HomeMy WebLinkAboutMinutes_Regular_11/28/1978 MINUTES OF THE MEETING OF THE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA November 2F~, 197 A Meeting of the Council of the Villa e of Tequesta, Florida, was held at 7:30 P.M., Tuesday, November 2~, 197 in the Village Hall, 357 Tequesta Drive, Tequesta, Florida. Councilmembers present were: Brown, Cook, Mapes, Ryan and Yoder. Also present were Robert Harp, Village Manager, Cyrese Colbert, Village Clerk and John C, Randolph, Village Attorney. Councilwoman Cook gave the Prayer and Pledge of Allegiance to the Flag. Additions made and approved to the Agenda were 2d. John Giba, Consultant to the Comprehensive Land Use Plan, 2e. Robert Moore, resident, 2f. Jack Bonnell, resident and 2g. Stanley Harte, Light- house Plaza. The minutes of the November 1~., 197$ Council Meeting the Village Manager's Report for November 12 through 25, 197$, the Financial Statement for the Village for the month of October, 197$ and the Water Department Financial Statement for the month of October, 197$ were received. Mr. George W. Hill, U.S.G.S. was present to present to Council the annual U.S.G.S Report. Mr. Hill told Council that on November 17, 197$ a report was sent to Mr. Harp, Village Manager and Village Staff on the water resources work performed by the U.S.G.S Geological Survey. The report was for the period of July 1 to September 30, 197. In the report there was also a "Annual Summary". Mr. Hill also informed Council that at the beginning of the year there ,were 21 observation wells, but during the year five (5) of the wells were destroyed by contractor or by vandals. That left only 16 observation wells. There have been no significant changes in chloride concentration in any of the salinity monitoring wells with the exception of one, Mr. Hill briefed Council on the water resource data collected during this past quarter and the "Annual Summary". Yoder asked Hill if he was surprised at the high content of salt in some of the wells -after we haventt been pumping .from them. Mr. Hill told Yoder he was not surprised because the well would take a long time t~ repair the damage done (to rid itself of the salt). Ryan asked if there was any way the wells could be locked up: Mr. Hill said there was but that it would be expensive. The report was received by Council. Mr. Charles Simmons, Gee & Jenson, was present to give a status report on the Street Resurfacing and Drainage Project. Mr. Simmons li-2~-7~ -02 told Council that since the last Council Meeting, he and the Village Manager have met with bhe 'TGreens Committee'?"for the Country Club and that the Country Club will_ allow storm water ponding on their golf course, He told Council that by the next Council Meeting he will have a Comprehensive Program, some findings and data on the project. Brown asked Mr. Simmons if he had contacted Palm Beach County, on clearing and cleaning out the ditch in back of Dover. N`r. Simmons said that Palm Beach County will cooperate with the Village in clearing and cleaning out the drainage ditch. Mr. John McKune, Gee 8c Jenson, was present to give a status report on additional water supply for Martin County. Mr. McKune reviewed his letter dated November 2£~, 197$ to the Village Council. In the letter Mr. McKune told Council that in the opinion of Gee 8c Jenson the Village of Tequesta can adequately provide water service in Martin County, to River Ridge subdivision, 17 lots on Jupiter Island, north of the Blowing Rocks Preserve and approximately 50 lots along the east side of U.S. ~1 to the north end of Conch Bar Road. Mr. McKune told Council that the 17 lot owners on Jupiter Island and the developers of these properties would be willing to finance the construction of the water main extension and turn the mains over to the Village of Tequesta Water System. The Village Attorney informed Council that the Broadview case had been argued in January, 197 and that he is still waiting to receive word on the ruling, he also said that although • it is almost one year it is oat unusual. Mr. Lindahl, Lindahl, Browning 8c Ferrari, Inc, told Council that he was representing the people from River Ridge and the 17 lot owners on Jupiter Island and his client can not wait any longer to get an commitment from the Village of Tequesta on selling them potable water. He told Council he is ready to fly to California with an answer for his clients. The Village Attorney advised that this was too soon for Council to make a commitment and that he should have a chance to review the recommendations of Gee & Jenson and that Council should do likewise. The Attorney told Mr. Lindahl that maybe by the next Council Meeting Council could have a decision. Yoder agreed with the Village Attorney and told Mr. Lindahl that he felt Council should not move post- hast~ebut should wait until the December 12, 197$ Council Meeting. Mr. John Giba, Planning Consultant for the Village, was present and informed Council that the Comprehensive Plan will be physically complete before Christmas. Then