MINUTES OF THE MEETING OF THE COUNCIL
OF THE VILLAGE OF TEQUESTA, FLORIDA
May 13, 1980
The Village Attorney told Council they could commence with
routine items on the Agenda now since there was still time left
til the 7:30 P.M. Council Meeting. Council received the Minutes
of the Council Meeting for April 8, 1980 as corrected, the Village
Manager`s Reports April 6 - 19 and April 20 - May 10, 1980 were
received. Council also received the Village and the Water Department
Financial Statements for March, 1980.
A Meeting of the Council of the Village of Tequesta, Florida,
was held at 7:30 P.M., Tuesday, May 13, 1980 in the Village Hall,
357 Tequesta Drive, Tequesta, Florida. Councilmemberspresent
were Cook, Little, Mapes, Ryan and Stoddard. Also present were
Robert Harp, Village Manager, Cyrese Colbert, Village Clerk and
John C. Randolph, Village Attorney.
• The opening Prayer and Plege of Allegiance to the Flag was
given by Vice-Mayor Stoddard.
Item 4d. Payment of Water Main Replacement was added to the
agenda and approved.
Mr. Fred E. Singer, Assistant County Engineer told Council
he was here to discuss and answer any questions Councilmembers
may have on the transfer of County Roads, within the Village, to
the Village. He told Council that the Village Manager's memorandum
to Council dated May 7, 1980, on the subject, was very self
and there was little more he could add. In the memorandum
the Village Manager reminded Council that under Rules of State of
Florida Department of Transportation Chapter 14-12, transfer of
jurisdictional responsibility for operation and maintenance of functionally
classified County roads within the municipality is to be completed no
later than July 1, 1982.
Mr. Singer felt that if the Village expressed its intent to make
the required transfer the County could provide funds in their budget
to make necessary repairs and resurfacing of the roads to be transferred.
Mr. Roger Fulling, resident, asked Council if the County would
drop some of the tax millage collected from the Village if the County
would no longer take care of the roads thru Tequesta.

Council also expressed concern that the Village does not have the
• personnel or the equipment to properly maintain the brige on Tequesta
Drive over the Loxahatchee River. Little moved, "we accept the roads
with the provisos that the streets be repaired and maintained to a point
of being accepted by the Village Manager and that a satisfactory agreement
be entered into between the County and the Village of Tequesta regarding
the maintenance of the bridge and the ditch". Stoddard seconded and
vote on the motion was:

Dr. Stanley Jacobs, President, Tequesta Country Club Community
Association read a letter addressed to the Mayor from the Association.
The letter was in reference to the Connector Road - County Line Road
to Country Club Drive. The Board of Directors for the Association
adopted on April 14, 1980 a resolution asking that the Village Council
appoint a special attorney to represent the Village at a hearing before
the Governor and the Cabinet on the connector road. The Board of
Directors agreed in ':.the resolution to contribute up to $250. toward
the expense of employing such an attorney. The Village Attorney had
announced previously that he could not represent the Village in this
• matter because of a conflict of interest.
Mr. Robert Moore, Country Club Drive, spoke to Council of the
importance of hiring this Special Attorney.
Mr. James Coble, President, Tequesta Assocation of Voters and
Taxpayers, told Council the Tequesta Assocation of Voters and Taxpayers
favor this connector road and will help by contributing up to $250. for
the expense of hiring a special attorney.
Mr. John Giba, resident, told Council he has been involved in this
for the past two (2) years and believes that a connector road is the
answer to this problem.
Mr. Tom Russo, Little Club Homeowners Association, spoke highly of
the law firm that the different Associations felt they wanted to hire to
be the special attorney and told Council he was glad the Village of Tequesta
is interested in the problem of a connector road.
The Mayor asked the Village Attorney if the Council could spend the
Village's money for a project outside the Village limits. The Attorney told Council
he felt they could because it is in the best interest of the Public that they
do so. Stoddard moved, "that the Village of Tequesta retain the firm of
Crary, Buchanan and Meginniss of Stuart to represent us in meetings with
the State Administration, the Governor and his Cabinet and that we accept
• the offer of the Tequesta Association of Voters and Taxpayers and
Tequesta Country Club Community Association to contribute toward the
necessary fund and that we also share this with the Little Club Home
Owners Association". Ryan seconded and vote on the motion was:

and therefore the motion was passed and adopted.
Mr. Roger Fulling, resident, praised past Council and present
Council for the projects that are being done and that have been done.
Mayor Mapes complimented EN CON because they have completed laying
the pipe down that is going into Bridge Road before the Villages' paving
contractor reached that area and thus preventing ENCON from tearing up the
newly paved road for the drainage pipe at a later date.
Councilmember Ryan praised Mr. Robert Moore and all of the work
he has done on the connector road.
Little moved, "that we accept the Site Plan Review for second
floor addition to Community Federal Savings and Loan Association
as submitted•(at the 7:00 P.M. Site Plan Review Meeting)". Stoddard
seconded and vote on the motion was:

and therefore the motion was passed and adopted.
Council approved May 21, 1980 at 5:00 P.M. as a Council Workshop
Meeting to be held with the Annexation Committee.
The Village Manager explained to Council the high interest received
from the Bank of Florida in St. Petersburg for deposit for Village Funds.
Stoddard moved, "that we approve the Bank of Florida in St. Petersburg
as Depository for Village Funds". Ryan seconded and vote on the motion
was:

and therefore the motion was passed and adopted.
'Che Village Manager told Council he had asked Mrs. Linda Otto if
she would serve on the Zoning Board of Adjustment and that she had agreed
and had submitted a resume, which Council received copies of. Ryan moved,
• "we appoint Linda Otto as a member of the Zoning Board of Adjustment".

The Village Manager explained his memorandum to Council dated
May 13, 1980 in which he had informed them that during the deepening
and widening of the drainage ditch running along the east side of
Seabrook Road it was necessary to lower two Water Main Crossings that
crossed the ditch from East to West Gee & Jenson had negotiated a price
of $7,000. for the work with E.N. P~urray, Inc. He recommended that
the payment be made from the Water Department Renewal and Replacement
Fund. Little moved, "we approve payment". Stoddard seconded and vote
on the motion was:

and therefore the motion was passed and adopted.
Council discussed with the Village Attorney the proposed full
• financial disclosure act. Most of Council were not in favor of the
full financial disclosure and instructed the Village Attorney to have
ready an Ordinance that would make it unneccessary that Council file
a full financial disclosure.
Vice-Mayor Stoddard expressed concern about an uncovered hole
at the Lone Star Piant. He said he had told the Police Department
and they were to notify Lone Star of the situtation.
The Village Manager informed Council that Phase I of the well
field testing and upgrading has -been completed and test was to begin
today.
