MINUTES OF THE MEETING OF THE COUNCIL
OF THE VILLAGE OF TEQUESTA, FLORIDA
June 26, 1979
A meeting of the Council of the Village of Tequesta, Florida,
was held at 7:30 P.M., Tuesday, June 26, 1979 in the Village
Hall, 357 Tequesta Drive, Tequesta, Florida. Councilmembers
present were Brown, Mapes, Ryan and Yoder. Cook was out of town.
Also present were Robert Harp, Village Manager, Cyrese Colbert,
Village Clerk and John C. Randolph, Village Attorney.
The opening. Prayer and Pledge of Allegiance to the Flag was
given by Councilmember Ryan.
Mayor Brown made the following announcements;
1. July 3, 1979 - Community Appearance Board Meeting to
consider 1). Landscaping plans for Georgetown Place
Townhouse, Phase I & II, Cypress Drive, North of
Tequesta Drive 2) Landscaping, driveway and parking plans
• for Parish Center, St. Judets Church,... 3) Plans for Wendy's
Restaurant
2. July 2, 1979 - Pre-construction meeting for Country Club
Drive and Dover Road drainage program
3. July 3, 1979 - Pre-construction meeting for the Tequesta
Country Club
1~.. June 2$, 1979 - Palm Beach County Commission meeting on
the request to construct a 10 stories highrise on Jupiter
Island
Under the item "Approval of Agenda" the following was added:

Mapes moved, "that the June 12, 1979 Public Hearing and the
June 12, 1979 Council Meeting minutes be tabled until the next
Council Meeting". Ryan seconded and vote on the motion was:

and therefore the motion was passed and adopted.
• The Village Manager's Report for June 10-23, 1979, the
Village Financial Statement for May, 1979 and the Water Department
Financial Statement for May, 1979 were received.
Yoder told Council he still wants to know about and still wants
tk~e study on the water line to Beach Road. He is asking if that
water line is adequate? He also wants to know if there is a
possibility that the Village will have to put in a water purifing
plant. The Village Manager will look into each of these questions and
report to Council.

John Giba, Planning Consultant for the Village, gave brief
reports on the following:
1. Jupiter Island - he has attended two meetings held by
Palm Beach County, on the proposed Oceanside Diamond development.
At the last meeting he spoke on the behalf of the Village informing
• the County that the Village height limits were 1001 at one time
but, the Village has since lowered it to 65'. The Village would
like to see the 100' taper downward til it reaches the Martin
County line. The proposed eleven (11) stories would be out of line
and if the County were to allow anything above eight ($) stories
high would set a precedent.
2. JIB Club - the Village Attorney and himself have looked
into this and will have a meeting on it Friday. The Village
Attorney told Council that the Village would first have to change
the Zoning:.then have a Public Hearing on the Annexation
3. Connector Road - Martin County Commission held a meeting
on June 19, 1979 at which time the. Attorney for the Girl Scouts,
Sen. Johnston told the Commissioners that Martin County made the
~soblem and it was their problem. Martin CountyTs legal department
researching the problem to get relief from the problem.
1,.. Comprehensive Plan - the Village has finished all the
Public Hearings and tonight the Village Council should take the
t'irst steps to adopt the plan.
Mr. Bob Moore, Country Club Drive, told Council that truck
traffic to Turtle Creek is still using the Village's roads to
reach Turtle Creek and asked why the Police Department was allowing
this to happen. Mr. Moore was informed by Council that since
there is no other roads into Turtle Creek the roads from the Village
had to be used.
• Mr. Al Mills, Dover Circle, asked Council why the Special
Council Meeting for June ;~2, 1979 was called so quickly and why
was it at ;3:v0 P.M. The Village Manager told Mr. Mi11s that the

time limitation for bids f'or the drainage improvements was
• June 24, 1979 and time was also running out on the negiotiated
bid prices. Mr. Mills told Council he was present to voice his
opinion against the drainage but because he has to remove his
plants and his hence at his expense. In 1y71 Mr. Mills gave the
Village of Tequesta an easement to put a drainage pipe on his
property to relieve the flooding problem that existed in his
neighborhood, now the pipe has to be replaced and everything
has to be removed and replaced at his expense. Council asked
the Village Manager how many easements like this existed. The
Village Manager replied there were two that he knew of. The
Council instructed the Village Manager to look into this situation
and the cost of removing and replacing the trees and fence and
that maybe the Village should be responsible for this since the
easements were given to the Village.
The Village Manager told Council that the Jupiter Town
I~Zanager told him Jupiter was holding a Workshop meeting tonight
and their Council will talk about the drainage improvements to
the drainage canal that runs part in Jupiter and part in Tequesta.
The Village Attorney told Council that if the County grantea the
Village an easement for the drainage ditch or if Palm Beach County
deeded the ditch to Tequesta, Palm Beach County would like to see
Tequesta or Jupiter or both municipalities maintain the ditch.
Asa matter of fact. Herb Kahlert, Palm Beach County, said this
would be the only way they .would recommend the $3,"10U. contribution
• to Tequesta from Palm Beach County for the Dover Road Area Drainage
Improvements. Yoder expressed his concern that the Village would
be all ready to move on the drainage program and nothing would have
been resolved on the drainage ditch maintenance. Ryan askew if
the Village Maintenance crew has a schedule of when they will
clean out the drainage ditch. The Village Manager told Council
that in the past Palm Beach County has sent prisoners to clean
the ditch, but they no longer do that and the Village does not
have the equipment to maintain the ditch. Mapes moved, "that
we accept their offer (Board of Palm Beach County Commission
to contribute maximum of $3,700. for Dover Road area drainage
improvements)". Yoder seconded and vote on the motion was:

and therefore the motion was passed and adopted.
The Village Manager read aloud his memorandum dated
June 26, 1979 to Village Council on financing drainage improvements.
Mapes told Council that when he proposed his plan at the Special
Council Meeting last week he had forgotten that Council had
agreed that the Bond Issue would do the drainage work and that the
General Fund would do the road work. In his plan that was accepted,
. all the General Fund vaent tv the drainage work and nothing was
left over for the road work. Mapes told Council they could recind
the motion that was made last week of the $500,000 Bond Net Proceed

and increase it to $720,000 for an additional 1~ increase in the
• utility tax.
Yoder believes that t-,he figures for the drainage improvement
and the figures for the road improvements should be separate.
Council asked that Joe B. Wise, William R. Hough & Co. give
them what the interest and prinicpal annual payment would be on
$720,000. Bond Net Proceed.
The next item on the a enda was, "Approval of Revised Section
7.0 Coastal Zone Protection~Conservaton of the Village Comprehensive
Plant'. Yoder moved, "that we accept the revised Conservation Element
and Solid Waste Element in our long range plant. Mapes seconded
and vote on the motion was:

and therefore the motion was passed and adopted.
The Village Attorney advised Council that the reading of
the Ordinance to adopt the Comprehensive Plan will have to be
first reading and then the Village must have a Public Hearing
• and advertise the second reading. This will go a little behind
the deadline of July 1, 1979 because of the neccessary two weeks
slippage. The Village Attorney reviewed the Ordinance and read,
by title only, A ZONING ORDINANCE OF THE VILLAGE OF TEQUESTA,
FLORIDA, ADOPTING A COMPREHENSIVE PLAN, INCLUDING A FUTURE LAND
USE ELEMENT, PURSUANT TO THE LOCAL GOVERNMENT COMPREHENSIVE
PLANNING ACT OF 1975• Mapes moved, "the adoption of first reading".
Ryan seconded and vote on the motion was:

and therefore the motion was passed and adopted.
The Village Attorney provided Council with an older proposed
agreement and a new proposed agreement between the Village of
Tequesta and Tequesta Country Club. He advised Council that this
agreement was made with several item the Tequesta Country Club's
Attorney had requested be included in the agreement. The Club
could not address itself to the Agreement tonight because their
Attorney was not present and he had not reviewed the new proposed
agreement. Council and the Village Attorney reviewed the Agreement.
Various changes were made to the Agreement. Yoder told the Club
that the Village agrees to having the Contractor out by August 31,
• 1979 but he hopes they will not be unreasonable in this time date.
Ryan felt very strongly that someone neutral should determine if
the job could not be completed in the time allowed.

Mr. Bill Wagner, Tequesta Country Club Golf Course Superintendent
• told Council that he was not made aware of the scheduled July 3,
1979 pre-construction meeting until he heard about it at this
meeting.
Mr. Bill Brennan, Tequesta Country Club President, told
Council he was very dissatisfied with Gee 8c Jenson when they
went on the Club's property without not ifing Bi11 Wagner.
It was the consensus of the Council that they are in agreement
with this Agreement between the Village of Tequesta and The Tequesta
Country Club.
Ryan moved, "that we grant the St. Jude's Church request for
expansion or enlargement of Special Exception Use". Yoder seconded
and vote on the motion was:

and therefore the motion was passed and adopted.
Mapes moved, "that William H. Blodgett be appointed to the
Annexation Committee". Yoder seconded and vote on the motion was:

and therefore the motion was passed and adopted.
The Village Manager told Council that the prices he had
received on replacement of sad on private property only after
the drainage improvements were done wasl$g a sq. ft., but he
believed that 15~ a sq. ft. was a reasonable and fair amount
for the sod.. Ryan moved, "to allow 15g a sq. ft. for replacement
sod'?. Mapes seconded and vote on the motion was:

The Village Manager told Council he had a little good
newsfor them and that was the Water Management District Staff

recommended the approval of the three additional out falls to the
river for the drainage improvements.
The meeting was adjourned at 10:35 P•M-
