MINUTES OF THE P~ETING OF THE COUNCIL
THE VILLAGE OF TEQUESTA, FLORIDA
January 25, 1U77

A Council Meeting of the Village of Tequesta, Florida,
was held on Tuesday, January 2,5, 1977 at 7:30 F.M. in the
Village Hall, 357 Tequesta Drive, Tequesta, Florida. Present
were Baron, Brown, Campbell, Huggins and Yoder. Also present
were Robert Harp, Village P~lanager, Cyrese Colbert, Village
Clerk and John C. Randolph, Village Attorney.
Yoder moved, "that the discussion on Prayer on the
agenda be moved up to after visitors". Brown seconded
and the motion was adopted.
Yoder gave the Prayer and Pledge of Allegiance to the
Flag, Mayor Campbell read a Proclaimation, Proclaiming
February 1 thru 5, 1977 as "Child Abuse Week" in the Village
of Tequesta and made other announcements. The Council
Meeting Minutes for December 14, 1976 were received as corrected.
The Council N~eeting Minutes f'or December 2$, 1976, Village
Manager's Re~~ort for January 1-20, 1977, Financial Report
for December, 1~a76 and Water Department Financial Report
f`or December, 1976 were received.
Mr. Charles Keller addressed Council on his complaint
of Florida Power & Light putting their bills on the doors
instead of mailing them.
Yoder moved, "that we devote no more than four (l,.)
minutes by anyone person (on item "discussion of Prayer on
Agenda) once, Council first then open to the floor". Vote on
the motion vaas:

there~.`ore the motion was adopted. Each Councilmember spoke
on this subject, when opened to the floor Nlr. Charles Keller
was the only person to speak on the subject. Brown moved,
"that the o~~ening of the meeting indicate that we open with
Devotion an~~ Pledge of Allegiance to the Flag". Vote on the
motion was:

The Village Attorney read an Ordinance of the Village of
Tequesta, Florida, ~~?roposing to amend the official Charter of
the Village of Tequesta at article II section 2.U1 relating to
selection, term and compensation of Village Councilmembers,
changing the election date from the third Tuesday of March of
each year to the second Tuesday of march of each year and
changing the term of off ice of each Councilmember from the
fourth Tuesday of March following his election to the next
Council meeting subsequent to the date of said Councilmember's
election and to amend all r~ortions of the Charter rec,uired
to be amended to conform to the intent of this Ordinance.
After discussion Huggins moved, "we approve first reading of
this Ordinance". The motion was adopted with second reading
scheduled for February $, 1y77•
The Village Attorney read an Ordinance of the Village of
Tequesta, Florida, amending Ordinance No. 211 the Official
Zoning Ordinance of the Village of Tequesta, as amended, at
Article IV, definitions, by amending the definition of lot
coverage, and by adding to said definitions the definition of
structure, by amending the definition of swimming pool and
at article XVI section 16.2 (6) so as to eliminate the
requirement. that uncovered swimming pools or patios be
considered in computing the lot coverage requirements of the
zoning ordinance. After some discussion and one addition,
• Brown moved, "first reading of this Ordinance be approved".
The motion Taas adopted. Second reading is scheduled f'or February 22,
1977 and a Public Hearing for 7:00 P.NI., February 22, 177
is also scheduled,
The Village Attorney read Inter-local Agreement between
Village of Tequesta, and Palm Beach County for Community
Development Act Funds for r~eriod October 1, 1977 to September 30,
1G7$. Bro~,rn moved, "that we enter into this inter-local
agreement between the Village of` Tequesta and Palm Beach County
for Community Development Act Funds f'or period October 1, ,1°77 to
September 3C, l~'7$". Vote on the mction was:

and therefore the motion was passed and adopted.
The Village Attorney read a Resolution of the Village of
Tequesta declaring acquisition of utility easements for water
transmission and distribution facilities to provide a source
of potable vrater to the Village of Tequesta and surrounding
environs to be a public necessity, authorizing the employment
• of real estate appraisers and authorizing the filing of eminent
domain proceedings. After some discussion Yoder moved, "that
we approve this Resolution". Vote on the motion was:

and therefore Resolution No. 7-76/77 was therefore passed and
adopted.
Mr. Ron Dixon, Robert E. Owens & Associates was present
to give Council an uptodate report on the Tequesta Drive
Improvements project and the new completion date. Mr. Dixon
informed Council that Robert E. Owens & Associates duty was
to make sure the work is done right but they have no direct
??ower over the contractor, but the Council does. Council
discussed at length the letter of January 1$, 1977 from
Gorham Construction Company.
Mr. Robert Sattley talked to Council about 'i0peration
Dee~~ Freeze".
Mr. William Smallwood, President North County First
Aid Squad, Inc. spoke to Council and demonstrated the latest
models of First Aid Equipment. Council was impressed with
the demonstration and the equipment. Brown moved, "that we
purchase five (5) of these Elder Valve Resuscitators and that
the funds come from budgeted funds". The motion was adopted.
Mayor Campbell explained the workings of C.O.G. and told
Council that if the Village of Tequesta stayed with C.O.G. then
maybe the three municipalities could stand up to Loxahatchee
River Environmental Control District.
Huggins moved, "to accept the resignation of Jacob J. Blair
as Alternate member of the Zoning Board of Adjustment and send
a letter of appreciation". The motion was adopted.
Brown moved, "that her resignation (Irene M. Dickson as
Village Representative on Community Development Division,
Community Action Committee) be accepted and a letter of appreciaton
be sent". The motion was adopted.
The Village Manager explained to Council the desire to appoint
Johnston, Sasser and Randolph (John C. Randolph) as the Village
Prosecuting Attorney. Brown moved, "'that the firm of Johnston,
Sasser and Randolph be appointed as the Village Prosecuting
Attorney". The motion was adopted. Huggins moved, "to send a
letter of a~~?reciation to Ed Fine (past Prosecuting Attorney)".
The motion was adopted.
Brown moved, "that we spend $625. for new lights and light
bars and approximately $1,500. for the unit from First Aid Squad"
The motion was adopted.
The meeting was adjourned ,t 11:15 P.M.
