HomeMy WebLinkAboutMinutes_Regular_04/12/1977 MINUTES OF THE MEETING OF THE COUNCIL THE VILLAGE OF TEQUESTA, FLORIDA April 12, 1977 A Council Meeting of the Village of Tequesta, Florida, was held on Tuesday, April 12, 1977 at 7:30 P.M. in the Village Hall. Present were Brown, Huggins, T4apes, Ryan and Yoder. Also present were Cyrese Colbert, Village Clerk and John C. Randolph, Village Attorney. The Village Manager, Robert Harp was ill and could not attend. Opening Prayer and Pledge of Allegiance to the Flag was given by Mayor Brown. Changes to the Agenda were made and approved. The Council Meeting P4inutes for March 22, 1977 were approved. The Village Manager's Rencr_t for March 20 through Aoril 9, 1977 was deferred until the April 26, 1977 Gouncil Meeting so the Village Manager could answer some questions. Mr. Robert Sattley, asked about a sign on U.S. ~~1 and Tequesta Drive. Mrs. Brown, talked about people putting their yard trash out long before pick up day. • The Village Attorney gave second reading, by title only, of an Ordinance of the Village of Tequesta, annexing certain parcels of land to the territorial limits of the Village of Tequesta with an R-1 Zoning classification with a Public Utility structure (fire station). Huggins moved, "for adoption on the second reading".Vote on the motion was: Brown for Huggins for Mapes for Ryan for Yoder for and therefore Ordinance No. 249 was passed and adopted on second reading. The Village Attorney reviewed the background of an Ordinance adopting and enacting a new code of Ordinances for the Village of Tequesta. The Village Attorney then read the Ordinance in full and after some discussion Huggins moved, "to approve first reading of this Ordinance". The motion was seconded by Yoder and vote on the motion was: Brown for Huggins for • Mapes Ryan for for Yoder for and therefore the motion was passed and adopted. 4-12-77 -2 The arbitration of Fire Protection Charge for Town of Jupiter was • deferred until the April 26, 1977 Council Meeting. The Village Attorney read a letter to him from the Attorneys for Tri-Southern, I~Tasow, Gildan & Yeager, P.A., Attorney at Law, asking the Village Council to enter into a modification Agreement to the Agreement made and entered into July 15, 1976 between the Village of Tequesta and Tri-Southern Utilities Company, Inc. The Village Attorney read in full a Resolution authorizing an amendment to the Bulk Sale Water Service Agreement between the Village of Tequesta and Tri- Southern Utilities Company, Inc. dated July 15, 1976, and further authorizing the execution of same by the Mayor of the Village of Tequesta, and the Village Clerk. After some discussion Mapes moved, "this Resoltuion be adopted". The motion was seconded and vote on the motion was: Brown for Huggins for Mapes for Ryan for Yoder for and therefore Resolution No. 12-76/77 was passed and adopted. Mapes moved, "that the Village Council be authorized through its Mayor to make application for a waiver for set backs to the Zoning Board of Adjustment on the Sutcliff property". The motion was seconded and approved. This was done because a portion of Mr. Sutcliff's property had been taken to lay water mains on certain easements within the Village. The Village Attorney talked briefly about the cost of collective bargaining and Council deferred this until the April 26, 1977 Council Meeting. Council talked briefly about two letters dated April 11 and 12, 1977 from Robert E. Owens & Associates, Inc. in reference to the Tequesta Drive Improvement Project then deferred it until the April 26, 1977 Council Meeting when Mr. Shephard, Robert E. Owens & Associates could be present. Mr. William B. Sydow, Gee & Jenson Engineers, Architects, Planners, Inc., read and discussed briefly two (2) letters to the Council dated April 12, 1977. Mapes moved, "that the Village Attorney be instructed to prepare the necessary Resolution. for the enactment, at April 26, 1977 Council Meeting. Council recognizing the continuing decline in water level due to the lack of rainfall, and continued high pumping rates within the Village and resulting in lower water availability and the endangering of salt water intrusion we hereby direct the Village Attorney and Village Manager to take appropriate steps should the Council find it necessary to impose water restrictions. Water restrictions would remain in force until alleviated by rainfall or until anticipated connection with Tri-Southern produces adequate water to support our needs". The motion was seconded and approved. ~, f 4-12-77 -3 Discussion of street lighting for Tequesta Drive from U.S. ~~1 to Cypress Drive was deferred until the April 26, 1977 Council Meeting. • Council requested that the Community Appearance Board hold a meeting and report to Council at the April 26, 1977 meeting their recommendation on Village Maintenance of street entry ways. Council directed the Village Manager to look at Country Club Drive and report to Council what is needed to make temporary repairs on the drive and the estimated cost of the work. The Council gave its' approval that the Mayor attend the April 21, 1977 meeting of the Loxahatchee ~'_iver Environmental Control District and request that they give us aYi estimated date of-completion on .Country Club Drive. Consideration of a Resolution urging action to initiate a mand- atory Statewide Certification Program for Construction Code Enforcement Officials was deferred until the April 26, 1977 Council T[eeting. Huggins moved, "that P4r. James Nagle be appointed to fill the vacancy, in a regular slot, for the Community Appearance Board, term ending May 1, 1979 (subject to his approval)". The motion was seconded and approved. Huggins moved, "that the permanent position of Water Consultant to Village Council be eliminated and that the Council be allowed to request support of knowledgeable persons when it so deeuls necessary and further more that a letter of appreciation be written to Mr. Fulling and Mr. Amy for their service and asking that they allow us to continue to rely on their experience if needed in the future". The motion was seconded and approved. Ryan moved, °'that we approve these Committees (list attached) in their entirety and that the deficiencies be appointed at a subsequence date". Mapes seconded and the motion was adopted. Huggins moved, "that the Transportation Committee be created consistent with the suggestions included in Mayor Brown's memorandum of April 11, 1977". The motion was seconded and approved. The Village Attorney outlined for Council his opinion on the guide lines for a special personnel Committee. After some discussion Yoder moved, '°that we proceed along the guidelines that the Village Attorney has outlined (see attached) and give the Village Manager authority to appoint the members of the Committee". The motion was seconded and approved, Council agreed that the Committee would be called Special Personnel Committee. Mr. Robert Sattley spoke on the odor from ENCON's Plantreat treatment plant. Council authorized the Village PZanager to write the Department of Transportation in reference to the large loose rocks on U.S. ~~1.
