MINUTES OF THE T~~ETING OF THE COUNCIL
OF THE VILLAGE OF TEQUESTA, FLORIDA
July 22, 19$0
A T%Ieeting of the Council of the Va_llage of Tequesta,
Florida, was held at 7:30 P.T+l., Tuesday, July 22, 19$0 in the
Village Hall, 357 Tequesta Drive, Tequesta, Florida. Council-
members present were Cook, T~Zapes, Ryan and Stoddard. Little
had advised he would not be in attendance. Also present were
Robert Harp, Village Manager, Gyrese Colbert, Village Clerk
and John C. F~andolph, Village Attorney.
The opening Prayer arld Pledge of Allegiance to the Flag
was given by Vice-Mayor Stoddard,
T~Iayor T~~apes announced the meeting of the Zoning Board
of Adj,astment on July 2$, 19$0 at 7:30 P.T~T, in the Village
Hall. The purpose of this meeting was for the request of
Lone Star Florida, Inc, to rebuild their plant.
• Mayor T~lapes also announced the ~iiTo.rkshop Meeting of the
Palm Beach County Commissioners on Wednesday, July 30, 19$0
to hear the Fair Tax Council Report.
The Village Manager's Report for July '~, 19$0 to July 20,
19$0 was received. The Site Plan Review T~iintates for July $, 19$0,
the Public Hearing Minutes for July $, 19$0 and the CouncS_1
T~Zeeting T~inutes for July a, 19$0 were all. received.
The Village Financial Statement for June, 19$0 and the
Water Department Financial Statement for June, 19$0 were
received.
1','Tr. Sandy Nettles, Gee & Jensen. was present to report
on the status of the Vdater Suppl.~~ Test .dell Project. T~ir. PJettles
reviewed with Council his memorandum on groundwater ~ti=ithdrawal
system safe yield determination status report dated July 22, 19F'0,
The exploratory observation well in well fields 72,3,4 and 5
have been completed and aquifer tests have been conducted in
well fields ~2 and ~5. The data received from field ~5 and well
field ~~2 have been good, But data received from well field ~4
indicated poor quality water near the base of the production zone
in the acquifer.
• I'~ir. l~Tettles told Counci7_ that ?Much. of the projected maximum
day withdrawal for tT1e Village appears to be available from the
c~7-zz-~n -oz
Village's existing well .fields but to maintain the integrity of
• the well fields and individual wells, the total well field
capacity should be double the number req~zired to meet the demands.
I'~Zr. Pdettles also told Council that there appears to be good
water capacity and quality northeast along the Tequesta peninsula.
Gee & Jenson feels these areas should be utilized to meet the total
future requirements.
Council and Nfr. Nettles talked of the possibilities of drilling
additional wells. If new wells are to be drilled they should
be close to the main plant area i~Ir. Nettles advised. NIr. Nettles
was authorized by Council to report back to Council on the
feasibility and cost and probable location of additional wells.
P~~ir. Guy :Meld was present representing Fidelity Federal. Savings
and Loan Association, in their request for a free standing sign
at their location in Lighthouse Plaza, I'~ir. Held told Council
he believes Fidelity Federal's request is unique because they are
not, part of the Lighthouse Plaza due to the fact that their long
term lease on the southeast portion of the Plaza property constitutes
ownership, therefore maka.ng such property an individual parcel,
which would allow for a free standing sign.
i~~1T'. Held showed pictures of other signs used by other
Fidelity Federal Savings and Loan Associations and also showed
the Site Plan Review drawing of where the sign will be located.
. i'Tr. Held expressed to Council their need for this sign. Stoddard
moved, "that a sign in the size of 6' x ht located at least
1.00 feet or more East of the shopping areas main sign or located
one half way between the Hart sign and the shopping center sign
be approved". Ryan seconded and vote on the motion was:

and therefore the motion was passed and adopted.
T~Zr. Lee Brown, '7 Pine Hill Trail East;, was present representing
the Tequesta Pines Homeowners Association. T~Ir, Brown informed
Council that the Developer of the subdivision recently turned over
the association to the homeowners, He introduced i~1x~. Foxman,
President of the Tequesta Pines Homeowners Association and Mrs. Evans
the secretary. P~Ir. Brown was present to protest the loading and
~~-loading of rip rap and quarry type items at the Lone Star plant.
i~'r. Brown felt that this type of work was not light industrial
but that property is only zoned for light industrial..
'1'hE Village Attorney advised that this is not a Zoning
problem. He told Council that there is a noise Ordinance that could
• be enforced if the railroad is in violation. of the noise level,

I~1r. Larry Zielinski, Dover Road, told Council that in his
opinion. the drainage improvements in some areas are not working.
• i4'Irs. ~~;thel Gravett, 20U River Drive told Council that her
family had received a "Notice of Violation" from the Police
Department on the illegal parking of trucks on her property.
Council told Mrs. Gravett, that the Village Manager would look
into the matter with the Police Chief, but they would not make
a determination if she were in violation of the parking ordinance,

The next item on the agenda was the consideration of a
Resolution requesting a perpetual utility easement from the
State of Florida for installation of a 12 inch sub-aqueous water
main crossing the Intracoastal ~'~aterway. This Resolution is needed
so Gee & Jenson can proceed with making application to Florida
Department of Environmental Regulation, U.S. Army Corps of
Engineers, Florida Department of Natural Resources and Bureau of
State Lands for necessary easements and permits for thelntracoastal
t~~=aterway subaqueous crossing.
The Village has obtained easement deeds for both the east
and west sides cif the Intracoastal tk~aterway.,
• All of the necessary permits and approvals will probably be
obtained in January 1951.. ~~Jher~ all of the necessary permits have

been received, advertisement for bids will then be made, with
• construction expected to begin in about 60 days following the
advertisement.

The next item on the agenda was the consideration: of a
Resolution petitioning Board of County Commissioners to provide
relief from taxes. The Village Attorney told Council that these
items came to bear first when Council was talking about the
Sheriff's 8oad Patrol. Florida Statutes provide that a governing;
. body of a municipality may pass a Resolution. identifying; cost of
service .rendered specially for the benefit. of the unincorpated
areas of the county.

the Village feels it is being taxed unfairly for. Stoddard
moved, "that we pass this Resolution". Ryan seconded and vote

Mayor T~Zapes read a letter from the Tequesta Association of
Voters and Taxpayers which said their Association supported the
• resolution.
A Budget Workshop Meeting was scheduled for 7:30 P. M., Tuesday
July 29, 19$0.
The Village Manager read a letter from Mr. Leon A. Katz,
Harte Pen-Teq Enterprises, Ltd. acknowledging receipt of the
Village Manager's letter dated June 19, 19$0 regarding the
Lighthouse Shopping Plaza's Agreement for improving the Plaza.
Mr. Katz also stated in his letter that requests made in the
Village Managerts letter had been taken care of. The Village
Manager was directed to review the situation to see, if in fact,
the improvements were completed.
