THE VILLAGE OF TEQUFSTA, FLORIDA
OCTOBER 26, 1..976
A Council Meeting of the Village of Tequesta, Florida. was held on
Tuesday, October 26, 1976 at 7:30 P. M, in the Village Hall. Present were
Baron, Brown, Campbell., Huggins and Yoder. Also present were Robert Harp,
Village Manager and. John C. Randolph, Village Attorney. Cyrese Colbert,
Village Clerk, was on vacation. Mayor Campbell gave the Opening Prayer,
Pledge of Allegiance to the Flag and made the announcements. The Village
Manager's Report (October 9, 1976 through October 23, 1976), the Financial
Statement for September, 1976 and the Water Department Financial Statement
for September, 1976 were received. There were no comments from the visitors
at this time.
Mr, Willard Wheeler, Attorney for Mr. Hurley Hankey, was present
with a "Petition for Waiver of Ordinance No. 239" to Council asking that
Council waive the provisions of Section 2, Ordinance No. 239 on grounds that
the provisions of that Ordinance constitute an undue, severe hardship on Mr. Hankey.
The Village Manager read the "Petition for Waiver" and legal notices published
in the paper to give notice of this meeting. The Village Manager explained to
Council the definition of a hardship. Council explained their feelings on the
• petition from Mr, Hankey., Mr. William Brennan, President, Tequesta Country
Club Community Association, advised Council that his Association opposed the
"Petition for Waiver." Brown moved., "that the petition for the waiver be denied.

Mr. Peter Pimentel, Executive Director, Loxahatchee River Environmental
Control District wa.s present to discuss the status of their sewer projects in the
Village of Tequesta. Mr. Pimentel to ].d Council that Guy Villa ~~ Sons contract
with them has been terminated. and that Country Club Drive is in various stages
at this point but it places as an important part in their Program. Council
showed concern over the uncompleted work started by the Loxahatchee River
Environmental Control District and asked that Mr. Pimentel attend each Council.
Meeting to give them progress reports on the emergency repairs within the Village.
Mr. S. F. Leahy, President, Tequesta Association of Voters and Taxpayers,
read their letter to Council, dated October 7, 1976 i.n reference to franchise
charges and taxes paid on utility bills and their concern that this amount of money
is exempt from personal income tax. The Village Manager explained to Council
that all utility taxes come back to the Village on a monthly basis and franchise
taxes are paid annually. The Village Manager explained that utility taxes are
• based on a usage basis so that people who use the most utilities pay a higher
tax instead of adding the necessary tax on Ad Va]_orem taxes, where everyone would

share the expense. The Village of Tequesta. pays 5~ where most Municipalities
in the State pay 10~,
Mayor Campbell read a letter dated October 21, 1976 from Mr. William
B, Sydow, Gee ~ Jenson, stating that the existing moratorium on the drilling of
irrigation wells be retained until the connection to the Tri-Southern Utilities
System is sufficiently close to completion so that the existing water supply will
not be endangered. Council felt that it was unfair for some residents of the
Village not to be allowed. to drill wells when others were. Baron moved, "that
as soon as all these little things, if any, necessary are complied with that we
give the Tequesta residents the right to drill shallow irrigation wells (area
between the Intracoastal waterway and the North fork of the Loxahatchee River):'
The motion was adopted. Baron moved, "that the Village of Tequesta Attorney prepare
whatever material necessary to permit the drilling of shallow irrigation wells
between the Intracoastal waterway and the North fork of the Loxahatchee River."
The motion was adopted,
Mr. Gary Preston, Recreation Director, told Council that the fall program
would start on November 8 and end December 10, 1976 and that the Art Festival would
be held November 27 and 28, 1976 at Tequesta Park. Mr. Preston also informed
• Council that the Recreation Board made five (5} recommendations for the proposed
bicycle path on Country Club Drive. Council talked at length and heard. from the
audience on the bicycle path, Council agreed that a survey should be taken on
those residents who would be affected by the bicycle path, passing through their
property, Those residents on Country Club Drive, Golf Circle, Country Club Circle,
Tradewinds, Leeward and Tequesta Circle would be affected and will be the ones
surveyed by the joint efforts of the Country Club Community Association, Mayor
Campbell and Councilman Huggins.
The next item on the agenda was the discussion of revisions to the
Village Charter, Baron did not wish to discuss the revisions and left the
meeting at 11:03. The rest of Council and the Village Attorney reviewed the
Charter for possible changes. Council instructed. the Village Attorney to review
the Charter and to inform Council as to the amount of time needed at a workshop,
to review those parts to be put on the March, 1977 Municipal Election.
