A ;~Ieeting of the Council of the Village of Tequesta, Florida,
eras held at 730 P.fi~1. , Tuesda-= , I~iay ~, 1Q79 in the Village Hall,
357 Teauesta Drive, Tequesta,-Florida. Councilmembers present
were Brown, Cook, P1lapes, Ryan and Yoder. Also present were
Cyrese Colbert, Village Clerk and John C, Randolph, Village
Attorne:r. The Village Iflanager Robert Harp was out-of-town at
a Conference.
The opening Prayer and Pledge of Allegiance to the Flag
cvas given by Councilmember Cook.
i-'ayor Brown announced the "Ground Breaking Ceremony" for
St . Jude's Church on Sunday, :•~;~ 13 , 1979 at 10:30 A . P~1. i•Iayor
BroTfm said that he would be unable to attend, but Councilmember
Cook volunteered to represent t'ne Village at that affair.
Brown asked that the words, Teouesta Country Club Golf
Course, be striken from the Agenda under item 2e.
The minutes of April 23, 1°79 ware received after one (1}
correcticn was made by Brown.
Under the Village I4lanager's Report for April 22, 1979 to
I~.ay la., 1Q7a Yoder asked for a copy of EiVCOi~1's reply to a letter
sent by the Village imager a s'_ling fnr a written status report
on the Country Club Drive pro.~ect. Council as?~ced that the
Village I~,anager follow-up on the locatior_ of SR707 right-of-way
under item ~~.$, Yoder said t.at he would li?ce the Village 14~Tanaaer
to look into the hiring of a Financial Consultant Firm on a
one-time-only basis for this drainage improvement program. The
Villa~,e Manager's Report for April 22, 197 to P~~y !~, 1979 was
received.
blr. Fred Martin, Kiwanis Club, was present to discuss revised
construc:;ion of the jogging path in Tequesta. Park, The proposed
path was to be six to eight feet wide with six inches of soil
removed then replaced with marl. After the work had begun
T~~ir. Roy Rood, who is a Kiwanis member, felt that the soil should
not be removed as not to disturb the root system to the pines,
but that the marl should be placed on the ground without removing
the soi.~, T~ir. Rood told the Council that the path involved about
,100 pin=; trees and if the roo ~s were disturbed the trees would die .

T~•'Ir. Preston, Recreation Director, told Council that he
had made severals calls to the County about trao paths they have
installed, The County removed the soil docan to six (6'f) inches
. and removed the roots. Palm Beach Gardens said they have cut
within 2' of the trees and ha-.re not lost any trees. The County
felt that marl around the trees would cause the trees to die.
i~~?r. Preston expressed concern that the marl would be scattered
and that roots would soon be exposed if the dirt and roots
~•rere not removed before the marl was put do~:rn. If the roots were
exposed then someone jogging or_ the path could be injured and
the 4Tillage i~rould be liable. Cook suggested that logs be
placed along the path. Ryan asked if a sign saying "Jog at
Your Own RiskT' would help. The Village Attorney said that in
his opinion the Village would not be protected from being sued
by using such a sign, Yoder moved, ''that we hold in abeyance
the decision on whether to proceed Frith the jogging path at the
Par's: until the resolution of the ttiro problems of the trees and
safety are mutually resolved''. Ryan seconded and vote on the
motion was:

and therefore the motion was amassed and adopted,
• T"r. Sandy Nettles, Gee ~, Jenson, was present to give a
status report on the Village's well field monitoring program.
There were twenty-eight (2$) z~rells monitored for water level
and specific conductance. Out of the twenty-eight (2$) wells
eighteen irrells had sediment plugging greater than 2 feet above
the screened or open hole of the wells. Much of the data
taken bras questionable. Pf~r. Pdettles said that there were
two {2) questions outstanding to Gee & Jenson. One is, where
is the Village of Tequesta going to get their well field supply
and tyro, is the Village of Tequesta going to increase their
T~~later System, Brown answered by saying that the Village has
said it will not furnish anyone else i~ith water until the
Village finds out if tire can get more ,,rater. Cook asked if
Sout.r~ Florida ti~Tater l%;anagement District was saying that the
Village has to prove to them that we have the water? Nir. Tlettles
replied that the present ~a~ells brill not supply the additional
wata:r,
Yoder said there were taro (2) things to be concerned with.
Problem number one is, will the Village be able to continue to
dratir water from our present :,cell field and problem two is,
krill Jupiter be able to supply us with our tirater commitment.
He also asked if more money ~•ras needed to upgrade the wells.
I'~ir. ~;ettles told Yoder that the money and upgrading isn tt needed
naw, but maybe in three months, In two or three more months
Gee cc Jenson will be able to re_nort to the Village with a better
report.

