MINUTES OF THE MEETING OF THE COUNCIL THE VILLAGE OF TEQUESTA, FLORIDA November $, 1977 A Council Meeting of the Village of Tequesta, Florida, was held on Tuesday, November $, 1977 at 7:30 P.M. in the Village Ha11. Present were Brown, Huggins, Mapes, Ryan and Yoder. Also present were Robert Harp, Village Mansger, Cyrese Colbert, Village Clark and Adams Weaver, Johnston, Sasser & Randolph, filling in for John C. Randolph, Johnston, Sasser & Randolph, Village Attorney, who could not be present. Opening Prayer and Pledge of Allegiance to the Flag was given by Mayor Brown. Changes made and approved, to the agenda, were 5b. payment of Unemployment Benefits, 5c. Planning of Local Comprehensive Planning 5d. Block Grant Funding 6a. Veteran's Day Holiday. Mayor Brown explained the Proclamation entitled "National White Cane Daytt on November 12, 1977. Ryan moved, ?'that we adopt the Proclamation of National White Cane Day, November 12, 1977". Huggins seconded and the motion was passed and adopted. Mayor Brown made other announcements. . Changes to the October 25, 1977 Council Meeting Minutes were made and approved. The Village Manager's Report for October 23, 1977 to November 5, 1977, the Financial Statement for September, 1977 and Water Department Financial Statement, 1977 were received. Mr. William Boo se III, representing the J.I.B. Club, Inc. spoke to Council about their petition before Palm Beach County Planning and Zoning Commission. The petition is for rezoning their property from CN-Neighborhood Commerical District to RH- Residential Multiple Family District (High Density). The J.I. B, Club, Inc. spoke to Council on a "good neighbor" basis since the property is located in Palm Beach County and not in the Village. Mrs. Cannon, Beacon Street, asked Council when the improve - ment work was going to be started on Beacon Street. After a lengthy discussion Yoder moved, "that we secure the service of Robert E. Owen & Associa tes to continue to develop the;~plan and proceed with ~;he bid to construct the Beacon Street road as originally planned'?. Mapes seconded. Huggins moved, "to amend that motion to include the repaving and restoration of Country Club Drive from Tequesta Drive to Martin County Line Road as part of the same activity". Yoder seconded the amendment. • November $, 1977 - 2 Vote on the amendment to the motion was: Brown -against Huggins -f o r Mapes -against Ryan -for Yoder -against and therefore the amendment was not approved. Vote on the original motion was: Brown -for Huggins -for Mape s -for Ryan -f o r Yoder -for and therefore the motion was passed and adopted. Mr. Syl Leahy, Tequesta Association of Voters and Taxpayers, read a letter addressed to Council from his association which asked several questions of the purchase of Tri-Southern Utilities, Inc. by the Village, Council discussed at length the letter and answered several questions that were in the letter. The Village Manager read an Ordinance by "title only" entitled "AN ORDINANCE OF THE VILLAGE OF TEQUES TA, FLORIDA, • ANNEXING CERTAIN PARCELS OF LAND TO THE TERRITORIAL LIMITS OF THE VILLAGE OF TEQUESTA WITH AN R-1 ZONING CLASSIFICATION (parcel owned by Otto B. DiVosta). Mapes moved, "for passasge on second reading of the Ordinance just previously read by "title only". Huggins seconded and vote on the motion was: Brown -f o r Huggins -for Mapes -for Ryan -for Yoder -f o r and therefore Ordinance No. 256 was passed and adopted. The Village Manager read an Ordinance by "title only" entitled "AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, ANNEXING CERTAIN PARCELS OF LAND TO THE TERRITORIAL LIMITS OF THE VILLAGE OF TEQUESTA WITH AN R-1 ZONING CLASSIFICATION (parcel of land owned by Northwestern Mutual Life Mortgage and Realty Investors). Mapes moved, "for passage of the Ordinance just recently read by "title only", Huggins seconded and vote on the motion was: Brown -f o r Huggins -for Mape s -f o r • Rya n -f o r Yoder -for November $, 177 -3 and therefore Ordinance No. 257 was passed and adopted on second reading. The Village Manager read an Ordinance by tttitle only" entitled 'SAN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, ANNEXING CERTAIN PARCELS OF LAND TO THE TERRITORIAL LIMITS OF THE VILLAGE OF TEQUESTA WITH AN R-1 ZONING CLASSIFICATION (parcel of land owned by Northwestern Mutual Life Mortgage and Realty Investors) Mapes moved, "for passage of the Ordinance just recently read by "title only'. Huggins seconded and vote on the motion was: Brown -f o r Huggins -for Mapes -for Ryan -f o r Yoder -for and therefore Ordinance No. 25$ was passed and adopted on second reading, The Village Attorney read a Resolution by tititle onlyi~ entitled 'tA RESOLUTION OF THE VILLAGE OF TEQUESTA, FLORIDA SUPPORTING PALM BERG H COUNTY COMMISSIONER DISTRICT N0. 