MINUTES OF THE MEETING OF THE COUNCIL
OF THE VILLAGE OF TEQUESTA, FLORIDA
February 12, 19f~0
A Meeting of the Council of the Village of Tequesta, Florida
was held at 7:30 P.M., Tuesday, February 12, 190 in the Village
Hall, 357 Tequesta Drive, Tequesta Florida. Councilmembers
present were Brown, Cook, Mapes, and Yoder. Councilmember
Ryan advised he could not be in attendance because of illness.
Also present were Robert Harp, Village Manager, Cyrese Colbert,
Village Clerk, and John C. Randolph, Village Attorney.
The opening Prayer and Pledge of Allegiance to the Flag
was given by Councilmember Cook,
Mai*or Brown announced Commissioner Peggy Evatt~s quarterly
meeting on March 3, 19~?0 at ?:30 P.P~~. Mayor Brown also announced
the T~-~a:~urc~ Coast Regional Planning C ~zxn~~:i.7~ Meeting at the
Jupiter Hilton on February 29, 19`'0.
The 1~linutes of the January 22, 1~~0 Site Plan Review and
January 22, 1Q~'0 Council Meeting were received. The Village
Manager's Report for January 20 - February 9, 19'0, the Village
Financial Statement for December, 1°?~ and the Water Department
Financial Statement for December, 1..9?~ were received.
t~Zr, Cotter Christian, Gee & Jenson presented Council with
the projected cost for the Village's Capital Improvements Program
for drainage, street resurfacing and water system, The total
cost of the program was $1,463,060. This figure had an inflation
factor of 15~ added to it. Mr, Christian told Council that he
has seen as high a figure as 25J quarterly inflation in some cost
to the other projects. But he feels 15~ inflation cost is safe.
The Capital Improvements program consists of six (6) projects,
drainage improvements, street resurfacing program, water supply
improvements Phase I, Intracoastal crossing, treatment plant
modifications and the S.W.I.M.M, program. The total program
is scheduled for an early 1~?F~2 completion,
Mr, Christian also gave Council the estimated construction
costs for the additional transmission main from Jupiter, The
total cost being $641,000, but with a credit of $99,550 from
Jupiter the net costs of the transmission main would be $541,450
with the capacity charges being negotiable,
A Council Workshop meeting was set for February 19, l~`~0 ~~~

1:00 P.M. to hear from Joe B. Wise, William R. Hough & Company
• for the consideration of a possible Bond Issue proposal,
Peter Baron, told Gee ~ Jenson he didn't understand why they
are now telling the Village it should improve on it own water
system, when they told the Council., vahen he was on Council, that
Tequesta should buy water from Tri-- Southern (now Jupiter Water
Company).
Mayor Brown explained t~-lat that was fora short term program.
What Council is dealing with now is for a long range program.
John Giba, told Council that his comments to Council would
be on the latter part of the Agenda.
The Village Attorney explained that the Ordinance amending
the Comprehensive Plan was for changing the Fitton Property
from Institutional to Single Family for the Comprehensive Plan.
The Attorney read the Ordinance by title only, entitled AN
ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA AMENDING THE
ADOPTED COMPREHENSIVE PLAN OF THE VILLAGE OF TEQUESTA. Mapes
moved, "for the adoption of the second reading of the Ordinance".
Yoder seconded and vote on the motion was:

and therefore Ordinance No. 27~ was passed and adopted.
Peter Baron told Coun.ril that he attended the County Commission
Meeting in regard to the floating; of a Bond Issue for street
resurfacing throughout the County and maybe the Village could
receive some of these monies.
The Village Attorney read an Ordinance regarding the financial
disclosure requirements and compensation of Councilmembers. The
Village Attorney advised that the Village Charter prohibits a
Councilmember from receiving an increase in salary which is
adapted during the term for which he was elected, but in the
Attorney's opinion the Charter requirement would not prohibit
a Councilmember from receiving travel and per diem. during the
term for which he was e3-eetnd. The Village Attorney suggested
that the Council not do anything at this time
regarding anticipated char?gLs in the financial disclosure require-
ments by the Legislature, Yoder told other Councilmembers
that the reason he brought the matter up was to make other
people who may think about running for Council feel it was a
little more worth their time if the Councilmembers fees were
increased. Council agreed t.o leave the Councilmembers fees the
way it is now. But Councilmember Mapes told the Village Attorney

