THE VILLAGE OF TEQUESTA, FLORIDA
November y, 1976
A Council Meeting of the Village of Tequesta. Florida, was
held on Tuesday, November y, 1976 at 7:30 P.M. ir, the Village
Hall. Present were Baron, Campbell, Huggins and Yoder. Brown
was out of town. Also present were Robert Harp, Village Manager,
Cyrese Colbert, Village Clerk and John C. Randolph, Village
Attorney. Councilman Huggins gave a reading and the pledge
of Allegiance to the Flag. Changes to the agenda were made
and approved and Mayor Campbell made the announcements.
Council discussed a letter from William R. Hough 8c Co.
asking Council to call a Special Meeting to consider a purchase
proposal of $2,500,000. Water Revenue Certificates. Yoder
moved, "that we set the meeting for Thursday, the 18th. at
1.1:00 A.M. at the Village Hall". Council approved with
Baron opposing.
The Council Meeting Minutes for October 12, 1976,
• October 26, 1976 and Special Council Meeting Minutes October 29,
1976 were received. The Village ManagerTs Report for October 2~.,
1976 through November 6, .1976 was received.
No one from the floor spoke at "Time for Visitors".
Mr. A. F. Meeks, Robert E. Owens & Assoca.ates, Inc. gave
Council a brief status on the Tequesta Drive improvement project.
Mr. Meeks, told Council that Tequesta Drive would be completed
by December 1, 1y76 and the sodding, sprinkler system and turn
out lane would be completed by the first week of December.
Old Dixie will be put off until Tequesta Drive is completed and
work on Old Dixie will be done by December 21, 1y76.
Mr. i~Ieeks told Council that the sum of $68,557.50 that the
County was to pay for the improvement at Old Dixie has been
referred to the County Attorney. Yoder moved, "to approve
in principle but not in content, the inter-local joint-project
agreement as submitted by Palm Beach County". The motion was
adopted.
The Village Manager gave second reading by "title only"
of an Ordinance providing for annexation of propert of
Charles R.L. and Jeanne B. ~°Jhite (1897$ Point Drive.

Huggins moved, "the Ordinance be approved on second reading?'.
Yoder seconded. Vote on the motion was:

and therefore Ordinance No. 241 was passed and adopted on second
reading.
The Village Attorney gave t'irst reading of an Ordinance
to provide for rescinding of Ordinance No. 152• Huggins moved,
"to accept first reading of this Ordinance. Baron seconded.
Vote on the motion was:

Yoder -For
and therefore the motion was adopted.
The Village Attorney gave first reading of an Ordinance
to provide f'or uniform maximum penalties pursuant to F.S.
Chapter 775 (this has been requested by the court t'or use
after the Village Court has been abolished as of January 3,
19?7) Yoder moved, "we adopt the change (Ordinance)". Huggins
• seconded. Vote on the motion was:

and therefore the motion was adopted.
The Village Attorney read in full an Ordinance to
provide for adopting the laws of the State of Florida relating
to misdemeanors through October 1, 1976 (this is necessary to
bring the Village up to date for the County Court system as
of January 3 , 1977) ".'Huggins seconded . Vote on the motion was

and therefore the motion was was adopted.
The Village Attorney read in full an Ordinance to
provided for the drilling of shallow irrigation wells in
that area of the Village lying between the Intracoastal waterway
and the North Fork of the Loxahatchee River. Baron moved,

"that (first reading) this Ordinance be adopted as read"
Huggins seconded. Vote on the motion was:

therefore the motion was adopted. The Village Attorney asked
that the record show that in his opinion the Council is a little
bit premature in doing away with the restrictions at this time.
Yoder said he appreciated the advice of the Village Attorney.
Mr. Lloyd Brown, Nichols Sanitation, Inc. was present for
the discussion of negotiation on a yard trash franchise with
his company for the period of December 1, 1976 through September
30, 19$0. Baron asked that the record show he does not ''believe
the "Consumer Cost of Living Index" is correct. There was
discussion from Council then Huggins moved, "to authorize the
Village Attorney to prepare a Yard Trash Ordinance for the
next scheduled Council Meeting". The motion was adopted.
Baron moved, "to accept the low bid of Palm Beach Dodge,
Inc. of West Palm Beach for $$,77$.00 (for two (2) police cars)".
The motion was adopted.
Baron asked the Village Attorney if Councilman Huggins
letter mailed to him in reference to the :Libertarian Pary was
in violation of the "Sunshine Law". The Village Attorney
advised Baron that it was not in violation since the letter
was mailed through the Administrative Office.
Baron said, "that because of the action of Council ignoring
the advice of the Treasurer baron) of the Village of Tequesta,
I can not be a rubber stamp, I, Peter Baron Treasurer of Tequesta
resign that position as of this moment". Huggins moved, "that
we accept this resignation as Treasurer". Yoder seconded and
the motion was adopted.
The meeting was adjourned
at 9:55 P.M.
