HomeMy WebLinkAboutMinutes_Regular_12/12/1978• MINUTES OF THE MEETING OF THE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA DECEMBER 12, 197$ A Meeting of the Council of the Village of Tequesta, Florida was held at 7:30 P.M., Tuesday, December 12, 197$ in the Village Hall, 357 Tequesta Drive, Tequesta, Florida. Councilmembers present were Brown, Cook, Mapes, Ryan and Yoder. Also present were Robert Harp, Village Manager, Cyrese Colbert, Village Clerk and John C. Randolph, Village Attorney. Vice-Mayor Mapes gave the Prayer and Pledge of Allegiance to the Flag. .Mayor Brown announced that Pete Pimentel of the Loxahatchee River Environmental Control District has announced that construction of the sewer main across Tequesta Drive and Country Club Drive will start January $, 1979 and will take approximately one week to complete. During that time the South gate will be closed and the traffic will be routed through Bermuda Terrace. There will • be a preconstruction meeting on January 3, 1979. He also announced a meeting of ENCON for December 21, 197$ in the Village Hall at 7:30 P.M. Mayor Brown also announced the birth of baby girl Randolph, daughter of the Village Attorney, John C. Randolph. Ryan wanted the record to show that at the last meeting he was not in agreement with Council, when Council said that the survey for the bicycle path should include only Country Club Drive and the streets that feed onto Country Club Drive. Ryan expressed his feeling that since the path would be built with tax dollars that everyone should have a voice in if the path should or should not be installed. Mapes asked about item X33 on the Village Manager's Report. The Village Manager told Mapes the representatives of Lone Star Florida, Inc., owners of the Maule Plant on Old Dixie Highway, met with the Building Official to discuss the proposed upgrading of the plant. Mr. Charles Simmons, Gee 8c Jenson, told Council that he was going to present to Council Gee & Jensons recommendations for short term improvements to relieve the problem flooding that the Village has now, if the Village should receive another serious rain storm that it had on November 11 and December 11, 19?$. Mr. Simmons told- Council that what he saw after the December 11, rainstorm was worse than the Novanber 11 rainstorm.. The areas 12-12-7$ -2 worst hit were Dover Circle and Beacon Street with Elm, Maple, Oak and Cedar following close behind. First priority, Mr. Simmons told Council, is for Council to authorize the recommendations • to relieve flooding conditions directly affecting protection of property and maintenance of traffic flow. The work includes cleaning storm drains and ditches, providing additional swales, increasing existing culvert capacity and providing additional ---storm drain lines. One of the culverts to be enlarged is the culverts at Seabrook Road. The culvert on Riverside Drive is working okay Mr. Simmons told Council. Mr. Simmons said he wanted to know, from Council, how they wanted to proceed with hiring a contractor to get this work done now. The Village Attorney told Mr. Simmons that the provisions are set forth to have work done within $1000. with the approval of the Village Manager. Yoder asked Mr. Simmons if this work is to clear the water that is staying now or to take care of the future. Mr. Simmons told Yoder it is for both now and later. Ryan spoke of the flooding on Fairway East but did not think there was flooding in the homes. Mr. Simmons told Council that the area around Beacon, Elm, Maple and Dover ~rere the areas where there was flooding in the homes. Yoder expressed concern that he didn1t see how that large amount of water, that was in the flooded area around Dover, will ever be handled and removed. Mr. Simmons said that Fairway East and West had approximately 1$T' of rain on the streets. This area drains onto the Country Club pond. He feels the Village could connect this pond to the outlet of the river and put a swale from River Drive to the river • for a temporary relief. A catch basin to the river would be a good idea, but the Village would need a permit from Palm Beach County Health Department and from the Department of Environmental Protection. The Village Attorney told Mr. Simmons that Council should get an estimate of what the cost would be, then Council could set a maximum of what the cost would be. The breakdown Mr. Simmons gave Council was: maintenance of ditch, approximately 2,500, additional culvert under Riverside Drive, approximately 6,000. This work to be done immediately but the project, Mr. Simmons said, does not include the removal of rubbish. The Village Manager asked Mr. Simmons where the rubbish from the ditch would go. Mr. Simmons said that it would remain on the sides of the ditch. Mapes moved, "that the Village Manager be authorized to spend up to $17,500. for the emergency repairs and installation of culverts and what not, as recommended by Gee & Jenson to take care of the immediate problems of this drainage and that the Village endeavor to get cost sharing by Jupiter and Palm Beach County". Yoder seconded and vote on the motion was: Brown -f o r Cook -for Mapes -for Ryan -for Yoder -for and therefore the motion was passed and adopted.' 