MINUTES OF THE MEETING OF THE COUNCIL
THE VILLAGE OF TEQUESTA, FLORIDA
November 22, 1977
A Council Meeting of the Village of Tequesta, Florida,
was held on Tuesday, November 22, 1977 at 6:30 P.M. in the
Village Hall, Present were Brown, Huggins, Mapes, Ryan
and Yoder. Also present were Robert Harp, Village Manager,
Cyrese Colbert, Village Clerk and John C. Randolph, Village
Attorney. Opening Devotion and Pledge of Allegiance to the
Flag was given by Councilmember Huggins. Mayor Brown made
the announcements. Changes to the Agenda were 2b.proposal
for Engineering Streets and Drainage Project 3b. Village
boundaries, delete 4a, 5a, and 5d. These changes were
approved by Council.
The Village Managers Report for November 5 - 19, 1977,
the Financial Statement for October, 1977 and the Water
Department Financial Statement for October, 1977 were received.
• Mr. George Hill, U,S.G.S. Hydrologist, reviewed with
Council his letter to Council dated November 17, 1977 that
summarized the water resources work done by the U.S. Geological
Survey for the Village of Tequesta during the 1977 water year
(October 1, 1976 to September 30, 1977) Mr, Hill informed
Council that a printed copy of the hydrologic work done from
1974 to 1977 should be available in approximately four months.
Mr. Robert E. Owen , Robert E, Owen & Associates, Inc.
was present at the request of Council to present his company's
proposal on a preliminary engineering report of the general
requirements for resurfacing and drainage program for the
streets of the Village. Mr. Owens explained the report would
include visual inspection of each Village street and result
in a condition report describing the degree of deterioration
and preliminary findings as to the most probable cause.
Mr. Owen also told Council the cost of the report would be
$4,176.00. Council discussed with the Village Attorney and
the Village Manager the Competitive Engineering Negotiation
Act. After a lengthy discussion Huggins moved, 'tthat the Council
authorize Robert E. Owen 8c Associates to proceed with the
preliminary Engineering Report described in their letter of
November 21, 1977 at a cost of X4,176.00". Ryand seconded
and vote on the motion was:

and therefore the motion was passed and adopted.
• The Village Attorney reviewed with Council some of the
important parts of the franchise between the Village of
Tequesta and the Loxahatchee River Environmental Control
District. The Council discussed most importantly the provision
in the Franchise that makes the District responsible for repairing
.streets and roads to the way they were before work by ENCON
was performed. Huggins moved, that the Village Manager conduct
a survey of those areas within the Village which have been
served by ENCON and that we determine which, if any, of those
areas has not been returned to its prior condition as described
in Section 2 of Ordinance Pdo. 209. Further that the Village
Manager notify the Village Attorney of these areas not in
compliance and the Village Attorney notify ENCON that unless
immediate action, is taken to correct the situation the Village
will submit the matter to our Attorney as provided in Section 9
of our Ordinance". Mapes seconded and vote on the motion ~uas:

and therefore the motion was passed and adopted.
The Council instructed the Village Attorney
• to proceed with the talks with Jupiter's Attorney for the
deannexation of property within the Village, along U.S.~1
and State Road 5. This is a parcel of land within the Village
but it abut s the town of Jupiter. The Police Department
could patrol it easier if it were annexed into Jupiter.
Yoder moved, "we approve the requested budget far COG
amounting to $$7~..TT. Mapes seconded and the motion was passed
and adopted. Council discussed the COG budget and the reason
why an Administrator was needed.
Mapes moved, "that Cal Christian be elected as the Administrator
for the Loxahatchee Council of Government". The motion was
seconded and vote on the motion was:

and therefore the motion was passed and adopted.

Council discussed the bids for tennis court lights in the
Village Park. Yoder moved, "that we approve the $17,320 (bid
received from C.R. Dunn, Inc.)". Mapes seconded and the motion
was passed and adopted.
Hudgins advised the Village Manager of certain plants in
road right-of way that were causing certain visual problems
for drivers.
The meeting was adjourned at $:39 P.M. with a Workshop
