A 1~'Ieeting of the Council of the Village of Tequesta
Florida was held, immediately following a Public Hearing
on Budgets, Tuesday, September 26, 1978, in the Village
Hall, 357 Tequesta Drive, Tequesta, Florida. The meeting
was started at $:27 P.M. Councilmembers present were
Brown, Cook, Mapes and Ryan. Yoder was still on vacation.
Also present were Robert Harp, Village Manager, Cyrese Colbert
Village Clerk and John C. Randolph, Village Attorney.
Vice-Mayor Mapes gave the Prayer and the Pledge of
Allegiance to the Flag. Mayor Brown announced a meeting
of the Loxahatchee Council of Governmentson October 12, 197
at 7:30 P.M. in the Village Hall. He also announced a
meeting on I-95 in the Jupiter High School, September 2$, 197.
He announced the October 5, 197 run off elections. Mayor
Brown also thanked State Representative Bill Taylor for
helping the Village receive Pund.ing for the Comprehensive
Plan. The Village Manager announced the October 5, 1~?7~
ENCON meeting at Jupiter and the Palm Beach County Solid
Waste October 1~, 197g Council Meeting.
The Council Meeting Minutes for September 13, 197$,
Village Manager's Report for September 10, 197 to September 23,
197 and the Financial Statement for August, 197 and the
~~later Department Financial Statement for August, 197 were
received without detailed discussion.
ldir. John Giba, Consultant on the Village of Tequesta
Comprehensive Land Use Plan was present and told Council
that the Committee is ready to discuss the Land Use Plan
with. Council. Council set up a Workshop Meeting for i4Tonday,
October 16, 197 at 4:00 P.N~.
P~Tr. John McKune, Gee & Jenson, told Council that Pflr, Sydow,
Gee & Jenson, was back in I.C.U. because he suffered a cardiac
arrest (the Village received word, September 27, 197 that
A~1r, Sydow had expired at 10:30 P.M., September 26, 1°7$).
Mr. McKune told .Council that when he attended the meeting of
Jupiter Hills and the South Florida Water TJIanagement District,
at the instructions of Council, on Jupiter Hill's application
for three (3) additional wells, he told SFG^TT~~~ that the Village
of Tequesta ti~aould have no objections as long as that area would
be subtracted from the previously allocated units in the Jupiter

Hills PUD, there was na objections by Jupiter Hills and
they were given permission by the SFW~ to drill the three (3)
additional wells. TiTr, McKune reminded Council that we now
have a permit for our wells in Tequesta Park to pump a max.
of 2.0 mgpd. If we were to service the additional areas
in Martin County, we would need to pump a total of 2.6 mgpd.
1~Zr. Gleason, SFt~JP~1D, told T~?r. P1cKune that the Village could
probably receive without much problem a total of 2.3 mgpd.
That would give the Village a total of 4,55 mgpd water with
the water purchased from the Town of Jupiter Water Syst~/m.
The 2.6 mgpd that is needed would service east of U.S. z~1 anal
River Edge. It would not include Indian Hills and Rolling
Hills and the Beach area. Council discussed what amount of
waters would be needed and where. The Village Attorney told
Council that he was under the impression that the report
tonight from Ns. l~'IcKune was only a status report and there may
not be a need for a franchise in the T~'Iartin County area
because we may not be able to drill more wells in Tequesta
Parlt, because of several reasons, one being a possible ruling
by the Supreme Court on the Broadview Case, Tf the Supreme
Court rules i.n favor of Broadvieva, the Village of Tequesta
w~1.1 be unable to drill outside its territoral limits and
he advised Council to hold off any action to increase the
areas served by Tequesta Water Department until after the
Supreme Court ruling. Mapes asked Ts. l~icKune, and Council
agreed, to prepare a report of the number of gallons of
water needed for Jupiter HilJ_s, U.S. ~1 and Heritage Oaks.
T~Ir. McKune, Gee & Jenson, told Cot.xncil that Mr. Miller
wa,~ on vacation and could not be present for the meeting
tonight. The Village Attorney had gotten together with
T~Tr. Simmons, Gee 8c Jenson, to discuss some changes in the
contract for engineering vaork to be done for the Village of
Tequesta on streets resurfacing and drainage program, that
the Council desired. P~~. Simmons and the Village Attorney
agreed on the changes in the contract. Mapes moved, "that
the Village Council employ Gee ~ Jenson, Engineers-Architects-
Flanners, Inc. Okeechobee Blvd., as the Engineering firm to
handle our road and drainage proposed construction project
pursuant to the Agreement presented to Council this date and
authorize the appropriate Village Officials to execute the
same". Ryan seconded and vote on the motion was:

and therefore the motion was passed and adopted.
The Village T~f'Ianager reviewed briefly the manner in which
the Village Water System is providing the requ~.red deposit
of $532,261.0$ with Jacksonville National Bank, Escrow Holder,
T~iapes asked what the Water Refunding Bonds Reserve Account
was and the Village T~Ianager :7a id it is for the principal and
interest on the ~3g0,015. TJ~anes asked v~~hat the amount is that;

has to be in the Reserve Account? The Village Manager answered
• that it is X55, 671.00 to make a total amount o.f ~s266, 519. T~iapes
asked where does the interest go. The Village Manager answered
the interest of the Reserve Account goes into the Revenue Fund
Account. Ryan moved, "that we approve the finalization of the
refunding program as of the September l~, 1°7~ memorandum".

ADOPTION OF THE BUDGETS FCR THE FISCAL YEAR COMMENCING

providing $4.OOc millage rate for Ad Valorem taxes for 197".
Cook seconded and vote on the motion was:

and therefore Resolution I~Io. 17-77/7 was passed and adopted.
The Village P~ianager gave notice of the three (3l steps
needed to be followed for the Village of Tequesta to receive
~5,t~06. from State Department of Community Affairs for
Comprehensive Planning Financial Assistance. The Village
Manager assured Council that we have complied with all the
necessary steps. Ryan moved, "to approve the contract and
to respond within the 21 days acknowledging the fact that we
would like to accept the money and abide by the terms of the

• Brown advised Council that Peter Pimentel, Executive
Director of the Loxahatchee River Environmental Control
District, announced in a •'iartin County newspaper that there
is a misunderstanding and that the sewer rates will be
lowered if they pay off the outstanding governmental bonds
and buy straight market bonds. ENCOPT will sewer in terms of
need. COG is going to have a meeting October 12, 197 at
which time dir. Pimentel. will attend. to answer questions asked
by the COG Board. Brown a7_so reminded Council that there
are two (2) seats up for election to the Board of ENCON,
The Village Attorney advised Council that he would recommend
that they not take any action tonight, but wait to see what
i~~ir. Pimentel. has to say. He feels it is not a good idea for
a governmental body to pass a Resalution requesting an
investigation on another governmental body, because their
records are open to the plabli.c, they are people voted in by
the public and that if anyone feels things are not right
they can look at ENCOTI's pavers, reports and records to
obtain the information they need. The Village Attorney also
said that if Council wants something like this it should be
better worded, but he did not agree with the Resolution as it
stands now. Council agreed that the Resolution should be put
off until after the October 12, 1°7~ meeting. Ryan felt that
Brown should work with the COG Attorney and administrator to
toughen up the Resolution and have it ready by next Council
Meeting.
The Village i~iunager explained Palm Beach County's
Metropolitan Criminal Justice Planning Unit's Application for
a Funding Assistance for• Law Enforcement A~aplicant Processing
Center Grant. The amount of the grant is ~$0,3~0. The Village
Manager told Council. that there was a Resolution attached to
the application and that the application would need approval
of Council if they felt it was beneficial. Mapes moved, "approval
of Council to support this application". Cook seconded and
vote on the motion was:

The Village Manager told Council of the State's Department
of Transportations request to widen U.S.~1 from North Palm Beach
to 70'7. Council voiced no ob,jection~.
The Village :Manager told Council that the Community Action
Council through the Board of County Commissioners Baas applying
for a grant. Council voiced no objections.

Ryan spoke to Council and asked the Village Attornev to
research an Ordinance about dog refuse, similar to the law
that New York just passed.
Brown spoke of an article in the Courier in reference
to the long meetings being held by Council until late at
night and told the reporte r from the Courier to check the
minutes to find out how late the meetings were, because in
his opinion they did not exceed 10:00 P.NI. very often.
The meeting was adjourned at ,10:45 P.M.