12-12-7$ -3 Mrs. Robert Walters, 2 Maple Ave., talked about traffic coming down Maple during the heavy flooding and causing wakes. She was unhappy because the Police Department did not stop the • traffic from using the street and she was also unhappy because the radio did not announce the serious amount of flooding in Tequesta. Mrs. Walters asked why there was a delay in getting pumps into the area. The Village Manager told Council that the reason there was a delay in pumping the water off the streets, was that the Village does not own pumps of their own and the pumps that were rented had to come from about 35 miles South. He told them that he reserved the pumps and that they got here as soon as possible. There was flooding as far south as West Palm Beach and therefore transportation of any kind was hindered. Chief Flannery told Council that his men checked out the cars using Maple, after he received the complaints, but the Officers reported that those people who were using the street actually lived there. Several people who spoke from the floor on the flooding were Mrs. Davidson, corner of Elm & Dover, Mr. Duncan, Beacon Street, Mr. Reed, Beacon Street, Mr. Concklin, Beacon Street and Mr. Murphy, Beacon Street. The next item on the agenda was the consideration of extending water service to certain Martin County areas. Mr. John Wise, Gee 8c Jenson Senior Vice-President, was present to give the report because Mr. John McKune had a previous business commitment. Mr. Wise reviewed his December 12, 19?$ letter with Council. In the letter there were answers to ten questions recently raised regarding Gee & Jenson's recent recommendations • for extending the Village water service area. Yoder told Mr. Wise that Council hasn't really decided what their water future is or if the Village wants to expand their facility. Brown expressed concern over the Broadview law suit and its impact and also if the County Health Department would allow the intermingling of our well water with the Jupiter's Water System water. Mapes moved, "that this Council notify the owners of these 17 lots on Jupiter Island that we do not wish to serve them with waterT'. Yoder seconded and there was discussion from Council. Yoder doesn't feel that it is worth serving only those 17 lots and even though they would pay for the construction of the lines and turn them over to the Village the maintenance of those pipes would still fall on all the users of the Tequesta Water System. Mr. Lindahl, Lindahl, Browning and Ferrari, spoke for the 17 lots owners. Mr. Lindahl felt that the low water pressure in one of the Beach condominiums that is in Tequesta water service area is not due to low pressure of the water lines but the problem exist within the condominiums own units. Mr. Lindahl told Council that he felt everyone on the island is entitled to a good potable water supply. After discussion vote on the motion made by Mapes the vote was: Brown -for Cook -for Mapes -for Ryan -f o r • Yoder -for and therefore the motion was passed and adopted. 12-12-7$ -addition to page -3 Mr. Lindahl told Council that River Ridge, which he was also representing is surrounded by the Village of Tequesta • Water System and has no other place to receive potable water from. Yoder asked if the connection fee was enough. Mapes moved, "that the Tequesta Water Department serve River Ridge, with potable water, subject to the capability of the system to serve same and further subject to the area being subject to all present and future Ordinances, rates, rules and regulations of Village of Tequesta and its' Water System". Ryan seconded and vote on the motion was: Rrr~~.rn ~.f nr 12-12-7$ -4 The Village Attorney read by "title only" an Ordinance entitled, AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, REQUIRING THAT OFFAL OR EXCRETA OF ANY ANIMAL DEPOSITED ON • PREMISES OTHER THAN THE PREMISES OF THE OWNER OF SUCH ANIMAL BE REMOVED IN A SANITARY MANNER; PROVIDING A PENALTY FOR A VIOLATION HEREOF; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN GONFLIGT HEREWITH' PROVIDING AN EFFECTIVE DATE; AND PROVIDING FOR CODIFICATION, for second reading. Ryan moved, "that we approve and adopt this Ordinance