DATE: September 3, 2008 RE: Jupiter Lighthouse Academy Voluntary Annexation By correspondence dated May 12, 2008 from Tod Mowery of the firm of Cotleur & Hearing, the owners of the above property now in unincorporated Palm Beach County requested that they be voluntarily annexed into the Village of Tequesta. The site is located at 4390 County Line Road and consists of approximately 3.1 acres. The site is currently adjacent to property included within the Village's boundaries. In order to move this request forward, we have received a petition for voluntary annexation that is signed by the property owners; we have provided Palm Beach County with all necessary notifications; and we have prepared the necessary ordinance to accomplish the requested voluntary annexation. The timetable for this voluntary annexation contemplates first reading of the ordinance in September, second reading of the ordinance in October and a 30 day appeal window which would conclude approximately November 10, 2008. Following the successful annexation of this parcel into the Village, both comprehensive plan and zoning designations will need to be assigned to the land. My understanding is that the applicant is desirous of continuing the current Jupiter Lighthouse Academy use with some renovations to the existing site. They have infon~lally requested a comprehensive plan designation of "multiple family" with R-2 zoning. They would then seek permission to operate their facility as a special exception use. Of course, these steps subsequent to the annexation will require the applicant to make formal application and proceed through all required public hearings before the LPA, the Planning and Zoning Advisory Board and the Village Council. It would be reasonable to estimate April, 2009 as the time frame that all of the above, including site plan approvals, could be concluded, barring any unforeseen issues. ORDINANCE NO. 14-08 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, ANNEXING ONE (1) PARCEL OF REAL PROPERTY COMPRISING A TOTAL OF 3.1 d ACRES, MORE OR LESS, LOCATED AT 4390 COUNTY LINE ROAD, INFORMALLY KNOWN AS THE "JUPITER LIGHTHOUSE ACADEMY", AND MORE PARTICULARLY DESCRIBED HEREIN; PROVIDING THAT THE SUBJECT PARCEL IS HEREBY ANNEXED PURSUANT TO SEC. 171.044, FLORIDA STATUTES AND SEC. 4.02 OF THE VILLAGE OF TEQUESTA CHARTER; DIRECTING THE VILLAGE MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS ANNEXATION; DIRECTING THE VILLAGE CLERK TO FILE A COPY OF THIS ORDINANCE WITH THE CLERK OF THE CIRCUIT COURT IN PALM BEACH COUNTY, THE CHIEF ADMINISTRATIVE OFFICER OF PALM BEACH COUNTY AND WITH THE DEPARTMENT OF STATE WITHIN SEVEN (7) DAYS AFTER ADOPTION; PROVIDING A CONFLICTS CLAUSE AND A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, the Village Council of the Village of Tequesta, Florida has n:ceived a written petition signed by the owner of real property hereinafter described, Teen Challenge of Florida, Inc., which entity desires that said real property be annexed into the Village of Tequesta, Florida, pursuant to the provisions of Secction 171.044, Florida Statutes and Sec. 4.02 of the Village of Tequesta Charter; and WHEREAS, the real property located at 4390 County Line Road, PCN 0042-40- 25-00-000-1190 is located in an unincorporated area of Palm Beach County, Florida which is contiguous to the Village of Tequesta and which is reasonably compact; and WHEREAS, it is the opinion of the Village Council that it is in the best public interests that the real property described below be annexed into the Village of Tequesta. NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, THAT: Section 1: The V;Ilage Council of the Village of Tequesta finds that the written petition for voluntary annexation bears the signature of the owner of the real property hereby annexed into the Village of Tequesta, Florida. Section 2: The real property consisting of a total of 3.1 d acres, more or less, legally described by metes and bounds as set forth on Exhibit A and depicted on the map attached hereto as Exhibit B and made a part hereof, being the subject of the aforesaid petition for voluntary annexation filed pursuant to Section 171.044, Florida Statutes, be and the same is hereby annexed into the Village of Tequesta, Florida as permitted by Section 4.02 of the Village of Tequesta Charter. Section 3: The Vitfage Manager is hereby directed to do all things necessary to effectuate this annexation. Section 4: The Village Clerk is hereby directed to file a copy of this Ordinance with the Clerk of the Circuit Court, Palm Beach County, and the Chief Administrative Officer of Palm Beach County and with the Department of State within seven (7) days of the adoption of this ordinance. Section 5: All Ordinances of parts of Ordinances in conflict herewith are hereby repealed. coon 6: Should any Section or provision of this Ordinance or any portion thereof, any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part thereof other than the part to be declared invalid. Section 7: This Ordinance shall take effect immediately upon second reading and final passage. I just want to thank you for encouraging and allowing the girls from Jupiter TeE~n Challenge to volunteer for S c u I ptu re our Earth Days at the Gardens Event. The teens were a tremendws help. The event was suc- ~~~; cessful because of their willingness to do what ever was neededof them with a smile on their ~~ ' face. As always, they were polite, professional and dependable. All worked extremely hard ' V a r~ e r~s and we could not have done this event without their assistance.Additionally I want to mention ~ t, that the girls clearly learn from example.