T~Ir. John ti~Tise, Gee & Jenson was present to give a status
report on street resurfacing program for the Country Club
Community and other areas of the Village. P,Tr. Z,Iise reviewed
t~~ith Council the proposed schedule for street resurfacing and
drainage improvements. The proposed completion dates are a s
follows, Country Club Drive paving and drainage - 7/14/79, Dover
Road S~.,orm Drainage - $/10/7G, Riverside Drive Culverts -
7/13/79, Golf Course Drainage Project - $/31/79, Country Club
Community Project - 2/22/0, Balance of Street Resurfacing
and i-'iscellaneous Drainage - 2/22/&0, and Street Repairs and
slurryr seal - 3/21/$0.
~~r. ~~Tise informed Council that as of this date only
Crabtree Construction Co. Inc. and Rubin Construction Co. has
picked up the plans and specs for the Country Club Drive
paving and drainage program.
i•'apes wanted to make sure that Bill ti~Tagner, Country Club
Golf ~~ourse Maintenance Director, and his people received copies
of the specs and plans for the drainage program on the Country
Club Golf Course. A copy of the plans and specs were given
to Iir. ~'Tagner that night and four (4) copies were to be hand
delivered to the Village Hall the next day.
Brown said that a L^Torkshop Pieeting with the Council,
Village Attorney, Village t~~nager, Gee & Jenson and the Country
Club people should be set up to review the specs and plans.
• The Village Attorney said he would like to meet kith the
Attorney for the Country Club so they could draw up an agreement.
Mr. Bill Brennan, Country Club P~lember, said that all work
on the golf course has to be completed by August 31, 1979 at the
latest.
T"~a_nes moved, "that we have a Special V~Torkshop Council Meeting
at 2:00 P.;~I. on Tuesday, P~Zay 15, 1979 for the purpose of discussing
the Community drainage program". Yoder seconded and vote on the
motion was:

napes moved, "that Gee & Jenson be named the agent for
filing t'_~ie letter of authorization for the bulkhead line,
vraterfi-ont construction, dredge fill permits". Yoder seconded
and vote on the motion was:

and therefore the motion was passed and adopted.
The Village Attorney said that he researched the time it
would probably take for Special Assessment as Yoder had requested
and that it ~,rould probably take one (1) year. He also passed
out copies of certain portions of the sign ordinance which he
had revised and would like the VillageTanager and Council to
revie~•r. The Village Attorney advised that the Supreme Court
had ruled in favor of the Village in the lawsuit Jupiter/
Tequesta Jupiter Inlet Corporation vs. Village of Tequesta.
Ryan moved, "that we appoint T~.ir, T•~1oore to the Annexation
Committee'!. P~Iapes seconded and vote on the motion was:

ir. Gary Preston, Recreation Director was present and
revie;•red with Council a memorandum sent btir the Village T4Tanager
on the bids for basketball. courts in Tequesta Park.. The Village
T~lanager and Recreation Director, recommended that the lour
bid from Elton Phillips, Concrete Contractor, for labor and
equipment to construct the basketball courts in -the amount
of 3,90$. be accepted and authorize the purchase of the
concrete and other materials in the amount of $4,$61.25 from
Rinker T~~aterials Corporation, Tequesta Plant.. Yoder moved,
"that the bids be accepted". P~yan seconded and vote on the

and therefore the motion was passed and adopted
Councilmem'oer Cook spoke a'oout a person asking her when
Tequesta .•ras going to build more ball fields and she replied
that she feels Tequesta has done their share in providing
ball fields for this area.
Councilrember Ryan asked that the Village r~lanager check
into c'r:anging the right hard lane at Tequesta Drive and Old
Dixie into a right-turn-only lane from Tequesta Drive onto
Old Dixie.

Councilmember Yoder expressed to Council that he :~rould
like to hire a "Financial ConsultantT' firm on a one-time-only
basis for the drainage and street resurfacing program.
