HomeMy WebLinkAboutMinutes_Regular_04/03/1979 MINUTES OF THE MEETING OF THE COUNCIL OF THE VILLAGE OF TE QUESTA, FLORIDA April 3, 1Q79 A meeting of the Council of the Village of Tequesta, Florida was held at 7:30 P.M., Tuesday, April 3, 1979 in the Village Hall, 357 Tequesta Drive, Tequesta, Florida. Council- members present were Brown, Cook, Mapes and Yoder. Ryan was ill and could not attend, Also present were Robert Harp, Village Manager, Cyrese Colbert, Village Clerk and John C. Randolph, Village Attorney, The opening Prayer and Pledge of Allegiance to the Flag was given by Councilmember Yoder. Mayor Brown told the audience that most of the meeting will be devoted to streets and drainage improvement program, at the request ~f Council. He welcomed everyone present. Report on the Martin County connector road by John Giba, Planning Consultant was added to the agenda by Brown, • Jahn Giba told Council that the connector road is a T~Zartin Co~.ulty problem. He also stated that we dontt care where the connector road goes, because it is not a Palm Beach County problem ar a Tequesta problem. We have just tried to get the problem straightened out. The Girl Scouts for their own reasons have rejected the proposed road. Giba believed that a letter from the Mayor to the P~aartin County Commissioners should be sent to thank them and their Chairman for the work they have done in trying to develop the facts and to let them know our concern as to what this problem is doing to our Village. He also said that in order to clear the air he again stated, that the Village of Tequesta has no say so in the matter and that the ball should be put back in the hands of Martin County. A proposed letter to Frank Wacha, Chairman of the Board of County Commissioners for Martin County from the Mayor was read by Brown. The proposed letter was drafted by Giba and amended by Brown. Mapes moved, "that you (Brown) be authorized to forward this letter to the Chairman of Martin County Commission". Cook seconded and vote on the motior. was: Brown -for Cook -for Mapes -for Yoder -for and therefore the motion was passed and adopted. 01~-03-79 -z (The letter was signed bar the Mayor and sent on April la., 1Q7~) •' Mr. Dick Hutchison, Beach Road resident, told Council that he had written a letter to Council in the past, asking. that a bicycle path be constructed between the intrac~~astal waterway bridge and U.S. ~1 on the north side. The Village Manager told Council and Nir. Hutchison that the right-of-way belongs to t'ne State and the property belongs to the Town of Jupiter, Council instructed the Village Manager to look into asking Jupiter about possibly de-annexating that parcel of land in order for the Village to annex it into the Village to build the bicycle path on it. Under the item la. Village N,anager's Report for March 25, 1979 to March 31, 1979 item X22, Council instructed the Village Manager to write a letter to Francis T. Ryan stating that the Village of Tequesta will service no one else with water service at this time. This is in response to a letter of March 27, 1979 from Mr. Ryan requesting bulk water from Tequesta. NIr. John Wise, Gee & Jenson, was present to discuss with Council the proposed Street and Drainage Improvements Program. D~Ir. Wise, Gee & Jenson, started off by saying that they are trying to tailor the program to make it financially feasible for the Village of Tequesta. Six monthsago Gee 8c Jenson thought that we were involved in a resurfacing program, but because of the severe storms in November and December things have changed. • CTee & Jenson now sees things as a drainage program and a street resurfacing program. The program now consists of five (5) {na.jor elements. Mr, titilise reviewed these with Council: 1. Dover Road, Maple, Oak, Elm, Cedar - is a major drainage element 2. Riverside Drive culverts and drainage canal would need a major cleaning out 3. Country Club Drive would require drainage and re- surfacing 4. Country Club Community would require proper drainage in this area 5. Other streets would need localized drainage and resurfacing 1'~;r. Wise told Council that the funding requirements will be greater than orginally expected. He also reiterated the problem of receiving drainage permits. In a letter to the Village dated March 30, 1979 Mr. Wise stated that item ~1 will function to a degree without completion of item ~2, but completion of item ~2 would provide optimum benefit during severe storm conditions. Mr. Wise said that he believes the County has a 30' right- of-way for the existing drainage canal along the south Village limits from the North Fork of the Loxahatchee eastward beyond Ole-C3-79 -3 Seabrook Road, • The drainage program for the Country Club Community involves collecting the drainage from the residential section and taking it across to the ponds on the golf course, The minimum retention is one inch in a drainage pond. Mr. Wise said that part of the drainage improvement systems fallwin the golf course and some of that area can be broken out into small units and contracted without obtaining a permit. The golf committee has requested that the program not interfere with the golf operations, Mayor Brown asked .Wise to explain what the Village of Tequesta plans on doing in the Country Club area because some of the people in the audience have nit been at different meetings