on second reading". Yoder seconded and vote on the motion was: Brown -f o r Cook -for Mapes -for Ryan -f o r Yoder -for and therefore Ordinance No. 265 was passed and adopted on second reading. The next item on the agenda was the consideration of a request for rezoning of lot 22, blk. 2, Jupiter in the Pines, Section "C" from R2 to C1 Retail Commercial District. Present was Mr. Keith Mayfield, First American Bank, who was the representative requesting the rezoning of this lot. Mr. Mayfield told Council that First American Bank would like to use this lot for additional parking for their bank, but he was aware of certain objections voiced by the owner of the Villager: Apartments that abut the parcel of land proposed as the parking lot. Mr. Mayfield asked the Village Attorney if he could just get the feeling of Council toward this proposal without causing any problems. The Village Attorney advised Council they could speak to it since Mr. Mayfield has asked. Yoder voiced concern because of the parking across the street from a place of business. Mapes did not feel it was a good idea. Cook was undecided. There was no motion made for a Public Hearing at this time. The Village Attorney explained the changes made to the Village Zoning Ordinance to include Site Plan Review for R-3, C-1 and C-2 Zoning District per the request of Council. The Village Attorney read the Ordinance entitled, AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA AMENDING ORDINANCE N0. 211 KNOWN AS THE ZONING ORDINANCE OF THE VILLAGE OF TEQUESTA BY ESTABLISHING PROVISIONS FOR A SITE PLAN REVIEW BY THE VILLAGE COUNCIL FOR NEW BUILDINGS OR CONVERSIONS OR REMODELING OF OLD BUILDINGS IN THE C-1 RETAIL COMMERCIAL DISTRICT AND THE C-2 WHOLESALE COMMERCIAL DISTRICT AND LIGHT INDUSTRIAL DISTRICT AND IN THE R-3 MULTIPLE FAMILY DWELLING DISTRICT FOR BUILDINGS OR MORE THAN Tw0'STORIES, by "title only". Ryan moved, "to approve on first reading". Mapes seconded and vote on the motion was: Brown -fo r Cook -for Mapes -for • Ryan -for Yoder -for 1z-1z-7$ -5 and therefore the motion was passed and adopted. • The next item on the agenda was the consideration of and first reading of an Resolution providing for a moratorium on the issuance of Building permits in R-3, C-1 and C-2 Zoning Districts. The Village Attorney told Council that after thinking -about the possible moratorium and the repercussions that might occur he would advise the Council against adoption of a Resolution for a moratorium and that the Council should just wait until final reading of the revised Zoning Ordinance. Council felt that -they needed the protection in the meantime with the exception of Ryan. Ryan agreed with the Village Attorney to wait for the second reading of the Ordinance. Council requested the Village Attorney to read the Resolution. Village Attorney read the Resolution entitled, A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, RESTRICTING THE ISSUANCE OF BUILDING PERMITS FOR A PERIOD NOT EXCEEDING THIRTY DAYS IN THE C-1 AND C-2 ZONING CLASSIFICATIONS OF THE VILLAGE FOR BUILDINGS IN EXCESS OF 2000 SQUARE FEET OF BUILDING FLOOR AREA AND ALSO FOR PROPOSED BUILDINGS IN EXCESS OF TWO STORIES IN THE R-3 ZONING CLASSIFICATION. Yoder moved, "that we pass this Resolution". Mapes seconded and vote on the motion was: Brown -f o r Cook -for Mapes -for Ryan -against Yoder -for • and therefore Resolution No. 4-7$/79 was passed and adopted. Ryan moved, "that we accept the appointments (of Patricia.. S. Anderson and Ernest C. Bryan to the Zoning Board of Adjustment for a three (3) year term)". Mapes seconded and vote on the motion was: Brown -f o r Cook -for Mapes -for Ryan -f o r Yoder -for and therefore the motion was passed and adopted. The next item on the agenda was the consideration of appointment to the Buildin Board of Appeals and the Housing Board of Appeals fora three (3~ pear term. In a memorandum dated December 6, 147$ from the Village Manager to the Village Councilmembers the Village Manager told Council that Theron R. Brayman, Norman L. Burg, Jr. and Glen Kloiber have indicated they would serve again for three (3) year term commencing January 1, 1979. Also Frank Broedell, Jr. has agreed to serve on the Housing Board of Appeals for a three (3) year term commencing January 1, 1979. Mapes moved, "they • (Buil~~ng Board of Appeals and Housing Board of Appeals) be approved". 12-12-7$ -6 Yoder seconded and vote on the motion was: Brown -f o r • Cook -for Mapes -for Ryan -f o r Yoder -for and therefore the motion was passed and adopted. Yoder told Council that he had changed his mind about wanting another survey done on the bicycle path, but would like some additions to the streets that were surveyed.
