HomeMy WebLinkAboutMinutes_Regular_06/24/1980 IJIINUTES OF TIIE I~~'1EETING OF THE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA June 21~, 19$0 A Meeting of the Council of the Village of Tequesta, Florida, was held at 7:15 P,&I., (Village Attorney advised Council they could dispense with items such as the Prayer, Pledge of Allegiance and I~~linutes and Reports until 7:30 P.P~7,), Tuesday, June 24, 19$0 in the Village Hall, 357 Tequesta Drive, Tequesta, Florida. Councilmembers present were Cook, Mapes and Stoddard, Little and Ryan had advised they would not be present. Also present were Robert Harp, Village Manager, Cyrese Colbert, Village Clerk and Adams VJeaver, Johnston, Sasser and Randolph. The regular Village Attorney, John C, Randolph, had advised he would not be in attendance, The opening Frayer and Pledge of Allegiance to the Flag was given by Mayor Mapes, There were no announcements. • I~~Iayor Mapes requested the following be added to the Agenda: lb. Council Meeting i~iinutes for June 10, 19$0 1c. Site Plan Review Minutes for June 10 , 19$0 The additions were approved. The Village ManagerTs Report for June $, 19$0 to June 21, 19$0 was received. The Council Meeting I~Zinutes for June 10, 19$0 and the Site Plar ~,eview T'~iinutes for June 10, 19$0 were also received. State Representative tidilliam TTDoc" Meyers was present to discuss the recent Legislative Session with Council. Representative Meyers told Council of the Truth in I,~iill.age Bill (TRIP~I) , this Bill requires the Property Appraisers to assess roperty at the lOC'% accessment and give them a period of three (3~ years in which to do it. He told Council that if the governing bodies of Municipalities in the State of Florida elects to exceed the 10$~ increase over their present budget then it would take a vote of at least four in favor of the i_ncrease~ n'~`., r~fi_.,.- ,; _~:;.~.:-~e~:c~:: ~~.~!~. ~~:a-t~1 p.~._ _~;u.~.<.:~ ~r~~#~a He reviewed with Council several of the changes made and answered que~ations addressed to him from tree audience and from the Council. • I~~ir. Dick Sorenson, Jupiter Inlet DistrictTs Representative, told Council he' was present to ask for support of a proposed dock and pier control Ordinance. The Jupiter Tnlet District believes a Committee should be formed, one person from each~jf the municipalities and County in this area, to set up guide lines and restrictions for 06-24.-~30 -2 the docks and piers being constructed in the bodies of water in • this area. After the Committee has gotten all the necessary restrictions laid out, then the members could go back to the other Commissioners from their Towns and have their Attorney draw up an Ordinance fvr their Nhznicipality. Stoddard moved, "that we ask Joe Yoder to accept this position on the Board". Cook seconded and vote on the motion was: Cook -for T~Iapes -for Stoddard -for and therefore the motion was passed and adopted. I~iarsha Evans, Tequesta Pines, asked Council if something could be done to prevent the continuing unloading of large rocks near the Lone Star plant. Council told T~Ts. Evans they would heave the noise looked into. The Village Manager explained that this next Ordinance was brought about by annexation of parcels of larid from Palm Beach County into the Village of Tequesta. The zoning of these parcels from County Zoning Glassifications had to be approved by the Board of County Commissioners. They approved the Zoning Classification changes on April 22, 190, The Village TJlanager then told Council where the various-parcels of lands were while John Gibs pointed to them on the map. Cook moved, "that we adopt AN ORDINANCE OF THE • VILLAGE OF TEQUESTA, FLORIDA PROVIDING FOR A ZONING CLASSIFTCATION FOR VARIOUS PARCELS OF LAND AND AT~NDING THE OFFICIAL VILLAGE ZONING T~ZAP TO CONFORT~I TO THE VILLAGE LAND USE T~IAP AS ADOPTED