he reviewed the pro pried dates of meetings to be held before the final adoption of the plan by Council. Mr, Giba told Council there were 3 must dates where everyone should attend. They are January 30, 1979, April 24, 1979 and June 26, 1979. Mapes moved, "that Mr. Giba~s schedule for Public Hearings and Meetings (see attached) for adoption of the Comprehensive Plan be approved'. Yoder seconded • and vote an the mation was: 11-2$-7$ -03 Brown -for Cook -for Mapes -for Ryan -for Yoder -for and therefore the motion was passed and adopted. Mr. Robert Moore, 275 Country Club Drive told Council that he thought it would be a good idea to connect Country Club Drive to Martin County Line Road. He also told Council that he attended a meeting in Martin County where they said they were going to try and mute construction traffic into Martin County through Country Club Drive, Yoder m~~~ved, 'Tto inform the developers of River Bend of our Ordinance "no thru trucks" and that they are aware of that and that it will be inforced, b, that we inform, thru Howard (Brown), at the COG Meeting, the unanimous feeling of this Council that the through road from route ~1 down County Line Road connecting Country Club Drive be expedited and c. a letter be written to the Martin County Commission, from the Village Manager, expressing our concern with the thru trafficTt, Ryan seconded and vote on the motion was: Brown -for Cook -for Mapes -for Rya n -f o r Yoder -for and therefore the motion was passed and adopted, Mr. William Borsdorff, 220 Country Club Drive, told Council that he is against the bicycle path and that he thought the bicycle path, if it gobs in, should b~ 'o-n the -W2st side ' of Country Club Drive. He feels it is an expense to the taxpayers and it is-unneccesary, Mr. Jack Bonnell, 143 Country Club Drive, spoke on the subject of the bicycle path, He asked Council if they had made an commitment' yet and was it definite? Brown told Mr, Bonnell that it is in the budget, but that no commitment have been made and that if the residents don't want it then so be it. He also gave Council a petition (see attached) from the people on the West side of Country Club Drive who are opposed to the bicycle path on the West side. He was able to contact 33 out of 40 homes on the West side of Country Club Drive. Council agreed they would like a survey done of the Country Club Drive areas and streets that feed onto Country Club Drive, along with a study on which side the bicycle oath should be installed. Mr. William Brennan, '755 Saturn Avenue told Council that a few years ago the Country Club Association was against the bicycle path, • Mr. Gruner, Turtle Creek, suggested that Country Club Drive be extended an additional six (6) feet on one side and put button reflector down the portion that would be used as the bicycle path. 11-2~-7£? -04 The next item on the agenda was the consideration of an Ordinance providing for a Planning and Zoning Commission. The Village Attorney told Council that after it had thought about it and researched it more he felt that a "Site Plan Review" Committee would do what the Council wanted done. He presented Council with a proposed Ordinance that would provide for a Site Plan Review by the Village Council for new buildings or conversions or remodeling of old buildings in the C-1 Retail Commercial District and the C-2 Wholesale Commercial and Light Industrial District within the Village. Council set up a Workshop Meeting for December 5, 197 at 7:00 P.M, to review this proposed Ordinance. Next item on the agenda was consideration of an Ordinance providing for removal of any animals offal or excreta on public or private property other than owner's property. The Village Attorney read. by "title only" AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, REQUIRING THAT OFFAL OR EXCRETA OF ANY ANIMAL DEPOSITED ON PREMISES OTHER THAN THE PREMISES OF THE OWNER OF SUCH ANIMAL BE REMOVED IN A SANITARY MANNER; PROVIDING A PENALTY FOR A VIOLATION HEREOF; REPEALING ALL ORDINANCES ~R PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING AN EFFECTIVE DATE; AND PROVIDING FOR CODIFICATION. Ryan moved, "that we adopt first reading of this Ordinance". Yoder seconded and vote on the motion was: Brown -for Cook -for Mapes -for . Ryan -for Yoder -for and therefore the motion was passed and adopted. Under Councilmembers report Yoder asked the Village Manager if the Village could have an on-going replacement program of the dead Royal Palm trees. He also asked when the sod was going to be laid on Beacon Street. The Village Manager told Yoder that the sod contractor had to wait until the ground dried up. Brown announced the COG Meeting scheduled for November 30, 197$ at 7:30 P.M. in the Village Hall. Council discussed briefly the December 26, 197 Council Meeting that falls on the day after Christmas. Yoder moved, "to cancel the December 26, 197 Council Meeting". Ryan seconded and the motion was passed and adopted. The meeting was adjourned at 10:50 P.M. Cy~se Colbert n U
