HomeMy WebLinkAboutMinutes_Regular_10/11/1977 MINUTES OF THE MEETING OF THE COUNCIL THE VILLAGE OF TEQUESTA, FLORIDA October 11, 1977 A Council Meeting of the Village of Tequesta, Florida, was held on Tuesday, October 11, 1977 at 7:30 P.M. in the Village Hall, Present were Brown, Huggins, Mapes, Ryan and Yoder. Also present was Cyrese Colbert, Village Clerk. The Village Manager, Robert Harp and Village Attorney, John C, Randolph were on vacation. Opening Prayer and Pledge of Allegiance to the Flag was given by Councilmember Ryan. A change adding 3b. Review of Application for Federal Funding was made and approved by Council. Announcements were made by Mayor Brown. Mr. Charles Prescott, Director of Civil Defense for the Village gave a breakdown of the Civil Preparedness Workshop Meeting held on September 19, 1977. Mr. Prescott told of the need for volunteers for various phases of the program and gave recommendations of communication systems needed in case • of a disaster. Mr. Prescott reviewed a flood hazard boundary map of the Village. Huggins moved, "to approve first reading of AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, ANNEXING CERTAIN PARCELS OF LAND TO THE TERRITORIAL LIMITS OF THE VILLAGE OF TEQUESTA WITH AN R-1 ZONING CLASSIFICATION, which refers to the DiVosta petition with property described as that part of the South 119.00 feet of ,the West 130,00 feet of the Southwest one-quarter (SW~) of the Northeast one-quarter (NEB) of section 25, township 40 South, Range 42 East, lying East of Riverside Drive, containing 0,224 acres, more or lesst'. Mapes seconded. The Village Attorney explained the motion that was on the floor as a motion to pass on first reading the Ordinance which has ,ist been recently read by "title onlytt and approved so on its fourth publication contingent upon the petitioner providing an amended petition changing the Zoning Classification as stated on the existing petition attached to the Ordinance we have existing here today to change only the Classification of Zoning from R-lA as it exist to R-1. Vote on the motion was: Brown -For Huggins -For Mapes -For Ryan -For Yoder -For and therefore first reading of the Ordinance was passed and adopted. 1C~-11-77 -z Huggins moved, "to approve first reading of AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, ANNEXING CERTAIN PARCELS • OF LAND TO THE TERRITORIAL LIMITS OF THE VILLAGE OF TEQUESTA WITH AN R-1 ZONING CLASSIFICATION, which refers to the Northwestern Mutual Life Mortgage and Realty Investors petition with property described as a certain parcel in the Northeast one-quarter (PdE~) of the Northeast one-quarter (NEB) of section 25, township 40 South, range 42 East, Palm Beach County, Florida, more particularly described as follows: beginnin at the Southeast corner of the Northeast one-quarter (NE) of the Northeast one-Quarter (NEB) of section 25, townshop 40 south, range 42 east; run thence North 0°-04'-51" East along the East line of said section 25, a distance of 254.$3 feet to an intersection with the Westerly right of way line of the Florida East Coast Railway right of way; thence North 22°-21'-40" West along said right of way a distance of 553.67 feet more or Tess to a t~oint in the Southerly line of Jupiter Cresta unit 1, according to the plat hereof recorded in plat book 26, page 24$, Pu~lic Records of Palm Beach County, Florida; thence South 67 -39'-14" West along the South line of said Jupiter Cresta Unit 1, a distance of 170.00 feet; thence South 22o-21t-4011 East, a distance of 4$0,6$ feet; thence South Oo-04'-511t West a distance of 25$.91 feet to a oint in the south line of the said Northeast one-quarter (NE~~ of the Northeast one-quarter (NEB) of section 25; thence South $9°-37'-16" East along said South line, a distance of 1$5.00 feet to the point of beginning, containing 3.11 acres, more or less". Ryan seconded and vote • on the motion was: Brown -For Huggins -For Ma pe s -Fo r Ryan -For Yoder -For and therefore first reading of the Ordinance was passed and adopted. Huggins moved, "to approve first reading of an ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, ANNEXING CERTAIN PARCELS OF LAND TO THE TERRITORIAL LIMITS OF THE VILLAGE OF TEQUESTA WITH AN R-1 ZONING CLASSIFICATION, which refers to the Northwester Mutual Life Mortgage and Realty Investors petition with property described as a certain parcel in the Northeast one-quarter (NEB) of the Northeast one-quarter (NEB) of section 25, township 40 South, range 42 east, lying South of the plat of Jupiter Cresta unit 1, as recorded in plat book 26, page 24$, Public Records of Palm Beach County, Florida, and lying westerly of the plat of Jupiter Cresta Unit 2, according to the plat thereof recorded in plat book 2$, page 10, Public Records of Palm Beach County, Florida, less the South 130.16 feet thereof, containing 1.79 acres, more or less". Ryan seconded 10-11-77 -3 and vote on the motion was: Brown -For Huggins -For Mapes -For Ryan -For Yoder -For and therefore first reading of the Ordinance was passed and adopted. Mapes moved, "that the Council move to accept the petitions for annexation attached to the Ordinances just approved for first reading providing that they are amended in the next two (2) days to reflect R-1 Zoning and that the petitions be notarized". The motion was seconded and approved. Mapes moved, "that the Village send a letter to the Palm Beach County Planning and Zoning Commission and County Commissioners protesting the installation of additional tankage for Tropigas, Inc.". Yoder seconded and vote on the motion was: Brown -For Huggins -Against Mapes -For Ryan -Against Yoder -For and therefore the motion was passed and adopted. This property is located on the West side of Old Dixie and East of the railroad and is located within the County. The Palm Beach County Planning and Zoning Commission sent the Village notice of a Hearing being held for 'tSpecial Exception Use", of the land by Tropigas. Yoder moved, "that we follow the recommended procedures outlined in the Area Planning Board's letter of October 27, 1977 (authorizing the Village Manager to carry out the review and comment function to the Area Planning Board of Palm Beach County in the event time does not permit Council's action)".