and they may like to be brought up to date on what is happening. h~~r. Wise said that the proposed program will funtion for a 3 year storm condition. The DER requires that a ~•etention area provide for one (1")inch of water retention during the first three (3 ") inches of rain.The pond areas of the golf course and parts of the fairways provide the retention areas requried. Culvert systems connecting some of these ponds were not installed originally, This resulted in no outlets for some of the ponds causing an accumulation of rain water especially at ponds #~6, 17 & 1~. They have recommended that a drain line be installed at Point Circle where there are easements. The rain water in the • retention areas on the golf course will help the golf course refurbish their wells for watering. He also advised the Council that the Village of Tequesta should have an easement for the rights to draining the ponds and for getting to the ponds. Yoder asked if pumps could be installed in the reten ion areas. T~lr, Wise said that they are expensive and that Gee & Jenson doesn~t recommend it. Brown asked if the recommendations that Gee & Jenson are making would stop the flooding of houses and streets with the rain like the Village had on November ll, 197$ and December 11, 197$, Wise replied that the Village would not have a problem that we had then, but there would be small amounts of water at the retention area. Mr, Wise reminded Council that 60 acres of the Village would be draining into pond X12 so the cost of enlarging this pond will be high. h Brown asked why the cost had increased from X17,000. to X100,000, Mr. Wise told Council that the $17,000. was for emergency relief for this area. The $100,000. will be for a permanent relief from flooding. Council instructed the Village Manager to talk to the Town Manager of Jupiter and ask if the Town of Jupiter will consider cleaning out their part of the canal, The Mayor said he would talk with the ~~layor of Jupiter to discuss the problem also . 01~-03-79 -4. On November 10, 197$ the Village recieved 1.25t1 of rain, on November 11, 197$ the Village received 6,05" of rain, but the problem was that prior to the November 11, 197$ rain it }.lad rained 1~., 5" of rain in the first 9 days of November. Yoder wanted to know, if the Village would be protected .from a 3 year storm, a 10 year storm or a 25 year storm. Mr. Wise said that with this program the Village would be protected from a 3 year storm. A rainfall of 2.75" of rain the first hour would be considered a 3 year storm. He also said this system would not accommodate a hurricane. This system is the minimum and probably the maximum on the affordable drainage. It is I~Zr. Wise's understanding that the Village will be better off with this drainage program. A good practice normally is to install a system for a 3 year storm system. Mr. Larry Zielinski, resident, told Council that 10 years ago when he first lived here he received 3" of rain water in his home. He went before the Village Council then to have something done about the drainage program. At that time Palm Beach County enlarged the drainage canal to 51,." and cleared the canal out to 3'T deeper than it is now. He told Council that the Village has spent $500,000, on Tequesta Drive, what is another $200,000. Mr. Zielinski said that if the Village installed double culverts on Riverside I/rive, cleaned up the canal and had a good maintenance program this should get the problem cleared up, He also thought that swale • areas should be maintained properly, Mr. Roger Fulling, resident, asked several questions of Mr. Wise. Mr. Fulling stated that the Country Club golf course wanted to enlarge pond ~6 several years ago but the South Florida Water Management District wouldn't let them. Mr. Wise said that Gee 8c Jenson will be dealing with Florida DER on getting a permit to enlarge the pond. T~Ir. Fulling asked if Palm Beach County and Jupiter had been asked to share the cost of cleaning the drainage canal, because in a previous Council meeting it had been stated in a motion that the Village would contact them, Brown assured Mr, Fulling that it had been looked into. Mr. Fulling said there is no connection between Fairway North to pond ~5. He stated that you can not exist on a gravity pond, He recommended a written agreement with the Village of Tequesta and the Country Club accepting two 4$rf lines going to the river. He also expressed concern about gravity ponds. Mr. Wise then continued with Gee 8c Jenson's recommendations On Country Club Drive it was recommended that an average of one ~1") inch leveling course of asphaltic concrete be used in areas that had slight depressions and that showed signs of cracking. Some of the area would require patching of the base. A one inch type II asphaltic concrete placement was also recammended for the entire area beyond the work by ENCON~s contract. A program of patch repairing those areas of streets where the pavement has failed was recommended. On Dover Road they recommend the patching and slurry coat as minimum protection, but maybe in 2 or 3 years a full paving should be done. Larry Zielinski, told Council that they should think of mutual aid and ask Palm Beach. County for money because they are helping other cities in Palm Beach County. Zielinski, that he had contacted Falm Beach County and was told by Herb Kahlert