A ~~`eeting of t~~e Council of the Village of Tequesta, Florida
was held at 7:30 P.i~i. , Tuesday, P.ovember 1~, 1°7$ in the Village
Fall, 357 Tequesta Drive, Tequesta, Florida. Councilmembers
?resent were: Brown, Cook, i~;apes, H.yan and. Yoder. Also present
were Robert Harp, Tillage ~~ianager, Cyrese Colbert, Village Clerk,
and Jotln C. Randolph, Village Attorney.
''?ayTor Brown gave t'r7e L rayer and Pledge of .allegiance to the
F1a~, He also made se~.reral anrounce~;ents. Brown asked that
items. !. (b) Bids for Park and Recreation Capital Items and 4 (c )
Joggi:~~° and. Exercise Path. in Tequesta Park be added to the agenda.
The zTillage Attorney requested that item ~(f) Consideration of
F_lanni.r.g and mooning Board be added to the agenda. There were no
ob,;,ections from Council on the additions to the Agenda.

were received. witri no questions or comments from Council.
'~r. Stanle;~ Harte was next on the agenda to discuss Lighthouse
Plaza . i'Tr. Harte spoke of the meeting T~aith ~~zayor Brown, Village
i~~ana~~~or Robert Harp, and resident John Giba and several ether
p~.o~.u who are involved with the Lighthouse Plaza. ~~2x•. Harte
ass~zrd Council that everything that should be dcne wi11 be done
~ruithir the next thirty (30) days. I?e told Council that he thinks
the improvements that the Village of Tequesta ti•~anted is not
onl~r .^_;aod for the Village but far the bu Finesses there. The Village
~vianag~:~r read a list of things that needed to be completed, trees
to be planted., sod to be planted, a_n the S.W. Corner. there is
going to be a rock barricade, the existing trees and shrubs are
to be trimmed and the exit signs are to be replaced and relocated.
i~~r, Harte also told of the reupdating and the proposed enlarging
of the ~rJinn Da_xie store. Yoder remarked. that he has heard so
much of things "t,o be done't that he will be happy when these
things are done. P~Ir•. Harte said that the things "to be done"
dc~~~~ not inclr_jde the things that, hazTe been done.
Larry ~.elinsl~i, Dover Road, asked P~.r. Harte about the garbage
ttiat is around the area, buy ~r» ~Iarte said. he never sava trash blowing

• Jerry •~iurphy, Beacon Street, told sir, Har-te that rie shops
at ~'binn Dixie in the Plaza anal after it rains you can go into the
store and t~~ley have pots and tubs catching v~rater from leaks in the
roof. i~~r. Harte replied that every store has normal leaks in the
roof, but the roof in ~-Jinn Dixie has been repaired.

?~s. Harte told Council that the work wo~.~ld be completed arld

Jerry Jackson, F~inkers, told Council he was present to point
out to Council the eventual improvements to the Rinkers plant and
.~aoulci like to get -the _feeling of Council. i~T', Jackson and Council

Charles Simmons, Gee <`;~; Jenson, advised Council that the
Village has a drainage problem aver and. above what they thought
existed. Ilfter the recent raa.ns, he had. surveyed the Village and
told Council there were people with septic tank problems because
they didn't work with all the rain, there was at least 6", sometimes
~?" of water on tl~e streets in certain areas throu bout the Village.
He gave a reviet~a of rainfall- frorcl P~ovember 1, 197 thru November 13,
1^7~ with the total rainfall. being 10" of rain in 13 days where
normally it is only 21'x. I-ie referred to this unusual amount of
rain being called the '~; year storm" anal that this is something
you can expect every fi~,-e (5) years, The three reasons he gave
for this happening now is 1. in the past things were nat as
developed as they are now, 2. tTle large amount of rain and 3. the
eaater level in the river was high. He told Council that the street
resurfacing and drainage program ~rai.11 have to be expanded somewhat.
Their purpose being 1. to deterriine the cause for each problem
(some streets may need repaving, some drainage ditches may need
• to be enlarged, some lakes may have to be connected to the
drainage) 2. provide for flood protection. Irs e]osing T~lr•. Simmons
said that Ciee ~~ Jenson feels that they can come up with solutions
to tl~ie pro'lems but the cost. ~,vi_1.1 varur.
Larry Zielinski, 1,;.30 Dover Road; told Council there was at
least four (1,.) feet of water in the street in front of his house
and ~,rt of Tflater inside his house. ±~~Tr. Zielinski said he told
the Council ten years ago of the probl.ern that existed on Dover Road.
He told Council that in his opinion the drainage cana]_ ('Jest of
Seabrook Raad) should be enlar~ecl and' cleaned so it could handle
a larger amount of water run off.
Ill i~-Tills, 406 Dover Circle, suggested t-;hat Gee ~ Jenson
survey the area and talk to the people about drainage problems in
their area, because the people would be able to help locate some
of the more troubled areas in the Village.
Jerry T~`lurphy, 1,.27 Deacon Street, asked Council to have something
done about the water settle4~lent on :elm Street. 1-Ie asTced if the
Villa~°,e could get a pump to p~_~mp the water off the street. The
Village T•`:anager informed Council and T~ir. T~iurphy that this was
an item to be done.
Frett Roberton, 131 Golfvie~a Drive, said that the Country
• Club area is also -having its problems with water and asked if the
pumps would be moved to C~olfvie~,a Drive .

