also told
Council that Mr, Morley, Palm Beach County, was making his recommend-
ations to the County at a ..January 15, 190 meeting and that the
bicycle path on Country Club Drive would be top priority. On the
Denver Road area Mr, Wise told Council that the contractor did a
computor analysis on the incorrect drainage installed in that area
and as it stands now there would be drainage in that area to relieve
it of high waters but does not match up to the basic design. The
contractor is willing to make a cash settlement if allowed to keep
the drainage "as is". Council expressed its strong feeling to
be relayed to the contractor that they want the work done to the
specifications. On River Drive - Mr, Wise told Council that there
was minimum damage done to the area and that there are some minor
clean ups that have to be done,
Council instructed Mr. Wise to check into other areas in the
Village that need resurfacing work started and to have ready for
Council at their next meeting a draft schedule on how long it would
be before the work can be done,
• Mr. James D, Hinchliff, President of the Blowing Rock Condominium
Association, told Council he and the other members of the Blowing
Rock Condominium Association were present to protest the address
change of their condominium made by the Building Official from
500 Beach Road to 1500 Beach Road. The Association feels that the
change is unecessary and unwarranted. Mr, Hinchliff told Council
that the address change would cause a lot of inconvenience for the
residents of Blowing Rock, He named a few examples of things that
the residents needed to change ie; bank accounts,credit cards,
stationery,
The Village Manager told Council that when the Pontifical
Institute for Foreign Missions was annexed into Tequesta the Building
Official changed the address of Blowing Rock to obtain uniformity
in the numbering system on Beach Road.
Mapes commented that he feels the way in which the people were
notified is not the way the Village of Tequesta should do things.
He was referring to the letter dated November 16, 1979 sent. to the
property owners of Blowing Rock Condominium,
James Coble, Tequesta Association of Voters and Taxpayers told
Council the Tequesta Association of Voters and Taxpayers supported
the rescinding of the address change.
The Building Official told Council he feels the Building
• Department has a pretty good rapport with .the people of the Village.

The Building Official cited different Building Permits that had
• been issued for various work done on the building at Blowing Rock

Mapes moved, "that the Village Manager use the numbers 400
and 500 Beach Road to maintain the 500 Beach Road the way it is
nova". Cook seconded and vote on the motion was:

and therefore the motion failed.
The Village Attorney gave second reading of an Ordinance
entitled, AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA,
AMENDING THE ADOPTED COMPREHENSIVE PLAN OF THE VILLAGE OF
TEQUESTA, which provides for change in Land Use for Blowing
Rock Condominium; Lots 2 and 3, Block 2, Jupiter in the Pines,
Section "C" and property owned by Pontifical Institute for Foreign
Missions, Mapes moved, "the adoption of the second reading of the
Ordinance". Cook seconded and vote on the motion was:

and therefore the motion was passed and Ordinance No. 277 was
passed and adopted on second reading,
The next item on the agenda was the first reading of an
Ordinance entitled, AN ORDINANCE OF THE VILLAGE OF TEQUESTA,
AMENDING THE ADOPTED COMPREHENSIVE PLAN OF THE VILLAGE OF TEQUESTA
which changes the present land use of the F, Reed Fitton. property
from Institutic~al to Single Family. The change was necessitated
because of an error in the layout of the land use plan, Mapes
moved, "the adoption of the first reading; of the Ordinance".

and therefore the motion was passed and adopted,
• The next item on the agenda was the discussion of petitioning
the Board of County Commissioners for Zoning changes for various
properties annexed to the Village. There have been seven (7)

parcels of land annexed into Tequesta recently. In accordance
• with Florida State law these have been annexed to Tequesta with
a County Zoning, The Village Attorney and Village Manager felt
it best to petition Palm Beach County for Zoning reclassification
to conform with the Village Zoning for these seven (7) parcels of
land. Councilmember Mapes asked if there was need to hurry on
any of these parcels of land.
John Giba, Planning Consultant, told Council he thinks its
good business to move this forward because he feels the Village
needs to clean up the Zoning Map,
The Village Attorney advised from his legal standpoint the
Village should petition Palm Beach County now, Yoder moved, "that
we proceed with all the parcels that we have annexed as described
in the memo from the Village Manager to the Council of January 2,
19b0 (see attached)", Cook seconded and vote on the motion was:

• The Village Attorney also told Counc~.l that in th€: future.
should someone petition- to come _i.nto the V~~.~age, he feels, they
should petition first Pa~.~r~ Beach ~:.`~ounty for a :zoning change
before petitioning the Village for annexation of their property.
The Council gave their approval for the next person(s) that
request to be annexed to seek County`s a~?~roval for zoning change
first. This way Council could see how it works,
The Village Attorney told Council that he, the Village
Manager and the Village Building Official reviewed the Lighthouse
Plaza, as instructed to do so by Council,. He told Council that
he basically went back to the first letter from Mr. Stanley Harte
to see what improvements Mr. Harte had promised to do. Mr. Harte
had agreeded to fix the parking lot, replace broken tile, remove
trash from parking lot, install fire signs in fire lane, plant trees
and grass in strip on either side of the entrance and exits and
so far as he could see all the things, with the exception of the
the replaced broken the have been complied with, He informed
Council he could advise Mr. Harte that these missing tiles are
a safety hazard and the Village would like them replaced. The
Village Attorney said he was thinking of drawing up an Ordinance
that would bring the commercial areas up to the other areas in
Tequesta as far as looks and landscaping are concerned. Council
told the Attorney they would like very much to see an Ordinance like
that.
• Councilmember Yoder presented Council with a written statement
he had prepared on his question should the Village support the
Jupiter Inlet District in its efforts to further open the river
estuary by constructing a channel 900 feet long by 100 feet wide?

In his statement, Yoder said that because shrimp grass has been
• found in the river it has become a controversial issue. Yoder
said that if the dredging is allowed there will be no channel where
there was no passage before, there will be no filling, no
bulkheading and no heavy usage of power craft. He told Council that
the Village has put their money on the line by donating Plantreat
to ENCON and by bringing the Village's storm drainage system up
to the quality required by the environmentalist of today. He
presented to Council a Resolution entitled, A RESOLUTION OF THE
COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, IN SUPPORT OF THE
JUPITER INLET DISTRICT'S REQUEST TO CONSTRUCT A CHANNEL 900+
FEET LONG AND 100 FEET WIDE IN THE WATER OF THE LOXAHATCHEE
RIVER ESTUARY, Yoder moved, "that we adopt this Resolution".

and therefore Resolution No. ~.-79/0 was passed and adopted,
Yoder moved, "that the Village's representative be authorized
to present a recommendation to COG that such a Resolution be adopted
by COG". Ryan seconded and vote on the motion was:

Mapes moved, "that the Mayor be authorized to continue the
meeting until 10:30 P.M.". Yoder seconded and vote o.n the motion was:

The next item on the agenda was the Job Description for
Finance Director. Yoder asked the Village Manager how he felt
about the Job Description for Finance Director, The Village Manager
replied he doesn't see anything wrong with it, Mapes moved,
"that the Council approve this ,job description for Financial
Director", Yoder seconded and vote on the motion was:

• Mapes moved, "that the Village Manager be instructed to form
a Committee to seek a Financial Director to be hired for the Village
of Tequestat1. Yoder seconded and vote on the motion was:

and therefore the motion was passed and adopted. Council recommended
the names of Ken Reems and George Becker as possible Committee members.
The Village Manager told Council that there are two buildings
at the Plant rest Plant that the Building Official and himself will
look over to see if the buildings could possibly be used by the
Village after ENCON hay razed the area.
Giba has written a new chart for the Zoning Ordinance and
has proposed changes to the Zoning Ordinance which have been
presented ~o Council for their review. A workshop is needed to
review the proposed changes made so far by Giba. Council set
a Workshop for Tuesday, January 15, 19f~0 at 4:00 P.M.
Yoder moved, "to accept Mrs. Patricia S. Anderson's resignation
from the Zoning Board of Adjustment, with regret", Cook seconded
and vote on the motion was:

Subject: Petition to Palm Beach County - Zoning for Annexed Parcels of Land
Date: January 2, 1980
The Village Attorney will discuss the referenced subject under
his items at the January 8, 1980 Council Meeting.
The records indicate the following parcels of land have been
annexed to the Village of Tequesta as noted, and would require the approval
of the Board of County Commissioners for requested zoning classification,
if desired, prior to the two (2) year period:
Parcel No. 1 January 9, 1979 -
That portion of the Northwest Quarter of the Northwest Quarter
• of Section 30, Township 40 South, Range 43 East,_being triangular
( in form, lying adjacent to and Southwesterly from the Westerly
right-of-way line of Florida East Coast Railway, said land
situate, lying and being in Palm Beach County, Florida.

Petition requested zoning classification: R-2
Land use pursuant to Plan adopted July 24, 1979 - Medium Density
Palm Beach County Zoning - RS - (Residential Single Family District}
Note: This small parcel (approximately .28 acres) abuts the
11.08-acres on the-north that was not rezoned from R-1 to R-2
by Ordinance No. 275, passed and adopted December 11, 1979.
You will-note that both parcels are in the same ownership. `
If the Village Council should determine that this garcel should
remain R-1 Single Family Dwelling Classification under the
Village Zoning Ordinance, procedures should be commenced to
amend the adopted Land Use Plan from medium density (5.5 - 13
dwelling units/acre) to single family (0-3.6 dwelling units/acre).