JULY 2L,., 1979 on first reading", Stoddard seconded and vote on the motion was: Cook -for Nlape s -for Stoddard -for and therefore the motion was passed and adopted. The Village Manager told Council that Palm Beach County Police Chiefs Association is interested in having the "Police Applicant Processing Center" being continually funded and that the Center may not be funded this year due to possible cuts in Federal Funds for this purpose. A sample Resolution was sent to each T~'Iunicipality which indicated the support of the Palm Beach County Police Chiefs Association to sponsor special legislation or a local Ordinance option which would allow the imposition of an additional X1.00 fee on all fines and forfeitures, The Village T~Zanager read the Resolution entitled., t'A RESOLUTION • OF TIIE VILLAGE OF TEQUESTA, FLORIDA, TO THE BOARD OF COUNTY COT~~i~IISSI0T~IERS 06-2~-$0 -3 OF PAL1~~'I BEACH COUNTY; SUPPOt~.TI;~dG THE PALi~T BEACH COUNTY LAW EIvTFOftCEIL~NT • APPLICANT PROCESSING CENTER AND ENCOURAGING COUNTY FUhTDING OF THE CENTER SU?`°:r'~I~~'111L'G SPECIAL LEGISLATION OR A LOCAL ORDINANCE OPTION TO ENABLE PALM BEACH COUNTY TO GEPdERATE REVENUE FROM FINES AND FORFEITURES TO CONTINUE FUNDING THE PROGRAM; PROVIDING A1VT EFFECTIVE DATE.. Stoddard moved, "that we approve this Resolution as prepared and submitted and as approved by our Village Attorney". Cook seconded. the motion was vote on the motion was: Cook -for I~Tapes -for Stoddard -for and therefore Resolution No, 13-79/&0 was passed and adopted. The Village Manager explained to Council that Palm Beach County had been selected as one of the possible dumping areas for Nuclear Waste and that the Palm Beach County Municipal League had adopted an Ordinance opposing the disposal of hazardous and nuclear waste and urged qualified local agencies to retain their jurisidiction, The Village Tanager read by title a Resolution entitled: A RESOLUTION OF THE VILLAGE OF TEQUESTA, FLORIDA OPPOSING HAZARDOUS AND NUCLEAR utiASTE DISPOSAL IN ANY AREA OF PALiG'T BEACH COUNTY AND URGING THAT QUALIFIED LOCAL AGEI~~CIES RETAIN THEIR JURISDICTION OVER ALL HAZARDOUS WASTES. Stoddard moved, "that we approve the adoption of this Resolution. as submitted". Cook seconded and vote on the motion was: • Cook -for Mapes -for Stoddard -for and therefore Resolution No. 1.4-79/0 was passed and adopted. The next item on the Agenda was the approval of "Special Exception" for Jupiter-Tequesta Junior Citizens, Inc. Building. The Village T~-Tanager explained that since we had the Public Hearing on this matter prior ;o this Council T~~eeting, all that was needed n,_.a was a motion. Cook moved, nto approve the enlargement of the existing Special Exception Use for the Jupiter-Tequesta Junior Citizens to provide for the construction of an ~.0' x 25' storage room on the northwest corner of the existing building", Stoddard seconded and vote on the motion was: Cook -for ~~Tapes -for Stoddard -for and therefore the mction was passed and adopted. The next item on the agenda was the consideration of preliminary approval for Final Plat of Shady Lane Subdivision. Mr, Tim Messler • was present representing Shady Lane of Palm Beach County, Inc. 06-24-~0 -4 The Village Manager told Council that the Village's Engineers, Gee & Jenson gave their preliminary approval on November 3, 1979. • The Loxahatchee River Environmental Control District has also reviewed the plans. Stoddard moved, "that we give tentative approval of the final plat of Shady Lane Subdivision subject to the approval of the Village Manager and with the understanding the maintenance of the two (2) islands be taken over and assumed by the developer". Cook seconded and vote on the motion was: Not present June 24, 1930 Thomas J. Little Cook -for Mapes -for Stoddard -for and therefore the motion was passed and adopted.