on septic tanks anal if it is a health problem, itlr, Novatny also
told Council of his concern ~~rith traffic evacuatio.ri if there v~~ere
to be a hurricane. _~~?^, aimmons said that. the septic tank problem
depends on the level o.f the septic -Lank as compared to the vaater
level, there vaould be a problem, is, Simmons pointed out, if the
water stays in the area fora longer period than three days.
~`Zr. Clemmons, Bermuda Terrace, told Council at first he
wondered about, the routing of traffic thru Bermuda Terrace then
Mayor Brown took hirn and sT:owed him the Country C]_ub area, which.
cars could not go thru because of the large amount of water on
the street caused by the rain.
Peter Pimentel, :~oxa'~atchee River Environmental Cont~'o1
District was present to t,ive ari update report on the construction
pro jF~ct for ENCON, T~Ir, Pimentel told Council that ET~ICON has
contracted ;a~ith Belvedere Paving to do the intersection of
Country Club Drive and Tequesta Drive. ET~~,COT,T would like to .find
out ~fah~t problems the toti~an has or zi~rill have T,vith the resurfacing.
sir, Pimentel believes there J~,rill be a problem with rerouting
Country Club Drive traffic throu~,h Bermuda Terrace, but that they
krill 'nave a meeting with tTie Bermuda Terrace people and the Country
Club peop]_e before construction starts. The work date has not
been set up because E1`ICC~ is -waiting on the Performance Bond from.
tTze Contractor, but, ~'Ir, Pimentel pointed out that trhen EA?CON
rece~.ves the bond ENC;)P~ T,~rill sign and give the contractor a stag°ting
date, ~~ir. Pimentel assured Cauncil there :could be a pre-construction
meeting before th.e work starts.
:~~N, De~n7e;T asked ~,rhich side of the road the bicycle path would
go on. Corz.~trrT Club Drive and ,~`Iayor Drown told him it would be the
East Si {e.
IIr. Osha, Barker, Osha ~, ~:nderson, Inc., Engineering firm for
EIJCOi~, told Council it would take approximately 160 days to
complete Country Crab Drive .
Mayor BroTfan called a 10 minute recess at Q:50 P.NI, to 10:00 P.~rI.
TL~e Village T~'Ianager told Council of a "Petition for Annexation"
that the Village had received from Ernest I~, Dorner. The petition
is fora small parcel of land East of Tequesta Pines, along the
railroad. The TTillage Attorney advised Council, that if Council
zaas in agreement then. they could make a motion to accept the petition
then accept the first reading of the Ordinance, .which could be by
"title only". TUIapes moved, 'tto accept anal approve the petition

Ordinance is annexing the .forementioned Dorner property).

Florida, annexing certain parcels of land to the territorial limits

The Village Attorney explained to Council that the Ordinance
annexing another parcel of land into the Village belonging
First ~ r~arine Bank £~ Trust Company of the Palm Beaches, `T'rustee
for Trust~`~0-000300 had to have first reading again, because
he found, aster researching the problem, that a parcel of land
can not be annexed into the Village and at the same time }lave a
Zoning Classification change. The parcel of land either has to
have the Zoning Classification changed by Palm Beach County before
it becor.~es incorporated into the Village or wait a year after it
becomes incorporated and then request the rezoning. The Village
Attorney gave first reading by "title only" of the Ordinance
annexing a parcel of land belonging to First T~Tarine Bank & Trust
Company of the Pal.rr Beaches, Trustee for Trust X20-000300. Yoder
moved., "to approve AN ORDINANCE OF THE VILLAGE OF TEf~UESTA, FLORIDA,

The Village Attorney explained to Council the Inter-Local.
P.greeraent between Palm Beach County and the Village of Tequesta
for the Community Develop~r~ent Act. He explained that this allows
Palm Beach County to use 170 Village of Tequesta population
figures with ether municipal populations in order to arrive at
the minir~-~um population of 200,000, which is necessary for the
County to be eligible for Community Development Act r~'unds. Yoder
moved, "to approve the Com::Aunity Development Act, Inter-local
Agreement between the Village of Tequesta and Palm beach Count;rrt,

bid received from three t3) companies contacted. by Folice Chief
Flannery on bids for tTrro (2) police cars. The cars would probably
not be delivered until Ilarch or April of 1~• ~~; , P•'ir. Harp also
inforr;ied Council that th~~ cars will be paid fo.r from Federal

members of the Advisory Board unanimously agreed with the