that the County's street programs have their money spent several zjears in advance. Mr. Wise informed Council that he could probably do the Country Club improvement draft in about two (2) weeks, and the Dover, Elm, Maple, Cedar plans are almost completed, possibly 2 or 3 more weeks for completion. Then they would work on the golf course program, this amount being $200,000. taking about 5 to 6 weeks to complete the plans. The Council then reviewed the cost of the different programs and possible financing of the program in part or in whole. The Village T~~Zanager said the Village has spent about X23,000. on roads and drainage and there is about ~21~2,$Ol. left in the account. Yoder said that the Dover, Nlaple, Elm, Oak, Cedar areas, F~iverside Drive and Country Club Drive areas total • X220,000, leaving about X22,000 left in the account. The golf course area is $220,000, the Country Club Community area is $200,000, and the minimum for other areas is about X100,000. The Village Manager said he was thinking about borrowing the extra needed money from the Water Department until such time as we could receive the financing for the improvements. The Village Attorney said that the money could be borrowed from the Water Department if properly documented. He also mentioned "Special Assesment". Mapes moved, "that we bring the Village drainage system, as recommended by Gee & Jenson, up to the three year or higher storm level design", Yoder seconded and vote on the motion was: Brown -f o r Cook -for Mapes -for Yoder -for and therefore the motion was passed and adopted, Yoder moved, "that Gee & Jenson proceed with the engineering specifications and plans for items 1, 2, 3 & 4 as recommended by Gee & Jenson and that Gee & Jenson prepare the documentations for going out to bid". The Village Council directed the Village Manager to look into the possible financing of the program. He was directed to consult whomever he would like to about the possible financing and have the discussion of the financing on the next agenda. The Village Attorney was directed to give a run down if the financing should be done by advalorem taxes or by special assessments. Yoder wanted the advantages and disadvantages of each, Mr. Wise stated, "he strongly urges the Council do this as soon as possible". The meeting was recessed for 10 minutes and was again called to order at 11:00 P.M. The Village Manager reviewed with Council his memorandum of April 2, 1979 on the General Fund Budget Revisions. Various line items had been revised to ref lect the current trends and to reflect prior expenses and anticipated expenses for the balance of the fiscal year. The Village Manager recommended that the revisions be approved. Mapes moved, "that the Resolution (providing for the revisions) be approved'?. Yoder seconded and vote on the motion was: Brown -f o r Cook -for Mape s -for • Yoder -for and therefore Resolution No. 7-7/79 was passed and adopted. The Village Manager explained to Council his memorandum dated April 2, 1979 on the Escrow Account for the Water Refunding Revenue Bonds. Jacksonville National Bank, Escrow Holder for Water Refunding Revenue Bonds advised the Village that the original deposit they had advised the Water Department to remit, was $3,902.17 less than it should have been. The Village T~flanager wire transfered the necessary $3,902.17 to Jacksonville National Bank on March 30, 1979. He requested that the Village Council approve this payment of $3,902.17 Yoder moved, "that we approve the payment of $3,902.17 to Jacksonville National Bank, Escrow Holder for Water Refunding Revenue Bonds". Mapes seconded and vote on the motion was, Brown -f o r Cook -for Mapes -for Yoder -for and therefore the motion was passed and adopted. The r~larch 30, 1979 Legislative Bulletin from the Florida . League of Cities strongly requests the Municipal support of HB 102 by urging all Legislators -co support and to sign on as a co-introducer. The Village ~fiager recommended support 01~-03-79 -7 and to sign on as a co-introducer, support of this bill. Yoder moved, effort on this HB1~02 via the League Village Manager send a wire". Mapes motion was: Brown -for Cook -for Mapes -for Yoder -for The Village Manager recommended "that we approve the of Cities and that the seconded and vote on the and therefore the motion was passed and adopted. The Village Attorney reported that he had been talking with other municipalities about double taxation and that other municipalities are filing their own law suit's. Yoder expressed his strong feelings again st full financial disclosures when a person filing would also have to file a copy of Income Tax Returns. He told Council, that if there wa s a need to file everything he would do so , but not ,just for putting everything in the newspaper. Yoder moved, "that we inform the Florida League of Cities and the Legislative Delegation of our strong opposition to full financial disclosure for the Villages the size of Tequesta and surrounding communities". Cook seconded and vote on the motion was: • Brown -f o r Cook -for Mapes -for Yoder -for and therefore the motion was passed and adopted. Yoder moved, "that we combine the Council's feeling on financial disclosure, prevailing wage rate, annexation HB4.02, and double taxat~n on one communication to the Legislative Delegation and Florida League of Cities".