The Village Attorney read in full a Resolution entitled,
• A RESOLUTION OF THE VILLAGE OF TEQUESTA, FLORIDA ESTABLISHING
P~IARCH 11, 190 AS THE DATE OF THE 190 GENERAL ELECTION.
Mapes moved, "for the adoption of this Resolution". Cook
seconded and vote on the motion was:

and therefore Resolution No. 5-79/0 was passed and adopted.
The Village Attorney told Council that Mr, Heinz VonZabern
has called h.im and requested that Council review his special
exception for the marina facilities, But the Attorney said it
~~~as his understanding that the Special Exception would be heard
either after the County waived the Zoning classification change
or the two (2) year waiting period had lapsed, However, he
has advised Mr. Heinz VonZabern that Council could consider
the Special Exception if they so desire. The Attorney also
reminded Council and Mr, VonZabern that Mr. VonZabern was
well aware of the fact that Council could not guarantee the
Special Exception for his Marina before his pr. operty was
annexed. Council told Mr, VonZabern to get with the Village
P•7anager and submit the Special Exception request to him for
the office review and Council directed the Village P~ianager
. to set up a Public Hearing on the Special Exception for 7:00 P.M.,
February 26, 190 for the JIB Club, Inc.
Mr. Paul Compare told Council he would like to put a small
office building on Lot 22, Block 2, Jupiter in the Pines, Section
"C", (southeast corner of Tequesta Drive and Fiesta Avenue)
He said it would be a small building with adequate parking and
shrubbery. The Village P~Zanager reviewed his memorandum to
Council dated February 6, 190 in v~hich he stated, "the request
has been reviewed by this office arzd the Planning Consultant
and it is our opinion that the request is not consistent with
the Village's Comprehensive Plan and that the existing medium
density land use and R-2 Zoning is the most appropriate use
for this property". P~Zapes moved, "that the request for
the rezoning of Lot 22, Block 2, Jupiter in the_
Pines, Section "C" .from R-2 Multiple Famil~,T Dwelling Classifi-
cation to C -1 Retail Commercial Classification be denied"
Yoder seconded and vote on the motion was:

and therefore the motion iras passed and adopted,
• Mr, Paul F, Corell, Beach. Road, told Council that when he

approached the Florida State Department of Transportation
• requesting that draw bridges in this area operate nn an
opening schedule that ti~~ould minimize the time that the highway
is closed to traffic to his surprise the D.O.T. was very happy
to hear this, because they would like to see it also. Mr. Corell
told Council that bridge tenders for the bridges in this area
have been taking boat's license numbers of those not removing
their outriggers and have been notifying them. by letter to remove
same before approaching a bridge. This they feel would eliminate
some of the openings.
P~iayor Brown told Council that C.O.G. feels that each municipality
should adopt a Resolution in regard to the bridges opening and
closings in the area of the municipality.
P~lapes moved, "that the meeting be continued until 10:30 P.M.'t.

and therefore the motion was passed and adopted,
Council discussed the fact that the General Election and
Presidential Primary Preference Election falls on March 11, 19£0
• which is Council's first Council NTeeting date in March, Yoder
moved, "to approve March l~, 190 as the Council's first scheduled
Council Meeting in March". Mapes seconded and vote on the
motion was:

and therefore the motion was passed and adopted.
Cook discussed with Council the possibility of a County owned
and run swimming pool in the Jupiter-Tequesta area. She told
Council that C.O.G. has supported a Resolution in favor of such
a project. Cook moved, "to go on notice that we are in favor of
the construction of the community swimming pool in the North
County area". Mapes seconded and vote on the motion was:

Under Councilmember's Report, Yoder asked the Village Manager
• about a letter some residents were receiving about a new alarm
system installed in the Police Station. Yoder wanted to know
why this was handled the way it was with no notice being sent
to the residents before the new system was installed. He requested
the Village Manager check into it.
Yoder also told Council he believes the Village should take
a stand on the Governors move to continue the 5J tax lid.
Yoder expressed his appreciation of a job well done by
John Giba as Planning Consultant to the Village and was sorry
to hear that Giba was not going to renew his contract.
Yoder also expressed concern over a memorandum sent to
Council from John Giba, on release of certain documents on file
in the Village pertaining to him,.. Yoder expressed concern that
these documents were just given without request to a person or
persons over the counter. Cyrese Colbert, Village Clerk, told
Council these documents were requested and in accordance with
Florida law copies were made available. Council agreed that
the Village Manager and Village Attorney should draw up a
procedure on releasing of certain documents within Village .files.
The Village Attorney informed Council that Florida law does
state that Public documents are open to the Public, but certain
items such as personnel files are a "grey area".
The Meeting was adjourned at 10:36 P.M.