1, PEGGY B. EVATT, AND THE LOXAHATCHEE COUNCIL OF GOVERNMENTS (COG) IN THEIR EFFORTS TO PRESERVE l$7 ACRES OF LAND AT THE HEADWATERS OF THE LOXAHATCHEE RIVER, LOCATED IN "TOWNSHIP 41 • SOUTH, RANGE 42 EAST, SECTION 6, PALM BEACH COUNTY SOUTH OF STATE ROAD 706 (INDIANTOWN ROAD EAST AND WEST OF T~iE LOXAHATCHEE RIVER". Yoder moved, 'Tthat the Resolution be adopted". Mapes seconded and vote on the motion was: Brown -for Huggins -for Ma pe s -f o r Ryan -fo r Yoder -for and therefore Resolution No. 1-77/7$ was gassed and adopted on first reading. Council discussed and announced there would be a Zoning Ordinance Revision Workshop immediately following the regularly scheduled Council Meeting on Tuesday, November 22, 1977 at 6:30 P.M. Mr. Bob Meyer , Representative from Jupiter-Tequesta Junior Citizens, Inc. was present and discussed with Council the operation of the club and the future plans for the Club. The Club is used by various non-profit organization in this area. Mr, Meyer advised Council of some of the problems the club is facing including a threat by Palm Beach County Health Department of shutting them down due to a leaking roof, After discussion by Council anct Mr. Meyer, Mapes moved, the Village Manager be authorized to pay November $, 1977 -4 $1,020, (to Jupiter-Tequesta Junior Citizens, Inc.) which is in the budget for next ,year in one lump_ sump, Ryan seconded and vote on the motion was: • Brown Huggins Ma pe s Ryan Yoder -for -against -for -for -for and therefore the motion was passed and adopted. Yoder moved, "that we increase the payment this year by the amount of $2,000.". Ryan seconded and vote on the motion was: Brown -f o r Huggins -against Mapes -for Ryan -f o r Yoder -fo r and therefore the motion was passed and adopted. Mr. Earl Owen , Robert E, Owen & Associates, discussed with Council the possiblitq~ of having a study of principal drainage problem:.-areas in the Village made by his Company and represent- atives of the the Village. The study would list principal problem areas with recommendations on what should be done to each area and the cost of the work needed to be done. • Huggins discussed the possibility of a new North County branch Library built in Tequesta and the increased funding by the County to a Municipality because it has its own library and Huggins along with Council feels just because a Municipality 'gas its own library it should not receive increased funding uut the Municipality should only receive what other Municipalities receive, The Village Manager and Huggins were to get together, per Council, and draw up a draft letter expressing the Councilts desire that no change in the apportionment stucture for County Branch Library funding be made differently than what it has been in previous years. Huggins also discussed the possibilty of Palm Beach building a North County Branch Library here in Tequesta, one-half of the funds to come from Palm Beach County and one-half, matching funds from the State. Ryan moved, 'fthat we authorize the Village Manager to write Florence Biller, Palm Beach County Public Library Director. and inquire as to whether.or not she could, at her convenience come to Tequesta and decide if there was enough evident interest in the possibilty of involving the Village in such a Library site within the Villagett. The motion was seconded and passed and adopted, The Village Manager discussed with Council briefly the amendments to Section 443.0$, Florida Statutes in regard to payment for unemployment benefits paid to former, eligible employees. (reference memo of November 7, 1977) Yoder moved, "we continue • Haying on an reimbursement basis", Huggins seconded and the motion was passed and adopted, November $, 1977 -5 Mapes mo ved, "that John Giba be appointed to the Planning Technical Advisor-~r Study Committee to help with the County wide • plan'T. Huggins seconded and the motion was passed and adopted. Council directed the Village Manager to proceed to notify the Division of Housing and Community Development of the two proposed projects as described in the November 3, 1977 memorandum from the Village Manager. The Village might be eligible for a portion of the Palm Beach County Block Grant Fund, Fourth Year Application. The meeting was adjourned at 11:29 P.M. r ~ I Cprse/ Colbert
